Report of Findings - C 12 - Ma99tore ~agglore The Secretary read the Report of Findings and Reso- lution C-12-2-Ao Commissioner ~ehster moved for adoption of the Reso- lution. Commissioner Anderson seconded° Carried unanimously. B. ~i) 6~ - ~andemere - re Condition #9 SD 6~ 'The Director o£ Public ~orks stated that in ~lscussing ~andemere Condition #9 with the CountyEngineers the figure of $10,000 was set ~or the construction of a box culvert. Reed - V 66 V 66 The Secretary read the request for a variance, Mr, Reed stated that he wished to add a service porch to his home which is a non-conforming use as it is within 12~ feet of the side line and should be 20 feet, After a brief discussion amon9 the Comissioners Commissioner Pasetta moved for 9ranting the vari- ance. Commissioner Tiffany seconded. Carried unanimously. Dan Cornforth 2. Dan Cornforth - V 67 V-67 ~he Secretary read the request for Use Permits on 3 lots and Variances on 2 lots. Mr. Cornforth stated the reasons for his request and stated that he wished the variance on lot to read, "From required 25s rear yard setback to la'", instead of, "From required 20s rear yard setback to 18t". Commissioner C~isp moved for approval or the re- quest as amended. 1. Use Permits on lots 17, 18, and 19 2. Variance on lot 17 as ~uended above. Variance on lot 18 - 25e rear setback to 6e rear set- back as shown on plot plan. Co~aissloner H199ins seconded. Carried unanimously. E.A, Nancinl 3. E, A. Nancini - V 68 The Secretary read the request and his report dated ~arch aT, 19~8. Mr. Mancini stated that he agreed with the report. Admiral Crisp moved for approval of the variance subject to requesting Mr. Mancinl to apply immedi- ately for a change of zoning. Commissioner Ander- son seconded. Carried unanimously. The"Se~retary explained that although building site approval had been applied for on this piece or property, it had not yet been reported on by the County subdivision committee. Therefore the Chairman ordered the hearing on the variance con- tinued until April 28, B. USE PFJ~IIT~ S,J,Water 1, San Jose Water Works - V 33 Works V 33 The Secretary s~ated that this use permit applica- tion was being continued from theApril 14th meet- lug, The Director of Public Works stated that 4,000 ~f fence would be required to fence the dam and a chain link or Anchor type fence Would cost approxi- mately $12,000. Commissioner Webster stated that he had personally surveyed the dam site. After a brief discussion of types of fencing and plants suitable for the dam area, Commissioner Anderson moved for approval of the use permit sub- ject to the following conditions: 1) Planting of native shrubs on the fence line and planting of approved type shrubbery on the doklnslope surface of the dam to cover scars. 2) 5e post and ~ strand barbed wire fence to/~:intained in perpetu- ity in good condition around the dam. Commissioner Webster seconded. Carried unanimously. V.D. Demarest a. V. D. Demarest - V 70 V70 The'Secretary read the request for a use permit. Mr. Demarsst stated the reasons and need for such a recreation area in the Brookview subdivision. In answer to a question from the Commission, Nr. Nay, architect, stated that there was parking space rot 55 cars, The Secretary read letters from the following, in favor of granting the use permit: Nrs, Carfie Rogelstad, Nr. and Nrs. Alfred E. Haltsman, 12541 Brookglen Drivel Mr. and Mrs. L. D. Oibson, 12546 Palmtag Drivel Mr. and Mrs. T.'Lendeland, 12512 Brook Glen Drivel Mr. and Mrs. B. Earl Lewis, 12529 Brook Glen Drivel Mr. and Mrs. Frank Lindsay, 125~0 Brook Glen Drivel Mr. and Mrs. Seymour Crroner, 12553 Brookglen Drive. The Secretary read a petition against granting the use permit signed by: Nr. and Nru. P. W. Cochran, Nr, and Nrs, H, L, Wilson, Richard Schnoor, Bea- trice Schnoor, JUliette N. Parfish, Nr. and Nrs. Ko Engelson, Nr. and Nrs. Franklin A. Packard, Nr. and Nrs. D. Lo Hughes, Nr. and Nrs. O. Hill, no addresses.' After a lengthy presentation by both proponents and agpons~slivlng in the immediate neighborhood of the proposed recreation area, Chairman Bennett suggested that both the proponents and the opponents should check the list of property owners submitted with the application for its accuracy. The following members o£ the Brookside Club presented their views on the need for a recreation area of this type in their area= Mr. and Mrs. B. G. Cameron, BrookGlenDr., Mr. and Mrs. R. Foster, Woodside Dr., p~r. and p~rs. W.R.McMahon, Brook 61en Dr. ~r. K. Engelson, 1256l~ Brook Glen Dr., stated that he is objecting because the recreation areaSs only approach is from Cox Ave., 1½ miles from the Brookview tract and this would probably lead to children taking a shortcut through private property. Hughes, la/~33 Brook Glen Dr., Mr. Cox, owner of property adjoining for 1,200 ft. Connnissioner Pasetta asked If a recreation area had been promised by the subdivider. p~r. Engelson~ salesman for the tract, replied that the subdivider had been willing to set aside ~ or 4 lots for later development by the homeowners as a recreation area but dropped the plan when p~r. F. ngelson advised him that a poll of the property oknners showed no interest. p~r. Fagin, Brook Glen Dr., questioned the matter of fencing. p~r. L. B. Gibson, 1~J~56 Palmtag Dr., stated that the area was no longer rural. Mr. Wilson, Palmtag Dr., stated that he had no objection to the activity but ~elt that access from Brookvlow should be restricted. Commissioner Webster asked that the proponents work out a street pattern showing the location of streets and homes in the immediate area. Chairman Bennett stated that inasmuch as Ord'in- ance 3-A-6 does not become effective until April 19, 19~8, this use permit application cannot be acted upon, therefore the public hearing would be continued until the April 28th meeting, and ref- ferred the application to the subdivision commit- tee for a report at that time. W. A. Meyer 3. W. A. Meyer - V 71 V 71 The Secretary read the request for a use permit for a Country ClUb and read the description of 'the facilities filed with the application. Mr. William A. Ingrham, San Jose attorney, stated that an option had been take~ on the property but no survey has been made yet. L. Crawford, owner of property adjoining on northern portion on Prospect Rd. stated that he felt more detailed plans as to the members of the corporation and its by-laws should be submitted. In answer to a question as to water ran-off from ~he property, the Secretary stated that building site approval must yet be obtained on this property and at that time conditions would be set to take care of any water problems, Chairman Bennett stated that he would like to see the property In question and Mr. Meyer agreed to meet with him and any other Commissioners who are able to be present at the City Hall in Saratoga at Thursday, April 17th and to take them to'the said property. Chairman Bennett continued the public hearing to the April 28, 1958 meeting. IV lt~ BUSINESS A. WRITT~ C(I~IUNICATIONS None B. PLACEMENT OF ELECTRIC POLES - Tract i'690 Electric Poles The Secretary explained the subdividers wt~h to Tract 1690 place poles on the rear of lots in Tract #1690, After a brief discussion by Mr. Dempsey, ~he sub- divider, and the Commissioners as to 'the pole placement in the adjoinin9 subdivision, Merrivale, Commissioner Pasetta moved that the rear pole line plan be approved? Commissioner Tiffany seconded. The followin9 votes were cast: Ayesl Anderson, .Bennett, Crisp, Hi991ns, Pasetta, Tiffany. Webster, who stated thai the reason for his vote was that he felt that the Merrivale subdivider should have been notified of the pending action, C. ORAL PETITIONS None V COM~ITTEE REPORTS A. SUBDIVISION James 1. James Barnett - ~ 56 Barnett ~I) 56 The Secretary expiained that a new tenative map had been submitted on April 8, 1958. The original tenative map had been approved by the Planning Com- mission on January 27, 1958. Jack Cuzia, Mackay & Somps engineer, explained that the property owners wished to leave out part or the property and develop it later. After a brier discussion among the Commissioners as to inadequate design, Connnissioner Pasetta moved that the application be rejected. Commis- sioner Anderson seconded. Carried unanimously. B. ARCHITECTURAL & SITE CONTROL P. Jackson 1. P. Jackson - The Secretary submitted the final plans for the Cottage Care to the committee. Commissioner H1991ns moved that the plan be 91yen architectural and site control approval on condi- tion that the parking area and access driveway be conformed to strictly as sho~n on the site plan sheet #I. Commissioner Webster seconded. Carried unanimously. A.A. 2. A. A. Dampsay- V 65 Dampsay V 6~ The Secretary submitted the final plans for the accessory building. Commissioner Biggins moved that architectural and site control approval be 9ranted for the plans as submitted. Commissioner Crisp seconded. Carried unanimously° Planning Mr. Lawrence Livingston, Planning Consultant for Consultant introduced. the City of 5aretoga was introduced to the Planning Commission. He 9ave a short resume of the Planning projects at hand and his plans for dealing With them. Commissioner Hi99ins moved that the Secretary be directed to ask for the City Council approval of a time schedule for land use ordinances as follows: Schedule 1. Ninimum lot size ordinance. for land use ordi- 2. Subdivision ordinance nances ~, eeneral plan, 4- Zoning regulation ordinance and that the Secretary be further directed to secure authorization of the City Council for Nr. LIvingston to proceed with the preliminary steps in the 701 program, Commissioner Webster seconded. Carried unanimously. Subdividers The Secretary stated that there had been numerous signs complaints about the size and number of subdivi- darts signs in the City of Saratoga, ~any sub- dividers have expressed interest in the new sign ordinance and would like to consult with the City about the signs.
