TYPE: Regular Meetling I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Crisp, Tiffany, Higgins, Webster Absent: None B. MINUTE~ Commissioner Crisp moved' that the minutes be approved as distributed and read by the individual Commissioners, se- conded by Commissioner Tiffany. Carried unanimously. II COI~'~LITTEE P£PORTS A. ARCHITECTURAL A~ SITE CONTROL None B. SUBDIVISION AND BUILDING SITE APPROVAL SDR-153 1. SDR-153 - T. ~nkley Hinkley The conditions were read by the Clerk. Commissioner Crisp moved for approval of the tentative map subject to the following conditions: 1. Submit record of survey. 2. Pay storm waters fee of $150.00. 3- Instal~ driveway approach 16 ft. wide on 6" base rock from edge of existing pavement to property.line, oil and screenings. 4. Install 12" corrugated metal pipe under driveway. 5. Bond of $200.00 for oil and screenings driveway approach and pipe under driveway. 6. Submit irrevocable offer of dedication as required for 30' half s~reet. 7- Front setback of 30 feet from future street line. 8. Construct house foundation on natural ground. 9. Approved for septic tank. Seconded by Commissioner Tiffany; carried unanimously. SDR-155 2. SDR-155 - M. M. Bertholf Bertholf The Clerk read the conditions as set forth by the Subdivision committee. Mr. Henwood of Campbell, former owner, spoke from the floor, protesting the matter of flooding. Mr. ~. M. Bertholf asked for a continuance. -1- The Chairman directed that this matter be continued until the next regular meeting. SDR-164 3. SDR-164 - J. O'Donnell 0'Donnell The Clerk read the conditions as set forth by the Subdivision Committee. Mr. Pond of Jameson, Pond and Scott Real Estate' fi~m~ spoke from the floor protesting condition'#8. The Chairman directed the matter .be 'continued until the next regular meeting. SD-158 4. SD-158 - C. C. Cox Cox The Secretary read a letter dated November 20, 1959, in which Mr. Gilbert of I~rk Thomas & Company, indicated on behalf of his client he was willing to give the Planning Commission an additional thirty days for action. Commissicner Crisp asked that the matter be referred to the Planning Consultant. The Chairman directed that the matter be continued until the next regular meeting. SDR-160 5. SDR-160 - C. E. Egbert Egbert The Clerk read the conditions as set forth by the Subdivision Committee. Mr. M. Hawks, Big Basin Way, Saratoga, representing Mr. Egbert, stated he was satisfied with the conditions. Commissioner Crisp moved for approval of the tentative map subject to the following conditions: 1. Front setback 30~. from future stree6 line. 2. Submit record of survey. O0 3. Pay storm waters fee of $15 · O. 4. Approved for septic tank. 5. Submit irrevocable offer of dedication for a 30 ft. half street. O. Widen existing l0 foot wide paving on Wild Oak Way to 18 ft. on 6 inch rock base with oil and screenings surface from Farwell Avenue to point where existing paving leaves the right of way, total distance about 150 ft. From this point construct a l0 ft. wide, or more, oil and screenings road on 6 inches base material to the driveway for the new house, total distance of about 350 feet. -2- 7. Bonds and inspection i'ee required, Bond $1,500.00; In- spection fee $67.50. 8. Dedicate 30 ft. drainage easement along westerly property line to Flood Control District. No permanent structures or patio type improvements permitted in this easement. Seconded by Commissioner Higgins; carried unanimously. SDR-162 O. SDR- 162 .- D. Davis Davis The Clerk read the conditions as set forth by the Subdivision Committee. Commissioner Bennett moved that this matter be referred to the Director of Public Works and to the Flood Control District for clarification of conditions #5 and #6, seconded by Commissioner Higgins. Carried unanimously. The Chairman directed that the matter be held over until the next regular meeting. SD-144 7. SD-144 - S. Williams Willjams Mr. Williams asked for a continuance and amended his letter of Octooer 19, 1959 in which he asked for an extension of time to December 3rd with the following signed endorsement "Please extend this time until December 28, 1959, for the necessary action referred to above". The Chairman directed that the matter be held over until the next meeting. III PUBLIC HEARING A. VARIANCES V-102 1. V-162 - S. G. Hernandez (8:05 P. M. ) Hernandez Mr. Hernandez spoke from the floor in i~vor o!' his applica%ion. A letter dated November 20, 195~ I'rom Rose Rispaud of 14493 Oak Street indicating approval of the variance, was read by the Secretary. Commissioner Bennett moved that the matter be reI'erred to the Variance Committee and that IJr. Hernandez submit a map to scale. Seconded by Commissioner Higgins. Carried unanimously. -3- Public Hearing closed by Chairman at 8:20 P. B{. Continded until next meeting by Chairman. In answer to a request by the City Administrator I'or instructions as to the.necessity i'or scaled and dimen- sioned plot plans in'connection with variances the matter was reI'erred by the Chairman to Commissioner Crisp for the purpose of drawing up a resolution to be pre- sented at the next meeting. Recess 8:30 P. M. Reconvened 8:42 P. M. B. ZONING REGULATIONS (8:42 P. M. ) C. S. Zoning 2. Commercial Service The Chairman read portions of a proposed ORDINANCE ADOPTING REGULATIONS COWFROLLING Ti{E USES OF LA~, THE DENSITY OF PGPULA~ION, THE LOCATIONS AND USES OF SUCH, THE AREAS AND D~!ENSiONS OF SI~ES A~VD TIIE APPEARANCE OF CERTAIN USES AIqD STRUCTUI{ES, AND REQUIREING THE PROVISION OF OFF STREET PARKING AND OFF STREET LOADING FACILITIES IN COI~RCIAL SERVICE DISTRICTS IN T~IE CITY OF SARATOGA. He read specifically Article 5 dealing with the Planned Commercial area and indicated that Article lO had been withdrawn and would.not be included as part of the Ordinance. Sections of Article ll were read by the Chairman. There were no comments by the Commissioners. ~r. Dan Hutlinger of 12019 So. Highway ~9, Saratoga, spoke from the floor in opposition to certain sections of the proposed ordinance, particularly as to' the . minimum site area and non-conforming uses. Mr. Nick Niljevich, Highway #9, owner o£ Hanson's service station, spoke from the floor protesting the possibility of his having to remove said gas station. Mr. Menard of 33 Peralta Street, Los Gs.~os, an architect, spoke from the floor objecting to certain sections of Article ll and connnented that the matter of the ~iljevich garage will hold up development of the entire Miljevich property. LIr. Sam Hernandez, Big Rasin Way, asked if variances could be granted.' The Chairman directed that the public hearing be continued until the next regut~r meeting. Commissioher Tiffany left the meeting a~ 9:45 P. M. because of illness. C. VARIANCE CO~'.~ITTEE UP-8 1. UP-8 - Saratoga'Inn Saratoga Inn Commissioner Anderson, Chairman of the Variance Com- mittee, read the Variance Co~mittee's report dated f November 23, 1959- Mr. Long of Farwell Avenue, spoke from. the floor raising several questions regarding the report which were answered to his satisfaction. Commissioner Higgins moved that the permit be granted subject to items 1 through 8 of the Variance Committee's report, seconded by .Commissioner Bennett. Carried unanimously. IV OLD BUSINESS SDR-108 A. SDR-108 - E. T. Stafford Stafford Commissioner Anderson moved that condition #1 as set forth by the Planning Commission at their meeting of March 23, 1959 be eliminated, seconded by Commissioner Crisp. Carried unanimously, -5- SDR-146 B. SDR-146 - W. Seagraves' Seagraves Since a new map has been submitted and conditions have not been received from County technicians the matter was continued until the next meeting. SDR-156 C. SDR-156 - H~ G. Zimmerman Zimmerman The Secretary read a letter from Mr. Zimmerman of 2481 Richard Court, Mountain View, California, in which he wished to discuss conditions #1, #2, #3, #4, #5, #7, #11, and #12 as set forth by the Plannlng Commission at their meeting of November 9th. Mr. Zimmerman'spoke from the floor. Commissioner Higgins moved that no change in the original conditions be made, seconded by Commissioner Anderson. Carried unanimously. V PETITIONS AND GRIEVANCES A. WRITTEN General 1. Secretary read a letter from the Planning Consultant Plan dated November 13, 1959 suggesting a date for a study session in connection with the General Plan. The Commissioners agreed to set the date of 12/21/~9. Subdivision 2. The Secretary read a letter from the County of Santa Fuller & Peabody Clara Planning Commission relative to a tentative sub- div'ision map submitted by F~ller and Peabody concerning property on Canon Drive. The Chairman referred this matter to the Subdivision Committee for handling with the County of Santa Clara. Commissioner Higgins moved for adjourmment at 10:50 P. I4., seconded by Commissioner Anderson. Carried unanimously.
