MINUTES Commissione~ Anderson moved for approval of the minutes as distributed. Commissioner Crisp seconded. Carried unanimously II PUBLIC HEARINGS A. VARIANCES 1. V-121 - M. F. Samis, Jr. V-121 The Secretary read the application for a variance from the M.F.Samis required 25' rear yard to 20' on lot 89, Tract 1690- A letter from the Hanover Corp, dated December 15, 1958, was read. Commissioner Crisp moved to grant the variance as requested according to plans submitted December 16, 1958. Commissioner Tiffany seconded. Carried unanimously. B. USE PERMITS 1. V-119 - Fred Durr V-119 The Secretary read the application for a use permit to F.Durr operate a general automotive repair shop on Highway #9 at Azule railroad crossing. Mr. Galeb, owner of the property and building, spoke in favor of the use permit. Chairman Bennett referred the application to the Subdivision Committee for study and report. The public hearin9 was con- tinued to the next regular meetin9. 2. V-120 Christian Science Society, Inc. V-120 Christian The Secretary read the application for a use permit for Science So- ciety, Inc. church and Sunday school buildings at 3.907 acre parcel on -1- Saratoga Avenue opposite Seagraves Avenue. Mr. Walte~ Powers and Mr. William OlKelly, representin9 the 6hutch, spoke in favor'of the use permit. Mr. Kleyensteuber, Lutheria Way, and Mrs. Florence Colvin, Lutheris Way, asked about future development of the whole property. The public hearing was continued in order that further plans showing tentative building, site development and exact area to be used for church purposes can be filed. The application was referred to the Architectural & Site Control Committee for report at the next meeting. C. CHANGE OF ZONING 1. C-16 - Emmette Gatewood - Time: 8:10 P.M. C-16 The Secretary read the proposed amendment. A letter from E.Gatewood Endotto T. Gatewood,. Jr. dated December 17, 1958 was read. After a brief discussion Commissioner Webster moved to recommend the proposed amendment to th~ zoning ordinance to the City Council. Commissioner Higgins seconded. Carried unanimously. llI N~I BUSINESS A. CHANGE OF ZONING 1. C-17'- W- Seagraves C-17 The Secretary read the application for change of zoning W.Seagraves from Ri:B2 and RI:B3 to RI:B2X for a 10.5 acre parcel on the eas~ side of Aloha Avenue. Commissioner Anderson moved that the Secretary be directed to set a date for public hearing. Commissioner Crisp seconded. Carried unanimously. IV OLD BUSINESS A. V-118 - Electrical Products V-118 Commissioner Htggins gave a report of his meeting with Mr. Elect. Products Held, the architect for the First National Bank of Saratoga Corp. Cupertino on the matter of a sign on the roof of the bank. -2- Mr.. Held spoke in favor of the sign as applied for. Commissioner qrisp moved for denial of the Architectural and Site Control permit without prejudice, with the stipu- lation that if new plans are submitted there will be no fee charged. Commissioner Anderson seconded. Carried unanimously. B. SUBDIVISION ORDINANCE Subdiv. 'Commissionar Crisp reported that the Subdivision Committee Ord. was still in the process of studying the proposed City subdivision ordinance. Chairman Bennett directed that a progress report be given at the next regular meeting. C. ARCHITECTURAL & SITE CONTROL FEES A.& S. The City Admtni'strator reported that in answer to a proposal Control fees of the Planning Commission, the City Council recommends that no changes be made in the fees at this time, as it would require an amendment to the ordinance. Chairman Bennett ordered that the matter be tabled. V COMMITTEE REPORTS A. ARCHITECTURAL & SITE CONTROL COMMITTEE V-122 1. V-122 - O. D. Marcus O.D.Marcus The Secretary read the application for a permit for a per- manent awning on the two story office building at Park Plaza. Mr. Held, Architect, told of the plans to improve the buildtnG,s appearance. Commissioner Higgins moved for approval of the Architectural and Site Control permit. Commissioner Crisp seconded. Carried unanimously,~ ~ B.SUBDIVISION COMMITTEE 1. '~D-23A - Paul Lee SD-23A P.Lee The Secretary read the report of the County Building Site Approval Committee meeting of December 17, 1958- -3- Commissioner Htggins moved for disapproval of the tenta- tive map. Commissioner Crisp seconded- Carried unanimously. 2. SDR-93 - Ray Babcock SDR-93 R~Babcock T~e Assistant City Attorney recommended denial in that there seemed to be a violation of Section ~-~ of Ordinance Mr. Babcock spoke in favor of the proposed division of land. Commissioner Tiffany moved for disapproval of the tentative map. Commissioner Anderson Seconded- Carried unanimously- 3. SDR-9ll.- S. D- 5elan SDR-9~ S.D.Selan T~e Secretary read the conditions set by the County Build- ing Site Committee meeting of 12/11/58. Mr. Selan questioned the future street line shown on the record of survey map. Commissioner Crisp moved for approval of the tentative map subject to the fol.lowing conditions: 1) Flood control fee of $150.00 per lot 2) Improve access to 18' minimum County specifications Commissioner Tiffany seconded. Carried unanimously. ~. SDR-95 - South Bay Construction Co. SDR-95 South T~e Secretary read the conditions as set by the County Bay Const. Building Site Approval Committee meeting on December 11, Co. 1958- Commissioner Higgins moved approvalvof the tentative map subfact to the following conditions: 1) Install concrete vertical curb and 9utter and repair pavement as required by County Engineer. 2) Record of survey 3) Flood control fee of $150.00 per lot Commissioner Tiffany seconded. Carried unanimously. 5. SDR-96 - Stern and Renzel SDR-96 The Secretary read a letter dated December 16, 1958 from Stern & Renzel Stern and Renzel asking for buildt~9 site approval for a -585 acre parcel, this being a smaller piece than that originally requested for a building site. The original conditions set.by the County Building Site Committee meet- inG on December 11, 1956 were read and the statement of the County Engineers that there would be no change in the conditions for this smaller parcel. Commissioner Crisp moved for approval of the tentative map for parcel "A" as shown on the record of survey map filed at the City'Office on December 16, 1958, subject to the followin9 conditions: 1) Future property line to be ~2' from centerline of Cox Ave. 2) Improvement plans showing access and parking area to be approved by County engineer - $1,200 bond. 3)Record of survey Flood Control fee to be $675-00 per acre on gross acreage, Commissioner Higglns seconded. Carried unanimously. 6. SDR-97 - Southbay Construction Co. SDR-97 Southbay T~e Secretary read the conditions set by the County Build- Const.Co. ing Site Approval Committee meeting of December 11, 1958. Commissioner Webster moved for approval of the tentative map subject to the condition that a record of survey be submitted. Commissioner Hi99ins seconded. Carried unani- mously. 7- SDR-96 I. Kirkorian SDR-98 I.Kirkor- T~e Secretary read the conditions set by the County Build- in9 Site Approval Committee meeting of December 17, After discussin9 with Mr. Kirkorian the proposed northerly extension of Beaumont~ Chairman Bennett directed that condition #3 be referred back to the County Engineers for clarification as to possible future street line. VI PETITIONS AND ~RIEVANCES A. Written 1. Copple & Co., Inc. re rezoning on Highway #9 Coppie The §ecretary read a letter from Copple & Co., dated & Co. ~ecember 18, 1958- Mr. Copple spoke in favor of allowing a lumber yard in a C-1 zone. The Assistant City Attorney suggested that the applicant present should/an interpretation of "lumber yard". Chairman Bennett directed that the plans submitted be referred to the Planning Consultant for his use' in studying the over- all area for the t~land use and circulation policy. B. Oral 1. Mr. Dan Hurtlinger, Blue Hills Area real estate man, spoke of t~e need' for re-zoning along Highway #9. Commissioner Anderson moved for adjournment at 10:07 P.M. Commissioner Crisp seconded.
