Mgr. SUBJECT: HP -2 ORDINANCE DESIGNATING THE VILLA MONTALVO AS A A HERITAGE RESOURCE Issue Summary 1. On November 4, 1981 the City Council adopted Ordinance No. 66 which allows for certain structures, districts, lanes, etc. that meet certain criteria to be designated as Heritage Resources. The ordinance limits the exterior alterations allowed for structures so designated. 2. The Montalvo Association is the second organization to apply for a heritage resource designation. 3. The Heritage Preservation Commission has determined that the Villa Montalvo meets the ordinance's criteria for heritage resources. Recommendation 1. The Heritage Preservation Commission recommends that the City Council approve an ordinance designating the Villa Montalvo as a heritage resource. 2. The Council needs to make the required finding(s) if it wishes to adopt this ordinance after the first reading of the ordinance. 3. The second reading of the ordinance would occur at the next council meeting and would go into effect 30 days after adoption. Fiscal Impacts None anticipated Exhibits /AttacYmients .1. REPORT �)ckrmrA TO MAYOR AND CITY COUNCIL DATE: 3/28/84 COUNCIL MEETING: 4/4/84 SUBJECT : HP -2, VILLA MONTALVO, MONTALVO ROAD At its meeting of February 29, 1984 the Heritage Preservation Commission reviewed the application of the Montalvo Association to designate their structure as a Heritage Resource in accordance with the City's Heritage Preservation Ordinance (_Ord. No. 66). Structures must comply with the criteria in Section 5 of the ordinance to qualify for Heritage Resource designation. The Commission made specific findings (attached to the end of the application) indicating that the Villa Montalvo conforms with these criteria and is recommending that the Council approve the designation. It is the Commission's opinion that the ,information in the attached application is sufficient documentation for the request. The City Council must now decide to approve, modify or deny the re- quest. To approve the request the Council must adopt an ordinance designating the Villa Montalvo as a Heritage Resource. The ordinance will go into effect 30 days after adoption. Prior to adopting the ordinance the Council must make the following findings: 1. The Villa Montalvo has special historical, cultural, archeaeological, scientific, architectural, or aesthetic interest or value as part of the heritage or history of the City, the County, the state or the nation. 2. The Villa Montalvo satisfies one or more of the criteria set forth in Section 5 of Ordinance No. 66. Once the designating ordinance goes into effect, the Villa Montalvo will be subject to the regulations or Ordinance No. 66 which restrict changes permitted to the exterior of a designated structure. If the ordinance is adopted a Notice of Designation will be sent to the owners of the Villa Montalvo. Briefly describe the present physical appearance of the site (including major vegetation features) or structure and describe any existing major alterations from its original condition: Situated on 175 wooded acres the Villa was built by the late Senator James D. Phelan in 1912 as his country home, designed after an Italian style villa. The main tiled roof building is "U" shaped, two story in height with covered porches and loggias. The Guest Cottage now ouses artists -in- residence and the Carriage House is a theatre and exhibit hall. Recently a pavillon was constructed between the villa and carriage house. B. Commissioner Cameron said the Commission should make an effort to formalize a budget for the City. Chairman Landsness in- . dicated she would find out the deadlines for presenting a budget for next year. B. Committee Assignments Commissioner Mc Arthur indicated she contacted Paul Alley at the Department of the Interior's National Park Service, Division of National Register Programs. He recommended that the Commission contact the State Office of Historic Preservation to have a field.check.of the proposed historic district boundaries before much additional research mas completed. Aaron Gallup of that office was contacted and he said someone would be scheduled to make a field check as soon as Marion Mittlhell- Wilson received a written request for a field check. A draft letter was given to Chairman Landsness to be typed for this purpose. Commissioner Heid recommended that when the field checker comes out that he review more than just the Oak Street area. 1. Heritage Resource Designation Committee: Commissioners Henderson and Voester'- will assist interested citizens with designations. 2. We feel fortunate to have this structure in our community ". The Commission made the following finding regarding the application: "This fine example of Italian Villa style architecture has been preserved intact as constructed in 1912 by Senator Phelan and is now enjoyed as a cultural.center of the arts. It is a stately structure worthy of this designation ". Commissioner Voester moved that the Commission recommend that the City Council designate the Villa.Montalvo as a Heritage Resource of the City of Saratoga. - Commissioner Henderson seconded the motion which passed unanimously. Commissioner Voester. and .Chairman Landsness submitted a sample certificate proposed for the recognition of Heritage Resource designees. Commissioner Kvamme will be working on this. Commissioner McArthur showed a sample handout entitled "Answers to Your Questions About Historic Preservation ". She indicated she would revise it for resubmittal to the Commission. Chairman Landsness suggested that the Commission try to have a logo designed to use on certificates and brochures. Every commissioner was asked to bring sample logo ideas for the next meeting. III. SUBJECT: Plans and Specifications for Quarry Creek Improvements ` Issue Summary The Northwest Hillside Specific Plan was adopted in June of 1981 and calls for various specific public improvements for the area. Drainage improvements and repairs along Quarry Creek are among these works. Conditions of approval on subdivisions within the area place responsibility for the cost of these repairs on developers. However, the City must specify the exact work to be done in order to set precise conditions. These conditions can be specified only through engineering analysis and study. Earlier this year, the City received the first phase of the Heiss Report which analyzed all of the improvements called for in the Specific Plan and estimated the range of costs for each. Along with that report, the City received a proposal from Terratech, Inc. of San Jose to update their 1979 analysis of improvements required along Quarry Creek. This update would enable the City to specify the improvements required for repair and stabilization of the creek. These specifications now are needed for determining the conditions of approval on pending subdivision work. Recent storms have further damaged the creek, and the City is attempting to obtain the needed improvements before furthur damage occurs. It is timely for the City to proceed with the Terratech study of the creek in order to determine the specifications for repairs and improvement with the developer. The cost of the study will be reimbursed through settlements with the developer. Recommendation (1) Authorize the City Manager to enter into an agreement pursuant to a proposal dated 2/13/84 with Terratech, Inc. of San Jose for geotechnical studies of Quarry Creek and preparation of plans and specifications for improvements. (2) Appropriate the amount of $21,000 from Drainage Improvement Fund for the cost of the work. Fiscal Impacts The $21,000 estimated for the study will be recovered through development fees. Advancing the costs at this time will allow the work to be performed in advance of development, thereby reducing risks of further damage. Eden Estates (Cocciardi property) to the culvert that carries Quarry Creek under Quarry Road. In 1979 we prepared a report for Mr. Cocciardi on the geologic/ geotechnical feasibility of improving Quarry Road (see Terratech report #2587 dated April 1979). In this report we offered two schemes for Mr. Cocciardi's consideration: 1. Improvement of Quarry Road by constructing a compacted soil buttress in Quarry Creek and reconstructing the north shoulder of Quarry Road by engineered fill. This scheme is shown in diagrammatic cross section in the attached sketch. (this sketch was one of the exhibits in our 1979 report). 2. Improvement of Quarry Road by minor improvements -- cuts, fills and retaining walls on either side of Quarry Road and the reconstruction of a landslide in the north shoulder of Quarry Road. Scheme 1 would bring Quarry Road up to City Standards with a 26 foot wide pavement and 3 foot wide shoulder on either side. This scheme, however, would have a large impact on the natural environment along Quarry Creek. Scheme 2 would have produced a usable road -- but not up to City Standards of stability -- with a 20 foot wide pavement, a 3 foot wide shoulder on the north side and a 2 foot wide drainage swale on the south side. February 13, 1984 Project 2587/2 - 2 - Our 1979 report was reviewed by the City Geologist, Mr. W. Cotton and by Mr. Don Wimberly, City Director of Inspection Services (at that time). Copies of their review memos are attached. You should note that Mr. Cotton and Mr. Wimberly both required additional investigation of Quarry Road. Mr. Wimberly subsequently provided specific direction on the extent of the required additional investigation. A copy of Mr. Wimberly's memo on this is attached. Since 1979, the landsliding in the north shoulder of Quarry Road has become much more extensive, largely as a result of the unprecedented, heavy rains during the winters of 1981/82, 1982/83 and 1983/84. The present extent of the landsliding -- caused by erosion at the toe of the slope that leads down from the north side of Quarry Road to Quarry Creek -- has ruled out Scheme 2 as a viable alternative to Scheme 1. In our opinion, if Quarry Road is to be improved, Scheme 1 should be adopted, and this proposal relates only to that scheme, modified to meet the development plans that are being considered by the City for Quarry Road /Quarry Creek. As we understand it, the development /improvement plan.presently being considered by the City for Quarry Road /Quarry Creek separates Quarry Road into two parts: 1) Quarry Road between Mr. Eden Estates and Vaquero Court and 2) Quarry Road between Vaquero Court and the culvert that carries Quarry Creek under Quarry Road. These two parts of Quarry Road would be improved to different standards. Quarry Road between Mr. Eden Estates and Vaquero Court is at present a private, narrow, dirt road used only by walkers and horses. This part would be improved to full City street standards with a 26 foot wide pavement, curbs and gutters, and a 3 foot wide shoulder on either side (the same road section as planned for Mt. Eden Estates). This part of Quarry Road would become a dedicated City street and would provide ingress and egress through Mt. Eden Estates to Mt-. Eden Road for residents of Vaquero Court. Quarry Road between Vaquero Court and the Quarry Creek culvert is at present a private paved road. The road pavement is in poor condition and there are several large landslides in the slope that leads from the north shoulder of Quarry Road down to Quarry Creek. The only improvement of this part of Quarry Road would be the stabilization of the flow line of Quarry Creek to minimize or eliminate further erosion by Quarry Creek at the toe of the slope down from Quarry Road. This portion of Quarry Road would be used subsequently only for emergency access. . February 13, 1984 Project 2587/2 - 3 - As we see it, the investigative and design work needed for the improvements being considered for Quarry Road, should be done by a professional team consisting of: a geotechnical engineer, a geologist, a civil engineer, a hydrologist and a landscape architect. The following is a list of the work that we think needs to be done. The geologic /geotechnical components of the list are based on Mr. Wimberly's 1979 memorandum. For each item in the list we have indicated the professional(s) who would be involved. 1. Prepare a geologic map of the Quarry Creek region from Mt. Eden Estates to Pierce Road. The mapping area will be approximately 60 acres of steep terrain interrupted by numerous landslides, the majority of which are on the slope that leads down from Quarry Road to Quarry Creek (TERRATECH). 2. Provide a topographic map at a scale of 1 " =50' of the Quarry Creek Region (crest to crest on either side of Quarry Creek) and cross sections through Quarry Road /Quarry Creek at 100' intervals at a scale of 1 " =10' (CIVIL ENGINEER). The topographic map would be used as the base for our geologic map and the cross sections would be used as the base for design of the buttress and new channel in Quarry Creek. 3a. Design a compacted soil buttress to be constructed in Quarry Creek between Mr. Eden Estates and Vaquero Court to provide lateral support for the landslides in the slope adjacent to Quarry Road; design compacted soil slopes to allow the widening of Quarry Road, where necessary, to provide a 26 foot wide pavement with 3 foot wide shoulders on either side; and design a pavement for Quarry Road and any necessary retaining walls (TERRATECH /CIVIL ENGINEER). 3b. Design stabilization works for the flowline of Quarry Creek between Vaquero Court and the culvert that carries Quarry Creek under Quarry Road. (TERRATECH /CIVIL ENGINEER /HYDROLOGIST). 4. Perform a hydrologic study to provide a means of selecting the flood flow of Quarry Creek to be used for the design of a lined channel (or culvert) and for the design of alternative energy dissipation structures. Make preliminary designs of the alternative hydraulic works for consideration by review agencies. After selection of the hydraulic works considered best for Quarry Creek, make detailed designs of these works. (HYDROLOGIST /TERRATECH /CIVIL ENGINEER) February 13, 1984 Project 2587/2 - 4 - 5. Provide specifications, construction drawings, cross sections and details of the whole scheme for the improvement of Quarry Road /Quarry Creek. The construction plan will be an overlay to the 1 " =50' topographic map described in 2 (CIVIL /ENGINEER /TERRATECH). 6. Make recommendations for mitigative works considering-the initial large impact the scheme will have on the environment along Quarry Creek (CIVIL ENGINEER /TERRATECH /LANDSCAPE ARCHITECT). 7..Prepare a comprehensive report dealing with the geology, geotechnical engineering, hydrology, hydraulics and civil work for the whole scheme (TERRATECH /CIVIL ENGINEER /HYDROLOGIST).
