Commissioner Anderson. moved that the reading of the minutes
be dispensed with and that they be accepted as distributed.
Commissioner Higgins seconded. Carried unanimously.

The acting secretary read from the City Council
minutes of March ~, 19~8 wherein Mayor Brazil directed
that the Planning. Coamission be asked to study stock
corporation type Of recreation areas.
Chairman Bennett referred the letter and the dir-
· ective from the City Council to the subdivision
commi tree.

Recreation The ac'tin'9 secretary explained the petition of Mr.

Maggiore for a change of zoning from R-1B2 to
R-Z[H BD for three and one half acres at the North-
westerly corner of Cox and Saratoga Avenues and
then read Exhibit C of the application for rezoning.

Mr. Wade Hover, San Jose attorney for Mr. Maggiore
s'tat~d that the pians submitted for 56 units of
multiple dwellings were strictly proposals and were
Su~'j'ect to change'if the Zoning was changed for the
area. He stated further that there was a need in
Saratoga for more. multiple dwellin9 zoning. This
particular piece of property woul'd be difficult to
do anythin9 else with because of its location at a
busy .intersection:
Mr. Walter Wagner, 19063 Cox ~.ve., stated that he
felt this zoning Would not increase value but decrease
Mr. Jo'e ~Shertey, 19095 Cox Ave., said he was opposed

to the rezoning b~cause o'f the hi9h class residential
neighborhood that'was already located there. He
felt-that 56 apartments were too many and would add
to the safety hazard at the inter~ection.
Mr. E. Van der Boa, Sarato9a Glen Court~ opposed the
-rezoni~g. He felt that the land could be used for
one family residences.
Commissioner Crisp stated that in the !and use policy
set by the City Council it stated: 1. No down
9radin9 of present. zonin9. 2~ Multiple family
residential uses Should be' confined to areas within
a reasonable walkin9 distance of commercial areas.
He alSo'added that this would be a case of spot
zonin9 and that it would be better to consider it
alon9 with the 9e~eral m~ster plan.
Attorney Hover was agreeable to this proposal.
CommissiOner Crisp moved to deny the rezoning without
"prejudice. Commissioner Passerrs seconded. Carried
' unanimously.

Graham- The acting secretary explained that this application
was referred to th.e County Planning Department for
their recommendation at the last meetin9. A letter
from 'the County Planning Department dated March 10,
1958 in which co~m'ents were made on the off Street parRin9
problem and crowding'of buildings on the one parcel
was read, .Mrs, Graham explained the re'queSt for
movin9 the buildin'~.
Commissioner Webst2r. asked if the actual length of
the building was not.~0t rather than 32' as shown on the
plot plan,
Mrs, Graham agreed that this was so and that part of
the buildin9 would have to be cut off. Commissioner
Hi99ins, Chairman of the Architecture & Site Control
Committee, stated that he agreed with the County
recom~me~d at i on s.
Comiissioner Hi99ins moved to deny the request..
Commissione~ Webster seconded. Carried unanimously.

The acting secretary stated that the County Health
Department had put'no cond'f'tions on ~he buildin9 "
site approval application,
Mr. Sweany, County.Engineering Department, had con-
tacted the City Office by phone and 9iron the follow-
ing conditions to be set on this property: 1. 18t
widened roadway from Pike Rd, to the buildin9 site,.
minimum standard, 2. Record Sf survey, ~, $i50
per building site for flood control fun~o
