Minutes Commissioner Higgins moved that the Minutes be aonroved as distributed. Commissioner Pasetta Seconded. ~ arried Unanimously. II PSBLIC HEARINGS A. Use Permits and Variances V-111 1. V-111 - Jean Murdock Jean Murdock The secretary read the application for a use permit and variance for a side set-back of 8 feet for a second story addition to a present garage instead of the required l0 foot side set back. Mr. Murdock presented a petition signed by 18 neighbors stating that they had no objection to the application. Commissioner Webster moved for approval of the applica- tion. Commissioner Higgins Seconded. Carried Unanimously III OLD BUSINESS V-104 A. V-104 - Santa Clara Sand and Gravel Co. Santa Clara Sand & Gravel Commissioner Webster stated that after intensive study the committee appointed to report on this use permit re- commends a meeting of this committee, a representative of the City Council, the City Attorney and the applicant and his attorney to discuss possible conditions to be set on the use permit. -1- TJSE PERMIT CoMmissioner Higgins moved that the planning Commission V-104 authorize such a meeting. Commissioner Pasetta Seconded. Carried Unanimously. Chairman Bennett stated that a notice of the time and place of this meeting would be sent to the newspapers although it is not a public hearing. B. SUBDIVISION ORDINANCE The City Administrator explained Ordinance No. 5 A ORD. 5A setting a new fee schedule to be paid by the Subdividers which was passed by the City Council on November 5, 1958. At the same meeting the City Council directed that the Planning Commission go to work on a subdivision ordinance for the City immediately as the new County subdivision ordinance is not suitable for adoption by the City. Chairman Bennett referred the matter to the subdivision committee and directed that it be put on the agenda for every meeting for a report. IV NE~,! BUSINESS A. Permitted Uses in H-1 Zonin~ districts H-1 Zoning The City Administrator explained the passage of Ordinance 3A-9 on November 5, 1958 by the City Council limiting uses in H-1 zoning districts, the ordinance to be in effect for 90 days or until the adoption of an amendment to the existing zoning ordinance controlling H-1 zoning districts regulations, whichever is the first in time to occur. The City Council also indicated that a study should be made by the Planning Commission of all uses permitted under various zoning districts. Chairman Bennett referred the matter to the subdivision committee. V COMMITTEE REPORTS A. Architectural and Site Control 1. V-110 - Pat Bucaria V-110 Pat Bucaria Mr. Bucaria presented his plan to the Commission and after discussing the lack of off-street parking, Commissioner Hlggins moved for denial of the application. Commissioner Anderson Seconded. The following roll call vote was recorded: AYES: Anderson, Higgins, Bennett NOES:. Pasetta, Tiffany, Webster ABSENT:. Crisp The motion did not pass. Commissioner Webster moved to set the matter over to the next meeting. Commissioner Pasetta Seconded. Carried Unanimously. Bo Subdivision Committee 3. SDR - 89 - Brookside Club SDR - 89 Brookside Club, The Secretary read the conditions as set by the building site approval committee on November 6,1958: l) Flood Control fee of $675. per acre 2) Provide acceptable wat~~ supply for domestic purposes. 3) Comply with flood control requirements for Saratoga Creek. 4) Record survey of property. 5) Construct access road of minimum width 18 feet from Cox Avenue to property improved with a minimum of 4 inch base rock surfaced witha minimum of 2 inch plant mix surfacing (Option of oil and screenings surface). After discussion of the conditions by the Commission, SDR 89 Mr. Demarest and Mr. William May, architect for the Club, Brookside Club' Commissioner Pasetta moved for approval of the tentative map subject to the following conditions: l~ Flood Control fee of $675. per net acre.less In-Tract Drainage. 2) Provide acceptable water supply for domestic purposes. 3) Comply with flood control requirements for Saratoga Creek, 4) Record survey of property. 5) Construct access road as shown on ~xhibit "A-l" s~bmitted ~0/29/58 improved with 6 inch base and Class B double seal to the full width of the easement. 6) Deposit a bond ~xith the City for half the improvement cost of the future extension of Brook Glen Drive for a distance of 443.65 feet. Higgi~s Commissioner/Seconded. Carried Unanimously. A. 'Architectura~ and Site Control Committee (Continued) V-112 2. V-112 - Brookside Club Brookside Club Mr. William May, architect for the club submitted further drawings. Commissioner Higgins moved for acceptance of the new plans as submitted. Commissioner Pasetta seconded. Commissioner Webster moved to amend the motion making the acceptsrice subject to submission of further plans showing 60 vehicle parking places and any reasonable scheme of outdoor lighting. Commissioner Tiffany Seconded. Carried Unanimously. The vote was taken on the original motion. Carried Unanimously. 3. V-114 - Samuel F. Tyler Mr. Tyler e~lalned his application for approval of V-114 S. F. Tyler a sign on a store in the commercial district. Commissioner Webster moved for approval of the application. Commissioner Tiffany Seconded. Carried Unanimously. The City Administrator e~lained that under the present ordinance a $20. fee is charged for all applications for architectural and site control permits and that it seems inequitable that permits for signs should have to pay this $20. fee. A. & S.C. Commissioner Higgins moved that a recommendation be sent Permit fees to the City Council that the fees on architectural & Site Control permits for signs be changed to $5.00. Commissioner Anderson Seconded. Carried Unanimously. B~ Subdivision Committse (Continued) 1. SD - 87 --George Day SD-87 George Day The Secretary read a letter dated Nov. 7, 1958 from Mr. Day asking for a continuance of 30 days. Commissioner Webster moved to grant the continuance. Commissioner Anderson Seconded. Carried Unanimously. 2. SDR-88 - J. W~ Lynch SDR-88 The Secretary read the conditions as set by the Sub- J. W. Lynch division Committee at-their meeting of Oct. 30, 1958. Mr. Lynch discussed with the Commissioners condition #3 namely "Improve Foothill Lane to 18 foot oil and screenings from north line of site to Pierce Road", The Assistant City Attorney recommended that this con- dition could be left out since a bond had already been posted with the City for this same work by a previous applicant for building site approval, namely Mr. Pen- dergraft, SDR - 66. Commissioner Anderson moved for approval of the ten- SDR -88 tative map subject to the following conditions:. J. W. Lynch l) Install culvert under Foothill Lane and dedicate 15 foot drainage easement between common lot line of lots bordering on the creek. 2) Provide $300. flood control fee. 3)Record survey Comm_issioner Higgins Seconded. Carried Unanimously. Mr. George Day asked that his Tentative Map SD-86 SD-86 be put back on the calendar. George Day Commissioner Webster moved to deny approval of the Tentative maps SD-86 and SD-87. Commissioner Hlggins Seconded. Carried Unanimously. Commissioner Anderson reminded the Commissioners that Land Use they should get In their suggestions on the land use Plan plan. Commissioner Higgins moved for adjournment at 10:50 P. M. Commissioner Pasetta Seconded.
