ANDREWS PARISH AND SCHOOL, 13601 Saratoga Avenue; - St. Andrew's Parish and School requests use permit approval to locate several portables on the concrete basketball court at the West Field property for the students to use for indoor physical activities during construction of the new gymnasium. St. Andrews obtained approval in 2003 for the construction of new facilities. Each portable is to be size 12 feet x 60 feet. The portables are to be placed together to make up a "gym" area during construction. The interior height of the portables is 9.5'. The exterior will be painted brown. The portables are temporary for one year while the main gym is being constructed. The primary hours are 7 am to 4pm -Monday to Friday. Motion: Upon motion of Commissioner Kundtz, seconded by Commissioner Hunter, the Planning Commission minutes of the regular meeting of June 8, 2005, were adopted as submitted. (4-0-2-1; Commissioners Rodgers and Schallop were absent and Commissioner Uhl abstained) ORAL COMMUNICATION There were no Oral Communication items. Chair Nagpal asked that the record show the arrival of Commissioner Schallop at approximately 7:04 p.m. REPORT OF POSTING AGENDA Director John Livingstone announced that, pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on June 16, 2005. REPORT OF APPEAL RIGHTS Chair Nagpal announced that appeals are possible for any decision made on this Agenda by filing an Appeal Application with the City Clerk within fifteen (15) calendar days of the date of the decision, pursuant to Municipal Code 15.90.050(b); 10 days for Conditional Use Permits. CONSENT CALENDAR There were no Consent Calendar items. Planning Commission Minutes for June 22, 2005 Page 2 PUBLIC HEARING -ITEM NO.1 *** • APPLICATION # 04-045 (397-06-064) -CHID, 18495 Woodbank Way; -Request Design Review Approval to add approximately 2,908 square feet to the existing 3,199 square foot single story house for a total floor area of 6,108 square feet. The project will also include a 2,337 square foot basement. The gross lot size is 64,904 square feet and zoned R-1-40,000. The maximum height of the residence will be approximately 26 feet. (SUZANNE THOMAS) Planning Intern Suzanne Thomas presented the staff report as follows: • Advised that the applicant is seeking Design Review Approval to allow a 1,700 square foot addition to the main floor, and 1,200 square foot addition to the lower floor for a total square footage of 6,108 square feet. A 2,337 square foot basement will also be added. • Described the parcel as consisting of 64,904 square feet and zoned R-1-40,000. • Added that the maximum height would be 26 feet. . • Said that there are homes of varied age and architectural design in the area. This proposed structure would consist of beige stucco with white trim and concrete roof tiles. • Informed that this project is consistent with required findings. It is not in a view corridor and there are no view impacts. There do exist mature trees. Nine walnut and two palm trees are proposed for removal and replacement. The walnut trees are determined to be in poor condition while the palms are in good condition. Thirty-four new trees will be planted on site including 10 Douglas Firs. • Said that the proposed addition adds character and interest. It is compatible as far as bulk and height. The project conforms to grading standards with 900 cubic yards of cut and fill. The project meets Design Review policies regarding bulk and privacy. The project includes a 525 square foot three-car garage. • Advised that there has been no negative correspondence regarding this project from the neighbors. • Added that the project is consistent with the General Plan. • Said that staff had initially been concerned about the proposal to locate the driveway pad at the lot line but the driveway has since been moved in by five feet. • Recommended approval. Commissioner Uhl said that although staff is reporting that no negative correspondence has been received from nearby neighbors, he was wondering if any signed correspondence at all was received about this project. Director John Livingstone replied that staff only includes neighbor correspondence if it is negative. Staff has not been adding signed letters in the staff reports if they are from neighbors who are simply acknowledging being informed about proposed plans by the applicant. He said it would be possible to do so in the future if this is the desire of the Commission. He suggested that this issue be discussed further later in the Agenda under Commission Items. Chair Nagpal opened the Public Hearing for Agenda Item No. 1. Mr. John Chiu, Applicant and Property Owner, 18495 Woodbank Way, Saratoga: Planning Commission Minutes for June 22, 2005 Page 3 • Said that the required acknowledgement forms were indeed signed by his adjacent neighbors as required. • Stated that he is excited to be before the Commission this evening with his proposed home design, which he has been working on for three years now. • Assured that this would represent a significant upgrade to the existing house and that elements from the Design Handbook have been incorporated. • Said he is a long-time resident who grew up in Los Gatos and has lived in Sazatoga for the last five yeazs. • Said that he plans to stay in Sazatoga for a long time. • Thanked the Commission for its consideration. Commissioner Cappello asked Mr. John Chiu if he has received positive feedback from his neighbors. Mr. John Chiu said that the Foxes thought it was nice. The neighbors in the back had only one concern, that there might be privacy impacts. Once they realized that there were no impacts, they are fine with this proposal. Chair Nagpal closed the Public Hearing for Agenda Item No. 1. Commissioner Hunter said that this project looks great and wished Mr. John Chiu and his family good luck. Commissioner Kundtz said that this is a wonderful property and an ambitious project. It will be an asset and upgrade to that corner of the road. Motion: Upon motion of Commissioner Hunter, seconded by Commissioner Kundtz, the Planning Commission granted a Design Review Approval (Application #04-045) to allow a residential addition on property located at 18496 Woodbank Way, by the following roll call vote: AYES: Cappello, Hunter, Kundtz, Nagpal and Uhl NOES: None ABSENT: Rodgers ABSTAIN: Schallop *** PUBLIC HEARING -ITEM N0.2 APPLICATION # 05-128 (386-10-043) FILIZELTI, 18570 "A" Prospect Road; -Request for a Conditional Use Permit to allow a Dental Office in an existing tenant space located in a Neighborhood Commercial Zoning District. (SUZANNE THOMAS) Planning Intern Suzanne Thomas presented the staff report as follows: • Advised that the applicant is seeking approval of a Conditional Use Permit to allow the establishment of a dental office in an existing 1,200 square foot tenant space at the Westgate Corner Shopping Center at Prospect and Lawrence Expressway. Planning Commission Minutes for June 22, 2005 Page 4 • Explained that this use requires approval of a Conditional Use Permit in a Neighborhood Commercial Zoning District. • Said that the Municipal Code encourages a variety of uses and services in the City's Commercial Zoning Districts. This proposed dental practice would be the only dental use in this Center. • Advised that staff is discouraging any additional dental uses in this Center after this one. • Reported that this project meets the required findings, as it is not detrimental to the health, safety and welfare of the community. • Added that the parking requirement for a dental office is the same as the requirement for retail use so there is adequate parking provided to support this use. • Said that this dental office would be beneficial to all uses at the Center and would serve as a compliment to other services offered. • Stated that the hours of operation would be from 9 a.m. to 6 p.m. from Monday to Friday and from 10 a.m. to 4 p.m. on Saturdays. • Advised that no correspondence has been received and that the existing tenants and property owner are supportive of this proposal. • Said that the necessary findings can be made in the affirmative. • Recommended approval and reported that the applicant is available this evening. Commissioner Kundtz pointed out the policy to encourage of a variety of uses. Commissioner Cappello asked if tenants and/or business owners are also notified of this public hearing or just the property owners. Director John Livingstone replied that the property owners are notified. Chair Nagpal pointed out that the applicant also talked to the existing tenants. Commissioner Uhl asked if there was any notification posted on site. Director John Livingstone replied that he was not sure. Chair Nagpal opened the Public Hearing for Agenda Item No. 2. Mr. John Machado, Representative for the Property Owner and the Doctor: • Advised that the management provided notices to the tenants. The owner and manager discussed this proposal with the tenants. • Explained that this center is evolving from retail sales to more service oriented location. Said that such centers help to reduce trips as customers can accomplish multiple tasks with one stop. With several services accomplished per trip, there is less traffic. • Said that he also spoke with the adjacent car wash group. They too were supportive. • Advised that a lot of cross shopping already occurs. Commissioner Hunter asked if this is a pediatric dental practice. Mr. John Machado: • Replied that this is a family dentistry practice. Planning Commission Minutes for June 22, 2005 Page 5 • Said that we are seeing more of quasi retail uses coming into these types of centers. It's an evolution of what is going on in retail. • Agreed with staff's recommendation that no further medical and/or dental uses be established in this center. The dental practice would be joining an existing optometrist's office in this center and would represent the extent of medicaUdental uses in this center totaling 2,400 square feet in space. Commissioner Kundtz asked what is the basis for the decision to develop diversity in proposed tenant uses in this center. Mr. John Machado reported that two dental practices had wanted to come to this center. This applicant was chosen because it is more of afamily-oriented practice that includes Saturday hours. Commissioner Kundtz asked if there were any straight retail candidates interested in this space. Mr. John Machado replied no. He added that he appreciates the Commission's consideration of this request. Chair Nagpal closed the Public Hearing for Agenda Item No. 2. Commissioner Cappello agreed that a dental office lends itself to the family nature of this center and helps to offer a nice rounded mix of businesses. Motion: Upon motion of Commissioner Nagpal, seconded by Commissioner Cappello, the Planning Commission approved a Conditional Use Permit to allow a dental office in an existing tenant space located at 18569 Prospect Road, Unit A, by the following roll call vote: AYES: Cappello, Hunter, Kundtz, Nagpal, Schallop and Uhl NOES: None ABSENT: Rodgers ABSTAIN: None *** DIRECTOR'S ITEMS There were no Director's Items. COMMISSION ITEMS Commissioner Hunter said that she wants to see any neighbor comments received, be it negative or supportive, included in the staff reports. Commissioner Uhl agreed that it is nice to see both types of comment. Chair Nagpal said that she supports the practice of providing all comments received for a project if there are any negative comments received but can support excluding the neighbor letters if it just represents a signature acknowledging being informed of a proposed project. This could help save paper. Planning Commission Minutes for June 22, 2005 Page 6 Commissioner Hunter said that she likes the practice of producing reports in double-sided copy format. Chair Nagpal reiterated her belief that if all that is provided is signatures; these forms don't need to be provided. Director John Livingstone said that in the future if there aze comments, staff would let the Commission see all of them. Commissioner Hunter clarified that she wants to see all comments received every time. Director John Livingstone said that as a submittal requirement, the applicant must submit comment forms from neighbors. Commissioner Schallop suggested that these comment sheets could be provided to the Commission in PDF format via email. Director John Livingstone said that this technology might be too advanced for the City at this time. Chair Nagpal said that it appears the consensus is to include all forms received from neighbors in the staff reports. Commissioner Cappello said that if no added comments aze provided with the signatures on the form, it might not be necessary to receive copies if the fact of receipt is documented in the staff report. However, if there were any specific comments provided by the neighbors, he would want to see those. Director John Livingstone said that since it is appazent that several Commissioners want this information provided each time, staff would include it from now on. He added, for the record, that the Planning Commission packets aze always reproduced as double-sided copies to conserve paper. Commissioner Hunter: • Reported her attendance at a Historic Preservation Workshop held today that was hosted by the City of Campbell and attended by 62 planners and preservationists from as far away as Berkeley onwazd. • Said that the group was provided with a tour of the Ainsley House and that she also visited Downtown Campbell. • Thanked the City of Campbell for putting this event together. • Explained that the subject of this workshop was how to preserve using the Department of Interior Standazds and the speaker was the State's Head Preservation Architect. Chair Nagpal reminded of the July 27~' Study Session and pointed out that only four of the Planning Commissioners are available. Commissioners Rodgers, Hunter, and Schallop are to be excused. Commissioner Schallop said he had thought that meeting would be cancelled. Chair Nagpal said that it could not be since there is a full agenda scheduled and a quorum can be achieved. Planning Commission Minutes for June 22, 2005 Page 7 Director John Livingstone explained that he had sent out an email to each Commissioner to determine availability for meetings for the remainder of the summer. The second meeting in July has too full an agenda to cancel. Suggested that it might be possible to cancel the second meeting in August instead of the first meeting in August. Commissioner Kundtz asked if it still makes sense to move forward with this Study Session even if only four Commissioners can attend. Director John Livingstone replied yes. He said that changing the date would move it to late August. He said that a Study Session is not mandatory. Chair Nagpal supported the idea of the Study Session. Commissioner Hunter asked when this item would come before the Commission. Director John Livingstone said the date is tentative to this point. Commissioner Hunter cautioned that the public might feel that they have been given no opportunity to participate in this Study Session if it is held in July when so many people are on vacation. Commissioner Schallop said that he has no problem with the Study Session going forward even though he cannot attend it himself. He added that he didn't think it was actually that necessary. Chair Nagpal asked if the Study Session could be continued. She asked if the public could speak at this Study Session. Director John Livingstone replied yes. He added that it would be held at the City's Prospect location. Chair Nagpal reminded about the July 6`~ joint session with Council. Commissioner Uhl asked what time this meeting would be held. Commissioner Kundtz replied 5:30 p.m. COMMUNICATIONS There were no Communications Items. A photograph of similar style portables is attachment 2. ~~'~®o~ PROJECT DISCUSSION St. Andrew's Parish and School requests use permit approval to locate five temporary portables on the concrete basketball court at the West Field property for the students to use for indoor physical activities during construction of the new gymnasium. Each portable is 12 feet x 60 feet. The portables are to be placed together to comprise a "gym" area during construction. The interior height of the portables is 9.5 ; however, the portables will sit on an approximately 3 foot tall platform. The exterior of the portables will be painted brown. The portables are temporary for approximately one year while the gymnasium is being constructed. The primary hours are 7 am to 4pm -Monday to Friday. No trees will be impacted by the temporary portable structures. Neighbor Notification The applicant mailed an informational letter to property owners within 500 feet to notify them of the temporary portables proposed at West Field, as well as, the commencement of the initial phase of construction. The applicants letter and labels are attachment 4. r~ Background For background information, St. Andrews obtained approval in 2003 for the construction of new facilities. The approved project includes demolition of the existing buildings (with the exception of the sanctuary, which is to remain) and the construction of five new structures. Proposed buildings include: a performing arts/gymnasium, administration offices, classrooms, a parish center, and a clergy building. Construction is to begin in phases starting Summer 2005. The initial phase beginning this summer includes construction of the gymnasium, parish center, and parking lot. For these construction activities, the students will be kept on-site during the school year. Several temporary classroom portables are being brought onto the job site for the students during construction and several construction trailers will be brought on-site for the storage of materials. The remaining scope of work including new classrooms, administration buildings and offices for the parish center are to be constructed in the next phase. At that time, the students will be relocated off-site during construction. In preparation for the commencement of construction tree removal permits have been noticed to the neighbors and obtained by the applicant. A preconstruction meeting with the Arborist is being scheduled by the construction project manager. Twenty-five trees are approved to be removed. Most of those trees are ornamentals with the exception of two Live Oaks and two Coast Redwoods and were noticed during the public hearing for the project in 2003. Heritage Preservation Commission The West Field property is located along Heritage Lane; therefore, the Heritage Preservation Commission reviewed the proposal to located several temporary portables at the site. The Heritage Preservation Commission approved the proposal by a vote of 5-0. ~~~~/1d~ Use Permit Findings The proposed project supports the findings for use permit approval; therefore, staff recommends the planning commission approve of the proposed project based on the following findings: • That the proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purposes of the district in which the site is located in that it is visually unobtrusive and that the aesthetic impact of the facility will be less than significant and the structures aze temporary. • That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfaze, or materially injurious to properties or improvements in the vicinity. • That the proposed conditional use will comply with each of the applicable provisions of this chapter in that the location, height, size and use proposed is conditionally permitted in this zoning district. Conclusion The project satisfies all of the findings required within Section 15-55.070 of the City Code. The temporary portables are not expected to be detrimental to the public health, safety or welfare nor aze they expected to be materially injurious to properties or improvements in the vicinity. We anticipate construction to start June 2005, with completion August 2006. Construction will involve removal of some trees, which has previously been approved by the City of Saratoga. In addition, we will be placing temporary portable units on the main campus for Parish offices and School classrooms. The School classrooms will be removed Summer 2006. The Parish office will be relocated to the interior of the project until Phase IV, the main school and Parish office buildings, are started. We will also be placing temporary portable units on the basketball court area at our West Field site. They will substitute for the gym facility we are demolishing and re-building. The size will be approximately 60' x 72', and will be located between the basketball hoops. Again, this is temporary only, until June 2006, when they will be removed. They will be used by the School and Parish primarily between the hours of 7:30am to 3:30 pm, Monday to Friday. When we are complete with this phase of the main campus, we will hopefully be able to move into the final design and construction for the last phase: the new Parish Clergy Office Building & Administration and School buildings. This construction will necessitate a move off site by both the Clergy offices & School. Saint Andrew's Parish & School is very excited about starting this much needed project, and we hope you share in that excitement. In addition, portions of the roof structure will be reconstructed. The maximum height of the proposed residence is 20.5 ft. The proposed residence including garage will be 5,502.5 squaze feet. Materials and colors aze to match existing including, a beige stucco exterior and clay the roof. The windows will be replaced throughout with Anderson wood frame with white cladding. The muntins will be their "simulated divided lite" which has the muntin bars fastened on both the interior and exterior. Existing residences in the project vicinity are predominately stucco with clay the roofs. Lot sizes in azea aze typically one acre or more. There is a mixture of one and two story residences in the project vicinity. Both the one and two story residences in the project vicinity aze large-scale residences. The proposed project is very consistent with the existing residences. The large lot sizes in the project vicinity can support the lazge scale homes. The footprint of the existing residence is to remain. The existing building footprint is expanded by approximately 600 squaze feet. The rooflines aze varied through changes in height. The main and highest roofline is 20.5 feet tall. The majority of the roofline is approximately 17 feet in height or less. Arborist Report The Arborist Report, dated May 20, 2004 details project impacts on the existing trees. A privot, tree #4, is proposed for removal. This tree (#4) is identified in the Arborist report as having poor structural integrity. The azborist report details the proposed driveway expansion shall not occur within eight feet from the tree trucks to preserve trees #1 and #2 both Mexican Fan Palms. The azborist recommendations have been incorporated into the conditions of approval. Note: The original plans included an addition to the gazage with was removed from the application; therefore, you may find reference to the gazage addition in the azborist report. Design Review Findings Staff finds the proposed project supports the findings for design review as discussed below: (a) Avoid unreasonable interference with views and privacy. The project site is a comer lot, over an acre in size, with a lot depth over 250 feet allowing for more than adequate separation between existing residences. The additions are one-story. The roof height will be increased to 20.5 feet in only a portion of the total roofline. The development shall be located and constructed as shown on Exhibit "A" date stamped June 16, 2005 incorporated by reference. 2. Four sets of complete construction plans incorporating this Resolution and the Arborist Report, dated May 20, 2005 shall be included on the plans submitted to the Building Division for permit plan check review. 3. Front yard landscaping shall be installed prior to final occupancy inspection. 4. All changes to the approved plans must be submitted in writing with a clouded set of plans highlighting the changes. Proposed changes to the approved plans are subject to the approval of the Community Development Director and may require review by the Planning Commission. 5. The site plan shall contain a note with the following language: "Prior to foundation inspection by the City, the LLS of record shall provide a written certification that all building setbacks are per the approved plans." 6. Babby, Registered Consulting Arborist May 20, 2005 INTRODUCTION The City of Saratoga Community Development Department has requested I review the potential tree impacts associated with the following at 14341 Sobey Road, Saratoga: [ 1) the proposed addition and remodel to an existing residence and garage, and [2] the proposed expansion of an existing driveway. I visited the site on May 18, 2005 and this report presents my findings and recommendations. The plan reviewed for this report includes a Site Plan (Sheet 1), dated 2/10/05, by Chris Spaulding Architect. The trees' locations, numbers and approximate canopy dimensions are presented on an attached copy of this plan. FINDINGS There are seven trees regulated by City Ordinance that are located immediately adjacent to the proposed project components. They include two Fan Palms (#l, 2); one Canary Island Date Palm (#3); one Privet (#4); one Valley Oak~(#Sj,.~ne Olive Tree (#6); and one Flowering Plum (#7). Specific data compiled for each is presented on the attached table. • Trees #1, 2 and 5 are not shown on the project plans and must be added. Their approximate locations have been plotted on the attached map and should not be construed as being surveyed. Based on the proposed plans, trees #1 and 2 would be in conflict and require removal. However, my measurement of the existing driveway width, which was found to be about 13.5 feet across, ~ reveals the driveway expansion will be within approximately one-and-a- half feet from the trees' trunks. Consequently, they would not be in direct conflict but potentially adversely impacted. To maintain their current health, I advise the proposed expansion does not occur within eight feet from the trees' trunks (their trunks are currently situated within approximately four feet from the existing edge). During my site visit, Mrs. Tran expressed she would like tree #4 removed. This tree is a relatively small, multi-stemmed Privet that contains poor structural integrity. As such, I find its removal would comply with City Ordinance. Tree #6, amulti-stemmed Olive, is in conflict with the addition to the garage. Its removal also appears appropriate. As mitigation for the loss of trees #4 and 6, I recommend two trees of 24-inch box size be installed at a suitable location on site. There is a large Eucalyptus (Eucalyptus globulus) comprised of eight trunks situated on the driveway's south side of the driveway opposite trees #1 and 2. Protection measures, however, need to apply as well as to other Ordinance-sized trees not inventoried for this report. I anticipate all trees planned for retention will be adequately protected provided the recommendations presented in the next section are carefully followed and incorporated into construction plans. Per City Code, the tree protection bond amount required for achieving the protection of retained trees is $5,800.2 RECOMMENDATIONS The recommendations presented below presume the retention of trees #1-3, 5 and 7, and serve as measures to protect their survival and mitigate those anticipated for removal. If plans become revised, the recommendations may require modification. Design Guidelines 1. The locations and canopy dimensions of trees #1, 2 and 5 should be added to the Site Plan. 2. The section of expanded driveway should not encroach within eight feet from the trunks of trees # 1 and 2. 3. The drainage design should not alter any surface runoff that currently flows towards the root zones of trees being retained. 4. Temporary or permanent drainage features, including downspouts, must be designed so water is not discharged beneath or towards the trees' canopies. 5. Any new underground utilities and services should be designed outside from beneath the canopies of trees being retained. Where this is not possible, I should be consulted for alternative installation methods. 6. Any unused, existing underground utilities/services, lines or pipes beneath the trees' canopies should be abandoned and cut off at existing soil grade. 7. If there are plans to install new underground utilities or landscaping, they should be reviewed for tree impacts prior to implementation. Protection Measures during Site Development 8. Tree protective fencing shall be installed precisely as shown on the attached map and established prior to any demolition, surface scraping, construction or heavy equipment Z This amount represents the combined, appraised values of trees #1-3, 5 and 7 and was calculated in accordance with the Guide for Plant Appraisal, 9`~ Edition, published by the ISA, 2000. Unless otherwise specifically approved, outside the designated fenced areas (ins fencing is removed) and outside from inventoried or not inventoried for this ~ limited to, the following: grubbing, grad equipment cleaning, stockpiling and equipment/vehicle operation and parking. all construction activities must be conducted eluding before fencing is installed and after beneath canopies of Ordinance-sized trees •eport. Any approved activities beneath the canopies of retained trees shall be performed manually and not require the travel or operation ofmotorized-wheeled equipment. 12. The disposal of harmful products (such as chemicals, oil and gasoline) is prohibited beneath canopies or anywhere on site that allows drainage beneath canopies. In addition, fuel should not be stored nor shall any refueling or maintenance of equipment occur within 100 feet of the trees' trunks. 13. Herbicides should not be applied beneath the trees' canopies. Where used on site, they must be labeled for safe use near trees. 14. Any tree pruning must be performed under supervision of an International Society of Arboriculture (ISA) Certified Arborist (not by construction personnel) and according to ISA standards. Information regarding Certified Arborists in the area can be obtained at http: //www. isa-arbor. com. Tree Replacements 15. Mitigation for the loss of trees #4 and 6 should include the installation of two trees of 24-inch box size somewhere on site. Acceptable replacement species include Quercus agrifolia, Quercus lobata, Quercus kelloggii, Quercus douglasii, Quercus dumosa, Acer macrophyllum, Aesculus californica, Pseudotsuga menZiesii and Sequoia sempervirens. The proposed location and sizes of new trees should be at least 15 feet apart and 15 feet outside from the canopy edges of retained trees. They must be installed prior to final inspection and, as necessary for support, be double-staked with rubber tree ties. Automatic irrigation must be supplied to each tree and be a drip or soaker hose system placed on the soil surface and not in a sleeve. PROJECT DISCUSSION The applicant requests design review to remodel an existing one-story home and construct a new second story. The total floor area of the remodeled two-story residence with an existing 102 square foot detached shed will be 4,282 square feet. The maximum height of the proposed residence will be 24 feet and will be similar in height with the other two-story structures that are on either sides of this home. The second story of the home will be smaller than the first floor, and its increased setbacks and scale will provide adequate facade articulation. A "materials and color board" will be available at the site visit and the public hearing. To the rear of this site is a vacant church property where arsine-lot subdivision is proposed. Neighbor Correspondence The applicant has shown the plans to the neighbors and their responses are attached to this report. No negative responses were received as of the writing of this staff report. Trees No ordinance sized trees are proposed for removal. However, the City Arborist has provided recommendations to protect the large Hollywood Juniper tree situated adjacent to the home's southwest corner. All of the City Arborist recommendations have been made conditions of approval. Design Review Findings Staff finds the proposed project supports the findings for design review as discussed below: (a) Avoid unreasonable interference with views and privacy. The project vicinity has a mixture of one and two-story residences. The project site has mature trees on its periphery which provide sufficient screening. The site is not located in a hillside area where there maybe unreasonable interference with views. (b) Preserve Natural Landscapes The existing landscape will be relatively unchanged as an existing single-story residence will be replaced by a remodeled two-story residence. The lot is level and minimal grading is proposed. (c) Preserve Native and Heritage Trees. There are no native or heritage trees that will be impacted by this proposal. (d) Minimize perception of excessive bulk. Earth-tone colors are used to minimize the perception of excessive bulk. My site visit on May 12, 2005 revealed the tree in question to be a large Hollywood Juniper that appears in overall good health and structural condition. The tree has a trunk diameter of 15 inches, is approximately 30 feet tall, and has an estimated 30-foot wide canopy spread. Recommendations for maintaining its longevity are as follows: 1. The tree should be pruned away from the home and future addition prior to construction. This work should be performed under the supervision of an individual certified by the International Society of Arboriculture (ISA); a listing of Certified Arborists in the area can be obtained by viewing http://www.isa-arbor.com. 2. Any construction activity shall not occur within 15 feet of the tree's trunk. These activities include, but are not limited to, grading, stripping the topsoil, trenching, equipment cleaning, stockpiling and dumping materials, equipment operation, and the discharge of water (including by downspouts). 3. Prior to construction, Irecommend afive-inch layer of coarse wood chips (%s- to 3/.- inch in size) is manually established on the soil surface within 15 feet from the tree's trunk; the wood chips should not be in contact with the tree's trunk. 4. The disposal of harmful products (such as chemicals, oil and gasoline) is prohibited anywhere on site. In addition, fuel should not be stored nor shall any refueling or maintenance of equipment occur within 75 feet of the tree's trunk (except on the street). 5.
