TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Crisp, Higgins, Parden, Webster Absent: Tiffany B. MINUTES Commissioner Bennett moved for approval of the minutes as distributed and read. Commissioner Parden seconded. Carried unanimously. II PUBLIC HEARINGS A. USE PERMITS 1. UP-19 - San Jose Water Works - 7:06 P.M. UP-19 The Secretary read the application for the Use Permit. S.J.Water Works Norman Andrews, San Jose Water Works, explained the application to the Commissioners. No one else spoke from the audiance either for or against the Use Permit. Chairman Webster closed the public hearing at 7:15 P.M. Commissioner Anderson moved that the Use Permit be granted. Commissioner Crisp seconded. Carried unan- imously. -1- B. VARIANCES 1. V-170 - S. G. Hernandez - 7:16 P.M. V-170 S.G. The Secretary read the application for a variance. Hernandez Warren Held, Architect for Mr. Hernandez, spoke in favor of the variance. The Secretary read two communications in the file from Joseph and Emma Horvath and Mrs. Amelia Costa, expressing no objections to the variance. No one else from the audiance spoke for or against the variance. Chairman Webster closed the public hearing at 7:25 P.M. Commissioner Bennett moved that the variance as applied for be granted. Commissioner Crisp seconded. Carried unanimously. 2. V-171 - W. H. Kelly - 7:26 P.M. V-171 W.H. The Secretary read the application for the variance. Kelly The following spoke in favor of the variance: Robert Van Der Toorren, Architect for the applicant; Lloyd Baker, Engineer for the applicant; Mr. W. H. Kelly. William R. Puder, 19680 Crestbrook Drive, stated his interest in the variance because the Kelly land ad- joins his property. Chairman Webster ordered the public hearing continued to the next regular meeting and ordered the matter re- ferred to the Variance Committee for report at that time. -2- III MATTERS REFERRED FOR REPORT A. REVISION OF RESIDENTIAL LOT SIZES Revision Commissioner Anderson reported for the Subdivision Comm- Res. Lot Sizes ittee, stating that the work wms progressing, but that the report has not yet been prepared. Chairman Webster deferred the report on the revision until the second meeting in May. B. ZONING AT SEAGULL AVENUE AND HIGHWAY 9 Zoning Commissioner Anderson read the Subdivision Committee Report, Seagull & Highway 9 dated April 24, 1960. Commissioner Higgins moved that the written report be adopted as read and be transmitted to the City Council and the Planning Consultant. Commissioner Bennett seconded. Carried unanimously. C. FUTURE SCHOOLS IN SARATOGA UNION SCHOOL DISTRICT Future Co~eissioner Higgins reported on his meeting with Dan Ungaro, Schools Sar. Union Superintendent of the Saratoga Union School District. After School Dist. studying the matter, the School District will notify Comm- issioner Higgins of its decision prior to the next regular meeting. Chairman Webster directed the Secretary to contact the Plann- ing Consultant regarding the need for this information in drawing up the General Plan. If the information is needed before May 10, a special meeting of the Planning Commission will be arranged. Chairman Webster further ordered the Secretary to inform the Planning Consultant that no action be taken on the future schools until he is notified that the Planning Commission has taken action on it. -3- IV COMMITTEE REPORTS A. ARCHITECTURAL AND SITE CONTROL 1. A-22 - Prince of Peace Lutheran Church A-22 Prince Commissioner Higgins reported favorably for the Archi- of Peace Luth. Church tectural and Site Control Committee. Gifford Sobey, Architect for the church, explained the application to the Commissioners. Commissioner Higgins moved that the permit, A-22, be granted. Commissioner Parden seconded. Carried unan- imously. 2. A-23 - John Lyngso ' A-23 Commissioner Higgins reported for the Architectural and John Lyngso Site Control Committee. Mr. Lyngso explained the application to the Commissioners. Commissioner Bennett moved that Architectural and Site Control approval be granted for the bins as shown on Exhibit "A", but that action on the sign be continued to a later date. Eommissioner Parden seconded. Carried unanimously. B. SUBDIVISION AND BUILDING SITE APPROVAL 1. SDR-185 - Mrs. Ruth Vogel SDR-185 The Subdivision Committee Report, dated April 22, 1960, Ruth Vogel was distributed to the Commissioners and the applicantS. bk. and Mrs. Vogel discussed the conditions with the Commissioners. The City Administrator recommended that a title search be made and the matter referred to the City Attorney. -4- SDR-185 Commissioner Bennett moved that SDR-185 be approved, Ruth Vogel subject to the eleven (11) conditions in the Subdivi- sion Committee Report distributed. Commissioner Higgins seconded. Carried Unanimously. 2. SD-191 - Gresham Construction Company SD-191 The Secretary stated that new maps had not yet been re- Gresham Const. Co. ceived by the City Offices. Chairman Webster ordered the matter continued to the next regular meeting. 3. SDR-194 - Post Office SDR-194 Commissioner Anderson reported on a meeting with the Post Office Post Office Department regarding the site development plan. George Whalen, Postmaster, spoke regarding the site location. Chairman Webster ordered the matter continued to the next regular meeting. 4. SDR-196 - Ray D. Hartman SDR-196 The Subdivision Committee Report, dated April 22, 1960, R.D.Hartman was distributed to the Commissioners and to Miss Jackson, representing Mr. Hartman. Commissioner Anderson moved that the tentative map be approved subject to the conditions in the report dis- tributed. Commissioner Parden seconded. Carried unan- imously. -5- 5. SDR-197 - J. H. Colby SDR-197 The Subdivision Committee report, dated April 22, 1960, J.H. Colby was distributed to the Commissioners and toM=. Loughrin, representing Mr. Colby. Commissioner Anderson moved for approval of the tenta- tive map, subject to the conditions listed in the report distributed. Commissioner Crisp seconded. Carried unan- imously. 6. SDR-198 - J. Bonacina SDR-198 Commissioner Anderson stated that the subdivision Comm- J. Bonacina ittee Report was not ready on this matter, as the tech- nicians' report had not been received. Chairman Webster ordered the matter continued to the next regular meeting. 7. SD-199 - Town and Country Realty SD-199 The Secretary stated that revised maps of SD-192, which Town & Country Realty was denied approval at the last Planning Commission Meeting, had been received by the City Office and assigned a new file number. Commissioner Parden moved that the filing fee on SD-199 be waived. Commissioner Higgins seconded. Carried unanimously. Chairman Webster ordered the matter continued to the next regular meeting. 8. SDR-200 - Saratoga Inn SDR-200 The Subdivision Committee Report, dated April 22, 1960, Saratoga Inn was distributed to the Commissioners and to Mr. Warren -6- SDR-200 Held, Architect for Saratoga Inn. Saratoga Inn Commissioner Anderson moved for approval of the tenta- tive map, subject to the conditions on the report dis- tributed, except for the following changes, Conditions 7, 8 and ll to read as follows: 7. Acceleration and deceleration lanes to be built for each entrance, subject to approval of the Director of Public Works. 8. Irrevocable offer of dedication for 45 ft. half street on Saratoga Avenue. ll. Dedicate 20 ft. easement for underground cul- vert along westerly property line to city of Saratoga. commissioner crisp seconded. Carried unanimously. 9. SDR-203 - San Jose Water Works SDR-203 A list of recommended conditions, dated April 25, 1960, S.J. Water Works proposed by the Director of Public Works, was distribut- ed to the Commissioners and to Mr. Norman Andrews, rep- resenting San Jose Water Works. Mr. Andrews discussed the conditions with the Commiss- ioners. Commissioner Anderson moved for approval of the entire San Jose Water Works property at this site, subject to the conditions written and distributed, except that Condition 2 be changed to read - "To provide 18 ft. minimum width access road from Saratoga Hills Road to entrance to property." Commissioner Parden seconded. Carried unan- imously. -7- V PETITIONS AND GRIEVANCES A. WRITTEN 1. Fremont High School District - Re: High School Site Fremont The Secretary read a letter from the Fremont High High School School District, dated April 5, 1960, requesting approval of a site for a future High School, and stated that a Use Permit Application had been sent to the School District. No reply has been received to date. After discussion among the Commissioners, Commissioner Parden moved that the requested approval be denied. Commissioner HigginS seconded. Carried unanimously. Commissioner Crisp moved that a letter be sent to Fremont High School District, signed by the Chairman of the Planning Commission, stating the reasons for the action taken, copies to be sent to other interested parties. commissioner Parden seconded. Chairman Webster stated that an invitation had been re- Campbell ceived from the Campbell Union School District to the Union School District Open House at their new administrative building on April 29, 1960. 3. Chairman Webster directed that the letter from George General Plan Cooper, regarding the General Plan, be referred to the Planning Consultant. B. ORAL 1. Chairman Webster stated that Mrs. Margaret J. Regan, Margaret Secretary of the Planning Commission, was attending J. Regan her last Planning Commission Meeting. -8- Margaret Commissioner Parden moved that a Resolution be passed J. Regan commending Mrs. Regan for a job well done. Commissioner Higgins seconded. Carried unanimously. Commissioner Parden moved that James Huff, Director of Public Works, be appointed Secretary of the Planning Commission, Pro Tem. Commissioner Bennett seconded. Carried unanimously. 2. Mr. Colby discussed the conditions of SDR-197 with SDR-197 the Commissioners. V-170 3. S. G. Hernandez requested a refund of filing fee of Hernandez V-170. No action was taken by the Planning Commission. Shelly 4. Shelley Willjams discussed the matter of Swi~ing Pools Willjams and wire clearance easements with the Commissioners. The City Administrator stated that this was a matter for the City Council. Commissioner Parden moved for adjournment at 10:05 P.M. Comm- issioner Anderson seconded. Carried unanimously.
