SUBJECT: Abatement of Nuisance and Fixing of Special Assessment in
connection with costs of cleanup performed as a result of removal
of hazardous waste stored at 13484 Holiday Drive, Saratoga (APN #
389 -37 -025).
Recommended Motion: Adopt a Resolution confirming Report of City
Manager to place a lien against property located at 13484 Holiday Drive,
Saratoga for the purpose of recovering costs incurred as a result of
removal of hazardous waste.
Report Summary: The incident arose out of a reported fire and hazardous
material spill at 13484 Holiday Drive. Investigation at the scene
revealed the presence of over 37 hazardous materials identified by the
Central Fire District Hazardous Materials Unit #2 (see CSO Report 94-
111- 150 -S).
Further investigation determined that hazardous materials were being
stored without proper permits or licenses as required by the Santa Clara
County Toxic Gas Ordinance and the Saratoga Municipal Code (Sec. 8-
05.030(a)(2), Sec. 8- 05.040(a) and Sec. 8- 15.070(a)).
Rapid removal and cleanup was deemed necessary to protect community
health and safety by all responding agencies (see April 27, 1994, letter
from the County Hazardous Material Compliance Division).
Mr. Warfel was advised by both City and County personnel that all
hazardous materials must be removed by the end of the day in order to
protect the health and safety of the neighborhood. City staff provided
Mr. Warfel with a list of contractors. Mr. Warfel and his parents
(current owners of the property) stated that they could not comply.
Therefore, the City Manager declared that an Emergency Nuisance existed
at the site. Mr. Warfel was requested to sign a release prepared by the
City Attorney, but he refused.
The chemicals were subsequently removed from the property by Chemical
Waste Management, Inc. and criminal charges were filed against Mr.
Warfel.
A letter detailing costs incurred by the City as a result of Mr.
Warfel's storage of hazardous materials was mailed to Mr. Warfel on
August 22, 1994. A summary of the costs to the City of Saratoga are:

Fiscal Impacts: None, if City recovers the costs incurred with the
incident. If not recovered, the City will have to cover the costs from
general fund revenues not previously budgeted.
Advertising, Noticing and Public Contact: The following notice was
provided for this item: a Notice of Abatement of Nuisance and Fixing of
Special Assessment was mailed to the property owner on August 22, 1994;
a notice was posted at the property on August 29, 1994; and a notice was
published in the Saratoga News on August 31, 1994.
Consequences of Not Acting on the Recommended Motions: The City will
not be able to recover the costs incurred as a result of this incident.

NARRATIVE:
On 4/21/94, at approximately 1102 hrs, Saratoga Fire District received a 9 -1 -1 emergency call
from Mrs. Marjorie Warfel at 13484 Holiday Drive. She stated there was a fire in the her
garage. Deputy Forest responded with Saratoga Fire for traffic control, and advised County
Communications at 1103 hrs of the structure fire on Holiday since the call came directly into
Saratoga Fire Station. Myself and CSO Iida also responded to the address to assist Fire
personnel with any traffic control. Upon Deputy Forest's arrival, (S)WARFEL met him in the
front driveway and stated the fire had been extinguished. Deputy Forest advised County
Communications of this status, but asked for an ambulance to respond to the scene. (S)WARFEL
had burned his right hand severely in the fire. At 1107 hrs. Saratoga Fire District received a
call back from Mrs. Warfel stating the fire had been extinguished, however Saratoga Fire
continued,to ensure that it was completely doused. They arrived at 1108 hrs.
CSO Iida and myself arrived at 1107 hrs. and met with Deputy Forest. In the driveway there
was a green pick up truck with its hood up, and under the truck I observed a dark liquid with
a strong odor, throughout the driveway and in the street gutter. Originally, Fire personnel
thought the fire was started in this area. They informed me that the liquid substance on the
driveway was a product called "GUNK". This product is used to clean engines. On the can it
read it was illegal in the State of California to dispose of GUNK contents improperly. Captain
Struthers requested that I contact the City Public Works crew to have sand poured on the liquid
by product which was in the street gutter. He wanted to avoid this product going into the storm
drains. CSO Iida spoke with (S)WARFEL and his parents concerning the chemical spill in the
driveway. I called Gary Enriquez and Bryan McQueen of Saratoga Public Works. When they
arrived sand was scattered on the driveway and gutter.

Deputy Forest conveyed to Fire personnel that the fire occurred inside the garage and not the
driveway. Apparently, while (S)WARFEL was boiling Kerosene in the garage, the liquid ignited
itself, and engulfed the pan his was holding. Fire entered the area through a cut out door in the
garage door. The garage was in a disarray, and very cluttered. They discovered that the fire
occurred on a work table in the garage. (S)WARFEL had used water and rags to put out the
fire. On the work table they observed several bottles of labeled hazardous chemicals, and other
chemical "lab type" equipment. There was a faint odor of chemicals in the air, so Captain
Struthers withdrew all personnel from the garage as a safety precaution. He contacted the Santa
Clara County Central Fire HazMat #2 to investigate this lab for possible public health and safety
hazards. Capt. Struthers had directed the City Public Works crew to cordon off the street at the
intersection of Holiday Drive and Dagmar Drive. Sgt. Finch of the Sheriff's department was
called to the scene for photos and for law enforcement support. Fire also notified The District
Attorney's Environmental Protection Unit, and Santa Clara County Hazardous Materials Unit due
to the hazardous materials issue. I Saratoga City Codes Administrator, Joseph Oncay arrived on
the scene per Saratoga Fire request at 1125 hrs.
AMR Paramedic Unit #307 arrived on the scene at 1112 hrs, but (S)WARFEL refused medical
attention. CSO Iida attempted to convince WARFEL to allow the paramedics to look at his
hand, however WARFEL still refused treatment. WARFEL stated that he was alright, and
would run cold water on the burn. It was apparent that WARFEL had at minimum, 2nd Degree
burns on his right thumb and forearm. He stated he would seek medical care on his own.
At 1210 hrs, Captain Hal Chase, and the HazMat #2 team arrived on scene. Capt. Struthers
relayed the details of the call and asked HazMat to assess the threat to public safety due to the
hazardous materials. Capt. Chase and his crew entered the garage with protective suits, and in
the course of their investigation they found over 17 different hazardous chemical, Chlorine Gas,
pressure cooker pots hooked up to other pots, flasks, scales, a portable burner, pans, gasoline,
a generator, a chemical spinner, transformers and various tubing. Several of the chemicals were
labeled as being flammable or containing poisonous gases. They also observed a padded freezer
in the garage which was held shut with bungie cords. This unit had several loose wires
protruding under the unit. (S)WARFEL could not identify the products in the freezer, so Capt.
Chase requested a Bomb Tech to the scene. He had concerns of a possible explosion hazard.
Sgt. Finch called County Communications to respond the Sheriff's Bomb Squad. (See Saratoga
Fire Report for cause of fire, and related issues.)
Several photos of the scene were taken, see photographic log of Finch, Iida, and Oncay.
While waiting for the Bomb Tech to arrive, an inventory was taken by HazMat, of the chemicals
in the garage. John Pedersen, Senior Inspector, District Attorney's office, arrived and also
examined the lab. Capt. Chase questioned (S)WARFEL as to what was his purpose for storing
these hazardous chemicals in his parent's garage. (S)WARFEL stated he was a chemistry student
and his parents had allowed his to set up a laboratory in the garage to work on different
experiments. WARFEL stated that before the fire today, he was attempting to purify and
crystalize Kerosene in order to use it as a cheap degreasing solvent. Capt. Chase observed that
(S)WARFEL had used plastic tubing to vent out fumes from the garage. This tubing was
attached to a fan, which was fastened to.one of the windows in the garage. (See Central Fire

At 1330 hrs. Bill Grimes from the County Hazardous Materials Division arrived and was advised
of the situation. He assisted Fire personnel with the inventory. Upon viewing the garage
contents, he stated that storage for these types of hazardous chemicals requires a permit from the
County. He was not aware of any County. Permits issued to (S) WARFEL or his parents. (See
Grimes' report.)
At 1335 hrs, Sgt. Leonard Anderson of the Bomb Squad arrived.. He opened the freezer without
incident. Inside the freezer there were approximately 20 more hazardous chemicals. See
HazMat report for complete inventory list. Due to the extend of hazardous chemicals in the
garage, Sgt. Anderson requested that Deputy Forest interview (S)WARFEL about his activities
prior to the fire. (See Sheriffs Department report.)
Saratoga City Manager Harry Peacock arrived on the scene and was apprised of the hazardous
chemical storage violation, and of the pending threat to public safety. It was agreed that the City
would issue (S) WARFEL a municode citation for the unsafe storage and handling of hazardous
chemicals, and for not securing a County Hazardous Chemical Storage Permit. The County
would remain in a support and advisory capacity.
(S)WARFEL's Kerosene experiment was the cause of the fire, and posed as a significant risk for
an unauthorized discharge of the hazardous chemicals into the community. He also was
improperly handling and mixing hazardous materials in a manner that substantially increased the
risk of an unauthorized discharge into the neighboring residences. Lastly, (S)WARFEL was
storing chemicals without obtaining a Hazardous Material Storage Permit from the County. Had
the Fire Department been needed to extinguished the fire in the garage, there was no information
posted on the exterior of the building to warn Fire Fighters of the dwelling's contents. This
would have posed significant danger to the Fire personnel and the surrounding neighborhood.
At 1415 hrs I issued (S)WARFEL citation #S5053120 for municode violations 8- 05.030(a)(2) -
unsafe storage of hazardous materials, 8- 05.040(a) - No County Hazardous Materials Storage
Permit, 8- 15.070(a) - Unsafe handling or dispensing of hazardous materials. All three counts
are misdemeanors. A court date was scheduled for June 13, 1994 at 0900 hrs at the San Jose
Municipal Court. I observed (S) WARFEL's right hand as he signed my citation. The skin had
peeled off, and the hand was very blistered. I advised (S)WARFEL to seek medical attention
immediately. He refused medical treatment again. He stated he did not want to leave his parents
alone to deal with the City and County agencies.
Joseph Oncay and Bill Grimes spoke to (S) WARFEL about the violations, and notified him that
the hazardous chemicals must be removed by the end of the day, in order to protect public health
and safety. A chemical disposal contractor list was provided to (S)WARFEL to expedite the
removal. (S)WARFEL consulted with his parents, the property owners, and returned to speak
with Oncay and Grimes. He stated neither he, nor his parents had the funds to pay for the
removal of the chemicals. He instructed Oncay that the City would have to remove the
chemicals, and place a lien on his parent's house for cost recovery. Oncay acknowledged his
response and contacted the City Manager at City Hall for direction at 1515 hrs. Mr. Peacock

consulted with the City Attorney Michael Riback, and an Emergency Nuisance Abatement was,
deemed necessary to protect the citizens of Saratoga. Upon recommendation of the Fire
Department and the County, the Abatement was ordered by Mr. Peacock at 1600 hrs. Joseph
Oncay contacted Chemical Waste Management in Fremont to haul away the hazardous chemicals
at 13484 Holiday Drive. They arrived at 1800 hrs. (See Oncay's supplemental report)

from the Holiday Drive residence.
The neighbors on both sides of (S)WARFEL made statements to both Oncay and myself
concerning the chemical lab and (S)WARFEL. (See witness statements)
This case is forwarded to the City Attorney for prosecution of the Saratoga Municipal Code
violations, and to recover costs for the chemical removal from (S)WARFEL's residence.

Re: Summary of Events by the Santa Clara County Hazardous Materials Compliance
Division (HMCD) - Holiday Drive at Dagmar Chemical lab fire
At approximately 1:15 p.m. I was dispatched to Holiday Drive at Dagmar where a resident was
reported to have maintained extensive chemical storage that contributed to a chemical fire earlier
in the day.
I arrived on -site at approximately 1:30 p.m.
After being briefed by representatives of Santa Clara County Central Fire District, City of
Saratoga Code Enforcement and the Investigator from the District Attorney's Environmental
Crimes Unit, I toured the storage area and assisted with the collection of chemical inventory
information.
It was determined that numerous violations existed at the site.
Violations of the Hazardous Materials Storage Ordinance relating to permitting, handling and
storage were evident as well as violations of the County Toxic Gas Ordinance (Ordinance #NS
517.44 adopted 9- 18 -90) relating to required permitting (§ B11 -317 (d(1))) and proper storage of
Class H regulated material - Chlorine gas (§ B11 -319 (c(1 through 9))), (§ B11 -319 (d(1 through
3))), (§ B 11 -319 (e(1 through 5))).
It was determined by discussion among the agencies represented at the site, that in order to most
efficiently and expeditiously enforce the violations evident at this location so as to maintain
public and community safety, enforcement would take place as follows:
Violations of the Santa Clara County Uniform Hazardous Materials Storage Ordinance
(HMSO), having been adopted into the City of Saratoga Municipal Code, would be enforced
under Citation authority of the City of Saratoga Code Enforcement Division. In this way,
local (city) jurisdiction could initiate rapid removal and cleanup of chemical materials and
pursue enforcement of the provisions of the HMSO within the Municipal Code as it deemed
necessary to protect community health and safety.
• Violations of the County Toxic Gas Ordinance would not be enforced by Santa Clara County
HMCD /District Attorney's office contingent upon the immediate removal, by proper
Board of Supervisors: Michael M. Honda, Zoe Lofgren. Ron Gonzales, Rod Diridon, Dianne McKenna

disposal or documented return to the manufacturer /vendor, of the 15 - 20 pound gas cylinder
of Chlorine gas.
Following this determination, it became the role of the S.C.C. HMCD to act in a support capacity
to the lead agencies within the City of Saratoga. Toward this end, information on disposal
contractors (vendor list) was provided to the responsible party and to City representatives.
I departed from the site at approximately 3:45 p.m.
To simplify cost recovery actions that may be undertaken by the City of Saratoga, any incurred
costs for HMCD involvement with this incident will not be charged.

SUPPLEMENTAL NARRATIVE - The responsible, Charles Warfel, was reducing a pint
of kerosene over a hot plate when the fumes ignited and spread to combustibles inside the
garage. Approximately 43 containers of various chemicals were also in the garage but were
not released. Smoke from the kerosene filled the garage area. The fire was extinguished
by the responsible prior to fire departments arrival. The responsible received 2nd degree
thermal burns to his right wrist and thumb. He refused medical treatment from the fire
department and paramedics. The responsible was cited and released by the City of Saratoga
Community Service Officer for violations of the City Hazardous Materials Code. All
chemicals and equipment were removed and disposed of by Chemical Waste Management
of Fremont, CA. under direction of the City of Saratoga.

STAGE AT SARATOGA AVE AND RANFRE. UPON E -31'S ARRIVAL FIRE WAS
EXTINGUISHED, HOWEVER THROUGH INVESTIGATION HAZARDOUS .MATERIALS WERE
FOUND. APPEARED TO BE SOME TYPE OF CHEMICAL LAB.
THE STREET WAS CORDINED OFF WITH THE HELP OF COUNTY S.O. AND CITY PUBLIC
WORKS
DISPATCHED TO SCENE WERE CFD HAZ -MAT 2, CITY SCO OFFICERS, CITY CODE
ENFORCEMENT OFFICER, AND CITY PUBLIC WORKS.
THROUGH INVESTIGATION BY HAZ -MAT 2, NUMEROUS CHEMICALS WERE FOUND TO BE
STORED. THIS INCLUDED; DENATURED ALCOHOL, FORMALDEHYDE 37 %, COPPER
SULFATE, ANHYDROUS TETRAHYDRO FURAN, SODIUM ACETATE, HYDROCHLORIC ACID,
H2 SO4, H N 03, SODIUM CYANIDE, ZINC, PERCHLORIC ACID, ACETONE (IN FLAME
PROOF CONTAINER), 1 -5 GAL. GASOLINE CAN (APPROX. 1/2 FULL), ALCOHOL,
SODIUM CHLORATE, CHLORINE GAS CYLINDER (LABELED CHLORINE), KEROSENE,
ETHYL ALCOHOL (200 PROOF, 1 PINT), ETHYL ALCOHOL (1/2 PINT), ACETONE DRY
(HAND WRITTEN ON MASKING TAPE ON BROWN 473 ML BOTTLE), ETHYL ETHER, 25
GRAMS ARSENIC AND 1 KG CYANIDE LABELED IN DOT CONTAINER.
ALSO INVESTIGATED WAS A REFRIGERATION UNIT, WRAPPED IN INSULATION WITH A
WIRE EXTENDING OUT OF THE GASKET AT THE DOOR. RESIDENT WAS UNABLE TO
IDENTIFY THE PRODUCTS INSIDE SO THE COUNTY SHERIFFS BOMB SQUAD WAS
CALLED IN TO INVESTIGATE. UPON INVESTIGATION A MAGNATUDE OF CHEMICALS
WERE FOUND WHICH INCLUDED; ACETIC ANHYDRIDE (500 ML, 99 %), HEXANE (500
ML, 85 %), TOLUENE, BENZENE, ACETIC ANHYDOCIDE (970), SULFUR CHLORIDE,
XYLENE, CHLORIFORM (99 %), SULFURIC ACID, CHLORIDE WATER, AUMONIUM
HYDROXIDE (30 %), PYRROLIDINE, ACETYL CHLORIDE (99% IN PLASTIC
CONTAINER), BENZYL CHLOROFORMATE, SULFURIC ACID /ALCOHOL (BROWN UNMARKED
BOTTLE), SILVER NITRATE.
A HAZARDOUS MATERIALS DISPOSAL COMPANY (CHEMICAL WASTE MANAGEMENT,
FREMONT, CA 510/770 -0575, CHARLES SCARCY) WAS NOTIFIED TO REMOVE ABOVE
MENTIONED CHEMICALS FROM RESIDENCE. RESIDENT IS UNABLE TO PAY FOR THE
COST OF DISPOSAL AND CLEAN -UP. THE CITY ACTIVATED THE STATE SUPERFUND
LAW. UNDER THIS STATE LAW THE CITY WILL BE ABLE TO RECOVER COST.
CITY CODE ENFORCEMENT OFFICER CITED RESIDENT UNDER CHAPTER 8 OF THE
CITIES HAZARDOUS MATERIALS CODES; #805.030, #805.040 AND #815.070A
RESIDENT (CHARLES WARFEL, AGE 36) RECEIVED 2ND DEGREE THERMAL BURNS TO
HIS RIGHT WRIST AND THUMB AREA. HE DECLINED MEDICAL ATTENTION AND

1. We were requested by Saratoga Fire to respond to a extinguished garage fire in which several chemicals were found
2. Haz Mat 2 meet with Incident Commander Struthers and represenatives of the City of Saratoga Code Enformement
unit. We were advised that several chemical containers and chemistry lab equipment were In the garage in vanous sizes
and locations. They were also aware that there were several chemical containers in a freezer In the garage. Haz Mat 2
personnal made an entry into the garage with monitoring equipment to assess the condition and contents of the
containers in question. An inventory list was made which contained 17 various chemicals. Entry into the freezer was not
made due to the concern of a possible expolsion hazard. SO Bomb Tech Sgt Anderson was called to the sceen to
Investigate. At the same time DA Investigater J. Pederson and Santa Clara County Toxic Enforcement Officer BIR,
Grimes were requested to respond. Haz Mat 2 awaited their arrival. Upon the arrival of all parties above, it was.
determined that Bomb Tech Anderson would enter and open the freezer. It was opened without incident.
Additional Inventory was taken of the freezer which contained an additional 20 chmeical conatiners In sizes from 500 MI
to 1 gallon. A complete Inventory list was provided to all parties concerned in the event. The following list represents
the chemical !containers and amounts found.

AND FIXING OF SPECIAL ASSESSMENT
NOTICE IS HEREBY GIVEN that the City of Saratoga has caused to be removed from 13484
Holiday Drive, Saratoga CA, a private residence, certain articles stored thereon described
Hazardous Materials, the presence of which created an immediate hazard to public health and
safety, posed a threatened release into the City's storm water system, and constituted a public
nuisance. An itemized written report showing the cost of such removal is on file in the office
of the City Clerk. Reference is hereby made to such report for further particulars. It is the
intention of the City Council of the City of Saratoga to make the costs of such removal a special
assessment against the property on which said nuisance was maintained or from which said
nuisance extended, said assessment to be collected at the same time and in the same manner as
ordinary municipal taxes. The property to be assessed is described as follows:
APN 389 -37 -025, 13484 Holiday Drive, Saratoga, California
Any property owner objecting to the proposed special assessment is hereby notified to attend a
meeting of the City Council of the City of Saratoga to be held on Wednesday, September 21,
1994, commencing at 7:30 p.m., at the Saratoga City Hall, 13777 Fruitvale Avenue, Saratoga,
California, when their objections will be heard and given due consideration.

Recommended Motion:

Amend policy to delete "will" and add "may, at the Council's discretion" to
the second paragraph of the policy.
Report summary:
Mr. Alan Halverson pointed out at the Council meeting of September 7 that the
Public Participation Policy stated "Requests which may require action on the
part of the City will be referred to staff for a report at the next regular
City Council meeting..." Staff believes the Council's intent was to refer
such items to staff for a later report only if a majority of the Council
wished to do so. The .proposed change would make this intention part of the
policy.
Fiscal Impacts:
None.
Follow Up Actions:
The new version of the policy will be made available to the public.
Consequences of Not Acting on the Recommended Motions:
Members of the public would expect all oral communications requesting action
to be referred to staff and appear on the next agenda.

SUBJECT: Construction Acceptance of Improvements for SD 92 -006
(14350 Douglass Lane) and Release of Performance
Securities
Recommended Motion(s): Move to grant Construction Acceptance of the
improvements for SD 92 -006 and authorize staff to release the
performance securities posted to guarantee completion of the work.
Report Summary: All improvements required of the developer of
SD 92 -006 (14350 Douglass Lane) have been satisfactorily completed
and accepted by staff. Consequently, it is recommended that the
Council grant Construction Acceptance of the improvements at this
time and authorize staff to release the performance securities
posted by the developer to guarantee satisfactory completion of the
required work. Upon taking this action, the one year maintenance
period. covering the improvements will begin. The required
maintenance is secured by a maintenance bond also posted with the
City by the developer.
Fiscal Impacts: None directly. The cash bond to be refunded to the
developer is in the amount of $8,467.32.
Advertising, Noticing and Public Contact: Nothing additional.
Conseauences of Not Actinq on the Recommended Motions: Construction
Acceptance of the improvements would not be granted and the
performance securities would not be released. Staff would advise
the developer of any additional requirements of the City Council
before Construction Acceptance could be granted.
Follow Up Actions: The performance securities (bonds and cash
deposit) will be returned to the developer. The one year

SUBJECT: Affordable Housing Project - CDBG
Recommended Motion(s):
1. Approve the site relocation for the affordable senior housing
project proposed by Community Housing Developers and authorize
the City Manager's Office to execute the agreement.
Report Summary:
At the July 20 Council Meeting, Council approved the request by
Community Housing Developers for a loan in the amount of $350,000
from the city to finance the acquisition of two properties that
would provide affordable housing to five very -low income seniors.
Staff proposed that the Community Development Block Grant funds be
used as the source of the loan. Currently the city has
approximately $350,000 in unobligated CDBG dollars. Both of the
proposed sites were located in the Sara Park Circle development,
which is a senior's project located off of Saratoga Avenue.
At this time, the council is being requested to approve a new site
location for the project. There had been some confusion regarding
the CC &R's established at the Sara Park Circle development and
their policies regarding rental options. Community Housing
Developers has located a single family home that they feel would be
more adaptable to the project's needs.
The home is located at 1552 Johnson Avenue in Saratoga and will
accommodate three to four seniors. The site would provide a shared
housing environment similar to that of the Project Match home
located at 20218 Blauer Drive, Saratoga. The requested purchase
price for the Johnson Avenue property is $366,000 with a loan
amount of $248,200 from the City.
Staff requests that the City Council authorize the City Manager's
Office to execute the agreement in order to implement the project
more quickly and efficiently.
Fiscal Impacts•
Unobligated CDBG funds would be used as the source of the loan and
would not require the use of general funds.
Conseauences of Not Acting on the Recommended Motions:
If the project change is not approved and the project falls
through, the city's unobligated CDBG funds will not roll over to
next year's account and the monies will be committed to other
projects within the urban county.

In July, 1994, Community Housing Developers, Inc. (CHD) made a proposal to the City
of Saratoga to purchase two properties for use as affordable housing for seniors on a

yards. The seller has agreed to terms and price which,meet CHD's criteria, although the

and confirmation of financing, including the City of Saratoga's participation.
Therefore, CI D requests consideration of changing the proposal to purchase the
properties at Sara Park Circle to the property at 1552 Johnson Avenue, with a purchase
price of $366,000, and assistance from the City of Saratoga in the amount of $2418,200,

SUBJECT: Notice of Need to Amend Conflict of Interest Codes - Saratoga
Parking Authority; Public Financing Authority; City of Saratoga
Recommended Motion:
Direct staff to make no changes in the codes of the Saratoga Parking
Authority or the Public Financing Authority. Direct staff to prepare changes
to City of Saratoga code; review the possibility of adopting the State model
Code; and return amended Code to the Council within 90 days.
Report summary:
The Political Reform Act requires that Conflict of Interest Codes be reviewed
biennially to determine whether they must be amended. The codes adopted by
the Saratoga Parking Authority and the Public Financing Authority in
connection with the Leonard Road project are current because these bodies
adopted the model code prepared by the Fair Political Practices Commission.
As to the City of Saratoga Code, certain consultants should be added as
designated employees because they participate in making decisions which could
foreseeably have a material effect on a financial interest.
In addition, the staff should review the possible benefits to the City of
adopting the State model Conflict of Interest Code. By so doing, any
amendments passed by the State would automatically become part of our
Saratoga code.
Fiscal Impacts:
None.
Follow Up Actions:
After the amendments are adopted, Statement of Economic Interest forms will
be provided to those who are newly designated.
Consequences of Not Acting on the Recommended Motions:
Saratoga would not be in compliance with State law.

ATTACHMENT A
CONFLICT OF INTEREST CODE FOR THE

The Political Reform Act, Government Code Section 81000,
et seq., requires state and local government 'agencies to adopt and
promulgate conflict of interest codes. The Fair Political
Practices Commission has adopted a regulation, 2 Cal. Code of
Regs. Section 18730, which contains the terms of a standard
conflict of interest code. It can be incorporated by reference
and may be amended by the Fair Political Practices Commission
after public notice and hearings to conform to amendments in the
Political Reform Act. Therefore, the terms of 2 Cal. Code of
Regs. Section 18730 and any amendments to it duly adopted by the
Fair Political Practices Commission are hereby incorporated by
reference and, along with the attached Appendix in which members
and employees are designated and disclosure categories are set
forth, constitute the conflict of interest code of the (name of
your agency).
Designated employees shall file statements of economic
interests with,the agency who will make the statements available
for public inspection and reproduction. (Gov. Code Section
81008). Upon receipt of the statements of the (your agency's
board and chief executive officer), the agency shall make and
retain a copy and forward the original of these statements to the
(place where statements will be filed)1/. Statements for all
other designated employees will be retained by the agency.
