Commissioner Higgins seconded. CaEried unanimously. II PUBLIC HEARINGS A. VARIANCES 1. V-12~.- Ray Babcock (Continued) V-12~ The Secretary read a letter from the Assistant City Attorney R.Babcock dated' February 6, 1959 i.n answer to the Commissionts re- quest gf the last meeting. Chairman Webster read from the Mayorts letter of january 8, 19~9 regarding a~tion on variances and at the request of Commissioner Crisp read from the Subdivision Map Act, Section rne Secretary read a letter from Edith S. Mills, owne? of adjoining property, in favor of granting the variance. Mr. Babcock displayed a map showing frontages on neighbor- ing properties. In answer to a question from the C~mmission, the Assistant City Attorney stated that if the variance was granted it would not be flaunting the policy of the City. Commissioner Pasetta moved to approve the variance in front- age from 125' to 95' at 1~930 Farwell Avenue subject to the condition that side setbacks on the lot adjacent to and to the north are to be 1~'. Commissioner HiSgins seconded. The following roll call vote was recorded: Ayes: Anderson, HiSgins, Pasetta, Tifl~any, Webster Noes~ Bennett Abstaining: Crisp Chairman Webster stated that Mr. Babcock could now file an application for Building'Site Approval. 2- V-1'27 - May L. Wooslay V-127 The Secretary read the request for a variance to allow the M.L.Woosley use of a house trailer as a dwelling in an R1B3 district and explained the history of. the case. Mrs. Wooslay and Mrs. Oden, Saratoga Avenue, spoke in favor of th~ variance. Mr. Tom Montemurro, Shadow Oaks.W~y, spoke against granting the variance. Commissioner Anderson moved that the variance be denied. Commissioner HiSgins seconded. Carried unanimously. In Answer to Mrs. Woosleyts further questions, Chairman Webster stated tha~ the case could be appealed to the City ~ounc]l if so desired by the applicant. 3. V-128 - Mrs. James Hannah V-128 The Secretary read the.request for variances from both 3. Hannah side setbacks on Lot #18, Tract #1318, Wildwood Heights, and stated that a variance from ~he required front setback of 30' to a request of 20' had been granted on this lot on October 27, 1958. Mrs. Hannah spoke in favor of the variances. Commissioner Pasetta moved that both side yard variances be denied. C6mmissioner Crisp seconded. Carried unanimously. B. USE PERMITS V-120 C.S.Society 1. V-120 Christian Science Society Inc,. (Continued) Inc.. The Secretary read a letter from the Christian Science -2- Society, Inc., dated February 9, 1959, stating that no further action was to be taken by them on the SaratoGa Ave-- site. Commissioner Pasetta moved for denial of the Use Permit. Commissioner Crisp seconded. Carried unanimously'- Chairman Webster declare'd the Public Hearings closed at 8:10 P.' M. III OLD BUSINESS REsolution PC-12 Fixing Time and Place of Meetings PC-12 The Secretary read Resolution PC-12 bein9, A RESOLUTION FIXINe Time & Place of TIME'AND PLACE OF F~ETING OF Th]E PLANNING OO~IISSION OF ~HE P.C. Meet- inGs CiTY OF'SARATOGA. Commissioner Crisp moved for approval of Resolution PC-12. Commissioner Tiffany seconded. Carried unanimously. B. Subdivision Ordinance Report Subdiv. Commissioner Pasetta stated that copies of the proposed sub- Ord. division Ordfhance had been distributed to all the Plannin~ Co.~issioners on February r[, 1959. Althg~gh the Subdivision Committee has met and has su99ested some dhang~s, their final report is awaitin9 recommendations from the individual Commis- sioners. These reco~endati[ons should' be sent to Coma~issioner Pasetta before the next meetihg. at which time a c.omplete report will be made. The' SecEetar9 was directed to send a copy of the proposed ordinance to the Dfrector of Public Works for his suggestions. C. SDR-iO1 Isabel Caulfield _ 1.'l]ot, Peach Hill Rd. !:Caul- The Secretary read a letter from Bru~e L- Wi99ins, County Fire field Marshal, dated February 6, 1959, in answer to a request made by the Commissioners atlth~ir last meetin9 regardin9 the ~afety factor on Peach Hill Road. The Directbr of Public Works stated that dual access is.a fact in this case. Commissioner Crisp stated that there were many other cases in the City and felt that a recommendation should be sent to the City Council that all narrow roads in the City, even though dual access, should be 18t wide. Commissioners Anderson and Pasetta stated their agreement. Commissioner Crisp moved that the tentative map for SDR-101 be reconsidered and that Condition #3 - "Improve Peac~ Hill Lane to 18' wide to minimum County apecifications, and extend 'to Piedmont Rd." from the previous approval be eliminated. Commissioner Andersbn seconded. The following roll call vote was recorded: Ayes: Anderson, Crisp, HiSgins, Pa~etta, Tiffany, Webster Noes: Bennett D- 5DR-103 - Carl Dimelf - 1 lot, Saratoga -Los Oatos Rd. SDR-103 Chairman AndersSn of the interim committee appointed at the C.Dimeff last meeting to study the problem of financing access roads read a proposed Resolution. Commissioner Anderson moved for adoption of PC-13 being, A RESOLUTION RECOPF~ENDING ~IEN~MENT TO ORDINANCE NO. 23, ~N ORDI!I~CE REQUIRINQ BUILDINO SITE APPROQAL, FOUR OR LESS LOTS. Commissioner Pasetta seconded. Carried unanimously. The Secretary'read the conditions set by the County Department of Public Works on SDR-103. After discdssing Conhition.#2 regarding the access road, Com- missioner Anderson moved that the Department of Public Works be asked to ciarify Condition #2' as tS the width and type 6f sur- facinG required and whether the driveway is private property or a right of way. Commissioner HiS.gins seconded. Carried unanimously. E. SDR-10~ - Bart Oiraudo 1 lot, Reid Lane. SDR-10~ T~e Secretary read t~.report, from the City Attorney dated Bart Oiraudo 1/29/~9 which had been requested by the Commissioners at their last meeting. Commissioner Higgins moved for approval of Parcel #3 shown on the Record of Survey sub,]ec~ tb pay~ent of $150.00'flood con- trol fee. Commissioner Crisp seconded. Carried unanimously. Com. mission~r Higgins stated that new plans for a sign at the Bank had been submitted showing a 195' vertical sign. Rather than act on this vertical sign at this time the Architect has been requ.ested to have a revised plan for a ~oor sign ready for the next meetin9. 2. Mr, Wal'~ers displayed models of his proposed sign. Afte~ discussing the possibility of standard off-tract directional s~gns the Commissioners decided on the following requirements: i) '47'x 6~' ~embers (6' for depth), 2) 11' overall height from the g~ound to the top of the top rail, 3)8' for the sign portion, 3' above the ~round to the bottom of the bottom rail, The verticals to ex~end into the ground so that no bracinO is necessary, 6) A rustic color brown stain on the frame, Commissioner Higgins moved for approval of SS-8 subject to 'the design as provided by the City of Saratoga and com- pliance with Ordinance 3A-10, ComMissioner Bennett seconded, Carried unanimbusly, Chairman Webster asked Commissioner Higgins to have complete plans incorporating the above requirements and also a -6- method of hanging the individual signs in the frame ready for the next regular meeting. Chairman Webster directed the Secretary to include on the application blanks the number and location of the signs already erected by the applicant. B. SUBDIVISION .CO~!ITTEE 1. SDR~90 - A. D. Houston - 1 lot.;, Houston Court 'SDR-90 A.D. T~e Secretary read.{he conditions set by the County Dept. Houston of Public Works at their meeting on January 29, 1959. C~mmissioner Bennett mo~d for approval of the tentative map subject to'the £ollowing conditions: 1) ReplaCe existing septic tank system. 2) Record of Survey.' Flood Control fee of $150.00 per new lot. Grade lot to drain ~o street. C~mmissioner Anderson seconded. Carried unanimously. 2. $D-99 Frank'C. Oalli-'9~ lots, Highway #9 SD-99 F.C.Galli Chairman'Webster read the report from Lawrence Livingston, Planning Consultant, dated February 6, 19~9, recommending that the tentative map not be approved. Mr. Oalli and Mr. Coburn, Civil Engineer~ spoke of the street pattern. Commissioner Pasetta moved that the tentative map, SD-99, be disapprovea on the basis of inadequate design. Cgmmis- sioner Higgins seconded.' Carried unanimously. Mr. Galli was given one of the Subdivisfon Street Pattern plans submitted by the Planning'Consultant. 3. SD-105 - Kosich Construction Co.- 63 lots, Saratoga Avenue SD-105 Kosich T~e Secretary read a letter from Kosich ConStruction Co., Const. Co. granting a 30 day extension for action on the subdivision map filed on F~nuary 19, 1959- The Commissioners discussed with Mr. Kosich the advisability -7- of a preliminary map rzther than a tentative map if only a part of the tentative map was proposed for completion at this time- The matter was referred to the City Admin- istrator for further discussion with the applicant. Chairman Webster continded the action on the tentative map to the meetin9 on March 9th. ~. Comanissioner Pasetta moved'foP approval of the tenthrive ma=p subject t~ the followin~ conditions. 1) Record of Survey. $150.00 per lot flood control. 3)15' future street line alon9 Boyce Lane. 4) 10' easement paPalled to line marked S3~°30,00'' West from northerly pPoperty to southerly property line for Flood Control District. Increase buildin9 ~i.te by 3,500 sq. ft. - a strip 28 feet by 125t on the east property line. Commissioner Anderson seconded. Carried unanimously.
