TYPE: Regular Meeting I ROFI~INE ORGANIZATION A. ROLL CALL Present:- Anderson, Bennett, Pasetta, Tiffany, Webster Absent: Crisp, Higgins. MINDTSS Commissioner Anderson moved for the approval of the minutes as distributed. Commissioner Tiffany seconded. Carried unanimously. II PbBLIC HEARINGS A. USE PERMITS V-119 1. V-113 - Saratoga Cooperative Nursery School Ext. of The Secretary read the application for the extension Use Permit of a Use Permit granted for a nursery school at 14040 Saratoga-Sunny~ale Road. Mrs. Roy Cameron, President of the Nursery School, and Mrs. Herbert Peltman spoke in favor of the Use Permit. The Secretary read a petition with ll signatures re- questing denial of the Use Permit. The following people stated they objected to the Nursery School; Mrs. Julia Cobb, Alice Thornton, Mr. D. M. Thornton, Commissioner Anderson moved for approval of the Use Permit with the following conditions: (1) Use Permit granted for a period of one year. (2) 0ffstreet parking to be provided in the rear of the lot:for the number of people in charge at one time. Commissioner Pasetta seconded. Carried unanimously. -1- B. VARIANGES 1. V-114 - John L. Atkinson V-114 Var. The Secretary read the request for a 15 foot f~ont set- Set-back back instead of the required 30 feet on lot 24, Tract No. 1318. Mr. Atkinson and Mr. Don Windell,representing the builder, spoke in favor of the variance. Commissioner Pasetta moved to grant the variance. Commissioner Tiffany seconded. Carried unanimously. C. Steinberg C-15 G.B.Steinberg The Secretary read the proposed change of zoning from Change of Ri:'BD6 to R4:.B4 on two parcels totaling approximately Zoning:. from Ri:BD6 32 ~ acres on Highway 9 opposite Broo~ood Lane. to R4::B4 The Secretary read five letters in the file in favor of high class multiple d,~elling. The following spoke in favor of the re-zoning: Art Wilson, Saratoga Real Public Hearing Estate man, Mr. G. B. Steinberg~ architect, Mr. Morris Piazza, manager of the Saratoga Bar~ of America. The following spoke in opposition to the re-zoning: Barney Deasy, representing Brookwood Lane residents; Mrs. Ruth Owen, 14180 Victor Place, Mrs. William Higgins, Mrs. Barney Deasy, Mrs. Golden, Mrs. Clarence Kingery, all from B~ookwood Lane. Mr. John Cahill asked about architectural and site control on the property. The City Administrator explained Ordinance 3A-8 re- stricts buildings as to heights and set-backs. Art Wilson stated that no bar or restu~nt was contem- plated. The PubIic hearing was closed at 8:30 P. M. The Secretary read s letter from the Planning Consultant dated Nov. 19, 1958. Commissioner Pasetta moved that re-zoning be approved Re-zoning for Parcel l, Exhibit "A"' submitted Sept. 26, 1958, from Ri:BD6 to R4:B4 to R4:B4 zoning district subject to the following con- dltions: l) Plans and specifications to be subject ~o architectural & site control. 2) If construction is not started within one year from the date of re-zoning of the property it will revert to Rl:~BD6. Commissioner Tiffany seconded. The following roll call vote was recorded: AYES: Anderson, Pasetta, Tiffany, Webster NOES: Bennett D. 0RDIN~CES 1. A-1 and A-2 re-zoning Ord. 3P~-l A-1 & A-2 Ordinance No. 3PA-1 reclassifying A-1 and A-2 zoning re-zoning to RE:nB4 districts to RE:B4 was read. In Section 4.1.d the number of tons was changed from one to fifty. Commissioner Webster moved for the adoption of the Ordinance as read and amended. Commissioner Anderson seconded. Carried unanimously. III OLD BUSINESS E. USE PERMIT _ V-104 - Santa Clara Sand & Gravel Co. Use Permit Chairman Webster of the special study committee read the V-104 proposed resolution granting conditional use permit for the Santa Clara Sand & Gravel excavation of natural materials. Co. After a discussion among the commissioners and Mr. John Brethauer, attorney for the applicant, the following changes were suggested: -3- 4 c Change 4:~00 P. M. to 4:30 P. M. The term "quarry type equipment" as used herein shall be d~emed to mean tractors, loaders, bull dozers, rock crushera, conveyors, and other equipment used primarily within the quarry as distinguished from use on public roads and streets. 4 J Change the word pouring to quarry. 4 n Insert the word "native" before plants and shrubs. 4 o Add these words after t~e word operations "except such records as directly disclose either operational revenues or operational expenses". 4 p Add these words after the word n~n-assignable "except with the prior written approval of the City of Saratoga Planning Commission. Chairman Bennett recessed the meeting at 9:40 P. M. Chairman Bennett called the meeting to order at 9:57 P.M. The following change was suggested: 4 a to read as follows "No rock crusher, conveyor, apron feeder, chute or bin shall be used for any quarry operation unless the same is sufficiently housed and enclosed with suitable materials to eliminate, so far as it is reasonably possible to do so, the emanation of noise, dust and fumes. Except for solid stock, mild steel, horizontal bars placed to prevent passage of material of greater size than the smallest inside cross- section of the hoppers to be used, and ~rovided no free fall of materials shall be permitted on said bars and provided all reasonable steps are taken to eliminate noise and ~ust emanating from the use of said bars, no materials shall be screened, graded or other~ise pro- cessed by the use of "grizzly bars" or any other device except a rock crusher.housed and enclosed as specified above. Commissioner Webster moved that Resolution No. V-104-1 be adopted as amended. Commissioner Anderson seconded. Carried unanimously. B. ARCHITECTU'~&L & SITE CONTROL PERMITS V-110 1. V-110 - Pat Bucaria Pat Bucaria Mr. Bucaria and Mr. Held, the architect, spoke in favor of the permit. The Secretary read a letter from the Plannin~ Consultant V-110 dated Nov. 17, 1958. Pat Bucaria A. & S.C. Commissioner Webster moved for denial of the application Permit on the grounds of a safety hazard and lack of necessary parking. Commissioner Pasetta seconded. Carried un- animously. 2. V-112 - Brookside Club V-112 Mr. Mays, the architect, explained the blue prints which Brookslde Club show the lighting an~ parking facilities as requested by A. & S. C. Permit the Planning Commission at their last meeting. The fence line has also been changed as suggested by the Planning Commission. Commissioner Pasetta moved final approval of the Architectural and Site Control Permit. Commissioner Anderson seconded. The following roll call vote was recorded: AYES:- Anderson, Bennett, Pasetta, Tiffany NOEW: Webster Commissioner Webster stated that the reason for his vote was he felt there should be'a limit on the lights of 150 watts and that this expe.diture for lighting should not be a basis for a further modification of the use permit. C. SUBDIVISION ORDINANCE Subdlv. Chairman Pasetta of the Subdivision Committee reported that Ord. the study would take sixty (60) days to complete. The Chairman directed that a progress report be given at the second meeting in December. D. ORDINANCE 3A-9 - USES IN H-1 DISTRICTS Ord. 3A-9 Chairman Pasetta stated that the Subdivision Committee re- Uses in H-1 Diet. commends a~option of Ordinance 3A-9 as a permanent ordinance with one change: Section 1A - 3a should rea~ "Nursery and Freenhouse, in- cluding retail sales of garden hardware, packaged plant food and kindred products". -5- Public Commissioner Pasetta moved that the Secretary be directed Hearing of 0rd. 3A-9 to set the date for Public Hearing for this ordinance. (uses in H-1 diet.) Commissioner Webster seconded. Carried unanimously. E. Ordinance 3A-10 - Sign Ordinance 0rd. 3A-10 .The Secretary read a memo from the City Council dated Sign 0rd. November 24, 1958 in which two changes were recommended in the Subdivision Sign Ordinance. Chairman Pasetta reported that the Subdivision Committee recommends the following changes be made in 0r~inance on subdivision signs: Subdiv. Section 3.1 A - 2 should read "Signs placed parallel or sign 0rd. at an angle to the street on which a subdivision abuts changes shall not exceed 24 s~uare f~et in size, save and except that the signs placed parallel may have advertising on one side only and signs placed perpendicular or diagonally may have advertising on two sides. Section 3.1 C - 3 should read "All off-tract subdivision dlrectional signs shall be within an architectural frame with a maximum width and height of 4 feet and 8 feet respectively. There shall not be more than four directional signs within any one frame. Only one directlonal sign may be placed within the frame for each individual enter- prise. Section 4.1 should read "All subdivision signs and bill- boards, except permanent on-tract subdivision signs used exclusively as name plates which are not in conformity with this ordinance shall be removed within thirty days from the effective date thereof". Commissioner Pasetta moved apprgvai of the suggested changes. Commissioner Anderson seconded. Carried unanimously. IV COMMITTEEREPORTS A. ARCHITECTU~.AL & SITE CONTROL V-115 1. V-115 - Electrical Products Corporation Elec. Prod. Corp, The Secretary read the application for a permit for a A. & S.C, Permit sign to be erected on a new store building at 14462 Big Basin Way. Mr. Davis, proprietor of the store, spoke in favor of the permit. Commissioner Tiffany moved approval of the architectural and site control permit. Commissioner Anderson seconded. Carried unanimously~ -6- B. SUBDIVISION COMMIT~E None V PETITIONS AND GRIEVA~NCES A. Written Communications Westhope 1. Westhope Church re: Directional Signs Church Use Permit The Secretary read a letter dated Nov. 10, 1958 fee from the Westhope Church signed by Brad Morter, President of the Board of Trustees. Commissioner Webster moved that the request for exemption from the $20.00 fee for a Use Permit be denied.. Commissioner Pasetta seconded. Carried un- animously. 2. The Secretary read a letter dated Nov. 23, 1958 from Mr. & Mrs. Ray Babcock. R. Babcock Bldg. Site After a discussion as to the interpretation of Ordinance Approval 3A-8, Section 4.4 Commissioner Webster moved that the City Attorney be directed to investigate and report on possible ways of preventing making a conforming-, lot at the expense of turning another site into a non- conforming site and that the matter also be sent to the Planning Consultant for explanation. Commissioner Anderson seconded. The following roll call vote was recorded:' AYES: Anderson, Bennett, Tiffany, Webster NOES: Pasetts The Secretary was directed to accept the map presented by Mr. Babcock and file it as application for one building site approval. B. ORAL I. The Secretary stated that there had been an inquiry as Use Permit to renewing a use permit which had keen granted for a period of one year. -7- Commissioner Webster moved that the Secretary be Use Permit Fees directed in all cases to charge $20.00 fee for application for use permit re-newal exoept where the Use Permit itself states that no fee is to be paid for an extension.
