COMMUNICATIONS FROM THE PUBLIC
Oral Communications on Non-Agendized Items
Any member of the public will be allowed to address the City Council for up to three (3)
minutes on matters not on this agenda. The law generally prohibits the council from
discussing or taking action on such items. However, the Council may instruct staff
accordingly regarding Oral Communications under Council Direction to Staff.

1. Council Candidate Interviews
Recommended action:
Conduct interviews of interested applicants for the vacant council seat; accept citizen
input; council discussion and decision; appointment of new council member; and
direct the City Clerk to administer the Oath of Office to the newly appointed council
member.

SUBJECT: Council Candidate Interviews
RECOMMENDED ACTION:
Conduct interviews of interested applicants for the vacant council seat; accept citizen input;
council discussion and decision; appointment of new council member; and direct the City Clerk
to administer the Oath of Office to the newly appointed council member.
REPORT SUMMARY:
At the May 19, 2010 City Council meeting, Council was asked to decide their preferred course of
action to fill the vacancy on the City Council. City Attorney Richard Taylor noted that State law
requires the City Council to act within 30 days of the vacancy occurring and added that Council
must decide by June 12, 2010, how they would like to fill this vacancy. He also stated that
Council could choose to call a Special Election, which would be held at the same time as the
Regular General Election in November of 2010, or Council could fill the vacancy by
appointment. Council voted to fill the vacancy by appointment by a 3-1 vote.
At this meeting Council also decided to hold a Study Session on Monday, May 24, 2010, to
discuss the interview and appointment process. The application form, interview questions, and
time and date of tonight’s meeting were a product of that Study Session.

CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION:
The vacant seat on the City Council would not be filled in a timely manner as required by State
law.
ALTERNATIVE ACTION:
N/A

FOLLOW UP ACTION:
Staff will agendize a ceremonial Oath of Office for the newly appointed council member on the
June 16, 2010 Council meeting.

Pursuant to Government Code 54954.2, this item was properly posted as a City Council agenda
item and was included in the packet made available on the City’s web site in advance of the
meeting. A copy of the agenda packet is also made available at the Saratoga Branch Library each
