B. MINUTES'
Commissioner Tiffan~ moved for approval of the minutes as dis-
tributed and read. Commissioner Crisp seconded. Carried unani-
mously.
II COMMITTEE REPORTS
A.ARCHITECTU~kL.& SITE CONTROL
1. A-6 - Saratoga Trunk Antique Shop
Mr, Dwight Caswell and Mrs. Helen Rayburn spoke in favor of

Antique Commissioner Higgins moved to refer the application back to

the applicant for a site development plan, floor plan end
elevation. Commissioner Bennett seconded. Carried unani-
mously.
In answer to a question from Mr. Caswell Chairman Webster
stated that provision for 5 off-street parking. spaces
would be advisable.
B. SUBDIVISION AND BUILDING SITE APPROVAL

Mr. Mackin discussed the conditions with the Commissioners.
Chairman Webster stated that cutting off one parcel at a
time rather than filing a subdivision map on the property
may cause problems for Mr. Mackin in the fu~dre when he
wishes to sell another site.

Emery Chairman Webster ordered the matter continued to the next

Burt W. Commissioner Anderson read the report of the Subdivision

Committee dated September ll, 1959.
Mr. Smith discussed the drainage problem.
Commissioner Anderson moved for denial of approval of the
tentative map. Commissioner Crisp seconded. Carried
unanimously.
III CHANGE OF ZONING APPLICATIONS

N. The Secretary read the application for change ~f zoning from
Sanoff
R~B2 to R4 and C-1-H.
Mr. Denney representing Mr. Sanoff spoke in favor of the appli-
cation.
Commissioner Bennett moved that ~he Secretary be directed to
set up a.date for public hearing. Commissioner Anderson
.seconded. Carried unanimously.
Commissioner Bennett moved that the application be referred to
the Planning Consultant for review and report. Commissioner
Higgins seconded. Carried unanimously.!

A. VARIANCES
1. V-155 - W. Noeggerath - 8:28 P. M.

Mr. W. Noeggerath spoke i~ favor of the variance.
No one else spoke for or against the application.
Commissioner Higgins mov,~d that the variance be denied.
Commissioner Crisp seconded. Carried unanimously.

2. V-156 - John M. Zane - 8:40 P. M.
V-156 The Secretary read the application for a variance and a

M.' petition with twelve signatures stating approval of the

The Secretary read a letter from Ethel J. Hinz dated Sep-
tember 9, 1959 opposing the variance application.
Mr. Leslie Hinz spoke in opposition to the variance.
Chairman Webster ~ppointed the foliowinE. Variance Committee -
Anderson, Bennett, CriSp, Commissioner Anderson to act as
Chairman. The committee may ask any other Commissioner to
render a report in writing to it on any matter under study.
Chairman W~bster closed the public hearing on V-156 at 9:02
P. M. and referred the. matter of V-156 to the Variance
Committee for investigation and report at the next regular
meeting.
~. Use Permits
-1. UP-4 - Saratoga Swim Club - 9:03 P. M.
The secretary read the application for a use permit for a

Saratoga private non-profit recreation area.
Swim Club
The following spoke in favor of the use permit:- "Joseph
Morris, ~9265.Monte Vista Dr., President of the club, Rred
Richards, Member and Architect for the club, Carl Piper

The following spoke in opposition to the use permit: Mr.
Wesley S. Burrows, Attorney of 267 Almaden Road-, San Jose,
who presented a petition with 27 signatures and a telegram
with five signatures; Mrs. Carl Mau, 19990 Bella Vista Ave.;
Mrs. Florence Egan, 14606 Horseshoe Dr.; Mr. Fred W. Buechner,
19915 Bella Vista Ave.; Alton Beckham, 20040 Bells Vista Ave.;
Dr. Pickworth, 19931.Bells Vista Ave.; Colonel D. Palmet, 14591

Chairman Webster requested a set of the official bylaws
UP-4 of the club from Mr. Morris and a.copy of the transcript
Saratoga
Swi~ Club being made of the meeting from Mr. Burrows.

Chairman Webster referred the matter,to the variance com-
mittee for study and ~eport at the next regular meeting if
possible and continued the public hearing to the next reg-
ular meeting.
V OLD BL~I.NESS
A. L~-3 - St. Nicholas Church

St. The Secretary stated that a use permit had been granted .to the
Nicholas
Church church for a sunday school and social hall however the plans
had been changed and the church now wished to build a residence
for the priest instead,
Commissioner Higgins moved to reopen the matter o{ St. Nicholas
Orthodox Church use permit without additional fee. Commissioner
Tiffany seconded. Carried unanimously.
Chairman Webster ordered the matter continued to the next regular
meeting at which time a public hearing will be held, notices to
be sent to all those previously notified.
Chairman Webster asked the'Subdivision Committee to review the
building site approval application SDR-141 in connection with
this same property.before the next meeting.
B. V-146 - Heath & Co.

Heath The Secretary read a letter from Mr. Hugh S. Center, attorney for
& Co.
the bank, dated August 26, 1959.
Mr. Center presented.a photograph showing the proposed use of
lighting on the sign. ..
Chairman Webster moved that the Commission reconsider V-146 and
amend the approval henceforth given by authorizing each letter of
the sign to be illuminated with a single neon tube. Commissioner
Anderson seconded. Carried unanimously. Commissioner Higgins
abstained from voting.

district A letter from the Cupertino Sanitary District dated August
27, 1959 and their resolution No. 78 were read.

Saratoga General Plan and reminded the Commissioners that

No. 3 Monday,September 21st, 7:30 P. M., was the date and time
Study Session set for the Study Session with the Planning Consultant at
Fruitvale School.
