HomeMy WebLinkAboutCity Council Resolution 01-060RESOLUTION NO. 01-060 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA GRANTING THE APPEAL OF PLANNING COMMISSION ACTION APPROVING DR-01-006, TUP-01- 003, AND UP-01-002, FOR A FIRE STATION TO BE LOCATED AT 14380 SARATOGA AVENUE WHEREAS, the Planning Commission conducted duly advertised Public Hearings on June 13, 200l and June 27, 2001, to consider DR-01-006, TUP-01-003, LL-01 003, and UP-01-002, during which all interested parties were allowed to speak; and WHEREAS, following the public heatings, the Planning Commission discussed all pertinent issues within their authority; and WHEREAS, the Planning Commission determined that the public good would be served by granting the various applications; and WHEREAS, On September 5, 2001 the City Council of the City of Saratoga conducted a continued Public Hearing to consider a properly filed appeal of the above referenced actions during which all interested parties were allowed to speak; and NOW, THEREFORE, the City Council of the City of Saratoga hereby resolves as follows: A. The City Council hereby finds and determines: That the proposed structure does not avoid unreasonable interference with views and privacy in that the structure is in excess of allowable height in the P-A Zoned District, and That the proposed project would remove existing landscaping in the Memorial Plaza, and That the perception of excessive bulk and mass are further aggravated through the lack of setbacks from property lines, and That the bulk and height of the proposed Fire Station are not in keeping with the neighborhood in that it does not maintain similar bulk and height to the Federated Church or other structures in the immediate neighborhood, and That the proposed conditional use does not comply with each of the applicable provisions of Chapter 15 of the City of Saratoga Municipal Code in that the requirements for setbacks, coverage and height are all exceeded and no evidence has been submitted that would support total deviation from established P-A Zoned District requirements, and That the proposed parking is not adequate top serve the proposed intensity of use due to the number of personnel and members of the public using the site, and That the location of the proposed use and the conditions under which it will be operated with respect to ingress and egress of emergency vehicles will be detrimental to the public health, safety and welfare. For the foregoing reasons the appeal of the action of the Planning Commission approving applications for the Saratoga Fire Station; DR-01-006, TUP-01-003, and UP-01-002, is granted and the Planning Commission action is overturned and said applications are hereby denied without prejudice. The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga City Council held on the 5 day of September, 2001 by the following vote: AYES: Councilmember Stan Bogosian, Vice Mayor Nick Streit, Mayor John Mehaffey NOES: None ABSENT: ABSTAIN: .. *None Councilmembers Evan Baker, Ann Waltonsmith Joh~/Mehaffey, Mayor 2 of 2
