PLACE: Fireman's Hall, Oak Street, Saratoga, California TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Crisp, Cameron, Higgins, Pasetta, Webster Absent: None B. MINUTES Commissioner Bennett moved that the reading of the minutes be waived and that said minutes of the previous meeting be approved. Carried unanimously. Ii NE~ BUSINESS A. VARIANCES 1. V 19 - John L. Famllton The Secretary of the Planning Commission read the details from the applicat].on of John L. Hamilton for a variance and at the request of the Chairman, read a letter dated #V 19 April 22,1957 from Charles ~. naval of 63 Ellenwood, Los John L. Hamilton Gatos, Calif. in which he offered no objection to the v~riance. A.MP. R. W. Fon.~ard, who owns the lot adjacent to Mr. Hamilton's, stated from the floor that Mr. Hamilton has been cooperative but he has not been able to ascertain whether or not the house is too big for the lot. He felt that he should have further information as to the location and size of Mr. Hamilton's house and the manner iD which it would affect the house he intends to build. After a short discussion Chairman Crisp recommended that the matter be continued until the next meeting and in the interim Mr. Hamilton and Mr. Forward get together and attempt to iron out their difficulties. B. USE PERMITS 1. V 17 - J. B. Perego The Secretary of the Planning Commission read the details of Mr. Perego's app, lication in which he applied for a use permit as necessitated in Ordinance 3A-4, Section 1.2. Mr. Raymond of Allendale Ave. asked a point of informa- tion, that is whether the use permit was'temporary. Chairman Crisp explained that the use permit in this case would be perpetual. #v l? J.B.Perego Mr. Eaymond, from the floor, stated that the smaller acreages are creeping up Allendale Ave. and in a short time would have an effect on the larger area lots further up on Allendale. Mr. Hartranft of Allendale Ave. Stated that while he had no objection to Peremont No. 3 he was under the impression that the immediate neighbors did not like it but in Justice it must be approved. Mowever he wanted to know whether or not this would establish a precedent for this entire area. Mr. Hartranft stated further that he had asked the Plan- ning Commission for a plan For the whole street and wanted to know whether this was establishing a precedent for the entire street and commented that he would like to see "that half acre business". Mrs. Dorothy Hurt of Montpere Way asked how big the lots were going to be. Chairman Crisp replied that they vary in size with a minimum frontage of 60' to 62'. Mr. Warfield of Peremont Gardens No. i stated that the minimum house area in Peremont No. I and No. 2 was 1,400 sq. ft. and that it was his understanding from the County Engineer's Office that Peremomt No. I and No. 2 contain nine and one half (9 1/2) acres in which there ~ere located thirty homes and that Peremont No. 3 had ten and one half'(10 1/2) acres with about double the ~umber homes. Commissioner Bennetb, at this point, stated that Peremont Garden No. 3 contained only forty one homes. Mr. Warfield commented further that he felt that every- thing should be done to stop making Peremomt No. 3 the same as the San Tomas area. Assistant City Attorney Clark stated that if Mr. Perego, at the time of his filing of his Record of Survey, made representations to the Planning Commission as to the type house that would be built then there may be some sort of control set up by these statements, however there is presently no law in which the City could control the architecture in the area. Mr. Hurt stated that while the City could not control the type house built in the area it was his understanding that they could control the area as far as 10,000 sq. ft. lots were conGerned. Commissioner Pasetta moved that the matter be taken under advisement until 5/13/57. Carried unanimously. 2. V 18- Glenn W. Lamplet The application for Glenn W. Lamplet for a~e permit as #V 18 necessitated in Ordinance No. 3A-4, Section 1.2, was Glenn W.Lampier read by the Secretary of the Planning Commission. Chairman Crisp stated that if Mr. Lamplet would examine the map of the proposed Freeway he would find that part of his subdivision was involved with said Freeway. Mr. Lamplet stated that he had not as yet seen the map of the Freeways but would make every effort to do so shortly. Chairman Crisp commented that the Commission was merely attempting to protect Mr. Lampier from building where the Freeway might come through. Commi~sioner Bennett stated that the matter had been investigated by a committee from the Planning Commission and moved for approval. Chairman Crisp commented that while the Commission would approve the tentative map it is probable that Mr. Lamplet would have difficulty in obtaining a building permit until a release from the State Highway Dept. was obtained. Mr. Bennett's motion was voted on and passed unanimously. 3- V 20 - Bernard Stuehler The Secretary of the Plannimg Commission read the appli- cation in which Mr. Stuehler asked for a use permit as required under Ordinance No. 3A-4, Section 1.2o #V 20 Mr. Theo WillJams of the Saratoga-Los Oatos Rdo stated Bernard StuehLer he was representing Mr. Stuehler and pointed out that this particular lot was recorded in 1904 and that while they could conform with the 25' front set-back required by the City of Saratoga they would have to have a 6' side yard set-back in view of the smallness of the lot. Commissioner Bennett stated that nobody was helped and nobody hurt by this building and recommended that it be approved. Carried unanimously. END OF POBLIC HE~ING - 8:30 P.M. IV MATTERS ~LD b~NDER ADVISEMENT 1. V 10 - W. Rodoni The Clerk read the conclusion of the minutes of the last Plan~.ing Commission Meeting of Aoril 8, 1957 in which it stated that the matter was taken under advisement for a decision to be rendered on April 22, 1957. Chairman Crisp asked Mr. Higgins whether his committee had. a report to make. Commissioner Hlggins reported that the City Attorney had made up a resolution covering their report and ~r l0 read Resolution No. V 10-1 in it's entirety. W. Rodoni After the reading of the resolution Commissioner Higgins moved that the resolution be adopted. Commis- sioner Cameron seconded the motion. Passed unanimously. Borris Stanley of Cupertlno who represented Mr. Rodoni thanked the Commission for their action but suggested as a matter of physical compliance that the sixty day limitation be given some consideration in the event that some hardship was worked out but promised that he and his client would make every effort to meet all the con- ditions as outlined by the Plannin~ Commission. 2. V 14 - W. Seagraves The Secretary of the Planning Commission read the con- clusion of the minutes of the April 8, 1957 Planning Commission Meeting in which the matter was taken under #V 14 advisement until April 22, 1957 and that Mr. Rankin, W. Seagraves Mr. Seagraves and the Architectural and Site Control Committee get together as to the type structures to be erected. Chairman Crisp asked Commissioner Higgins whether he had anything to report on this matter. Commissioner Higgins stated that he had met with Mr. Seagraves, his son and Mr. Rankin at the building site and that he had found Mr. Seagraves very cooperative. He suggested to Mr. Seegraves that they consider changing the shape of the additional houses, using different colors, designs, etc. In this he found Mr. Seagraves very recep- tive and Mr. Seagraves agree8 to confer as to architectural restriction with the Architectural Site Control Committee of the Saratoga Planning Commission. Later Mr. ~igEins stated Mr. Seagraves showed six different plans which he is considering using. In view of Mr. Seagraves coopera- tive attitude Mr. Higgins recommenaed that the use permit be approved on the'basis that plans would be submitted to the Architectural and Site Control Committee, and further that the minimum 10' side yard set-back be reduced to 6' in this instance. Motion carried unanimously. V COMMITTEE REPOETS A. ARCHITECTD~AL ~ND SITE CONTROL None B. SbBDIVISiON 1. SDRjl9 Dr. George Phillips The Secretary of the Planning Commission read the con- ditions as submitted by the County of Santa Clara Planning Dept. #SDR-19 Dr. Phillips spoke from th~ floor and stated. that the Dr. George access road referred to by the Planning Dept. did not Phillips exist and that he would appreciate some action so that he could get a building permit immediately. The Secretary of the Planning Commission told Dr. Phillips that if the matbet was approved by the Planning Commission he could secure ~ building permit immediately. Commissioner Cameron moved that the tentative map be approved subject to the conditions set out by the County of Santa Clara Planning Dept, Carried unanimously, 2. SDR-20 H, S, Weeth The Secretary of the Planning Commission read the two conditions set out by the County of Santa Clara #SDR-20 H, S. Weeth Planning Dept, Commissioner Bennett move~ that the tentative map.be approved subject to the conditions outlined by the County of Santa Clara Planning Dept. Carried unanimously, 3- SDR-21 J, Rodriques The Secretary of the Planning Commission read the conditions as outlined by the County of Santa Clara Planning Dept, Commissioner Bennett moved that the #SDR-21 J, Rodriques tentative map be approve8 subject to the conditions outlined by the County of Santa Clara Planning Dept, Carried unanimously. 4, SDR-23 E, H, Oxendine The Secretary of the PlaDning Commission read the conditions as outlined by the County of Santa Clara Planning Dept, and then read a further explanation #SDR-23 from the file as submitted by the Health Dept, in E,H,0xendine connection with the drainage in the affected area. Mr, Oxendine was present and stated that he understood the conditions and had agreed with them, Commissioner Bennett moved that the tentative map be approved on the basis of the conditions as sub- mitte5 by the County of Santa Clara Planning Dept, Carried unanimously, 5- SDR-24 T, Yamagami The Secretary of the Planning Commission read the #SDR-24 conditions as submitte8 by the County of Santa Clara T,Yamag~mi Planning Dept, Commissioner Webster moved for approval subject to the conditions submitted by the County of Santa Clara Planning Dept. Carried unanimously. 6. SD-18 0. R. Maggiore The Secretary of the Planning Commission read the conditions as submitted by the County of Santa Clara Planning Dept. Commissioner Anderson moved that an additional condition be added to the condition~ ~aid #SD-18 0.~.Mag~iore condition being "no lots to be less than 10,000 sq. ft. in area" . Commissioner Anderson moved that the conditions as sub- mitted by the County of Santa Clara Planning Dept. plus the additional conditio~ clotlined above be the basis for approval of the tentative map. Passed unanimously. 7. SDR-26 Ruth Kirby The Secretary of the P~annlng Commission ~ead the con- ditions as submitted to him by the County Engineers and #SDR-26 also the conditions as submitted to him by the Health Ruth Kirby Dept. Chairman Crisp moved that the tentative map be approved on the conditions as submitted to the Secretary of the Planning Commission. Carried unanimously.
