TYPE: Regular Meeting ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Crisp, Bennett, HiSgins, Pasetta, Tiffany, Webster B. MINUTES Commissioner Anderson moved that the minutes be approved as distributed. Commissioner Pasetta seconded. Carried unanimously, PUBLIC HEARINGS A, V~.RIANCE5 I, V-10? - Bill Powers V-IO? This was a request for a variance from 22~ required rear B.Powers setback to 10' on lot 23, Tract 1938. Mr. Lee Brandenberg of Country Squire Estates represented Mr. Powers and spoke in favor of the variance. Commissioner Pasetta moved for granting of the variance. Seconded by Commissioner Crisp. Carried unanimously. B. USE PERMITS 1. V-lOS - V. Bittner V-108 This was a request for a use permit for the operation of a V.Bittner rest home located at Mr. Eden Road on the West side of Pierce Road. Mr. V. A. Bittner, the applicant, spoke in favor of the use permit. Opponents of the use permit were: Mrs. Jan Keller, Pierce Rd., Mrs. W. A. Thomas, Via Regina Rd., 3ohn Baker, Mt. Eden Rd., Mr- H. E- Bailey, Mr. Eden Rd-, Mr. W. A. Thomas, Via Regina, Mrs. Redd, Via Regina, and Mrs. Ray, Mt. Eden Rd. Commissioner Pasetta moved for denial of the use permit. Seconded by Commissioner Anderson. Carried unanimously. -1- 2. V-b7 - Saratoga Cooperative Nursery V-47 The Secretary read a letter dated October 4, 1958, from Saratoga Coop. Mrs. Helen Cameron, President of the Saratoga Cooperative Nursery Nursery School, in which they ask for a renewal of the use permit granted October 14., 1957. Commissioner Crisp moved that a hearing be se~ for October 27, 1958 to cover the renewal of the use permit and that the usual payment of the $20.00 for use permit application be waived in this case. Seconded by Commissioner Hi99ins- Carried unanimously. III N~,I BUSINESS A. CHANGE OF ZONING I. C-15 - G. B. Steinberg C-15 This was an application for a change of zoning for property G.Steinberg in the vicinity of the Saratoga Creek off Highway #9 from R1-BD6 to luxury 9arden .~partments Th~ Chairman directed the Secretary to set a date for hearing and the date of November 24, 1958 was suggested. At the same time the Secretary was directed to refer the matter to the Planning Consultant- IV COI~ITTEE REPORTS A.ARCHITECTURAL k~ SITE CONTROL None B. SUBDIVISION CO~ITTEE 1. SD~81 - Glenbrook #2 SD-81 Commissioner Pasetta moved that the tentative map be approved Glen- Brook subject to the followin9 conditions: #2 1) Complete improvement plans and specifications to be approved by'the Coun%y Engineerin9 Department'before recording'~f final map. 2) Grade lb'ts to drain into streets in a manner acceptable to the Engineering Department. 3) Provide 1 foot reservations, also P.U.E. vs as approved by -2- P. G. & E. 4) Streets to be paved with a minimum of 2 1/2" plant mix surfacln9 on a minimum of 6" base material. Actual thickness requirements to be determined by County En~ineer- 5) The developer must provide satisfactory storm drainage facilities as required by the Engineertn~ Department. 6) Provide: 1. Concrete vertical curbs,'gutters and con- crete driveway approaches. 7) Design of the geometric sections and other construction of all proposed and existin9 streets shall conform to the prevailIn9 standards of the Engineering Department. In cases of critical topography, special requirements may be imposed by the Engineerin9 Department for street construction, drive- way design, lot 9fading, arc- 8) Final map not to be recorded until (a) adequate sanitary sewer'bond is posted (b) plans and specifications for sani- tary sewers are approved by Sanitation District No. 4' 9) Glen Brae Drive be extended, paved and improved, to within 1 foot gf the tract~s westerly boundary. The most westerly 1 foot of Glen Brae Drive be deeded to the City of Saratoga, the deed to be held in escrow by the California Pacific Title Company; the deed to be recorded upon the pay- ment of $4300-00 to the R. & B- Development Company by the adjoinin9 property owner to the west. 10) Improvements on Ramsay Drive to be removed and replaced as required by County Engineer. 11) Saratoga Creek improvements to conform to requirements of Santa Clara County Flood Control District, as originally approved 9/6/56. 1~) Protective planting on hillside cuts will be necessary. 13) Test by laboratory to set angle of repose in steep slope area. -3- 1~) Floo~ Control fee $150.00 per lot less costs of in-tract facilities and requirements of Flood Control District for improvement of Saratoga Creek- 15) Extend trunk storm drain from back lot lines Lot 55-56 as required by County Engineer. Seconded by Commissioner Webster. Carried unanimously. Commissioner Pasetta strongly recommended to the subdivider that lots 188, 189 and 190 be set aside as a recreational area to be used by the people living in the subdivision and owned by them. V PETITIONS ~ND 6R!EV~YCES A. WRITTEN CO[~NICATIONS None None VI OLD BUSINESS A. ORDINANCES Sub- 1. Subdivision sign ordinance div. Sign Commissioner Webster moved that the following qhanges be Ord. made in the o~dinance as proposed. In Section 3.1 (A) 2, the paragraph should read as follows: Signs placed parallel or at an angle to a street on which a subdivision abuts shall not exceed 60 square feet in size, save and except that the signs placed parallel may have advertising on one side only and signs placed perpendicular may ha~e advertisin9 on two sides. Signs placed diagonally to such street may have two signs joined to0ether to form a 90° angle but neither sign shall exceed 45 square feet in size. Commissioner Webster moved for approval of the ordinance as corrected. Seconded by Commissioner Higgins. Carried unanimously. At this point Commissioner Hi~gins moved that Section 3.1 (C) 2'be chanOed'to read: No more than two such off-tract subdivision directional signs shall be allowed for each indi- vidual subdivision, and each sign shall not exceed in size. Seconded by Commissioner Pasetta. The motion to correct the ordinance to the extent noted above passed unanimously. Commissioner Webster moved that the matter be sent to the 'Council for handlin9 with the recommendation of the Plannin9 Commission. Seconded by Commissioner Hi99ins. Carried unanimously. 2. Off Street Parking Ordinance Off Street In a review of the ordinance the following corrections were Parking Ord. advised: Section 1, (7) should read: Dwelling, Multiple a building or portion thereof used and/6r designed as a resi- dence for two or more families living independently of each other and doing their own cooking in said building, including apartment houses and flats. Section 1, (9) should read: Gross Floor Area - The total horizontal area in square feet on each floor within the exterior walls of a structure but not including the area of inner courts or shaft enclosures. Section 2.1 d. should read: SCHOOLS AND COLLEGES including public, parochial and private elementar~ and high schools, kindergartens and nursery schools - One space for each one employee, including teachers and administrators, plus suffi- cient space for safe and convenient loadin9 and unloading of students. Where needed, additional spaces for student parkin9 may be prescribed by the City Plannin9 Commission. Section 2.1 e. should read: BUSINESS, PROFESSIONAL AND TRADE SCHOOLS and colleges, art, craft, music and dancing schools One space for each I employee, including teachers and admin- istrators. Where needed additional spaces for student parkin9 may be prescribed by the City Planning Commission. Section 2.1, 1., should read: That neither present nor anticipated future traffic volumes generated by the use of the site or uses of sites in the vicinity reasonably require strict enforcement of the requirement- Section 2-1, 3., should read: That reducin9 the number of spaces will not create a safety hazard or any other condition inconsistent with the purposes of this ordinance. In no case shall less than two parkin9 spaces be provided for a use specified in paragraphs c through q. In Section 2.4-, after 9., this should be inserted: The City Plannin9 Commission may reduce the number of berths required if the Commission makes the following findings: 1. That neither present nor anticipated future traffic volumes generated be the use of the site or the uses of sites in the vicinity reasonably require strict enforce- ment of the requirement. 2. That reducing the number of berths required will not result in the parking or loadin9 of vehicles on public streets in such a manner as to interfere with the free flow of traffic on the streets. 3. Flat reducing the number of berths will not create a safety hazard or any other condition inconsistent with the purpose of this ordinance. The City Attorney, in a communication dated 10/10/58 advised the following additions and corrections in the proposed ordinance: The followin9 language should be used at the start of the ordinance: "WHEREAS, it appears necessary to require the provision of and for off-street parkin9 and loadin9 facilities incidental to new land uses and 'to major alterations and enlargements -6- of existing land uses, in order to progressively e~eviate and prevent traffic congestion and shortage of curb spaces and on street parkinD facilities, and W..~FEREAS, it becomes necessary in order to protect the public health, safety and morals to require existing and future uses which by their nature attract additional vehicular traffic into the City of Saratoga to provide adequate off-street parking in reasonable proportion to anticipated and actual increase in City traffic and parkin9 attracted by said facilities, and in order to help insulate adjacent land uses from the impact of such increased vehicular traffic and parkin9, Ng~i THEREFORE, the City Council of the City of Saratoga does hereby ordain as follows:" After Section 2.10, Section 3 should be started and Section 3.1 should read: "This ordinance shall be subject to all of the penalty and enforcement provisions of Ordinance No. 11 of the City of Saratoga." Section 4, OONSTITUTION.4LITY Section 4.1- If any section, subsection, sentence~ clause or phrase of this ordinance is for any reason held by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining.portlons of this ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, sub- sections~ sentences, clauses or phrases be held invalid oF unconstitutional. This ordinance was regularly introduced and after the waiting ....... period required by law was thereafter passed and adopted -?- .this day of , 1958, at a regular meeting of the City Council of the City of Saratoga, by the following vote:" Commissioner Higgins moved that the off-street parkin~ ordi- nance as proposed and with the corrections and additions suggested by the Planning Commission as listed above plus the recommendations of the City Attorney be approved by the Planning Commission and passed on to the City Council for further action. Seconded by Commissioner Anderson. Carried unanimously. 3- A-1 - A-2 Rezoning. A-1 - The Secretary read a letter dated october 6, 1958 from the A-2 Rezoning City Attorney in which he stated he was enclosing a suggested ordinance to cover this matter. The Chairman directed the Secretary to refer this letter to the Subdivision Committee ~no will meet with the Planning Consultant and the City Attorney on 10/21/58 for further discussion, after ~nich conference the matter will be referred back to the Planning Commission for further discussion and action. The Secretary exhibited a tentative map submitted by Mr. George Day covering the 55 acres of a proposed subdivision on Sara[oga Avenue near Fruitvale and he was directed to refer the matter to the Plannin9 Consultant in addition to sendin9 it along through the usual channels in the Count~. Review of The Planning Commission expressed an opinion that a review filing fees should be made by the Council of the filing fees and other fees in connection with the handling of tentative subdivision maps- Commissioner Higgins moved for ad3ournment.
