HEAD: SUBJECT: Authorization to Reroof the Mansard on the Civic Theater Recommended Motion (s): 1. Co., Inc. of San Jose to be project. 2. Move a change orders to the contract up to Report Summary: The wood shake mansard of the Civic Theatre is in need of replacement. The mansard is approximately 25 years old and over the last two years has lost a number of cedar shakes that have blown off during winter storms. While loss of the shakes detracts from the appearance of the Theatre, it may also point to areas of water damage to the sub - sheeting of the roof system. Staff is recommending a complete replacement of all cedar shakes with a Hardislate shake which closely matches the shakes on the City Hall mansard. The Hardislate shake is a fiber - cement slate tile with a fifty (50) year product warranty and has a Class A fire resistance rating. The slate tile installed on the mansard above both wings of City Hall is no longer manufactured and the Hardislate shake is the closest match recommended by the three roofing contractors which submitted bids. Staff requested quotations from qualified roofing contractors using the informal bidding procedures contained in Section 12 -15 of the City Code. Three contractors responded with bids which are summarized as follows: California Roofing Co., Inc. $21,343 Los Gatos Roofing $25,755 Waterproofing Associates $27,000 As staff has carefully checked the low bid and determined that it is responsive to the City's solicitation for bids, it is recommended that Council declare California Roofing Co., Inc. of San Jose to be the lowest responsible bidder. Fiscal Impacts: The current budget contains $23,000 in Activity 84 (building maintenance), account #4530 (repair service), for the replacement of the Civic Theatre mansard shake roof. The lowest responsible bidder is California Roofing Co., Inc. who quoted an installed price of $21,343. Advertising, Noticing and Public Contact: Nothing additional. Conse uences of Not Acting on the Recommended M ions: The roof replacement will not be approved as recommended staff will assume it is directed to make the best possible repair to the existing roofing system unless instructed otherwise. HEAL SUBJECT: Landscaping and Lighting Assessment District LLA -1; Reauthorization for FY 96 -97 Recommended Motion(s 1. Move to adopt the resolution describing improvements and ordering the Engineer's Report for reauthorization of the District for FY 96 -97. 2. Move to adopt the resolution appointing the Attorneys for the District for FY 96 -97. 3. Move to accept the proposal from John H. Heindel dated February 12, 1996 to provide assessment engineering services for the District for FY 95 -96 through FY 00 -01. Report Summary: Attached are the various Resolutions which the Council must adopt to initiate the reauthorization of the Landscaping and Lighting Assessment District LLA -1 for FY 96 -97. A brief summary of. each of the actions the Council must take follows: 1. Resolution describing improvements and directing preparation of Engineer's Report for Fiscal Year 1996 -1997 - This is the resolution required under Streets & Highways Code Section 22622 to initiate the annual renewal process for the District for the ensuing fiscal year. The resolution refers to the improvements proposed to be undertaken (Exhibit A), and orders the preparation of the Engineer's Report required under S &H 22565. 2. Resolution appointing attorneys for Fiscal Year 1996 -1997 - This resolution appoints the City Attorney's office as the attorneys for the District for FY 96 -97 and limits the attorney's fees to a maximum of $500. 3. Proposal for Assessment Engineering services - It is recommended that the Council accept the letter proposal from John H. Heindel dated February 12, 1996 to provide assessment engineering services for the District for FY 96 -97 through FY 00 -01. The assessment engineering services are well defined under "Scope of Services" in the proposal and generally include preparation of the Engineer's Report, preparing and mailing the notices of the Public Meeting and Hearing, and coordinating with the County Assessor's and County Auditor's offices to ensure accurate placement of the assessments on the property tax roll. Mr. Heindel has served as the Assessment Engineer for the District for many years now and has provided exceptional service to both my office and the District, and I recommend accepting his proposal to provide such services for the next five years to avoid the need to annually obtain proposals for Assessment Engineering services. Last year, the Council was uncomfortable with the idea of entering into a multi -year proposal, however this situation is really no different than the ongoing agreements for professional services the City maintains with the City Arborist, City Geologist and City Surveyor. All of these professionals have served the City for quite some time offering very specialized services. By virtue of their intimate knowledge of City processes and needs, their value to City staff is such that it would be impractical to terminate any of their agreements unless their performance dropped to an unacceptable level. In addition, Mr. Heindel is offering in his multi -year proposal to install and annually update the Parcel Management System he uses on a City PC at no additional cost to the City or District, (Proposal Item No. 2). This could be a very useful tool for City staff. Lastly, a check of at least one other firm which can provide Assessment Engineering services has revealed that Mr. Heindel's fees are quite low, something which is directly attributed to his length of service as Assessment Engineer. Fiscal Impacts• All of the costs associated with the Landscaping and Lighting Assessment District LLA -1 are charged against and recovered through the District. There is no direct fiscal impact on the City's General Fund. A more precise look at the proposed funding of the District in FY 96 -97 will be available when you receive the preliminary Engineer's Report. Advertising, Noticing and Public Contact: Nothing additional at this time. Eventually, notices will be mailed to those property owners in the District whose assessments are proposed to be increased, informing them of the upcoming Public Meeting and Hearing. Conseauences of Not Actina on the Recommended Motions: This would depend on what recommendations the Council does not vote in favor of. Either the reauthorization process would not begin; or the City Attorney's office would not be appointed as the Attorneys for the District; or the proposal from the Assessment Engineer would not be accepted. Follow Up Actions: Work on the Engineer's Reports will begin. The remaining schedule of events is as follows: April 17 - Preliminary Engineer's Report is received by the Council and preliminarily approved. Council adopts Resolutions of Intention and schedules the Public Meeting and Public Hearing. April 18 - Joint Notices of Public Meeting and Public Hearing are mailed. May 15 - Public Meeting. June 5 - Public Hearing. Council adopts resolutions overruling protests and ordering the assessments. By August 10 - Assessment Engineer delivers Assessment Roll to the County Auditor. Scope of Services 1. Revise the existing computer program used for generating the assessment rolls, to accommodate revisions to the formula for spreading assessments in the Village Parking District. 2. Install a Parcel Management System on a PC in the City offices and provide an operation manual therefor. The system's capabilities will include for all parcels within the City of Saratoga: a. Search for parcel by assessor's parcel number b. Search for parcel by owner's name C. Display parcel data from the assessor's file, including owner's name and address and assessed valuations d. For parcels within the landscaping and lighting district, display all information appearing on the roll in the Engineer's Report, plus the previous year's assessment The Parcel Management System will be updated annually from the County assessor's roll. All software and the manual will remain the property of Engineering Data P. O. Duplication of software or manual will require prior approval by Engineering Data Services. 3. Consult with City staff personnel to determine costs, contributions and carryovers for the next fiscal year, segregated by zone. 4. Generate a preliminary roll for parcels in the existing district, using the information determined under 2. above and the previous year's parcel data file, to be used for the public hearing. 5. Compile a data file, generate a preliminary roll and prepare an assessment diagram for parcels to be annexed to the district, if any, using current assessor's data, to be used for the public hearing. 6. Complete the Engineer's Report, including all additional items required by the Act of 1972. 7. When the new assessor's roll becomes available from the County (probably in July), update the data files, preliminary rolls and assessment diagrams to produce final files, rolls and diagrams which agree with the new assessor's roll. 8. Send notices to the owners of all parcels to be annexed, if any, and to the owners of other parcels as directed by City staff or as otherwise required by law. A notice will be produced for each parcel, which will contain the following information: Owner's name and address, assessor's parcel number, amount of the existing assessment, amount of the proposed assessment, the address to which property owners may mail a protest against the proposed assessment, a statement that a majority protest will cause any assessment increase to be abandoned, and the dates, times and locations of the public meeting and public hearing, respectively. This notice, together with a copy of the Resolution of Intention, will be sealed in a window envelope provided by the City, stamped and mailed. 9. Attend any public meetings and public hearings that might be held relative to the proceedings, to explain the methods of spreading the assessments and to answer any questions relative to the above services. Produce and file with the county auditor a computer tape of the assessment roll containing the assessments shown on the final roll. 11. Perform any services requested by the City which are additional to those described above. Fee for Services For fiscal year 1996 -1997 I propose to perform Items 3 through 7, 9 and 10 above for a lump sum fee of $5,800.00, plus $6.65 per parcel added to the roll since the preceding year. For fiscal year 1996 -1997 I propose to perform Item 8 above for a fee equal to $1.65 per notice ($150.00 minimum) , plus cost of postage and reproduction of the resolution. For fiscal year 1996 -1997 I propose to perform Item it above for a fee equal to $110.00 per hour expended by me, plus 115% of the cost of any outside services and expenses incurred by me. I propose that each subsequent year, beginning with the 1997- 1998 fiscal year, the above fees be escalated proportional to the May value of the San Francisco - Oakland -San Jose Consumer Price Index, as published by the U. S. Department of Labor. If the City accepts this proposal to enter into a multi -year agreement (through fiscal year 2000 - 2001), I propose to perform Items 1 and 2 above at no additional cost to the City, assuming the number of parcels in the district does not fall below the present number. If the City elects to enter into a one -year agreement (for 1996 -1997 only), I propose to perform Items 1 and 2 above as described for Item 11 above. HEAD SUBJECT: Authorization to purchase replacement vehicles and to dispose of surplus property Recommended Motion(s 1. Move to authorize the replacement of Vehicle #69 by purchasing through the 1996 State vehicle procurement program. 2. Move to authorize the replacement of Vehicle #'s 63, 64, 65 & 72 by advance purchasing through the 1996 State vehicle procurement program. 3. Move to declare the entire Surplus Vehicle Inventory List dated February 26, 1996 as surplus property, and authorize its disposition in the manner deemed most appropriate by the City Manager. Report Summary: Recommended Vehicle Replacements: Staff has received the bid list for the 1996 State vehicle procurement program. Whenever possible, the City attempts to purchase vehicles through this program since the City avoids having to develop bid packages and solicit bids for vehicles on its own. In reviewing the current bid list, the prices for pickup trucks are again very competitive, as is the price for at least one model of automobile, an Oldsmobile Ciera. Consequently, staff is recommending the purchase of replacement vehicles off of the State bid list as follows: 1. Vehicle #69 - A 1989 medium duty pickup truck assigned to the Street Maintenance Superintendent and budgeted for replacement in FY 96 -97 for $20,000. However, this vehicle should be replaced now to avoid further maintenance and repair costs which, in the past two years, have been excessive. The recommended replacement for Vehicle #69 from the 1996 State bid list will cost $18,375. To accomplish this, it is recommended that the replacement of Vehicle #55 ($27,000) be deferred from FY 95 -96 to FY 96 -97 after the 1997 State bid list is received. At that time, staff believes the replacement vehicle can be downsized to a medium duty CNG powered pickup for which AB 434 (40 %) funds have been applied for in the t*ird funding cycle. 2. Vehicle #63 - A 1987 light duty pickup truck assigned to the building inspectors and budgeted for replacement in FY 96 -97 for $15,000. The recommended replacement is a light duty CNG powered pickup for $19,056. The City was allocated $16,000 in the second cycle of the AB 434 (40 %) funding program to acquire this vehicle. Delivery and payment would be deferred until after July 1. 3. Vehicle #64 - A 1987 light duty pickup assigned to the Public Works Department and budgeted for replacement in FY 96 -97 for $15,000. The recommended replacement is a similar pickup for $15,812. Delivery and payment would be deferred until after July 1. 4. Vehicle #65 - A 1987 Dodge Aries assigned to the vehicle pool and budgeted for replacement in FY 96 -97 for $15,000. The recommended replacement is a CNG powered 8 passenger mini -van for $25,335. The City was allocated $22,500 in the initial cycle of the AB 434 (40 %) funding program to acquire this vehicle. One anticipated use of the van will be for Planning Commissioners to conduct their bi- weekly inspections of land development sites. Delivery and payment would be deferred until after July 1. 5. Vehicle #72 - A 1990 Ford Tempo assigned to the vehicle pool and budgeted for replacement in FY 96 -97 for $15,000. The recommended replacement is the Oldsmobile Ciera off of the State Bid for $15,260. Delivery and payment would be deferred until after July 1. Disposal of Surplus Vehicles: Upon acquisition of the replacement vehicles as described above, the City will have 15 surplus vehicles to dispose of which includes those vehicles replaced in recent years. These are itemized on the attached inventory prepared by the Street Maintenance Superintendent dated February 26. Upon conferring with one firm which specializes in auctioning surplus fleet vehicles, the City can expect to receive approximately $28,000 for the vehicles on the list. To begin the process of disposing of these vehicles, and to have them removed from the City's list of vehicles for which insurance must be maintained, it is recommended that the Council declare the entire list as surplus property as required by Section 2- 45.170 of the City Code and authorize its disposition in the manner deemed most appropriate by the City's Purchasing Officer, i.e. the City Manager. Fiscal Impacts• As discussed above. The adopted and approved budgets for both FY 95 -96 and FY 96 -97 contain sufficient funds in Activity 82 (Equipment Operation) , Account 6785 (Rolling Stock Replacement) , to complete the recommended purchases. Adjustments to the revenue side of the budget will be made to reflect the sales of the surplus vehicles, and the receipt of the AB 434 (40 %) funds not anticipated when the budget was adopted last year. Advertising, Noticing and Public Contact: Nothing additional. Consequences of Not Acting on the Recommended Motions: Some or all of the recommended vehicle replacements would not be made depending on what the Council decides. This would lead to increased maintenance and repair costs as older vehicles are maintained in the City's fleet. Further, revenues from the sale of surplus vehicles might not be realized as expected, and /or the City could not claim the AB 434 (40 %) funds to which it is entitled. Follow Up Actions: 1. The replacement purchase for Vehicle #69 will be made. 2. Orders for the replacement of Vehicles #63, 64, 65 & 72 will be made with instructions to hold deliveries and invoicing until after July 1. 3. Arrangements for the disposition of the surplus vehicles will be made. 4. Claims for AB 434 (40 %) funds will be processed. 5. A budget amendment will be processed to reflect additional revenues from the sale of vehicles and the receipt of AB 434 (40 %) funds.
