Item 1
The Land Use Committee is comprised of interested Planning Commission members. The committee
conducts site visits to properties which are new items on the Planning Commission agenda. The site
visits are held Tuesday preceding the Wednesday hearing between 12:00 p.m. and 2:00 p.m.
It is not necessary for the applicant to be present, but you are invited to join the Committee at the site
visit to answer any questions, which may arise. Site visits are generally short (5 to 10 minutes) because of
time constraints. Any presentations and testimony you may wish to give should be saved for the public
hearing.

As stated in the May 14, 2003 Planning Commission meeting, Staff is attaching three
Resolutions for adoption at tonight's meeting: (1) Resolution No. 03-021 -denial of
Variance request to exceed the maximum allowable floor area for all structures on the
property; (2) Resolution No.03-022 -denial of Variance request to encroach into the side
yard set backs; (3) Resolution No. 03-023 -Design Review approval. As discussed in the
May 14, 2003 meeting, Resolution No. 03-023 includes a condition of approval requiring
the revision of the building design in compliance with applicable Zoning Ordinance
requirements effective at the time of submittal for Building Permits.

RESOLUTION OF DENIAL NO.03-021

WHEREAS, the City of Saratoga Planning Commission has received an application for
Design Review Approval and two Variance Approvals to demolish the main .structure and
construct a 2,661 square foot -two-story home. The applicant -has requested two Variance
approvals for the proposed new home to: (1) exceed the maximum allowable floor area for all
structures on the site by 559 square feet; and (2) encroach within the required setbacks for the
first and second stories; and
WHEREAS, the Planning Commission held a duly noticed Public Hearing at which time
all interested parties were given a full opportunity to be heard and to present evidence; and
WHEREAS, the proposed home is Categorically Exempt from the Environmental Quality
Act (CEQA) pursuant Section 15303, "New Construction or Conversion of Small Structures,"
Class 3 (e) of the Public Resources Code (CEQA); and
WHEREAS, .while the Planning Commission has determined that the proposed project
implements all of the policies of the Residential Design Handbook for Design Review approval as
stated in Resolution No. 03-023, the applicant has not met the burden of proof- required to
support said application for both Variance requests as stated in this Resolution No. 03-021 and
Resolution No. 03-022; and
WHEREAS, the Planning Commission has determined that the all of following findings
stated in MCS 15-70.060 cannot be made in the affirmative to support the Variance request to
exceed the maximum allowable floor area for all structures on the property:
1. That because of special circumstances applicable to the property, including size, shape, topography,
location or surroundings, strict enforcement of the specified regulations would deprive the applicant of
privileges enjoyed by the owners of other properties in the vicinity and classified in the same zoning
district.
This finding cannot be made in the affirmative in that the presence of the cottage is not a
hardship constituting a special circumstance applicable to the property in terms of size,
shape, topography, location or surroundings. The cottage is a structure with usable
living space. Moreover, the presence of the cottage does not impact the ability to build a
reasonable sized main dwelling.
2. That the granting of the variance will not constitute a grant of special privilege inconsistent with the
limitations on other properties in the vicinity and classified in the same zoning district.

This finding cannot be made in the affirmative in that the applicant is proposing a new
structure. Since this is an older area of Saratoga, there may be structures built prior to
current floor area requirements. However, in Staff's view, these structures do not set a
precedent for new construction. All new construction in the vicinity is subject to the
same floor area requirements as a function of the lot size.
3. That the granting of the variance will not be detrimental to the public health, safety or welfare, or
materially injurious to properties or improvements in the vicinity.
This finding- can be made in the affirmative in that a total square footage above the
allowable limit will not be detrimental to the public health, safety or welfare.
Now, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve
as follows:
After careful consideration of the site plan, architectural drawings, plans and other
exhibits submitted in connection with this matter, the Variance request to exceed the allowable
floor area for all structures on the property in Application #02-248 has been denied.
Unless appealed pursuant to the requirements of Article 15-90 of the Saratoga City Code,
this Resolution shall become effective fifteen (15) days from the date of adoption.

This finding cannot be made in the affirmative in that MCS 15-65.160 already provides an
exception for side yard requirements for substandard lot widths. There are no plausible
reasons to provide any further exceptions for this lot by granting a Variance. Since this is
entirely new construction, the floor plans can be modified to comply with the setback
requirements.
2. That the granting of the variance will not constitute a grant of special privilege inconsistent with the
• limitations on other properties in the vicinity and classified in the same zoning district.

This finding cannot be made in the affirmative in that granting of the Variance will
constitute a grant of special privilege inconsistent with the limitations on other
properties in the same zoning district in that all new structures within this district are
regulated by the same setback requirements. The subject project proposes new
construction with an attached garage. There are no special circumstances on the subject
property that prevent the applicant from complying with the required setbacks.
3. That the granting of the variance will not be detrimental to the public health, safety or welfare, or
materially injurious to properties or improvements in the vicinity.
This finding can be made in the affirmative in that the minor setback encroachment will
not be detrimental to the public health; safety or welfare.
Now, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve
as follows:
After careful consideration of the site plan, architectural drawings, plans and other
exhibits submitted in connection with this matter, the Variance request to encroach within the
required setbacks for the first and second stories in Application #02-248 has been denied.

structures on the site-by 559 square feet; and (2) encroach within the required setbacks for the
first and second stories; and
WHEREAS, the Planning Commission held a duly noticed Public Hearing at which time
all interested parties were given a full opportunity to be heard and to present evidence; and
WHEREAS, the proposed home is Categorically Exempt from the Environmental Quality
Act (CEQA) pursuant Section 15303, "New Construction or Conversion of Small Structures",
Class 3 (e) of the Public Resources Code (CEQA); and
WHEREAS, while the Planning Commission has denied both Variance requests in
conjunction with application #02-248, as stated in Resolution No. 03-021 and Resolution No.
03-022, the applicant has met the burden of proof required to support said application for
Design Review approval in that the following findings specified in Municipal Code Section 15-
45.080 and the City's Residential Design Handbook have been made:
Policy #1: Minimize Perception of Bulk
The proposed Victorian style home is well-articulated with a turret, porches, bay windows,
wood siding and other architectural details. The proposed architectural style is very
compatible with the character of the neighborhood.
Policy #2: Integrate Structures with the Environment
The proposed use of wood siding will blend with the natural environment and existing
residences. Only one tree is proposed for removal. The proposed residence has also been
designed the natural contours of the site to minimize soil removal.
Policy #3: Avoid Interference with Privacy and Views
The proposal has been designed to minimize any impacts on privacy. The second story has
been set back from the side property fines, and most window living areas have been oriented
to the front and rear of the proposed home to minimize impacts on neighbors.
Policy #4: Preserve Views and Access to Views
The project site is located in a flat portion of Saratoga. The proposed 23 feet tall structure will
not have any impacts on access to views.

Policy #S: Design for Energy Efficiency
The proposed residence will meet all standards for energy efficiency.
NOW, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve as
follows:
Section 1. After careful consideration of the site plan, architectural drawings, plans and other
exhibits submitted in connection with this matter, application #02-248 for Design Review
Approval is hereby granted subject to the following conditions:
COMMUNITY DEVELOPMENT
1. The proposed design of the home with a maximum height of 23 feet shall be similar to
what is shown on Exhibit "A" incorporated by reference, with the exception that the
design shall be slightly revised so that the total floor area and set backs are in compliance
with the requirements of the Zoning. Ordinance effective at the time of submittal of
construction plans to the Building Division.

2. Pursuant to Municipal Code Section 15-56.030 (d), a one-time 10% increase in site
coverage and allowable floor area may be granted if the existing second dwelling unit
(cottage) is deed restricted so that it may be rented only to below market rate
households. If the applicant chooses this option, the deed restriction shall be recorded
prior to issuance of City Permits. The applicant shall work with Staff on this matter so
that the appropriate wording, that is acceptable to the City, is contained in the deed
restriction.
3. Four sets of complete construction plans incorporating this Resolution and the Arborist
Report received December 19, 2002 as a separate plan page shall be submitted to the
Building Division.
4. The site plan shall be stamped and signed by a Licensed Land Surveyor.
The site plan shall contain a note with the following language: "Prior to foundation
inspection by the City, the LLS of record shall provide a written certification that all
building setbacks are per the approved plans."
6. A grading and drainage plan combined with a storm water retention plan indicating how
all storm water will be retained on-site, and incorporating the New Development and
Construction -Best Management Practices, shall be submitted along with the complete
construction drawings.
7. A landscape, irrigation and utility plan shall be submitted with the complete
construction drawings.
8. All landscaping shall be installed prior to final building inspection approval.
CITY ARBORIST
9. All recommendations contained in the Arborist Report received December 19, 2002 shall
be followed. The complete construction plans shall be reviewed by the City Arborist
prior to issuance of Ciry Permits. This requirement is in reference to Recommendation#1
contained in the Arborist Report.
l0. Tree protective fencing as shown on the Arborist Report shall be installed and inspected
by Planning Staff prior to issuance of City Permits.
11. Prior to issuance of City Permits, the .applicant shall submit to the City, in a form
acceptable to the Community Development Director, security in the amount of $9,438 to
guarantee the maintenance and preservation of trees on the subject site.
12. Prior to Final Building Inspection approval, the Arborist shall inspect the site to verify
compliance with tree protective measures. The bond shall be released after. a favorable
site inspection by the Arborist, the planting of any required replacement trees, and
payment of any outstanding Arborist fees.
FIRE PROTECTION DISTRICT
13. The applicant shall comply with all Saratoga Fire District requirements.
CITY ATTORNEY
14. Applicant agrees to hold Ciry harmless from all costs and expenses, including attorney's
fees, incurred by the City or held to be the liability of City in connection with City's
defense of its actions in any proceeding brought in any State Federal Court, challenging
the City's action with respect to the applicant's project.
Section 2. Applicant shall obtain a Building Permit and start construction within 24 months
from the date of adoption of this Resolution or approval will expire.
Section 3. All applicable requirements of the State, County, City. and other Governmental
entities must be met.
Section 4. Unless appealed pursuant to the requirements of Article 15-90 of the Saratoga City
Code, this Resolution shall become effective fifteen days from the date of adoption

PROJECT DISCUSSION:
The applicant requests Design Review approval to construct aone-story 4;514 square foot
home with a maximum height of 21 feet - 3 inches. The project includes the substantial
demolition of an existing 3,697 square foot one-story residence. Pursuant to Municipal Code
Section [MCS] 15-45.060, a Design Review public hearing is required for ariy new single-
storystructure over 18 feet in height. The proposed home will not have a basement.
Architectural styles in the neighborhood are primarily one and two-story contemporary
ranch style homes interspersed with a few recently constructed homes with stucco siding.
The proposed residence will be in a Mediterranean style with beige stucco siding, .stone
veneer accents, off-white trim and concrete: flat-tile roofing. A color board will be brought to
the public hearing. This home is very similar in style to many of the other riew homes built in
Saratoga. As shown in the attached letter, the applicant has shown the proposed plans to
neighbors. Staff has not received any letters of concern from neighbors as of the writing of
this Staff Report.
The .applicant does not propose to remove any ordinance size trees. The attached Arborist
Report includes a recommendation to modify the proposed design to protect tree #10, a large
coast redwood. As shown in the attached Exhibit A, the applicant has revised the project
design in compliance with this recommendation. Staff has required compliance with all
Arborist Report recommendations as a condition of approval in the attached Resolution.-
Staff is concerned about the scale of the entry portion of the proposed home. The entry
projection with columns is approximately 20 feet in height and may be incompatible with
the smaller scale entries of the surrounding homes. Staff requested the applicant to reduce
the height of the entry area. However, the applicant feels that the entry is an integral part of
the design and is proportionate with the other design features of the facade.
Apart from the entry element, Staff finds that the scale of the proposed home will be
compatible with the -sizes of the surrounding homes. Below is a discussion of how this
project implements the Residential Design Policies:
Policy #1: Minimize Perception of Bulk
The home is articulated with varying rooflines and circular elements with bay windows.
The stone veneer accents also help to reduce the appearance of height. The proposed
home will be approximately 3 feet taller than the existing home, and will be well below
the 26 feet maximum height limit.
Policy #2: Integrate Structures with the Environment
The proposed home, with ].united number of materials and earth tone colors, will blend
with the natural environment and existing residences. No ordinance size trees are
proposed for removal. .

west of the. site are situated at a higher elevation. However, access to views will not be
affected by the proposed single-story home.

The proposed residence will have new insulatiori, which exceeds State requirements, and
will be equipped with energy efficient heating and cooling appliances.
Conclusion
Staff finds that the proposed home implements the City's Residential Design Policies.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission conditionally approve Design Review
Application No. 03-040 by adopting the attached Resolution.

WHEREAS, the City of Saratoga Planning Commission has received an application
for Design Review to demolish the existing home and construct aone-story 4,514 square foot
home with a maximum height of 21 feet - 3 inches; and
WHEREAS, the Planning Commission held a duly noticed Public Hearing at which
time all interested parties were given a full opportunity to be heard and to present evidence;
and
WHEREAS, the project, which proposes to construct a new small single-family
home, is categorically exempt from the California Environmental Quality Act (CEQA)
pursuant to section 15303 of the Guidelines for the Implementation of CEQA. This Class 3
exemption applies to construction of a single family home in an urbanized area; and
WHEREAS, the applicant has met the burden of proof required to support said
application for design review approval, and the following findings specified in Municipal
Code Section 15-45.080 and the Ciry's Residential Design Handbook have been determined:

NOW, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve
as follows:
Section 1. After careful consideration of the site plan, architectural drawings, plans and
other exhibits submitted in connection with this matter, Application No. 03-040 for Design
Review approval is hereby granted subject to the following conditions:
COMMUNITY- DEVELOPMENT
1. The development shall be located and constructed as shown on Exhibit "A"
incorporated by reference. Any proposed changes to the approved plans shall be
submitted in writing with a clouded set of plans highlighting the changes. Proposed
changes to the approved plans are subject to the approval of the Community
Development Director.
2. Four sets of complete construction plans incorporating this Resolution and the
Arborist Report received March 10, 2003 as a separate plan page shall be submitted
to the Building Division.
3. The vertical distance from the highest point of the proposed home to the immediately
adjacent natural grade not created by fill shall not exceed 21 feet - 3 inches.
4. The site plan shall be stamped and signed by a Licensed Land Surveyor..
5. The site plan shall contain a note with the following language: "Prior to foundation
inspection by the City, the LLS of record shall provide a written certification that all
building setbacks are per the approved plans"
6. A grading and drainage plan combined with a storm water retention plan indicating
how all storm water will be retained on-site, and incorporating the New
Development and Construction -Best Management Practices, shall be ,submitted
along with the complete construction drawings. An explanatory -note shall be
provided if all storm water cannot be maintained on site.
7. The grading and drainage plan shall incorporate all Arborist Report
recommendations, and shall be reviewed and approved by the City Arborist prior to
issuance of City Permits.
8. A final landscape, irrigation and utility plan shall be submitted for Arborist review
and approval prior to issuance of City Permits.

. 9. There shall be properly maintained front yard and exterior side yard landscaping
prior to Final Building Inspection approval.
CITY ARBORIST
10. All recommendations contained in the Arborist Report received March 10, 2003 shall
be followed.
11. Tree protective fencing, the platform buffers and other protective measures as stated
in the Arborist Report, shall be installed and inspected by Planning Staff prior to
issuance of City Permits.
12. Prior to issuance of City Permits, the applicant shall submit to the City, in a form
acceptable to the Community Development Director, security in the amount of $6,132
to guarantee the maintenance and preservation of trees on the subject site.
13. Prior to Final Building Inspection approval, the Arborist shall inspect the site to
verify compliance with tree protective measures. The bond shall be released after the
planting of any required replacement trees, a favorable site inspection by the
Arborist, and payment of any outstanding Arborist fees.
CITY ATTORNEY
S 14. Applicant agrees to hold City harmless from all costs and expenses, including
attorney's fees, incurred by the City or held to be the liability of Ciry in connection
with City's defense of its actions in any proceeding brought in any State Federal
Court, challenging the City's action with respect to the applicant's project.
Section 2. A Building Permit must be issued and construction commenced within 24
months from the date of adoption of this Resolution or approval will expire.
Section 3. All applicable requirements of the State, County, City and other Governmental
entities must be met.
Section 4. Unless appealed pursuant to the requirements of Article 15-90 of the Saratoga
City Code, this Resolution shall become effective fifteen (15) days from the date of adoption

SUMMARY
Ten Ordinance-sized trees were inventoried and evaluated. for this report. Plans indicate
each tree will be retained and I recommend a bond of $6,132 to ensure their protection.
The only foreseeable significant impacts involve a 24-inch diameter Coast Redwood (tree
#10). Design modifications are suggested to the portion of home proposed within 7-feet
from tree #10's trunk.
I anticipate each tree will remain vigorous and structurally stable provided all
recommendations presented in this report are carefully followed and incorporated into the
project plans.
ASSIGNMENT
This report has been prepared at the request of the City of Saratoga's Community
Development Department in response to the proposed demolition of an existing and
construction of new one-story single-family residence at 13622 Saraview Drive, Saratoga.
My assignment includes reviewing effects the proposed project will have on Ordinance-
sized trees located on the subject property; identifying each tree's overall condition,
species, and size; establishing an appraisal value to each tree; and determining bond
values. This report presents my findings aswell asrecommendations -for mitigating
possible damage to inventoried trees. A summary of my findings is presented on the Tree
Inventory Spreadsheet attached to this report.
Each tree's approximate location, number and canopy dimension are shown on an attached
copy of the Proposed Site Plan (sheet Al.l) prepared by TD Building Design, dated
February 18, 2003. Recommended tree protection fencing locations are also shown on
this plan.
OBSERVATIONS
Ten Ordinance-sized trees were inventoried for this report. These include two Palms #1
and 2; three- Olives #3, 4 and 5; and five Coast Redwoods #6 through 10.
All trees appear in overall good condition.
Each tree has been assigned a high, moderate or low suitability for preservation rating
based on its health, structural integrity, location, size and specie type. Trees #1 through 5
are- assigned a moderate suitability, and the remainder (#6 through 10) a high suitability.

condition to the relatively undisturbed soil beneath their, canopies.

REVIEW OF PROPOSED PLANS
Plans indicate all trees will be retained.
The two unnumbered trees shown on the Proposed Site Plan are smaller than Ordinance
size, and thus, not inventoried for this report.
No more than minor impacts are anticipated to trees #1 through 9.
High impacts are anticipated to tree #10. This tree's trunk is situated approximately 21-
feet from the northwest most corner of the existing home: Plans propose. establishing the
home's footprint approximately 7-feet from the trunk. Unfortunately, this will affect e
tree's longevity and vigor, as well as expose the future home to possible structural damage
in the future.
To promote this tree's longevity and avoid foreseeable structural damage to the home, I
suggest the following:. (1) establish the home's footprint no closer than 15-feet from the
trunk shown on the plan, and (2) design the home's future structure using a pier and on-
grade beam type foundation for the portion constructed on exposed soil within 25-feet
from the trunk (not to include the .existing portion of home within 25-feet from trunk).
TREE APPRAISAL AND BOND VALUES
The appraised tree values are presented on the Tree Inventory Spreadsheet attached to the
end of _this report. The values were calculated in accordance to the Guide for Plant
Appraisal, 9`h Edition, established by the Council of Landscape Appraisers and in
accordance with the Western Chapter of the International Society of Arboriculture.
The cumulative appraised amount for all trees is $40,880. I suggest a 15-percent bond of
$6,132 to ensure their protection.

RECOMMENDATIONS
All recommendations presented below are based on plans reviewed. If revisions to the
plans occur, the recommendations may require modification.
Protection Fencing
1. Fencing must be installed and inspected by the City of Saratoga prior to obtaining a
demolition permit. This fencing must be comprised of five to six-feet high chain link
mounted on two-inch diameter steel posts, driven two-feet into the ground and spaced
no more than 12-feet apart. The fencing should be established,as per the attached Plan,
and be placed no further than four-feet from the future home's footprint.
2. The fencing for tree #10 should be installed in two separate phases, one for demolition
__
and one for.construction (see attached Plan).
3. Once established, all fencing must remain undisturbed and in place throughout the
construction process and until the project receives final approval. Modifications to the
fencing location must be allowed only by permission from the City of Saratoga.
4. The fencing should be inspected by the City of Saratoga prior to issuing the demolition
permit.
5. All construction activities must be conducted outside the fenced areas. These activities
include, but are not limited to, the storage of materials, vehicle parking, and dumping
of concrete or other construction materials. If accidentally spilled, the materials should
be removed immediately and disposed of off-site or to apre-approved washout pit.,
Design Modifications for Tree #10
~ 6. The future home's footprint should be located no closer than 15-feet from tree #10's
trunk. In addition, the new portion of the home proposed beyond the existing home's
footprint and within 25-feet from the trunk should be constructed using a pier and on-
grade beam type foundation with no soil beneath the foundation being excavated.
Root Zone Protection
7. Prior to the construction phase, afour-foot wide platform buffer must be installed
beneath the canopy of tree #10, between the protection fencing and home's footprint.
It should be placed on the exposed groundsurface and consist of a three to four-inch
layer of coarse wood chips covered by plywood approximately 3/4-inch thick. This
plywood should then be securely fastened to enable a sturdy walking surface.
8. Prior to commencing demolition, a three to four-inch layer of wood chips or organic
composted mulch beneath should be placed beneath canopies of trees #8, 9 and 10.
Root Severance Guidelines
9. Roots two-inches and greater in diameter that become exposed and/or damaged during
the construction process, should be cut clean with a hand or chainsaw and, if possible, .

back to a lateral (side) root. As soon as severance occurs, cover or wrap the root end
with a plastic bag secured with tape or rubber band and backfill with- soil as soon as
possible.
Drainage
10. All roof drains must be designed and constructed so water is displaced away from
retained trees.
11. Any alterations to the natural grade must ensure water drains away from rather than
towards trees' trunks.
Below Ground Pipes and Utilities
12. Pipes and/or utilities located underground and beneath protected trees' canopies should
be abandoned. If their removal is absolutely necessary, the work must be performed by
hand.
13. Plans for installing utilities must be reviewed by me prior to installing. I advise all
utilities be installed outside from beneath the canopies of trees #1 through 5; and no
closer than 20-feet from the canopy edge of trees #6 through 10.
Tree Pruning
14. Any pruning performed before or during the development process must be performed
under the supervision of an International Society of Arboriculture certified arborist or
tree worker. No more than 15-percent of the live canopy should be removed at any
given time. .
15. To maintain tree #5's natural structure, I suggest no branches larger than '/~-inch in
diameter are removed.
Landscaping
16. The landscape design should incorporate placing three to four-inches of organic
composted mulch on exposed soil beneath canopies of Redwoods #8, 9 and 10. This
mulch could then be covered with a few inches of decorative bark, wood chips or
gorilla hair.
17. Irrigation heads must be directed-away from all tree trunks, including areas where turf
would be proposed. Minimize the. removal, replacement and/or addition of irrigation
lines beneath canopies of retained trees. .
18. Irrigation trenching, if performed, should be outside the canopy edge of each tree. If
inside, the trenches must be in a spoke arrangement radiating out from the -tree trunk, as
spokes on a wheel. This will help minimize root damage by trenching in-line with the
natural direction of root growth.. Radial trenches should be at least 10-feet apart at the
canopy perimeter and must not encroach closer than five times the trunk diameter from
the trunk..

19. Avoid rototilling or installing bender board beneath tree canopies.
Watering
20. Supplemental water must be supplied to trees #4, 8, 9 and 10 during the dry summer
and fall monthsl and continue throughout the development period. The suggested
~,_
application rate is 10-gallons per inch of trunk diameter every two weeks. The water
should be applied by soaker'-hoses placed beneath approximate mid-canopy. The
length of time required for application .can be determined by placing the installed
soaker hose inside afive-gallon bucket and monitoring the time it takes to fill. The
soaker hose should remain on as long as it takes to provide the necessary water and wet
the soil to a depth of 12 to 24-irtches.
General Construction Guidelines
21. Tree trunks must not be used as a winch support for moving and lifting large loads,.nor
must signs, fencing or construction materials be attached to them.
22. Concrete pumping equipment must be .carefully positioned and operated so damage to
trees does not occur. Please note that the articulating arm on this equipment can
.significantly damage trees.
23. Temporary construction facilities and utilities must not be placed over the exposed
ground surface beneath the canopy of any protected tree or in a location that would
affect their canopies.

REVIEW OF APPLICATION #03-040 (APN 503-53-030) - TRAN; 13622
Saraview Drive; -Request for Design Review approval to construct a new single
story home that will have a maximum height of 21 feet. The total floor area of the
new home with an attached garage will be 4,514 square feet: The lot is 20,515
square feet and is located in the R-1-40,000 zoning district.
All interested persons may appear and be heard at the above time and place. If you challenge a decision
of the Planning Commission pursuant to a Public Hearing in court, you may be limited to raising only

PROJECT DISCUSSION:
The applicant, Dr. Nguyen, is seeking a Conditional Use Permit approval to establish a dental
office in a 1,710 square foot tenant space. The tenant space is situated in the same building
directly behind the orthodontics office of the property owner, Dr. Anthony Ellenikiotis. The
existing orthodontics practice occupies over two-thirds of the building and faces Saratoga-
Los Gatos Road.
On March 13, 2002, the Planning Commission granted a Conditional Use Permit to allow the
establishment of the existing orthodontics office. At the March 13, 2002 public hearing, the
Planning Commission had concerns regarding the number of office staff and dental chairs in
the proposed office and its implications on parking needs. However, the Planning
Commission granted the Conditional Use Permit after the property owner clarified the daily
operational features of the orthodontics office. Since the granting of the Conditional Use
Permit, the property owner has significantly improved the appearance of the building and
the site. The existing orthodontics practice has been in operation for over two months.
The proposed dental office will not have any street frontage, and will be accessed from the
rear of the building. Pursuant to Municipal Code Section 15-19.050, a Conditional Use Permit
is not required for a medical office that does not have any street frontage. However, as a
condition of Use Permit approval for the existing orthodontics office, the Planning
Commission required that the occupant of the tenant space also obtain a Conditional Use
Permit so that impacts of all uses in the building can be evaluated. This requirement is stated
in condition #5 of Resolution No. 02-012 (attached).
The proposed dental office will have 3 staff members (1 doctor and 2 staff). Dr. Nguyen
proposes to operate Monday through Friday 9:00 a.m. to 6:00 p.m. He will maintain his other
dental office in San Jose. Staff has not placed a condition of approval limiting the hours of
operation to those stated above to allow the owner greater flexibility for any future
adjustments to the hours of operation. Attached Exhibit A shows the proposed floor plan:
Parkingand Circulation
The site currently has 30 parking spaces, plus 2 handicapped spaces. Pursuant to MCS 15-
35.030 (1), the parking requirement for medical offices is 1 space per 200 square feet of gross
floor area. The building has a gross floor area of approximately 5,659 (including basement),
requiring 28 parking spaces. Therefore, according to the standard municipal code
requirement, sufficient parking exists on the site. Staff has visited the site at various times of
the day during business hours, and finds that there would be sufficient parking to serve the
applicant's office. Nevertheless, Staff has added the standard condition of approval, which
states that the Planning Commission shall retain continuing jurisdiction of the Use Permit,
and may at any time modify, delete or add new conditions.

Signage
The applicant has not yet proposed any signage for the proposed dental office. A condition of
approval has been included in the attached draft Resolution requiring that the applicant
submit a Sign Permit application for review and approval by Staff. .
Correspondence
No correspondence regarding this application has been received to date.
Conclusion
All of the findings required for Conditional Use Permit approval stated in MCS 15-55.070 can
be made in the affirmative in that:
• The proposed dental office meets the objectives of the Saratoga Zoning, Ordinance
and the purposes of the zoning district in which the site is located in that more
people will be drawn to the downtown Village. Parents running errands nearby after
dropping off their children at the dentaUorthodontics office is a common activity. The
establishment of this office in a concentrated downtown village area will be mutually
beneficial to all, and is compatible with the existing orthodontics office; and
• The proposed dental office will not be detrimental to the public health, safety or
welfare, nor be materially injurious to properties or improvements in the vicinity in
that appropriate conditions have been placed on the project to minimize potential
impacts; and
• The proposed dental office will comply with all other applicable provisions of the
Saratoga Municipal Code.
STAFF RECOMMENDATION:
Approve the Conditional Use Permit application with conditions by adopting the attached
Resolution.

WHEREAS, the City of Saratoga Planning Commission has received an application for
a Conditional Use Permit to allow the establishment of a 1,710 square foot dental office in an
existing building in the CH-1 zoning district; and
WHEREAS, the Planning Commission has conducted a duly noticed Public Hearing at
which time all interested parties were given a full opportunity to be heard and to present
evidence; and
•
WHEREAS, the Planning Commission finds the proposed project consisting of the
conversion of an existing small structure from one use to another is Categorically Exempt
from the Environmental Quality Act (CEQA) pursuant Section 15303, "New Construction or
Conversion of Small Structures", Class 3 (c) of the Public Resources Code (CEQA); and
WHEREAS, the Planning Commission finds that all of the findings required within
Section 15-55.070 of the City Code can be made in the affirmative in that:

Now, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve as
follows:
Section 1. After careful consideration of the site plan and other exhibits submitted in
connection with this matter, the application for a Conditional Use Permit approval is hereby
granted subject to the following conditions:

PLANNING
1. The dental office shall operate as represented on the plans marked Exhibit A.
2. The Planning Commission shall retain continuing jurisdiction over the Conditional
Use Permit and may, at any time, modify, delete or impose. any new conditions of .the
permit to preserve the public health, safety, and welfare.
3. Any intensification of this use shall require an amended Conditional Use Permit.
4. Prior to issuance of Building Permits for internal tenant improvements for the
proposed dental office, detailed construction plans shall be reviewed and approved
by the Planning Division for Zoning Clearance to verify consistency with the
approved Exhibit A plans. The construction drawings shall incorporate a copy of this
Resolution as a separate plan page.
5. The proposed use shall at all times operate in compliance with all regulations of the
City and/or other agencies having jurisdictional authority over the use pertaining to,
but not limited to, health, sanitation, safety, and water quality issues.
6. A Sign Permit Application shall be submitted to the Planning Division for any
proposed signage for the new business establishunent. All signage shall conform to
the Saratoga Municipal Code.
7. The applicant shall obtain a Business License from the City of Saratoga prior to
opening the dental practice.
FIRE PROTECTION DISTRICT
8. The proposed occupancy classification was not identified on the drawings. As a
general dentistry office, it can be assumed that the occupancy would be "Business" as
defined in the California Building Code, and the comments that follow are based on
that assumption. However, should the location perform oral surgery wherein general
anesthesia must be administered, the occupancy classification of the project will be I-
1.2 and the more restrictive requirements of that occupancy classification shall be
complied with.
9. An off-site supervised, early warning fire alarm system (EWAS) shall be provided
within the structure in accordance with City of Saratoga Ordinance requirements.
Fire detection shall be provided on both floor levels and within all room spaces. The.
building has existing EWAS and shall be modified to include required detection and
notification. Early Warning Fire Alarm system shall have documentation relative to
the proposed installation and shall be submitted to the Saratoga Fire District for
approval.
10. The business establishment shall be identified with a distinct and separate
identification such as a suite or room number if the same premises address is used.

CITY ATTORNEY
11. Applicant agrees to hold City harmless from all costs and expenses, including
attorney's fees, incurred by the City or held to be the liability of City in connection
with City's defense of its actions in any proceeding brought in any State or Federal
Court, challenging the City's action with respect to the applicant's project.
Section 2. A Building Permit or Business License must be issued and construction or
business operations commenced within 24 months from the. date of adoption of this
Resolution or approval will expire:
Section 3. All applicable requirements of the State, County; ,City and other
Governmental entities must be met.
Section 4. Unless appealed pursuant to the requirements of Article 15-55.080 and 15-
90 of the Saratoga City Code, this Resolution shall become effective ten (10) days from the
date of adoption.

WHEREAS, the City of Saratoga Planning Commission has received an application for a
Conditional Use Permit to allow the establishment of a 3,682 (gross) square foot orthodontics
office in an existing office building; and
WHEREAS,-the Planning Commission has conducted a duly noticed Public Hearing at
which time- all interested parties v~•ere given a.full opportunity to be heard and to present
evidence; and
WHEREAS, the Planning Commission finds the proposed project consisting of the
conversion of an existing small structure from one use to another is Categorically Exempt from
the Environmental Quality Act (CEQA) pursuant Section 15303, "New Construction or
Conversion of Small Structures", Class 3 (c) of the Public Resources Code (CEQA); and
WHEREAS, the Planning Commission finds that all of the findings required within
Section 15-55.070 of the Ciry Code can be made in the affirmative in that:
• The proposed orthodontics office meets the objectives of the Saratoga Zoning Ordinance
and the purposes of the zoning district in which the site is located, in that the proposed
establishment will draw more people to the Saratoga Village and maybe mutually
beneficial to the surrounding businesses;
• The proposed orthodontics office will not be detrimental to the public health, safety or
welfare, nor be materially injurious to properties or improvements in the vicinity in that
appropriate conditions have been placed on the project to minimize potential impacts;
and
• ..The proposed orthodontics office will comply with all other applicable provisions of the
Saratoga Municipal Code.
Now, THEREFORE, the Planning Commission of the City of Saratoga does hereby resolve
as follows:
Section 1. After careful consideration of the site plan and other exhibits submitted in.
connection with this matter, the application fora Conditional Use Permit approval is hereby
granted subject to the following conditions:

Permit -and may, at any time, modify, delete or impose any new conditions of th

3. The Planning Staff shall review this Conditional Use Permit in six months and twelve
months from the date of this approval, and upon receipt of any complaints. Any non-
compliance issues shall be reported to the Planning Commission.,
4. Any intensification of this use shall require an amended Conditional Use Permit.

A tenant proposing to occupy the 1,935 square foot tenant space shall also require a
Conditional Use Permit approval from the Planning Commission.
6. Prior to issuance of Building Permits for internal tenant improvements for the proposed
orthodontics office, detailed construction plans shall be reviewed and approved by the
Planning Staff for Zoning Clearance to verify consistency with the approved Exhibit A
plans. The construction drawings shall incorporate a copy of this Resolution as a
separate plan page.
7. Prior to issuance of Building Permits, all proposed exterior modifications, including a
matei~als and colors board, shall be submitted for review and approval by the Planning
Staff.
8. Prior to issuance of Buildnzg Permits, alandscape/tree replacement plan shall be
submitted for review and approval by the Planning Staff. All approved landscaping-shall
be installed prior to final occupancy approval.
9. A decorative surface treatment, such as stucco or plaster, shall be applied to the tall
concrete-wall at the rear of the property to coordinate with materials and colors used for
the building. Prior. to issuance of Building Permits, a materials and colors board for the
proposed surface treatment shall be submitted for review and approval by the Planning
Staff. The approved surface treatment of this wall shall be completed prior to final
occupancy approval.
10. Prior to final occupancy approval, the wrought iron gate at the rear of the property shall
be removed so that there is unrestricted passage between adjacent commercial sites.
11. The proposed use shall at all times operate in compliance with all regulations of the Ciry
and/or other agencies having jurisdictional authority over the use pertaining to, but not
limited to, health, sanitation, safety, and water quality issues.
12. A Sign Permit Application shall be submitted to the Planning Di~~ision for any proposed
signage for the new business establishment.
13. A Business License from the City of Saratoga shall be obtained prior to opening the
. orthodontics practice.

FIRE PROTECTION DISTRICT
14. The proposed occupancy classification was not identified on the drawings. As a general
dentistry office, it can be assumed that the occupancy would be "Business" as defined in
the California Building Code, and the comments that follow are based on that
assumption. However, should the location perform oral surgery wherein general
anesthesia must be administered, the occupancy classification of the project will be I-1.2
and-the more restrictive requirements of that occupancy classification shall be complied
with.
15. Afire hydrant must be located within 225 feet of the entrance of the property from
Saratoga-Los Gatos Road. If none is present; it must be provided by the developer.
(California Fire Code. Section 1004.2.4)
16. An off-site, supervised early warning fire alarm system (EWAS) shall be provided within
the structure in accordance with City of Saratoga Ordinance requirements. Fire
detection shall be provided on both floor levels and within all room spaces.
17. Separation of Exits -Proposed Main Floor Level. Exterior exits shall be separated a
minimum of ~fz the maximum overall diagonal of the floor of the building. The centerline
of the two exterior doors of the main floor must meet this minimum separation.
(California Building Code. Section 1004.2.4)
CITY ATTORNEY
18. Applicant agrees to hold City harmless from all costs and expenses, including attorney's
fees, incurred by the City or held to be the liability of City in connection with Ciry's
defense of its actions in an~~ proceeding brought in any State or Federal Court,
challenging the City's action-with respect to the applicant's project.
19. Noncompliance with any of the conditions of this permit shall constitute a violation of
the permit. Because it is impossible to estimate damages the City could incur due to the
violation, liquidated damages of $250 shall be payable to this City per each day of the
violation.
Section 2. A Building Permit must be issued and construction commenced within 24
months from the date of adoption of this Resolution or approval will expire.
Section 3. All applicable requirements of the State, County, City and other
Governmental entities must be met..
Section 4. Unless appealed pursuant to the requirements of Article 15-90 of the Saratoga
City Code, this Resolution shall become effective fifteen (15) days from the date of adoption..

Tom Sullivan, Community Development Director, presented staff report.
Director Sullivan noted explained that the appellant is requesting the City Council
overturn a Planning Commission denial of a variance to allow the over-Code height
of the 190 -foot section of the exiting property line wall along the north and
northeasterly sides of the parcel. The City Code allows a maximum height of 6-feet;
the request is to allow the existing wall to remain. The existing wall reaches heights
7-feet 6-inches in certain portions.
Director Sullivan described the findings that must be made to grant a variance and
the facts relevant to making that determination.
Vice Mayor Waltonsmith asked if the City has ever granted a variance for a fence
over 6- feet high near this particular property.
Director Sullivan responded that he is unaware of any variance being granted for
fence height.
Mayor Streit asked if the two property owners Davies & Smith agreed with the wall.
Director Sullivan noted that Maggie and Neil Smith sent a letter dated May 6, 2002
that stated they supported the fence. Mr. Cutler has on his property.
Mitch Cutler, 14480 Oak Place, noted that he has lived at the property for three years
and stated that he agrees with the staff report presented to Council. Mr. Cutler stated
that the importance at this time is for the Council to understand how it all came to be.
Mr. Cutler stated hat the height. has been described as 7-feet 6-inches from top to
bottom. It was clearly noted in the engineers report which was approved by the
building department that the fence was 6-feet with a 1-foot 6-inches retaining wall.

Mr. Cutler stated that the fence was later verified by the building department and
signed off by the building inspector.
Councilmember King a asked when the inspector came out after the footings was put
in or after the wall was built
Mr. Cutler responded that the building inspector visited the property both times.
Patrick Matas, 20385 Saratoga-Los Gatos Road, noted that he is against the City
grating a variance to Mr. Cutler for three reasons:
1. The Planning Commission could not fmd sufficient facts
2. Mr. Cutler's project violated City Code and therefore it's illegal
3. Mr. Cutler should not be rewarded for breaking the law
Frank Matas, 20385 Saratoga-Los Gatos Road, noted that Mr. Cutler has violated the
City Code by building his wall on ingress/egress public service easement. Mr. Matas
stated that his grant deed stated no public structures can be built ion this easement.
Mr. Matas stated that the City already established that Mr. Cutlers wall is a structure
which requires a set back, which the wall does not have any set backs from the
Davies property line and the public service easement. Mr. Matas stated that this wall
should be taken down completely because it's a structure not a fence. Mr. Matas
stated that the Mr. Cutler must not receive any special considerations at the expense
of his neighbors and himself.
Dolores Smith, 14560 Westcott Drive, noted that for the past two years at this site
there has been construction noise six days a week. Ms. Smith noted that when a
neighbor impedes the surrounding neighbors something must be done.
Bill Breck, 20375 Saratoga-Los Gatos Road, sited Saratoga Code Section 15-70.010
regarding the basis of granting a variance. Mr. Breck stated that.he disagrees with
Mr. Cutler reason why he feels he should be granted variance. Mr. Breck stated that
Mr. Cutler states that he should be granted a variance because of the lack of privacy
from the surrounding two story houses and the amount of noise from neighbor's
backyards. Mr. Breck stated that there are no practical difficulties or unnecessary
physical hardships that result from obeying the wall ordinance that restricts wall
heights to six feet. Mr. Breck reviewed the various tree damage to the heritage oak
trees property.
Sean Mazipore, 18590 Avon Lane, Structural Engineer, noted that he designed the
fence for Mr. Cutler. Mr. stated that he has done hundreds of projects in Saratoga.
Mr. Mazipore stated that if any part of the wall is removed he would not take the
responsibility of the structural integrity of it.
Councilmember King asked if the wall he designed was built 8-feet all the way
around.
Mr. Mazipore stated that yes to the best of his knowledge.

In regards to the ingress and egress in which Mr. Matas stated is built on his property,
Mr. Cutler stated that that the property is actually his. Mr. Cutler stated that the
lawsuit filed in 1992 stated that anything could be built on utilities easements as long
as it didn't affect the utilities.
Vice Mayor Waltonsmith noted that she visited the site on both sides of the fence,
she read the Planning Commission minutes .and read all the letters that Council
received. Vice Mayor Waltonsmith noted that she cannot make the findings to grant
the variance.
Councilmember Kline noted that does not support granting the variance: He agrees
that this is a unique lot, but is not a privacy issue.
Councilmember King concurred with Vice Mayor Waltonsmith and Councilmember
Kline's comments and notes that she does not support granting the variance.
Councilmember Bogosian stated that yesterday was the first time he visited the site.
Councilmember Bogosian stated that Mr. Cutler's lot is the most bizarre and strange
shaped lot he has ever seen in Saratoga. Councilmember Bogosian stated that this
property deserves a 7-foot fence. Councilmember Bogosian noted that he could
make the findings to grant Mr. Cutler a variance.
Mayor Streit noted that he could only make. 2 out of three of the finding s so he
cannot support grating the variance.

5. REDWOOD MIDDLE SCHOOL TRAFFIC PLAN
STAFF RECOMMENDATION:
Accept Redwood School Traffic Improvement Plan and authorize a change order
for $7500 to George Bianchi Construction Inc.
Lorie Tinfow, Assistant City Manager, presented staff report.
Assistant City Manager Tinfow explained that many drivers use City Hall parking
lots to both drop-of and pick-up Redwood School students. The interaction of
vehicles, pedestrians and bike riders creates unsafe conditions for walking and
biking students as well as interference with arriving and departing City hall
visitors and employees. Last Spring, City staff and Public Safety Commissioners
approached Redwood School officials about traffic concerns in and .around
Redwood School during drop-off and pick-up times. Over the course of several
meetings, school officials agreed to create a new drop-off and pick-up area site at
the end of Allendale within the School's corporation yard. In addition, staff
learned of Redwood School's expansion plans scheduled to occur during School

year 2003-04. The plan was developed and the school district voted to fund the
costs for changes made to school property.
Assistant City Manager Tinfow explained that the Public Safety Commission
reviewed the plan and is recommending that Council approve funds to implement
the following:
• Paint new crosswalk across Allendale
• Install new "no u-turn" sign on Allendale
• .Reset signal timer at Allendale and Fruitvale
• Lengthen left turn pocket on northbound Fruitvale
• Install a "pork chop" median on northbound Fruitvale that would prohibits
left tunes from the street into the school parking lot
• Modify parking restriction signs on Montauk to say "No stopping 9 am to 4
pm

Assistant City Manager Tinfow explained that the plan includes limiting use of
City hall parking lots to City hall visitors and employees, and installing new sign
to announce the change. A driver re-education campaign will be launched with the
participation of the Sheriff s Office when school starts in Fa112003.
Assistant City Manager Tinfow explained that staff is requesting that the Council
accept the Redwood School Traffic Improvement Plan and authorize Public Works
to issue a change order for $7,500 to George Bianchi Construction to install the
plan elements for which the City is responsible.
Cindy Cheng, Parent, noted that she has been participating in school traffic
mitigation for a along time and she has realized that parents usually want to do the
right thing they just need direction. Ms. Cheng stated that educating the parents
helps tremendously.

Kim Saxton-Heinrichs, Senior Recreation Coordinator, presented staff report.
Coordinator Heinrichs noted that the purpose of this policy is to provide a process
through which the City of Saratoga can acquire and accept artwork on loan or as a
gift. It will provide guidance for purchasing or commissioning new artwork, for
sponsoring temporary art exhibitions on City property, and guidance regarding
deaccessioning City-owned artwork. Art in public and municipal places can be

defined as any visual work of art displayed in a City-owned park, the exterior of
any City-owned facility, and within any City-owned facility in areas designated, by
the Council.
. Coordinator Heinrichs noted that the City Attorney has advised that the City .will
have obligation under the First Amendment depending on the extent to which it
opens various portions of City property to public art,. In doing so, the City may
create what the courts view as a forum for public discourse. In public forum, the
rights of the government to limit expressive activity are constitutionally
circimscried.
Tracy Halgren, Arts Commission, 14003 Chester Avenue, thanked the Council for
forming the Arts Commission and noted that the Commission is proud to preset
the Arts Policy to the Council.

7. SARATOGA LIBRARY PROJECT UPDATE

John Cherbone; Public Works Director, presented staff report.
Director Cherbone noted that the resolutions before the Council this evening
continue the process for renewing the Landscaping and Lighting Assessment
District LLA-1 for FY 03-04.
Director Cherbone noted that there are no increases in the parcel assessments. All
of the costs associated with the District are recovered via the assessments except
for indirect costs.
Director Cherbone explained that staff is looking for direction from Council on
whether the City should pursue the creation of a new landscape and lighting
district maintenance zone for the future "Gateway" improvement area, bounded by
Prospect Avenue and the Union Pacific Railroad tract. The improvement project
will create new landscaped medians, new landscaped areas along unimproved
parcel frontages, lighting, and a water feature. These improvements will all have
ongoing maintenance and operating costs.
Director Cherbone explained that currently the City pays for the landscape
maintenance and water costs for all of the medians throughout the City. Director
Cherbone pointed out that the majority of other landscaped areas within the City
right-of--ways are maintained via a City Landscape and Lighting Zones, an
individual property owner,; or a homeowner association.
Director Cherbone explained that an estimated cost for maintaining the "Gateway"
area is $25,000 per year. A landscaping and lighting district is advantageous in
that maintenance can be handled by one contractor thus the level of maintenance
and costs are normalized and reduced through efficiencies of scale.
Director Cherbone explained that attached proposal would extend the existing
professional contract between the City and John Heindel for an additional three
years.

and Lighting District in the "Gateway".

AUTHORITY (SVACA) JOINT EXERCISE OF POWERS AGREEMENT

Assistant .City Manager Tinfow explained that at the .February meeting of the
Silicon Valley Animal Control Authority Board, the City of Cupertino expressed
concerns about the potential for the JPA to force Member Agencies to contribute
to shelter construction activities against their will. The board :asked Counsel to
draft a JPA amendment with language to address this concern. Each City must
now approve the amendment in order for it to become part of the JPA.

10. LEAGUE OF CALIFORNIA CITIES SPECIAL MEETING MAY 15, 2003
STAFF RECOMMENDATION:
Designate a voting delegate.
Cathleen Boyer, City Clerk, presented staff report.
City Clerk Boyer stated that the League of California Cities is requesting that all
cities be represented at the Special Meeting on Thursday, May 15, 2003. The
purpose of this Special Meeting is to consider one or more proposals prepared by
the Board of Directors concerning the state budget and state local fiscal form. The
league is requesting a response by May 9, 2003. Mayor Nick Streit is unable to
attend this Special Meeting.
City Clerk Boyer explained that the League bylaws state that "Any official of a
Member City may, with the approval of the City Council, be designated- the city's
voting delegate or alternate delegate to any League meeting."

West Valley Sanitation District -noted that at the last meeting he raised questions
regarding their noticing policies and requested that they look into how Saratoga notices •
their residents.
Mayor Streit reported the following information:
Cities Association -discussed the solvency of VTA, possible merger of MTC and ABAG
and forming strike teams to lobby Sacramento for specific bills.
CITY COUNCIL ITEMS
Vice Mayor Waltonsmith noted that the Heritage Foundation would be holding a joint
meeting with the Heritage Preservation Commission on April 28, 2003, 6:00 p.m. at the
North Campus.
In regards to the Odd Fellows project, Vice Mayor Waltonsmith noted that the City's
Trails Subcommittee wondered why no one requested them to connect their open space
area to the San Marcos Trail. Councilmember requested that staff contact the Odd
Fellows and ask if it could still be accomplished.
Councilmember King announced the Rotary Art show on may 4, 2003 at West Valle
College.
In regards to a letter sent to the City Council from the Wildlife Center requesting a
contribution of $352.52, Councilmember Bogosian requested that Council agendize the
letter.
Consensus of the City Council to agendize the letter from the Wildlife Center.
