C6mmissioner Crisp moved for approval of the minutes as written
and distributed. Commissioner Higgins seconded. Carried unan-
imously.
II PUBLIC BEARINGS
USE PERMITS
1. UP-15 - saratoga country Club 7:08 P.M.

Saratoga The Secretary read the application for a use permit to

Mr. Dell R. Ross, representing the Saratoga Country Club,
spoke in favor of the use permit.
No one spoke against the use permit.
The Chairman ordered the public hearing closed at 7:15 P.M.
and referred the matter to the subdivision committee for
report at the next regular meeting.
2. UP-16 - A. E. Beckham 7:20 P.M.

Beckham The Secretary read the application for the use permit for
auto'sales and service.
Mr. DiFiore, owner of the adjacent property spoke against
the use permit.
Chairman Bennett ordered the matter continued to later on
the agenda as the applicant was not yet present.

the last Planning Commission Meetingz Thirteen were in opposi-
tion and four were in support of the zoning map.
The following spoke in opposition to the zoning map: D.L.
DiFiore, 1444 Mercer Ave., San Jose; Robert van der Tooren,
representing Mr. Kelley, Saratoga Ave., presented a letter;
Don Ljepava, 13421 Highway 9, presented a petition with 55
signatures; Richard W. Morton, San Jose, attorney for property
owners on Prospect Ave., presented a letter; Robert Morgan,
616 Morris Street, San Jose, owner of property on Saratoga Ave.,
presented a letter; Frank Peterson, representing Paul T.
Michaels, the owner of property at the end of Reid Lane; Dick
Garrod, Mr. Eden Rd., owner of 50 acres of orchard land,
presented a copy of Senate Bill 1461, Chapter 1658; Dan Huttlinge~
representing J. J. Pon, owner of property on Prospect Ave.;
L. Victor Riches, Palo Alto Planner, representing Saratoga Civic
League, presented a letter and figures on taxes.
The following people spoke in favor of the proposed zoning map;
Ross Mosher, Saratoga Creek Drive; Mr. Jacques Bergues, owner
of 17 acres on Allendale and representing ~r. Martin A. Charles,
30 acres on Gardiner Lane and Mr. Giurlani, owner o~ il acres
on Allendale.
Chairman Bennett Closed the public hearing at 8:20 P. M. and
referred the matter to the subdivision committee for study and
report.

The following spoke agianst the issuance of the use permit;

owner of adjacent property.
Chairman Bennett closed the public hearing at 8:34 P.M-
Commissioner Anderson moved that the use permit be granted
subject to the following conditions:
1. The permit be granted for six months from date.
2. Work, service and storage to be condined to structure.
3. No gasoline or other automotive fuel pump or service
shall be installed on the premises.
Commissioner Crisp seconded. Carried unanimously.

Zabelle Commissioner Anderson read the report of the variance com-
mittee dated February 1, 1960.
Commissioner Anderson moved that the application for a
variance be denied. Commissioner Crisp seconded. Carried
UNANIMOUSLY.
8. C-25 - Sacred Heart Church

Sacred Commissioner Parden moved that the proposed rezoning to R4-H
Heart
Church be recommended to the City Council with the condition that
if construction is not started in two years from date of
rezoning that the property will revert to the present zoning.
Commissioner Crisp seconded. The following roll call vote
was recorded.
AYES: Anderson, Crisp, Higgins, Parden
NOES~ Bennett
Joseph McKernan, Real Estate Representative of the Church
and Father Geary spoke in favor of the rezoning.
Commissioner Parden moved that the proposed rezoning to R4-H
be recommended to the City Council with the condition that

if construction is not started within one year from the date

B. SUBDIVISION AND BLDG. SITE APPROVAL

this matter was continued to later in the meeting.

Turner Mr. Turner stated that he would have a new map on file
shortly.
Chairman Bennett ordered the matter continued to the next
regular meeting.
3. SDR-171 - Wilson-Hillyard

Wilson Commissioner Anderson read the report of the Subdivision

Mr. Hilljard stated that he understood the conditions.
Commisioner Crisp moved that the tentative map submitted on
January 29, 1960 be approved subject to the conditions read
with the following corrections being made:
3. Construct double seal coat oil and screenings (or
better) driveway approach 16 feet wide from edge of
existing paving to property line for each site.
4. Install 12" Corrugated metal pipe under each driveway.
Commissioner seconded. Carried unanimously.

dated February 4, 1960.
Mr. Bell stated that he understood the conditions.
Commissioner Anderson moved for approval of the tentative
map subject to the conditions as read. Commissioner Crisp
seconded. Carried unanimously.

Seagraves Commissioner Anderson read the Subdivision Committee report
dated February 4, 1960.
Maurice Rankin, attorney for ~. Seagraves, discussed the
conditions with the Commissioners. Mr. Seagraves, discussed
the conditions, and stated that he understood the conditions.
Commissioner Anderson moved for approval of the tentative
map subject tO the conditions as read. Commissioner Crisp
seconded. Carried unanimously.
6. SDR-174 - H. Agard

Agard Commissioner Andrsson read the report of the Subdivision
Committee dated February 4, 1960.
Mr. Agard discussed condition No. 6 with the Commissioners.
Commissioner Andsrson moved for approval of the tentative
map subject to the conditions as read. Commissioner Crisp
seconded. Carried unanimously.
7. SDR-175 - Westbrook

Committee dated February 4, 1960.
Commissioner Anderson moved for disapproval of the ~entative
map as per the repor~ read. Commissioner Crisp seconded.
Carried unanimously.

Morgan C~mm~ssioner Anderson stated that additional information was
needed before conditions could be set.
Chairman Bennett ordered the matter continued to the next
regular meeting.

Cox Commissioner Anderson reported that due to reports from the
(Cont.)
County technicians and the Planning Consultant the SubdivisiOn
Committee recommended denial.
Commissioner Anderson moved for denial of the tentative map

Cox because inadequate design. Commissioner Parden seconded.
Carried unanimously.
C. ARCHITECTURAL AND SITE CONTROL

Saratoga Commissioner Higgins reported for the Architectural and Site
Swimming
Club Control Committee.
Commissioner Higgins moved that the Architectural and Site
Control permit be granted subject to the following conditions:
1. The chain at the entrance and exit to the parkin~
area not be required at the present time; to be
added later if needed.
2. In place of cyclone fencing around the parking area
a hedge fence may be used.
Commissioner Andsson seconded. Carried unanimously.

A. 'BUILDING SITES

Thompson The Secretary read a letter from Louise Thompson received
February 2, 1960, regarding two conditions in the Building
Site Approval File.
CommiSsioner Anderson read the report of the Subdivision
Committee dated February 6, 1960.
Mrs. Thompson discussed the report with the Commissioners.
Commissioner Anderson moved to mod.'.~y.3~the~conditions set on
Commissioner Crisp seconded. Carried unanimously.
2. SDR-147 - Emery Deimas

Delmas ~e Secretary read a letter in the file dated February 5,
i96o~ asking for postponement to the agenda of February 23,
1960.
Chairman Bennett ordered the matter continued to the next
regular meeting.

Commissioner Higgins moved for approval of the request.
Commissioner Pardon seconded. Carried unanimously.
Commissioner Higgins moved that the Secretary be authorized
to renew, at her discretion, subdivision sign permits as out-
lined under Section 3.2 of Ordinance 3A-lO. Commissioner
Anderson seconded. Carried unanimously.

had ~een distributed to the individual Commissioners and
