ROLL CALL Present: Anderson, Crisp, Bennett, Hi99ins, Pasetta, Webster Absent: None B. MINUTES Commissioner Higgins moved that the reading of the minutes be dispensed with and that they be accepted as distributed. Commissioner Anderson seconded. Carried unanimously. II NEW BUSINESS A. WRITTEN CQ~hvKINICATIONS 1. Good Govermment Group re minimum lot size ordinance The secretary read a letter from John E. Cox, M. D., President of the Good Government Group of Saratoga. ~C-3 _ Chairman Crisp stated that there was no intent on the Min.LQt Size Ord. part of the Planning ComMission to make lots already recorded illegal. Chairman Crisp referred the minimura lot size ordinance to the Subdivision ComMittee with the request that they report back to the Commission. Commissioner Anderson suggested that Chairman Crisp ask the Mayor to appoint a member of thejCeuncil to consult ! .with the Subdivision Committee on the revision and change of this ordinance. B. ELECTION OF OFFICERS Commissioner Anderson nominated Commissioner Bennett as Chairman of the PlanniD9 ComMission. Election- aommissi6ner Pasetta moved that the nominations be closed. of Officers A white ballot was castdfor Conmlissioner Bennett. Chairman Bennett ~emmissi~ne~x~isp nominated Commissioner Webster for Vice-Chairman. Commissioner Anderson moved that the -1- nominations be closed. A white.ballot was cast for Commissioner Webster. Chairman appointed the following committee: Sub-division Committee: Crisp, Poseira, A~derson Arch~tectfiral..!and site control col~ittee: HiOgins, Webster. C. NEW ZONINO PETITIONS None III PUBLIC HEARINGS 'A, AME!iDMENT TO ZONING ORDINANCE re Private non-profit recre- ation area - Time: 7:~ Pk M. The secretary read the notice of public hearing. Mr. Walter ScoLt, Saratoga Glen Court, spoke in favor of the proposal. Non-Profit Admiral Cormally, Beaumoat Ave., stated that any area Recreation Areas that can be set aside for recreation for youngsters meets with his approval. Commissioner Poseits moved that the hearing be closed at 8:03 P. M. Co.nmlissioner Annderson seconded. Carried unanimously. Commissioner Crisp moved that the zoning ordinance be am_mended by adding to Section 33 a new sub-section to read "33.1.11 Private, non-profit recreation areas" and that it be so recommended to the Council. Chairman Bennett appointed Commissioner Crisp to take charge of the meeting with Mr. George Day and Mr. Van Den Boa in connection with the recreation area in their subdivision. B. USE PERMITS AND V. nuRIgNCES 1. v-33 - San 3ose Water Works Mr. Norman Andtaws, San Jose Water Works stated that the v-33 reservoir was to be built entirely on company property. San Jose Water Works Water would be diverted from Saratoga Creek int6 the reservoir in winter time and then let out to reservoirs further downstreaan. It will take approximately 4 years -2- to build and $400,000.' He ~tated that San Jose Water Works had been given a "permit a year ago by the State Division of Water Resources to store this water. Mr. Andrews .~nd~sDn stated that probably another dam will have to be built within the next ten years by San' Jose Water Works. Commissioner Crisp asked if the dam would be unsightly in the summer time. Mr. Andrews stated that this dam was the way to get a supply of water for expanding Saratoga. Mrs. Vogel asked i'f this was the only way of providing water. Commissioner Crisp stated that there was no assurance as to fencing, landscaping or intake. Commissioner Webster agreed with Commissioner Crisp. Chairman Bennett ordered the hearing continued until further plans are received from San Jose Water Works. 2. V-~? - S. E. Queen The secretary read t~e request for a variance. V-~7 Mr. Queen explained the reasons for a car port. B.E.Queen Mr. Morello, 18660 Devon Ave., spoke in 'favor if the variance. Mr. Ramos, 18692 Devon Ave., stated that he was not op- posed to the variance. Commissioner Pasetta moved that the variance be granted for a car port only, not to be enclosed ever, and that this not be considered as a precedent as this is a hard- ship case. Coznmtssioner Crisp seconded. The vote was as follows: Ayes: Bennett, Crisp, Pasetta, Webster. Nos: Higgins,~nderson. Carried. 3. V-~8 Z. Clyde Standard' The secretary read the request for a variance. V-~8 Z.C. Standard Mr. Standard explained the case to the Commission. Mr. GrubS, 19208 Panorama Drive, stated that he had no -3- ob3ec tion to the variance. Commissioner Crisp moved for approval. Commissioner Webster Sec6nded. Carried unanimously.- 4. V-59 - DaU Cornforth The secretary read the request for a use permit. V-59 'D.Cornforth Commissioner Webster'mo~ed for approval. Commissioner Anderson seconded. Carried unanimously. SUBDIVISION ORDINfi~CE (continued) 1. PC-4 - Subdivision Ordinance Commissioner Crisp moved'that the ordinance be sent to the City Attorney for checking of its legality and phraseology and upon ihs return it be referred back to the Subdivision Committee for readin9 in public. Com- PC-4 missloner Anderson secohded. Subdivision Ordinance Co~nissloner Webster mSved to a~mend the motion to eliminate the first par.agraph of sub paragraph A of Section 19 and substitute "all lots shall conform to all regulations of the dlstric[ in which they are located". Commissioner Anderson seconded. The original motion and seconded was then withdrawn. Commissioner Webster moved that this ordinance in its presently revised form be sent to the,jSity Attorney for necessary wording chan~es, 'and that lines 1 through 16 of Section 19 be deleted and the following be'substitu'ted for the deleted portion: "All lots shall conform to all regulations of the zoning district tn which they are lo- cated." Commissioner Webster moved for approval of the tentative map subject to the followin9 condiflons: 1) Provide survey. 2) Pay $150.00 for drainage. 3) Septic Health Dept. system to meet with approval of county/office. Carried unanimously. 2. SDR 58 - A. Bogart The secretary read the'conditions set by the subdivision SDR 58 committee of the county planning commission at their A. Bo0art meetin9 of February 4"1958- Commissioner Webster moved for approval of the tenative map subject to the followin9 conditions: 1) Pump and fill septic system, subject to jCounty Health Dept. specifications. 2) D~ed widenin9 of road. -3) Provide $150.00 for drainage.
