II COMMITTEE REPORTS A., ARGHITECTL~AL AND SITE CONTROL: 1. A-6 - Saratoga Trunk Antique Shop (Cont..) A-6 Commissioner Higgins moved for approval of the permit in ~arstoga Trunk Antique Sh6p accordance with elevations and plot plans submitted on (Cont.)- September 24, 1959. Commissioner Crisp seconded. Carried unanimously. Commissioner Anderson noted that the 8 ft. by 20 ft. parking spaces were approved only because of special conditions which included parallel parking, 2. B. .SUBDIVISION AND BUILDING SITE APPROVAL 1. SD-144 - S.S. Williams (Cont.) SD-144 S-S.Williams Commissioner Anderson gave an oral reDor6 on the Subdivision (Cont.) Committee meeting with the Subdivider. The Secretary read a letter from Mr. S. S. Willjams dated September 25, 1959 gr~nting an extension of time in which to consider the tentative map. Chairman Webster ordered'the matter continued tc the next regular meeting. 2. SD-145 - Jerry Hoff (Cont.) SD-145 Jerry Hoff Commissioner Anderson read the recommendations of the Sub- division Committee dated September 25, 1959 and commented on the condition No. 5. Mr. Huff discussed the conditions wi~h the Commissioners. Commissioner Anderson moved for approval of the tentative map submitted on September 10, 1959 subject to the conditions as read and revised,. namely; .'. 4. Streets to be paved with a minimum of 2~" plant mix surfacing on ~ minimum of 6" base material. Actual thickness requirements to be determined by County Engineer. 6. Rrovide suburban plant mix (asphalt) curbs on.Ruddell Court. 14. Omit Commissioner Bennett seconded. Carrled unanimously. 3, SDR-147 - Emery Delmas (Cont.) SDR-147 Emery Delmas Commissioner Anderson read the recom~mendatio~s of the Sub- (C6nt.) division Committee dated September 25, 1959- Mr. Bini, Creegan and D'Angelo, discussed the conditions. Commissioner Anderson mo~ed for approval subject to the -2- conditions as read. Commissioner Higgins seconded. Carried SDR-147 Emery Deltas unanimously. (Cont.) 4o SDR-149 - Western Rills Development Co. SDR-149 Chairma~ Webster read the recommendation of the Subdivision Western Hills Development Co. Committee dated September 25, 1959. Mr. Kettle spoke in favor of the application. Commissioner Anderson moved for disapproval of the Building Site ~pproval application. Commissioner Crisp seconded. Carried unanimously. 5. CoMmissioner Anderson moved for approval of the building site subject to the conditions as r~ad. Commissioner Higgins seconded. Carried unanimously. 6. SDE-151 - John B. Claborn SDR-151 John B. Claborn Commissioner Anderson read the recommendation of the Sub- division Committee dated September 25, 1959- Mr. Claborn discussed tl~e conditions with the Commissioners. Commissioner Anderson moved for approval of the building site subject to the conditions as read. Commissioner Crisp seconded. Carried Unanimously. 7. SDR-152 - A. R. Cough SDR-152 A.E.Oough Commissioner Anderson read the recommendation of the Sub- division Committee dated September ~5, 1959. Mrs. Cough discussed the conditions. III PUBLIC HEARINGS C. USE PERMIT o UP-4 Saratoga Swimmin~ Club - 9:45 P.M UP-4 Saratoga Chairman Webster read the following documents: Letter from Swimming - Club Dr. and Mrs. Pickworth dated September 25, 1959; letter from Mrs. A..F. Jonas dated September 25, 1959; letter from Anthony Zaro dated 5ept,~mber 28, 1959; letter from the City Administrator to the County Planning Dept. dated September 2!,-195~; letter from John HaaS, County Planning Dept., to the City Administrator dated September 24,.1959; letter from Robert C. Kirkwood dated September 21,.1959; letter from Nestor Barrett dated September 24, 1959; letter from Joseph Morris, President of the Swimming Club, dated September 23, 1959; and stated further that the file,contained a copy of the building permit and the Health Dept. approval of the septic tank at the Swimming Club. At the request of Chairman Webster for an indication of audience feeling on the matter approximately 65 persons stood as being in favor of the use permit, 6 persons stood in Opposition to the use permit and ll persons stood as owning property within 300 ft. of the Swimming Club, 6 of these were in opposition to the club. Mr. Joseph Morris and Geo~ge.peirce spoke in favor of the use permit. Mr. Burrows, attorney. for the opponents to the use permit, read.a letter from Colonel Buechner dated September 28, 1959- Mr. William Bre~chly spoke in opposition to the use permit. Commissioner Anderson stated that although the mat'tot had - -4- been referred to the Variance Committee for a report at this b~-4 Swimming meeting, the Committe~ had merely reviewed the club site and Club studied the papers in.the file as no conclusions could be reached until the public hearing was closed. ' Chairman Webster closed the public heWring at 10:50 P.M. and referred the matter to the Variance Committee for a report at the next meeting. Chairman Webster requested that Mr. Morris submit a true copy of the Articles Of Incorporation of the Club~to the City Office. A. CHANGE OF ZONING: ~. C-24 - N. Sanoff 10:52 P. M. C-24 N.SanoFf The Secretary read the application for a change of zoning and distributed the Plannin~ Consultants report which was re- quested at the last meeting. Mr. Denny, representing the ow~!er, spoke in favor of the reaching. No one else spoke for or against the rezoning. Chairman Webster closed the public hearing at 1~:04 P.M. and continued the matter to the next regular meeting for review of the Planning Consultants report. B. VARIANCES:. 1. V-157 - Alladin Builders,, Inc. ll:10 P.M.. V-157 Allsdin The Secretary read the applicatTon for a variance. Builders Inc. Mr. D. Timehey spoke in favor of the variance. Commissioner Anderson gave the report of the Variance Committee and moved that the variance be granted as shown on the plot plan submitted. Commissioner Bennett seconded. Carried unanimously. 2. V-158 - Gladys C. Wood - ll:15 P.M. V-15~ Gt~dys The Secretary read the application for a variance. C. Wood - Dr. Wood. and. Mr. Hall, next door neighbor, spoke in favor of the variance. No one spoke in opposition. Commissioner Anderson stated that the Variance Committee recommended approval. Commissioner Bennett moved that the -5- variance be granted as shown on the plot plan in file. V-158 Gla~ys Wood Commissioner Anderson seconded. Carried unanimously. C. Use Permits 1. UPs3 - St. Nicholas Church - ll:18 UP-3 St. Nicholas The S~cretary stated that the application was for a priest's Church home at the present church site. Commissioner Highins moved for approval of the use permit. Commissioner Crisp seconded. Carried unanimc. usly. Mr. G. E. Sobey, Archite~ for the Church, discussed the conditions with the Commissioners. Commissi6ner Bennett moved that the church be allowed to defer the improvement of SaratoEa Ave. and installation of 375' of curb along Saratoga Ave, as set forth in conditions 4 and 7 respect- ively, for a ?eriod of three years or until construction of amy units beyond those marked "A" on the plot plan in file received July 23, 1959, whichever is earlier. Commissioner HiSgins seconded. Carried u~animously. V. PETITIONS AND GRIEVANCES: A. WRITTEN 1. H. Taylor Peery - Re: Blue Hills Shopping Center H.T.Peery Letter The Secretary read a letter from Mr. Peery dated September 24, 1959 regarding zoning of his property at Prospedt Road and Highway q. Mr. Dan Huttlinger, Blue Fil'ls Real Estate man, discussed the letter with the Commissioners. B. 0ral 1. The City Administrator stated that the Commercial Service Com. Service Zoning Disin.~ict Zoning District regulations would be.ready for pTesentation to the Commission in the n~ar future. -6- Commissioner Higgins moved that the Plsnning Consultant be Com, Service Zoning District directed to draw up the boundaries of the proposed commercial service zoning district immediately in order that public hearings can be held on the zoning regulation and the boundries simultaneously, Commissioner Tiffany seconded, Carried unanimously, Commissioner Bennett moved for adjournment at 12:10 A.Mo Commissioner Higgins seconded, Carried unanimously, Present:. 100 Press: 4 City Officials Present: 'City Kdministrator, Asst. to the City Administrator, Director of Public Works, Asst.
