Recommended Motion:
Accept the subject project and authorize filing of the "Notice of Conpletion ".
Report Summary:
The Saratoga City Council, at'their regular'meeting on 7 -6 -88, awarded the
contract for above project -tq Raisch Construction Canpany. The work on the project
has been satisfactorily completed. This project was overrun by $18,852.80 due
to extra excavation and extra paving on Fruitvale Avenue. Therefore, please
approve the attached Appropriation Resolution.
Fiscal-Impacts:
Total construction cost; $189,116.41.

OBJECTIVES AND PLANNED PERFORMANCE:
To provide for the maintenance of all bike paths, foot paths, city
streets on a continuing basis using City personnel and equipment.
Included is the maintenance work called for in the Pavement Management
program performed annually through contracted labor and material. The
activities provided for include: patching, crack sealing, resurfacing
of the travel surface, overall maintenance of approximately 128 miles
of streets rights of way. Also included is an increased level in the
control of roadside weeds. Note: the PMS budgets for maintenance
for 1987 and 1988 have been modified to conform to the updated
pavement condition survey completed in April 1987. The maintenance
performed under the P.M.F. will reduce the use of Chip Seals so that
it is used only on rural roads and in conjunction with another type
of seal which will cover the chips and eliminate dust, loose stones,
and excessive oil. We have included a regular monthly street sweeping
service of all arterials.

Recommended Motion:
Report Summary:
Review report, formulate comments, direct staff to
prepare letter of response.
Santa Clara County Transit is requesting input on a
Comprehensive Operational Analysis of the basic route
network. Of the six routes serving Saratoga, only one
route is proposed for modification. County Transit is
doing special outreach to persons affected by that
change. The COA is a short range program to be implemented
from 1989 to 1991.

SUBJECT: Review and comment on Santa Clara County Transit
Comprehensive Operational Analysis Report
Background
The Santa Clara County Transit Board has contracted with ATE
Management, Inc. to conduct a comprehensive operational analysis
(COA) of the basic route network, for the purpose of identifying
ways to restructure the bus system to make it more direct,
streamlined, and efficient. The need for the restructuring effort
was identified as a priority by the Transportation 2000 Plan.
The recommendations in the COA report are subject to extensive
public and jurisdictional review prior to approval and
implementation. A workshop was held on November 9 for the Transit
District Board, Transportation Commissioners and
Staffs. In addition, five community public meetings
late November, and County Transit has undertaken
effort to notify riders and impacted parties rega

The COA is comprised of three basic components: Immediate Phase,
Short Range and Long Range Plans. The Immediate Phase Plan, the
largest section of the document, covers service revisions to the
local route network which can be implemented in 1989. The emphasis
was placed on modifying the system rather than completely
overhauling it. The modifications are designed to enhance route
directness and identity, work toward a more effective grid network
and better match service levels with demand. The Short and Range
Plans build on the Immediate Phase Plan, targeting T2000 priority
service improvements that can be implemented in 1990 -91. These
include revisions to Express routes and full integration of the bus
system with the LRT system.

There are currently six bus routes serving Saratoga. The attached
Map A shows the configuration of all of the routes in Saratoga; the
remaining maps show each of the routes individually. No immediate,
short or long -term changes to any of the existing route segments in
Saratoga are proposed, except to Line 54. In addition, no new
routes in Saratoga are proposed. Each of the routes are described
more fully below:
Line 26 - This line is an east -west route between East San Jose and
Campbell with its primary alignment on Curtner, Tully,
Union, Bascom, and Campbell. It is also a north -south
route between Campbell and the Moffett Park /Lockheed area
with its primary alignment on Miller, Wolfe, and Fair
Oaks. The line travels through Saratoga on Prospect Road
between Saratoga Avenue and Miller; average monthly
boardings at stops in Saratoga is 1,740.
Line 27 - This line is an east -west route providing connections
between Saratoga and Los Gatos, and serving the southeast
portion of San Jose with its primary alignment along
Blossom Hill. The line travels through Saratoga on
Saratoga -Los Gatos Road to Saratoga Avenue and along
Fruitvale to West Valley College; average monthly
boardings at stops in Saratoga is the highest of all the
lines serving the community, 6,980.
Line 53 - This line is a lengthy north -south neighborhood feeder
route with a number of schools along its route,
terminating in commercial centers at both ends. The line
travels through Saratoga on Prospect Road between
Saratoga - Sunnyvale Road and Saratoga Avenue; average monthly
boardings at stops in Saratoga is 110.
Line 54 - This line is a north -south route running through Saratoga,
Cupertino and Sunnyvale. The line travels through
Saratoga on Saratoga- Sunnyvale Road, with the southern end
serving Fruitvale Avenue and West Valley College via a
one -way counterclockwise loop on alternate trips. Average
monthly boardings on stops in Saratoga is 6,920.
This line has an immediate phase recommendation to delete
the segment in Saratoga that travels on Saratoga -Los Gatos
Road and the southern end of Allendale. This segment has
very low ridership, and a portion of it is also served by
Line 27. To improve route identity, bi- directional
service and convenience, the COA recommends that all trips
to West Valley College from this line should travel from
the intersection of Hwy 85 and Hwy 9 in downtown Saratoga
in both directions via Saratoga Avenue and Fruitvale. No
other immediate, short or long -term changes are proposed
for the segment in Saratoga.
Line 57
- These are major north -south
routes providing main
line
and
service on Bowers, Kiely,
and Saratoga Avenue.
The
Line 58
southern end of the lines serve West Valley College;
Line

57 travels on Quito and Allendale and Line 58 uses
Saratoga and Fruitvale. The northern terminus of Line 57
is the Tasman -Great America area (with some peak period
trips to and through Lockheed); the northern terminus of
Line 58 is the community of Alviso with some connections
to portions of the Golden Triangle area. Average monthly
boardings on stops in Saratoga is 2,880 on Line 57 and
2,920 on Line 58.
During the COA data - gathering process, many communities asked the
County Transit staff to study special service requests. The City of
Saratoga asked for a study of the potential for another east -west
route in Saratoga, possibly along Cox Avenue, and the potential for
expanded service on Quito south to Saratoga -Los Gatos Road. In
response to these requests, the COA report states the following:
Cox Avenue - "While the street exhibits some grid
characteristics, it does not exhibit strong transit
potential. In addition, neither end ties into any other
east -west streets so that an adequate grid route in this
portion of the County can be designed. Layout of existing
routes in this area is good, and deviations from them to
serve Cox would destroy their design integrity and
inconvenience current users. Cox cannot generate
sufficient ridership to require a route of its own.
Another issue is the impending construction of Hwy 85,
which will cut through Cox. COA recommendations have
avoided, wherever possible, orientation of bus routes in
the construction corridor."
Quito Road - " ..currently served between Saratoga and
Allendale by Line 57. The remaining segment, from
Allendale to Saratoga -Los Gatos, is low density and
relatively high income. It is also narrow, curvy and
operationally unsafe with no opportunities for bus stop
placement. Quito Road does not warrant bus service at
this time."
Saratoga also asked for consideration of an east -west connection
from Quito to Pollard, since the only existing Saratoga -Los Gatos
service is via Saratoga -Los Gatos Road (Line 27). While this request
was not addressed in the COA report, County Transit staff have
indicated that the route was not considered at this time again
because of Hwy 85 construction through that route.
Action by the Council
County Transit staff is requesting that all input on the COA report
be submitted by December 16, 1988. After reviewing all the input
received, they will develop a set of staff recommendations to go
with the report. Another round of community meetings is scheduled
for February, with Board of Supervisors adoption tentatively set for
April, 1989.

The intent and scope of the COA report is a short -term
implementation program, from 1989 to 1991. The goal is to establish
a more efficient and direct base route network within that time
frame, which can then be expanded and enhanced once the changes are
implemented.
The portion of Line 54 to be deleted serves the southern end of
Fruitvale, between West Valley College and Hwy 9. This segment has
two stops (Crisp and San Marcos) which are served only on alternate
routes; boardings and alightings are extremely low. The affected
users of this segment are at the Oddfellows Home. County Transit
staff is doing special outreach to the Oddfellows to solicit their
input on the proposed change.
Because only one of the routes serving Saratoga has a segment
change, staff recommends that it is not necessary for the Council
to hold a public hearing on this item in addition to those already
scheduled by County Transit. Council should formulate its comments
on the report and direct staff to forward a letter to County
Transit. If additional time is needed, the item can be continued to
the December 7th meeting, still leaving time to meet the December
16th deadline.

Enclosed is a copy of the final report prepared by ATE Management, Inc. for
Santa Ciara County Transit. It contains specific route and service change
proposals which ATE is recommending as a result of their Comprehensive
Operational Analysis of County Transit's bus system.
The Transit District Board of Supervisors contracted with ATE to conduct
this comprehensive study of the basic route network. The purpose of the study
was to identify ways to restructure the bus system making it more direct,
streamlined and efficient. The need for this restructuring effort was
identified as a priority by Transportation 2000, which has set the vision and
direction for countywide transportation improvements over the next decade. The
basic route structure developed as a result of the ATE study will provide the
framework upon which future service expansions will be built.
The proposals in this report will be subject to extensive public and
jurisdictional review prior to approval and implementation. As part of this
review process, ATE and County Transit staff will be holding a special workshop
on November 9, 1988 for the Transit District Board, the Transportation
Commissioners and the city planning staffs (please see enclosed agenda).
Starting in late November, County Transit staff will then present the ATE
report to the community at five public meetings which have been scheduled at
various locations throughout the county. After the last public meeting, on
December 1, 1988, County Transit staff will reexamine all of the input received
and develop a set of staff recommendations. It is important, therefore, that
the cities have submitted in writing their comments by December 1, in order to
have them considered as part of the staff review. Send comments to:

Accompanying the ATE report is a list of streets on which ATE is proposing
to operate new service. County Transit will be notifying the residents on
these streets of the proposal and inform them about the public meetings. City
staff should review this list and comment as to any limitations (structural or
otherwise) that may prohibit County Transit from operating on these streets.
If at any time the city feels that it would be beneficial to meet and
discuss ATE's proposal individually, County Transit staff will be available to

Report Summary:
The Housing Assistance Plan is prepared every three years and
submitted to HUD as part of the Urban County's obligation as a
recipient of the Community Development Block Grant (CDBG).- Each
of the eight jurisdictions which comprise the. Urban County CDBG
Program prepares an individual report which is then compiled for
submission to HUD. In addition to the three -year plan, each
jurisdiction prepares an annual increment statement (for the
period October 1 to September 30) stating current year achieve-
ments and goals for the following year. Saratoga's HAP goals are
achieved primarily through SHARP, the housing rehabilitation
program which uses CDBG funds to provide no- and low- interest
loans to qualifying low income residents. The figures used in
preparing the HAP were compiled from the 1980 Census data and the
City's 1984 Housing Element.
The Council is requested to accept and approve the 1989 -91 HAP
which has been prepared by the City's Planning staff for submis-
sion to the County.

RESOLUTION ACCEPTING THE THREE YEAR HOUSING ASSISTANCE PLAN
FOR 1989 -91, PURSUANT TO TITLE I OF THE HCDA OF 1974, AS AMENDED
WHEREAS, the City of Saratoga is a participant in the Santa Clara
County Urban County Cooperation Agreement to undertake or assist
in the undertaking of essential activities pursuant to Title I of
the Housing and Community Development Act of 1974, as amended for
fiscal years 1988 -90; and
WHEREAS, every three years each participant in the Urban County
is required to prepare a Housing Assistance Plan describing their
housing conditions and goals to meet the housing needs of lower
income persons, and identifying specific housing actions to be
undertaken to fulfill its housing needs; and
WHEREAS, the 1989 -91 Housing Assistance Plan for the City of
Saratoga has been prepared and submitted to the City Council for
review;
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
accept and approve the 1989 -91 Housing Assistance Plan.
The above and foregoing resolution was passed and adopted at a
regular meeting of the Saratoga City Council held on the 16th day

Narrative on Housing Assistance Needs
I. Definitions
A. Substandard Housing: Those housing units which do not
meet Section 8 Existing Housing Quality Standards and /or
display visual evidence of minor or major structural
deficiencies or extreme delapidation.
B. Substandard Suitable for Rehabilitation: Housing units
which display evidence -of minor or major deficiencies are
considered to be candidates for rehabilitation unless the
cost of the repair exceeds 50% of the value of the unit.
Structures in a visually apparent state of extreme
delapidation are also excluded.
II. Expected to Reside ETR
The City of Saratoga continues to maintain a zero "Expected to
Reside" (ETR) figure. This is based on the fact that there is
no significant commercial, industrial, governmental or service
employment anticipated to be generated by new or expanded
development within the next three years. The only remaining
land zoned for light industrial uses is anticipated to be
rezoned for residential use and about 5 acres of undeveloped
commercial land remains in Saratoga. The City is primarily
residential in character and current employment within the
City is also limited. As for the elderly, there is
insufficient data on non - resident elderly households
obtainable from current waiting lists for existing assisted
housing, and there are currently no major health facilities
within the community which are likely to be used by non-
residents.
III. Conversion of Rental Housing to Condominium or Cooperative
Ownership
In order to control condominium conversions, Saratoga has
enacted an ordinance which requires that applications for
approval of a tentative map for conversion of existing
multiple family rental housing units to residential community
housing shall not be accepted, unless and until there is
evidence of a vacancy surplus. This is a vacancy rate in
excess of 3 %. No displacement of rental households is
anticipated during the period of applicability for this
Housing Assistance Plan.

V. Special Housing Needs
There are no particular population groups with special housing
needs that have been identified in Saratoga. There is
virtually no information that is readily available to the City
on these groups. As such, no special housing programs for
these groups (including the handicapped and single individuals
with dependent children) are contemplated. Individuals in

these groups will be assisted with their housing needs as
would other individuals of lower income.
Narrative Section for Three Year Goal
No standard residential units in Saratoga will be demolished as a
result of Federal, State, or local action during the next three (3)
years.
The City of Saratoga will provide housing rehabilitation services to
16 low income households during the three year period. We feel this
goal is realistic given the need in the community and the resources
available. All housing rehabilitation loans will be for low and
moderate income households. In addition, the City will assist a
maximum of 15 housing units through the Section 8 Rental Program
administered by the County Housing Authority. This figure is the
maximum to be assisted, and is anticipated to be somewhat lower
based on resources available, as determined by the County.
In recent years, the City has encountered the following impediments
to achievement of prior housing rehabilitation goals: 1) lack of
response to outreach efforts, and 2) due to staff changes and
shortages, lack of staff time devoted to promotion of the program.
It is anticipated that as the Planning staff responsible for the
program returns to full strength, outreach efforts will be
increased.
Narrative Section on the Annual Goal
The City will provide housing rehabilitation services to 5 -6 low
income households through the SHARP during the program year. The
City will also assist 5 housing units through the Section 8 Rental
Subsidy Program. Both programs are designed to serve low and
moderate income households only through direct screening of incomes
at the initial contact stage. Only low and moderate income
households may participate.

It appearing that on or about May 25, 1982 , the street, storm drain and other
improvements as shown on the hereinafter referred to subdiviison map and on approved
improvement plans therefore were completed and thereafter were maintained by the sub-
divider for a period of not less than an additional year from date of satisfactory
completion.
NOW, THEREFORE, the City Council of the City of Saratoga hereby resolves as follows:
That portion of the City's previous resolution rejecting the dedication of certain

Northern California Savings and Loan - Association hereby authorizes
you to draw on us all amounts allocated for construction of the
subdivision improvements provided for the agreement for the im-
provement of The Parker Ranch, Unit 2, Tract 6528, dated April 21,
1982. The amount allocated for construction for said improvement
is Two Million, Eight Hundred Forty -two Thousand Dollars,
($2,842,000.00).
Accompanying your site draft shall be your signed statement that
Blackwell.Homes did not complete all of the subdivision improvements
provided for in the agreement for the improvement of The Parker
Ranch, Unit 2, Tract 6528, which agreement is dated April 21, 1982,
or having completed them did not maintain said improvements for a
period of time as might be necessary in order for Blackwell Homes
to correct all deficiencies of construction and said improvements.
This letter of credit is intended to constitute an improvement
security as that term is more particularly defined in Section 66499C
of the Government Code of the State of California. The undersigned
hereby pledge that Two Million, Eight Hundred Forty -two Thousand
Dollars, ($2,842,000.00) is on deposit and is guaranteed for payment,
and this letter of credit is hereby declared to be irrevocable.
Drafts must be drawn and negotiated not later than the expiration
of one year after the completion of all work of construction of im-
provements provided for in.the above-referenced agreement. All
drafts drawn under this credit.must bear its date and amount, and
the amounts must be endorsed on the reverse side of this letter of
credit by the negotiating bank. We hereby agree with drawers, en-
dorsers, and bona fide holders of all drafts drawn under and in com-
pliance with the terms of this credit, that such drafts will be duly
honored upon presentation to drawee.

Background
Staff has received an application for waiver of annexation for a
single parcel on Hidden Hill Road within the City's urban service
boundary. We also have an inquiry regarding annexation for a site
on Prospect Road which was waived in 1986. The Council's past
policy regarding annexation has been not to annex properties with
geologic problems or where services are too costly for the City to
develop (Prospect Road). The exception has been where the site is
in a visible location and should be controlled by the City's design
review process ( Bainter Avenue).
Recently, however, the Council has indicated that it is interested
in annexing all properties within the urban service boundary in
order to control the development and ultimately expand the City's
limit line to coincide with the urban service boundary. While
geologic and service constraints would be considered, land use
controls would be of primary concern and the property annexed. Once
the property is annexed, development would be subject to the City's
ordinances regarding grading, drainage, scenic and architectural
quality.
15839 Hidden Hill Road
The subject site is vacant, with an average slope of 23 %. It is
located off an existing driveway extending from the cul -de -sac at
Hidden Hills Road. All services are available to the site and there
is no evidence of geologic problems. It is contiguous to the City
at the west (Hwang residence off Bainter). It is not particularly
visible from the valley floor.

Recommendation

WHEREAS, Charles Goss is the sole owner of Assessor Parcels 510 -6 -12
and 510 -6 -56.
WHEREAS, Charles Goss has requested that said real property be reverted
to acreage in the manner and form as set forth hereinafter; and
WHEREAS, on November 16, 1988, the City Council of the City of Saratoga
held a duly noticed public hearing as the request of Charles Goss for said reversion
to acreage, and after the closing of said public hearing, reviewed and considered

Recommended Motion: Uphold staff's decision to deny Mr. Yuen's application for a
permit to sell concealable weapons.
Report Summary: Pursuant to Saratoga Municipal Code Section 4 -30, Mr. Yuen sub-
mitted an application to the City for a permit to sell concealable weapons. Mr.
Yuen is licensed by the federal government as a firearms dealer, and operated
such a business from his home when he lived in Mountain View. Upon moving to
Saratoga, he applied for the required permit to sell the firearms from his home
as he had done in Mountain View. His application was denied by the Planning
Department because such activity violated the home occupation provisions of
Saratoga Municipal Code Section 15- 40.010; specifically, Subsection (a) which
states:
"'There shall be no stock -in -trade other than products manufactured on
the premises."
and Subsection (k) which states:
"There shall be no display of merchandise, products or other material or
equipment for advertising purposes."
In accordance with Saratoga Municipal Code Section 4- 30.090, Mr. Yuen chose to
appeal the decision of staff to deny his application.

This is in response to your application to the City of Saratoga
for a permit to sell concealable weapons.
Your application for the permit was denied by Acting Planning
Director Harry Peacock pursuant to Saratoga Municipal. Code Sec-
tion 15- 40.010, Subsections (a) and (k). Subsection (a) states
that:
"There shall be no stock -in -trade other than products manu-
factured on the premises."
Subsection (k) states that:
"There shall be no display of merchandise, products or other
material or equipment for advertising purposes."
The denial of your application is based on the fact that you will
have merchandise in the form of hand guns stored at your resi-
dence for sale to potential customers. It is understood that
most of these hand guns would have been purchased by your custom-
ers through a catalog, and the purchased guns would be delivered
to your residence to be stored until the appropriate waiting
period had expired before the guns would be turned over to the
buyer of these weapons. It is also understood that you had
planned to store these hand guns in a safe until the waiting
period had expired. According to the Planning Department, these
material facts violate the above referenced sections of the
City's home occupations code, and thereby constitute grounds for
denial of your permit application. Your application was reviewed
by the planning department in accordance with Section 4- 30.030
(c)(2) of the Saratoga Municipal Code which states that said
application must be reviewed by:
"The Planning Director for determination as to whether the
conduct of the business at the proposed location will be in
compliance with zoning requirements and other rules, regula-
tions, and ordinances of the City."
Pursuant to Saratoga Municipal Code Section 4- 30.090, you have
the right to appeal the administrative denial of your application
before the City Council. Specifically, this section states that:

which, this license shall be subject to forfeiture:
1. The business shall be carried on only in the building designated in the license;
2. The license, or a copy thereof, certified by the issuing authority, shall be
displayed on the premises where it can be easily read;
3. No pistol or revolver shall be delivered:
(a) within fifteen (15) days of the application for the purchase, and when
delivered shall be unloaded and securely wrapped; nor
(b) unless the purchaser either is personally known to the seller or shall
present clear evidence of his identity;
4. No pistol or revolver or imitation thereof, or placard advertising the sale or
other transfer thereof, shall be displayed in any part of said premises where it can
be readily seen from the outside.

HOME OCOPATIONS
515 - 40.010 General regulations
All home occupations shall comply with the following regulations:
(a) There shall be no stock -in -trade other than products manufactured on
the premises.
(b) A home occupation shall be conducted within a dwelling by an occupant
thereof, and shall be clearly incidental to the use of the structure as a dwelling.
(c) A home occupation shall not be conducted in an accessory structure and
there shall be no storage of equipment or supplies in an accessory structure or
outside the dwelling.
(d) There shall be no external alteration of the dwelling in which a home
occupation is conducted.
(e) The existence of a home occupation shall not be apparent beyond the
boundaries of the site. '
(f) Medical offices for doctors, dentists, osteopaths, chiropractors and other
practitioners of the healing arts are not permitted as home occupations in any A, R-
1, HC -RD, NHR or R -M district.
(g) No person other than a resident of the dwelling shall be employed in the
conduct of a home occupation.
(h) A home occupation shall not create any noise, odor, dust, fumes,
vibration, smoke or radio or television interference beyond the boundaries of the
site.
(i) Not more than one truck, of not more than one -half ton capacity, and no
semi - trailers, incidental to a home occupation shall be kept on a site.
Q) A home occupation shall not create pedestrian, automobile or truck
traffic significantly in excess of the normal amount in the district.
(k) There shall be no display of merchandise, products or other material or
equipment for advertising purposes.
(1) Professional or administrative offices wherein clients or prospective
clients are regularly met upon the premises shall not be permitted as home
occupations in any A, R -1, HC -RD, NHR or R -M district. This prohibition shall not
apply to the sale of dwelling units out of a temporary office established in a model
home when properly authorized by a use permit.
VIOLATION OF ANY OF THE ABOVE REQUIREMENTS SHALL CONSTITUTE GROUNDS
FOR REVOCATION OF YOUR BUSINESS LICENSE.
