MINUTES Commissioner Anderson m6ved that the minutes he approved as written and distributed. Commissioner Pasetta seconded. Carried unanimously. II PUBLICiHEARINGS A. ZONING CHANGES 1. H. E. Gamel - C-1t C-lh. Commissioner Anderson of the Subdivision ComMittee reported H-E. Gamel that in the opinion of the Committee it would be imprudent to pass on this particular application for zoning at this time until the Planning Consultant has completed the Interim Plan. Mr. Dan HuttlinGer of the Blue Hills Realty spoke on behalf of t~e proponents for the application urging immediate action. Commissioner Anderson moved that the application be denied without prejudice. Seconded by Commissioner Pasetta. Car- ried unanimously. B- VARIANCES 1. Donald W- Scoble - V-90 V-90 The following individuals spoke from the floor against the B.W- Scoble request for this variance: Ernest Lawson, Bonnie Brae and Mendelssohn Lane M. White - Bonnte Brae and Mendelssohn Lane L. F. Weisler, 20161 Hill Ave. C. E- McClelland, Bonnie Brae Way -1- Margaret Dennis, 20201 Hill Ave. Edison Brock, 20120 Mendelssohn Lane Dr. G. T. Nordin, 20191Bonnie Brae Way. Commissioner Anderson moved that the variance be denied. Seconded by Commissioner Crisp- Carried unanimously. 2- R. & B. Development Co. - V-91 V-G1 Commissioner Pasetta made the followin~ motion: R-& B- Develop- 1) The variance in connection with Lot 58 as to the front ment Co. setback be approved as shown by the red line on Exhibit A dated 7/14/58 be approved. 2) The variance for front and rear setbacks on Lot 71 as shown by the red line on Exhibit A dated 7/lh/58 be approved. Seconded by Commissioner Crisp. Carried unanimously C. USE PERMITS 1. Prince of Peace Lutheran Church - V-92 OJd 2/_~?/~} b~/~/~x- V-92 Prince The following persons spoke from the floor on behalf of the of Peace Lutheran application for the Use Permit: Church W. E- Munt~, Secretary of the Church Council John Barnard, 19006 Brookview Drive. After some discussion Chairman Bennett dtrected that the Public hearing be continued to 7/28/58. III COMMITTEE REPORTS A. SUBDIVISION COmmITTEE 1. James Barnett - SD-56 SD-56 Commissioner Anderson moved that the tentative map be approved J. Barnett subject to the following conditions: 1) Complete improvement plans and specifications to be ap- proved by the County Engineering Department before re- cording of final map. 2) Grade lots to drain into streets in a manner acceptable to the Engineering Dept. 3)Streets to be paved with a minimum of 2½" plant mix -2- surfacing on a minimum of 6" base material. Actual thickness requirements to be determined by County Engineer. The developer must provide satisfactory storm drainage facilities as required by the Engineering Dept. 5) Provide: Concrete vertical curbs, gutters; and con- crete driveway approaches. 6) Design of the geometric sections and other construction of all proposed and existing streets shall conform to the prevailing standards of the Engineering Dept. In cases of critical topography, special requirements may be im- posed by the Engineerin9 Dept. for street construction, driveway design, lot grading, etc. 7) Final.map not to be recorded until (a) adequate sanitary sewer bond is posted; (b) plans and specifications for sanitary sewers are approved by Sanitation District No. 4- 8) Existing wells to be sealed to satisfaction of Health Dept- prior to recording final map. 9) No occupancy of otherwise completed houses permitted until (a) dsable sanitary sewer is available; (b) public water system approved by Health Dept. is available. 10) Existing dwellings to be connected to sanitary sewer. 11) Septic tank systems to be pumped and filled to Health Dept. specification. 12) Each lot to contain no less than 10,000 square feet. 13) Minimum width at the building line to be 85 feet. IS) Improvements on Quito set per 60 feet right of way (30 feet from centerline). 15) Dedicate 45 feet from existing centerline of Quito within subdivision limits. 16) Secure deed from Schibler for 10 foot widening of Qutto and improve same. 17) Lot division to conform to map_filed with Planning Com- mission June 20, 1958- 18) Loquat Court be entirely improved to the specifications set forth. Seconded By Commissioner Pasetta. Carried unanimously. 2. James Millikin - SDR-72 SDR-72 Commissioner Anderaon moved that the tentative map be ap- J.Millikin proved subject to the following conditions: I) Improve access to Pierce Road to 18' minimum width as required by County Engineer. 2) Record survey. 3) Provide $150-00 per lot Flood Control fee. Seconded by Commissioner Pasetta. Carried unanimously. 3. Walter Borer - SDR-73 SDR-73 Commissioner Anderson moved that the tentative map be ap- W.Borer proved subject to the following conditiQns: 1) Submit satisfactory Site Development Plan to County Health and Engineering Departments. 2) Record Survey 3) Provide $150-00 per lot Flood Control fee. 4) Comply with Flood Control requirements on natural channel. Seconded by Commissioner Tiffany. Carried unanimously. 4- Leland Fry - SDR-74 SDR-74 Commissioner Pasetta moved that the tentative map be approved L-Fry subject to the following conditions: 1) Provide $150-00 per lot Flood Control fee. 2). Record Survey Seconded by Commissioner Anderson. Carried unanimously. 5. F. L. Calktns - SDR-75 SDR-75 Commissioner Anderson moved that the tentative map be ap- F.L.Calkins proved subject to the following conditions: 1) Submit satisfactory Site Development Plan to County Health and Engineering Depts. 2) Comply with Flood Control requirements on Calabazas Creek. 3) Relocate driveway away from road intersection. He moved further that the matter of providing $150.00 per lot Flood Control fee be clarified by the Secretary's office. Seconded by CombatssiGner Pasetta. Carried unanimously. 6. Argonaut #5 - SD-76 SD-76 The Clerk read a letter dated July 14th from the ArGonaut At9onaut #5 Company by J. S. Lodato in which a 9rant of an extension of the tentative subdivision map of Argonaut Place, Unit No. 5, for a period of thirty days beginnin9 July 2A~, 1958 to August 23, 1958~ was made. Chairman Bennett ordered the matter continued. B. ARCHITECTURAL &SITE CONTROL 1. Sidney A. Austin - V-93 V-93 This matter was referred to the Architectural & Site Control S.A.Austin Committee, two of whom were not present at the meeting. 2. A- A- Dempsey - V-94 V-9~ This matter was referred by the Chairman to the Architectural A.A-Dempsey and Site Control Committee and continued until the next meeting. IV PETITIONS A~ND GRIEflANCES A. WRITTEN COFAMUNICATIONS Saratoga 1. Saratoga Union School District re Fencing by Developers Union School re A letter dated July 1,'1958 from V~nce S- Gar~od, Chairman Fencing of the Saratoga Union School District was read by the Clerk. Chairman Bennett directed the'Clerk to file said letter. V NEW BUSINESS 1. Minimum Lot Size Ordinance Minimum Commissioner Anderson moved that Resolution # PC-3-2 Being A Lot Size Ordinance RESOLUTION PROPOSING AMENDMENT TO ZONING ORDINANCE AND DIRECTING SECRET/RY TO SET TIME AND PLACE FOR PUBLIC ~{F~RINGAND 6RDERING NOTICE OF HEARING PUBLISHED be approved. Seconded by'Commissioner Pasetta. Carried unanimously. 2. Swimming Pool Ordinance Swimming The Secretary stated that at a recent study session the Pool Ordinance Planning Consultant suggested that the City consider a separ- ate swimming pool ordinance and along these lines copies of ordinances of other cities covering this subject were sent to the various Planning Commissioners. Chairman Bennett referred this matter to the Subdivision Committee. 3. Off Street Parking Ordinance Off-Street The Secretary stated that at a recent Planning study session Parkin9 the Planning Consultant had suggested that the Commission immeaiately consider an off-street parking ordinance for residential areas. Copies of the City-of Newark Ordinance furnished by the Planning Consultant to the City were sent to the Planning Commissioners for study. Chairman Bennett referred this matter to the subdivision committee. interim and Emergency Ordinance 3A-~ Interim The Clerk informed the Commission that a interim and Emergency Emergency Ord. 3A-~ Ordinance 3A-~ had been passed on the 17th day of July, 19~7, and. stated that it was the opinion of the legal department that an immediate study should be made by the Planning Com- mission for the purpose of creating permanent regulations for those districts formerly zoned A-1 and A-2. Chairman Bennett referred this matter to the subdivision committee for study and consultation with the Planning Consultant. Commissioner Pasetta moved for' adjournment at 9:~ P.M.
