Commissioner Higglns moved that the minutes be approved
as prepared and distributed to the Commission. Carried
unanimously.
II N~ BUSINESS
A. ~YEW ZONING PETITIONS
1. C-9 - Fred Vogler
The Administrative Assistant read the petition as
presented by Mr. Vogler and Commissioner' Higgins
C-9 moved that the Clerk be directed to set a dste for
Vogler,F.
hearing. Carried unanimously.
Commissioner Bennett moved that the first meeti~
in October be set as the date for the hearing.
Carried unanimously.
B. WRITTEN COMMDi~ICATIONS
1. Westview Recreation Association
The Administrative Assistant explained the presen-.
tation of Mr. George Day and Mr. Van der Bos and
exhibited the diagrams and maps submitted by them.

Recreation Mr. Van der Bos of Palo Alto stated that he was

subdividing this area along with George Day and that
he would be glad to answer any questions the Commis-
sioners might have in connection with the proposed
recreation area. He stated that it had been in
existence for about three years in Palo Alto and
had been quite successful.
The City Administrator spoke briefly in connection
with the responsibilities of the City in the event
that the recreational area did not continue to
exist.
Commissioner Bennett requested:
1. A report from the plaything department
2. Subdivider to produce the deed clause
involving this recreational area
Mr. Van der Bos co~ented that the area could be
operated on as few as 50 members on a limited scale
by the subdividers however the subdivider would have
to "feel" his way through.
Commissioner Webster stated that he would like to
see a non-profit organization operate the area and
the pool.
Commissioner Bennett moved that the matter be filed
for study and that it be brought up at each meeting
until the study is completed. C~rried unanimously.

IV PUBLIC HEARINGS
~. REZONING
1. C-8 - John Tripoli
The Administrative Assistant explained the petition
of Mr. Tripoli for a chan~e of zoninF. from ½ acre and
acre lots to 10,000 sq. ft. lots, in an area roughly
C-8 described as Vickery and Lomita.

Mr. John Tripoli of 2897 Forrest Ave., San Jose, owner
of the property, stated from the floor that he felt
this rezonlng would balance out the area.
Mrs. Long of Douglas La-ne, Saratoga, asked a question
regarding the boundaries and said boundaries were
explained to her.

Commissioner Higgins stated that he didn't like the
idea of down-grading zoning.
Commissioner Anderson stated that he was in agreement
~ith Commissioner Higgins.
Commissioner Webster stated that he was luke-warm to
the idea as Mr. Tripoli had not given any valid reasons
for down-grading.
Commissioner Higgins moved that the request of rezoning
be denied. Carried unanimously.
B- VARIanCES Ai'~ USE PERMITS
1. V-41 - W. A. Pennington
The Administrative Assistant explained the request of
Mr. Pennington for a use permit in connection with his
property on Highway 9-
Mr. Pennington of 12275 Highway 9, Saratoga, California,
stated from the floor that he wanted a little more room
for the cabinet shop to display products and since he
was building it he "might as well make it larger and
V-41 get more rentals out of it".

possibly asbestos siding.
in answer to questions regarding the present occupant
he stated that the shed next to the cabinet shop which
has been in existence for ten years or more was used
by a landscape gardener named Greco. Next to this there
was a residence occupied by Mr. Pennington and next to
Mr. Pennington's residence was a building used by the
LuRay Plumbing Co. which consisted of people by the
name of Adsms and jones. Mr. Pennington admitted under
questioning that the LuRay Plumbing Co. operated ll or
12 trucks which w~re parked in back of the building
before described.

Commissioner Higgins moved that the matter be
taken under consideration until September 23, 1957.
Carried unanimously.
VI COMMITTEE REPORTS
A. ARCHITECTDT~AL AND SITE CONTROL
1. V-39 - Fred Durr
The Administrative Assistant explained the
architectural and site control request put in by
Mr. Durr covering the building st the rear of the
plaza and owned by Frank and Angelo Boitana.
A letter dated September 4, 1957, from the County
of Santa Clara Building Inspection Department was
read which indicated that the building in question
was far below the standards set up in the building
V-39 code.

Mr. Durr, the petitioner, stated that the Saratoga
Garage was in .' worse condition than the contemplated
area.
Commissioner Pasetta explained that the building code
takes precedence over anything else and that it would
have to be satisfied before proceeding further.
Commissioner Webster stated that ~ven though the Com-
mission granted an architectural and site control
permit the Commission still couldn't waive the require-
ments of the uniform building code and furthermore if
the Commission did approve the architectural and site
control permit they would be under constant pressure
to break down the building code.
Mr. Durr stated that if he couldn't use the building
in question for a garage he would be forced out of
town.
Commissioner Hidgins stated that perhaps the City
needed more commercial zoning.
Mr. Durr asked how much time he would be allowed
to bring the buildiD~ up to the building code.
Commissioner Webster stated that he would not be
allowed several years but would. be asked to put
the matter out to contract immediately.
Commissioner Higglns moved that the Commission
defer action awaiting proper plans that would
pass code. Carried unanimously.
B. SLYDIVISION
1. SDR 3~ and SDR ~7
Attorney Richard Rhodes of Saratoga explained his
client's stand.
It is understood that under SDP. 34 a letter dated
August 23 had been submitted by Dr. Case indicating
his withdrawal of a tentative map dated june i and
that a new tentative would be submitted.
The new tentative map was submitted under SDR 47 and
SDR 34 and Commissioner Webster moved that the map be approved

Dr. Case on the basis of the following conditions:
1. Northernmost lot not approved as building site
until existing septic systems for guest cottage
and home are relocated as approved by the Health
Dept.
2. Show 40' return radius at intersection of Mt.
Eden Rd. and Pierce Ed.
3- Survey required
4. Flood control contribution of i~150 each for
three lots
Carried unanimously.
2. SD 40 - Western States Land Co.
The Administrative Assistan~ read a letter from the
SD 40 City Administrator outlining the Council's attitude

by the administration office and the City Council
in connection with drainage and highway problems
in this area.
The City Administrator amplified the statements
made in his letter.
Commissioner Webster stated that it was his oplnion
that the mather should be held up if the Council is
working on it.
Commissioner Higgins agreed.
Commissioner Bennett felt that the planning
Commission could approve the tentative msp and then
the Council could take any action they wish at the
time the final map is submitted.
Commissioner Webster moved that the applicant be
asked for a 30 day extension of time.
Mr. Mackay of the firm Mackay & Somps stated that
his client would be happy to grant a 30 day extension
up until approximately October 14, 1957-
3. SD 42 - John Rodrigues
Commissioner Pasetta moved bhat the tentative map
SD ~2 be approved subject to all the conditions outlined

by the County Building Site Com~nittee plus an
additional (13) condition which states that no lots
to be less than lO,O00 sq. ft. in area. Carried
unanimously.
4. SDE 44 - Ernest Schmidt
SDR 44 The Administrative Assistant stated that the Health

5. SDE 45 - Charles Aldridge
Commissioner Higglns moved that this case be held

include a dimension plan of the b~llding. Carried

6. SDR 46 - Harold Jepsen
Mr. Kaemmerling of the engineering firm of George
Nolte asked the Commission whether or not the City
interpreted the 10' future street line as eliminating
land from the net acreage of a lot. He stated that
it was the County's interpretation that 'the placing of
a future street line did not eliminate the affected
land from the net acreage.
SDR 46 There followed a discussion regarding the 10' future

street line but no definite answers. was given to Mr.
Kaemmerling other than it was of the opinion that
the City followed the County interpretation but that
there was a new ordinance upcoming which would change
the City's position in this matter.
Commissioner Webster moved for approval of this case
on the basis of the following conditions:
1. Provide letter from adjoining owner accepting
runoff
2. Show 10' future street line
3- Post !~150 cash for flood control
4. The building line must be 40' from the right-
of-way line.
Carried unanimously.
Commissloner Webster moved for adjournment at 9:30 P.M. Carried
unanimously.
