REPORT: At the City Council meeting of January 16, 2002 a member of the public requested that the City take a position on the West Valley-Mission Community College District Bond Measure ("Measure E") that will be considered by the voters at the March 5, 2002 election. Staff to obtained information on Measure E and presented that information to the City Council at its meeting of February 6, 2002. The Council also accepted public testimony from supporters and opponents of the Measure at that meeting. Following public testimony Council members expressed concern with the Measure and staff was directed to prepare a resolution in opposition to the Measure for consideration at the next City Council meeting. RESOLUTION OF THE CITY COUNCIL OF SARATOGA OPPOSING MEASURE E - A BOND MEASURE PROPOSED BY THE WEST VALLEY-MISSION COMMUNITY COLLEGE DISTRICT WHEREAS, the West Valley-Mission Community College District has proposed a ballot measure to the voters that would authorize issuance of up $268,653,300 in bonds to be used for a number of specified projects at West Valley College in Saratoga and at Mission College (in the City of Santa Clara) and this measure has been designated as Measure E on ballot for the March 5, 2002 election (a copy of the full text of the Measure is attached as Exhibit A); and WHEREAS, Measure E would authorize funds for a number of projects at West Valley College including a project to "[r]enovate, modernize, complete and equip athletic facilities at West Valley College;" and WHEREAS, at the City Council meeting held February 6, 2002 the City Council received a report on the contents of Measure E at which time supporters, opponents and all other interested parties were given a full opportunity to be heard and to present information relevant to the Measure; and WHEREAS, the West Valley-Mission Community College District in 1998 adopted a resolution declaring that it "desires to construct an outdoor stadium facility" for athletic and other. events with seating for up to 5,000 people with amenities which may include "seating, amplified public address and speaker systems, scoreboards, outdoor lighting (including lights, poles and standards), ticket booths, restrooms, concession stands, and other spectator-oriented accessory structures or other such features" (a copy of the full text of the resolution is attached as Exhibit B); and WHEREAS, West Valley-Mission Community College District in the 1998 resolution declaring its desire to construct an outdoor stadium facility further declared that development of the outdoor stadium and development of all classroom facilities at the West Valley College are not subject to compliance with the use permit issued to the District by the City or with either the zoning ordinance of the City of Saratoga or the Santa Clara County zoning ordinance; WHEREAS, the City of Saratoga has adopted a zoning ordinance in order to promote the public, health, safety, and welfare by establishing standards and review procedures to encourage planning and design that minimize traffic, noise, and other impacts to the surrounding community; and WHEREAS, the City of Saratoga actively seeks to promote educational opportunities in the community in a manner that is consistent with maintaining and enhancing the public health, safety, and welfare; and WHEREAS, because the West Valley-Mission Community College District has declared that it need not comply with either its use permit or the City's zoning ordinance in developing the outdoor stadium facility and the numerous classroom facilities that would be funded by Measure E there is no assurance that those facilities would be developed in a manner that would protect the health, safety, and welfare of Saratoga residents; WHEREAS, the City of Saratoga acknowledges that the West Valley-Mission College District provides valuable educational service to the community and acknowledges that renovations and repairs to the college facilities maybe necessary, but does not support the inclusion of funding for an outdoor stadium facility or proceeding with new construction without complying with the City of Saratoga's zoning requirements; and WHEREAS, the Saratoga City Council strives to preserve the integrity and character of the City's neighborhoods and strives to protect the quality of life that the citizens of Saratoga value. REPORT SUMMARY: On January 18, 2002 a small fire occurred in the Cultural Exchange Building on the Hakone Gardens property. The City leases this property to the Hakone Foundation. Under the lease agreement that was renewed in November 2000 the City is responsible for providing "fire and extended coverage insurance on all buildings and other insurable improvements located on the premises which are the property of the Landlord." The City's claims examiner met with Masako Hall the Director of Administration at Hakone Gardens to assess the damage on January 23, 2002 and again of January 29, 2002 to investigate the incident. Full coverage is available on this loss subject to the $5,000 Property Program Deductible. In order to mitigate the smoke damage sustained throughout the Cultural Exchange Center, Four Star Restoration was called and performed the necessary clean-up totally $10,856.71. Ms. Hall is currently obtaining estimates and invoices for the cost to repair the divider screen door, the floor framing and the replacement costs for the electric burner. So far the estimates total $4,066.64 FISCAL IMPACTS: The deductible will be paid in the amount of $5,000 from account #001-1025-511-10.60 CONSEQUENCES OF NOT FOLLOWING RECOMMENDED ACTION: The claim will not be settled. ALTERNATIVE ACTION: The City Council could decide not to pay deductible. FOLLOW UP ACTION: Process payment. REPORT SUMMARY: At the City Council meeting held on February 6, 2002, two Councilmembers requested staff to investigate the City's financial relationships with the Chamber of Commerce-the building lease agreement and the annual financial support-and report back at the Council's next meeting on February 12, 2002. Relationship Overview Council interest in financially supporting the Chamber of Commerce dates back to at least 1968. Council minutes from May 15, 1968, reflect discussion of the topics of annual support payments and office space. However, consensus was not reached and no action was taken at that time other than to - research the possible use of acity-owned pump house as office space. In 1973, City Council minutes documented the declaration of the James McWilliams House as a gift from Vendla and Hugh Purcell. Staff has not found any agreement between the City and the Purcells that might assign conditions on the gift but continues to research this matter. The City shared the cost of relocating the house to City-owned park property on Saratoga-Los Gatos Road with Saratoga's Rotary and Historical Society (see attached Saratoga News article). In March 1976, the City and the Chamber entered into a license agreement that permitted Chamber use of the structure for payment of $1 per year. The agreement was renewable annually (see attached copy of license agreement) and included additional terms and conditions such as responsibility for utilities and termination of the license. Council minutes at the same time indicate that the City was also providing "funding for programs" although the dollar amount is not indicated. License renewal has become one of the elements of the agreement considered by the Chamber and City every two years. Staff has not been able to identify exactly when financial support began but available records show annual or bi-annual agreements for at least the last 10 years. The Chamber has occasionally asked for funding increases and the total reflected in each agreement does vary. In 1990, Council approved payment to the Chamber of $7,000. Between 1993 and 1998, the total was reduced, and funds paid have ranged between $3100 and $3400 per year. In Spring 2000, the Chamber requested their cash allotment be increased to $10,000 per year to reflect the wide range of services they provide to others beyond their membership. For example, they respond to phone calls, emails and drop-in traffic as a Visitors Center. The City Manager began negotiations with the Chamber president and brought an agreement to Council on June 21, 2000, that reflected the $10,000 increase (copy attached). The request for increased funding was not incorporated into the 2000-01 fiscal budget. Council did not approve an agreement for 2000-O1 because the City and the Chamber could not come to terms on a revised scope of work for the new agreement. As a result, the Chamber has been operating without a written agreement for the last 19 months. Staff has continued to process payments for amounts shown in the most recent agreement. In 2000-01, the Chamber received a total of $2933.75 (three payments of $836.26 and one of $425). In 2001-02 to date, the Chamber has been paid $2508.75 (three payments of $836.26). City of Saratoga Financial Support City-provided financial support includes more than just the annual cash payments. A staff report from 1996 gives the following breakdown for total (both cash and in-kind) City support: Celebrate Saratoga personnel, supplies and services $9585 Celebrate Saratoga liability coverage for one-day event $1500 Office space market rate $10,800 Cash 1996 $3245 Total support in 1996 $25,130 The City continues to provide this level of support. Costs have only increased in the past 6 years and staff estimates the total now to be somewhere between $30,000 and $40,000. Records show conflicting numbers for the square footage of the Chamber office, but even using the smallest size (560 sq.ft.) at current market rate, the rent subsidy is about $16,800 per year. City/Chamber Support in Other Cities According to the City's business license database, 2,399 businesses are located within Saratoga. The Chamber of Commerce serves 330 member organizations or roughly 14% of all businesses. Staff performed a quick survey of the City/Chamber support in nearby cities. Make no changes to financial support at this time but take Chamber's behavior, and the relationship between the Chamber and the City into consideration for next year's budget process. A2. Email messages from community members as of February 11, 2002 3 of 3 Saratoga News ~ Letters Page I of 2 h~~hA~ September 19, 2001 Saratoga, California Since 1955 L~i~~~tii 7dG {~~~~~!/~ Letters Historical buildings moved through time As a follow-up to your recent articles about the Saratoga Historical Park, I would like to have your readers know some more facts on how the buildings were moved to become the Chamber of Commerce office and the Historical Museum. The year was i9~2, and the James McWilliams House (circa i85o) was to be demolished to make room for a Western Federal Savings and Loan Association office to be built on the site. The home was built by one of Saratoga's early blacksmiths and in 1972 was one of the oldest buildings in town. I was told by the Western Federal regional vice president, Henry Duque, that the building would be demolished if not moved in two weeks. I was president of the Saratoga Rotary Club, and acting on their behalf, along with the assistance from Saratoga Historical Foundation and approval by the city of Saratoga, the ancient house could be moved to the Historical Park. It was agreed by the city to rent it for $i a year, and with a $1,00o donation from the Rotary Club and funds from the Florence Cunningham Estate, the house was moved. On far too many occasions, it has acted in a manner contrary to the benefit of Saratoga's merchants and citizens. My puzzlement became surprise at the City Council meeting on February 6 when a representative of the Chamber advised that the Chamber of Commerce was planning to endorse Measure E. Two things turned surprise into shock: - The representative referred to a "few bleachers", which is the same phrasing as West Valley College has assumed of late. - The decision to support Measure E was made solely by the Board, with no inputfrom members. It is inconceivable to me that a Chamber of Commerce would use a phrase which indicates there has been no due diligence on the facts. A nominal investigation would have discovered the line item in Measure E for $5.5M. Even a Defense Department which pays $400 for a hammer would not pretend that $S.SM was needed to install a "few bleachers". The Chamber is supposed to represent the business community of Saratoga,: and every realtor who has spoken to me is concerned about the loss of property values and higher tax rates making Saratoga a less desirable community to live in. Measure E is a divisive issue in the city, and the Chamber should have taken the sense of its members in a ballot, not acted like an imperial agent with total disregard for the circumstances. In our previous homes, the city and the Chamber of Commerce have been like a partnership, because both had the benefit of the community at heart. The opposite is currently the case in Saratoga. I can accept that the Chamber has a right to oppose the city, but in a case of biting the~hand that feeds it, the hand has the right to stop feeding. I cannot believe that the Chamber, if in possession of ALL the facts regarding this bond, is actually planning to support Measure E. As a member of Saratoga, 1 have no problem "lending a helping hand" to the college to make sure it is a safe and thriving place for students to learn. I understand, as a homeowner, the continuous maintenance that is required fo keep structures in good working order and I would be in favor of a bond of reasonable amount with specifics spelled out as to expenditures; l think we are entitled to that if we are putting out our hard earned dollars. From the college's point of view, why are they putting out a bond issue that's doomed to fail by including $5.5 million for the stadium (under the guise of classroom repairs/upgrades) that the community has been against since the inception of building the college in Saratoga? It was specified in the Conditional Use Permit that an outside stadium would NEVER be built and they agreed. I don't understand why the governing body of West Valley College has chosen to continue a battle they have lost in the past and will inevi! tably loose in the future -the members of Saratoga will NOT allow it; the negatives of having a stadium far outweighs any positives the college would enjoy. The timing is extremely badl The present economy is very shakey, especially in this community because of the dot.com fiasco of 2001 and in this country due to the aftermath of the events of September 11. I was in attendance at the Assembly meeting in Sacramento where one of the trustees from West Valley College said during his presentation that the opponents of the stadium were a few homeowners with a lot of money and a lot of free time; THAT, we all know, is very far from the truth. There are many members of this community who were here when Saratoga was an agricultural community. In addition, these people who have been here for a very long time are aging and many are on fixed incomes; yes, they maybe living in a home that is very valuable, but that is "paper wealth", not "cash wealth". To support a financial burden on a community with a 38-year payback commitment for approximately $715 MILLION to an entity which has proven many many times to be fisl tally irresponsible and unconcerned with its relationship or affect its actions has on the community it resides is just plain WRONGf . We have ALL worked long and hard for what we "have" and no one has the right to any of it without our support and consent. 1 urge you to reconsider your position on this issue and 1 urge you to support the citizens of Saratoga and Saratoga herself. Since Marchelle Fox is a member of that board, there is obviously a conflict of interest going on with. their decision to support the College. I have lived in Saratoga since 1977 and during-that time there have been many attempts by the College to overturn the original agreement made between the city and the college to allow the College to be built in the first place. The major issue was the Stadium. I have read the documents and the current wish list it for a stadium not a few bleacher seats. I don't consider an electronic scoreboard, amplified sound system, food buildings, press box, permanent toilets, and seats for 5000 people to be a minor addition. What I find even more offensive is the idea that the College would unilaterally destroy an agreement made between the college and the pity by calling the new stadium nothing but a new classroom. Additionally, I noted that the Saratoga News is writing articles that support the College. That is to be expected. The News obtains revenue from advertising. The College has hired very expensive PR agents to clean up their image and I think you could find with little effort that the PR firm has basically captured the ear of the News because they can help direct " advertising. One would have to be naive to think otherwise. Understand, I am not against fixing up old buildings in~need of repair, but the underhanded method used by the College to capture the funds for the Stadium is absolutely the worst example of bad governance. Finally, if one looks closely at the list of projects that the College wants to fund, you will notice that the start date for each project seems to be scheduled for years in the future. It would seem to me that anything that far in the future could be funded by other means, such as a parcel tax. Unfortunately, even that is not acceptable if one realizes that 60~ of the students come from outside the district. West Valley Community College does not appear to exist any longer and should not tax the local citizens to pay for costs that are more appropriate to the State. Additionally, if the Chamber of Commerce Board is nothing more the another arm of the College, then any funding from the City should cease immediately since they seem to want to fight the City on this and other issues. I have had kids at Oak Street school, Argonaut, Redwood, and Saratoga High. 2 have watched the negative effects from Highway 85 and increased housing density move Saratoga from the special little community where I chose to raise. my family towards the homogeny of urban sprawl. The Chamber of Commerce has sometimes acted as the vehicle of a few self-interested individuals with businesses in the city, to the detriment of the quality of life of Saratoga residents. This attempted ramrodding of the west valley College stadium project is one of those times. The fact that a representative of the college (and, therefore, the tax payers) is allowing the college facility to be used for private enterprise every time the chamber has a closed-door meeting there, and then retains a position on the board of the Chamber in order to further their own ego and career needs/aspirations is reprehensible, unethical and potentially illegal. We'll find out. Apparently the Chamber is only interested in lining the pockets of a few members. From that, 2 assume that the Chamber is only motivated by money. If the bond issue passes and the stadium "improvement" project moves forward, I will personally lead a Boycott Saratoga campaign to see that Chamber members get the message and are fiscally diminished. Saratoga residents are losing more in property value from the Chamber's actions than they could ever hope to benefit from supporting Saratoga businesses. This is one case where less truly is more. 2 retired young, and I have plenty of time to spend on this. As a resident and voter in Saratoga, I certainly support each of the points Mr. Bogosian made in his email. I did not want more seating at the Mountain Winery, and 2 certainly do not want a stadium at West Valley College. I go to some pains to shop in Saratoga. Shopping in Saratoga is not convenient for me. Yet, I feel that every dollar I spend is a vote for a business to continue, and I want. business to continue in Saratoga. However, I will not spend my dollars for substandard service, or goods. Now I wonder if I should stop patronizing the businesses of Chamber members. Since the Chamber is working against the interests of the citizens of Saratoga, I am beginning to feel that I should shop and eat in other cities, besides Saratoga. As to the funding of the Chamber of Commerce. I admit that I am not in the best position to know how to handle the Chamber of Commerce. However, I believe the Chamber is working against the best interests of the citizens of Saratoga. If ending the city subsidy will help the Chamber to untlerstand~ that they need to work for the citizens of Saratoga, then I fully support an effort to end the subsidy. The Chamber must understand the need for reciprocity in their relationship with the citizens of our city. I hope that the Chamber of Commerce will come around. I shudder to think of the ramifications of a boycott of Chamber member businesses. "Don't shop at Chamber member's businesses" could too easy be misinterpreted as "don't shop in Saratoga." Once citizens start shopping in other cities, they will not come back. At Board meetings and in publications many of the key statements by the College District's management have been shown to be false. I do not understand why the College District's management tries to hide its obsession with building a stadium at West Valley, but this "hiding" process has served to establish for me that the present management of the College District has no respect for facts. The Chamber of Commerce should not support the current College District's management, and should demonstrate this by endorsing a no vote on Measure E. The Chamber of Commerce should understand that the College District's management must be changed. A good first step in the change is the resignation of the Chancellor. The next step will be the defeat of Measure E. After that, through elections the makeup of the Board of Trustees will be changed to rid the District of destructive obsessive behaviors and poor management practices. Finally, I want the Chamber to know that I do not live by West Valley College and therefore I am not a member of the small group of vocal neighbors of the college, the group the Chancellor likes to blame for everything. This behavior is typical of the way that the West Valley College Board acts toward the community. They try and hide the fact that a stadium is part of the bond issue. They hide behind their lawyer when they don't want to answer questions from the community. They behave in a arrogant manner at their board meetings and show total disregard for the community. I understand that there is continued pressure from the rce for your endorsement of this Measure. I believe that it is a conflict of interest and should be disclosed that Marchelle Fox is a Chamber Board Member. I also believe that those who continue to state that included in the Measure is just a few bleachers should go to the WVC web site and see for themselves the extent of the plans. Although those plans say 3500 seats instead of 5000, many of the other elements are noted. Overall, I am seriously concerned about the amount of money the Measure calls for and the lack of responsible financial planning and analysis surrounding the whole Measure.
