A. ROLL CALL
Present: Anderson, Bennett, Crisp, Glenn, Parden, Webster
Absent: Higgins
B. MINUTES
Commissioner Parden moved that the minutes be approved as dupli-
cated and distributed. Commissioner Glenn seconded. Carried
unanimous ly.
II PUBLIC HEARINGS
A. VARIANCES
1. V-179 - Dr. D. M. Bissell - 7:03 P.M.
V-179 Lot 40 - Wildwood Heights
Sissell
The Secretary read from the application for the variance
and a letter from George S. Kocher, supporting the appli-
cation.
Dr. Bissell and Mr. Kocher, his Architect, spoke~
Chairman Webster closed the public hearing at 7i16 P.M.
Commissioner Parden gave the Variance Committee Report.
Commissioner Bennett stated that an aesthetic hardship
exists, and this constitutes a physical hardship.
Commissioner Parden moved that V-179 be denied. Commis-
sioner Crisp seconded. The following roll call vote was
recorded:
Ayes: Anderson, Crisp, GlePm, Parden, Webster
Noes: Bennett
Absent: Higgins
Motion Carried and the Variance Application is Denied.
Dr. Bissell asked if possible to have matter reconsidered.
Chairman Webster stated tha~ if new evidence could be pre-
sented, V-180 could be reopened; that the action of the
Commission did not indicate a desire to keep people from
building in Saratoga, but that the grounds for granting a
Variance were inconclusive.

Swain The Secretary read the application; letters from Mrs. Clara
Goetz, 21142 Sullivan Way, Mr. and Mrs. Bruce E. Boyer,
211~O Sullivan Way, expressing approval of the variance
and a letter from I~. Swain stating that he was out of
town and could not attend the hearing.
Commissioner Crisp stated that an elevation plan was needed
to show actual slope in relation to the proposed building
and or a cross section of the alternate plans.

V-180 Chairman Webster ordered the Public Hearing continued to
Swain the next regular meeting, and requested the filing of pro-
posed elevations of the house, and a cross section of lo-
cation at the required setback and at the requested set-
back, by the applican~ before the next meeting.
III COMMITTEE REPORTS
A. ARCHITECTURAL AND SITE CONTROL
1. A-30 - Kraules Jeweler - Sign

Kraule Commissioner Bennett gave the recommendation of the Arch-
itectural and Site Control Committee that the maximum height
be limited to 12 inches.
Commissioner Anderson stated that sign could only be seen
from across the street, so didn't need to be large. He
pointed out that it was not offensive with only 2 letters
16 inches high and all other letters 6 inches lower.
Commissioner Bennett asked if recommendation of 12 inch
maximum height letters sent to the Planning Consultant
was what was intended.
Commissioner Anderson stated that he had been thinking of
all capital let+'ers and that this made a difference.
Commissioner Bennett questioned the advisability of permit-
ing a sign which would be unacceptable three years after
the passi~ of the sign ordinance.
Mr. Ernest Kraule stated that the sign had been made before
the application was filed.
Commissioner Crisp mentioned that the Bank had been turned
down when it requested larger letters.
Commissioner Bennett moved that the sign be approved, with
the limitation that none of the letters exceed 12 inches in
height, for Architectural and Site Control Permit. Com-
missioner Parden seconded. The following roll call vote
was recorded:
Ayes: Anderson, Bennett, Glenn, Parden, Webster
Noes: Crisp
Absent: Higgins
Motion Carried with the above limitations.
B. SUBDIVISION AND BUILDING SITE APPROVAL
1. SDR-233 - Linton Real

Co~miesioner Anderson referred to the Map Act which permits,
when lots of one acre or more are involved, Subdividers,
Mr. Dollard of Mt. Eden Estates, to sell lots after 'only'
getting tentative approval of the Subdivision Tentative
Map. He questioned Mr. Dollard's having told the purchasers
of these circumstances. He read Section 4.4 of Ordinance
23 regarding the setting of Conditions by the Pl~ing Com-
mission.
Mrs. Monroe, Mrs. Real's Builders wife, represented Mr. and
F~s. Real.
The Commissioners discussed Condition 6.
Chairman Webster questioned the clarity of Conditions 7 and
8, stating that No. 8,phrased in a very broad manne~
should be more specific.
SDR-233 Mr. Huff stated that it was not the intent to have Pierce
Real Road improved by private individuals at this time. The
condition referred only to extending the edge of existing
paving to the edge of the diversion channel.
Commissioner Anderson moved that SDR-235, Linton Real, be
granted Tentative Building Site Approval subject to the
11 conditions on Exhibit "X" with Condition 7 to read as
follows:
"Submit a 15 foot drainage easement along the proposed
water course diversion to the City of Saratoga or its
nominee."
Commissioner Parden seconded. Carried unanimously.
2. SD-235 - Brown & Kauffms~n

Brown & Commissioner Anderson stated that there was a letter in the
Kauffmann file granting extension to October 28, 1960, and that new
maps had been submitted.
Chairman Webster ordered SD-235 - Brown & Kauffmann be con-
tinued to the next meeting.
3- SDR-237 - Dr. T. E. Lewis

Lewis Dr. Lewis was present and stated that he agreed to the con-
ditions.
Commissioner Crisp moved that 8DR-237 be granted Tentative
Building Site Approval subject to the 9 conditions on Ex-
hibit "X". Commissioner Parden seconded. Carried unani-
mously.
4. SDR-238 - H. G. Zimmerman
SDR-238 i lot - Pierce Road - Mr. Eden Estates
Zimmerman
S. S. Williams represented Mr. Zimmerman.
Commissioner Anderson moved that SDR-238 be granted Tenta-
tive Building Site Approval subject to the 9 conditions on
Exhibit "X". Commissioner Crisp seconded. Carried unani-
mously.
5. SDR-239 - Barbara Caldwell

Caldwell Commissioner Anderson stated that the map submitted with
the application did not have the correct Contours shown,
and that a new map was to be submitted.
Chairman Webster ordered SDR-239 continued to the next
meeting.
6. SD-2~2 - O. C. Cox
SD-2~2
Cox Commissioner Anderson stated that the Highway Department
objects to the road placement as shown on the tentative
map, that time would be needed to work on this problem
and that there was a letter in the file granting an ex-
tension of 30 days for action on SD-242.
Chairman Webster ordered SD-2~2 continued to the next
meeting.
7. SD-245 - Robert Kirkwood

Kirkwood Commissioner Crisp stated that Henry D. Gilbert, engineer
for the applicant, had seen a copy of the conditions and
that they were satisfactory, if the rights-of-way asked
for in condition no. 12 could be obtained from the "Owner".~
Commissioner Crisp moved that SD-2~3 Tentative Map, Exhibit
"B", submitted September 20, 1960, be approved subject to
the l~ conditions on Ex. hibit "X". Commissioner Glenn secon-
ded.
Commissioner Bennett questioned the propriety of the dedica-'
SD-243 tion and improvements of condition lO. Stating that this
Kirkwood property was not properly involved with the Flood Control
District, since there was no stream involved.
The Motion was unanimously carried.
IV OLD BUSINESS
A. REQUEST FOR EXTENSION OF TENTATIVE BUILDING SITE APPROVAL
1. SDR-15~ - Jack Blackwell

Blackwell Commissioner Anderson moved that SDR-154 Tentative Approval
be extended for one year from the expiration date, November
9, 1960. Commissioner Crisp seconded.
Commissioner Anderson stated that the matter more properly
was a concern of the Count~ since only a very small portion
of the site is in the City of Saratoga, with the actual
home site in the County.
The motion unanimously carried.
VPETITIONS & GRIEVANCES
A. WRITTEN
1. Requests for Reconsideration of Conditions of Tentative
Approval.
a. SD-216 - Clay Development Co.
SD-216
Clay The Secretary read a letter from Clay Development Co.
Dev. Co. asking for reconsideration of conditions 17 and 18 set
on Tentative Subdivision Map July 25, 1960, and read
the two conditions.
Commissioner Higgins arrived at 9:25 P.M~
Commissioner Glenn gave the Report of the Subdivision
Committee on reconsideration of Condition No. 17- The
Commissioners discussed the possibility of setting a
precedent if.they did not require the posting of a bond
after originally requiring one.
Mr. Woolworth, Subdivider, stated that they were widen-
ing Quito Road to a conforming width now, and to do
more at this time imposed an undue hardship; that an
assessment district would probably be formed when and
if Quito Road was widened.
Mr. Walters, subdivider, stated that the lot fronting
on the footage in question, had an existing dwelling
on it.
Commissioner Parden moved that so much of Condition No.
17 as reads "Post Bond adequate to provide for construc-
tionof 50 foot half-street within 5 years subject to
renewal for additional 5 years." be struck out and that
Condition No. 18 be retained. Commissioner Anderson
seconded.
Commissioner Crisp moved to amend the motion "Post
Bond for i year subject to extension beyond that time."
Commissioner Bennett seconded. The motion to amend the
motion did not carry.
The original motion was unanimously carried to amend
Codition No. 17 by deleting the second sentence and
retaining the rest of the original condition, with
Condition No. 18 to remain unchanged.
Chairman Webster recessed the meeting at 9:05 P.M. The meeting was
called to order at 9:15 P.M.
b. SDR-236 - Robert C. Jones
SDR-236
Jones Chairman Webster read a letter from the applicant re-
questing reconsideration of Cenditions 5, 8 and lO.
Mr. Jones stated that Condition 8 could not be complied
with since Mrs. Pickering refused to sell or dedicate
any of her property under any circumstances.
Commissioner Anderson stated that if and when Mrs.
Pickering developes her property, she would most cer-
tainly be required to comply with the same type of
condition.
Commissioner Anderson moved that Conditions set on
SDR-236 be amended as follows:
No. 5 to read - "The existing well may be used subject
to the following conditions;
1. All sewer lines ~re located lO0 feet from
the well.
2. Approved cross-connection device is installed
on water utility service to frame.
3. Well head is protected to prevent entry into
casing of foreign objects."
No. 8 to be deleted.
No. lO - The name of the Fire District be changed to
read "Central Fire District".
Commissioner Parden seconded. Carried unanimously.
c. SDR-2$1 - Roman T. Chavez
SDR-241
Chavez Chairman Webster s,~mmarized a letter from Mr. Chavez
asking for reconsideration of Condition 4 of Tentative
Building Site Approval granted September 26, 1960.
The Secretary read Condition No. ~.
Commissioner Anderson stated that Condition No. 4 was
in accordance with existing Ordinance 23, Section 1.2,
~.1, ~.2c,
No one was present to represent the applicant.
Commissioner Bennett moved that the request for relief
from condition No. $ be denied. Commissioner Higgins
seconded. Carried unanimously.
B. ORAL
Commissioner Anderson stated that the Subdivision Committee of
the Planning Commission and the Planning Committee of the City
Council will meet with the Planning Consultant to discuss the
forthcoming Zoning Ordinance. Tentative Date, October 26, 1960.
Commissioner Glenn will attend the City Council Meeting October
19,,'o~ommisstone~ Parden .will attend the November 2 Meeting and
Commissioner Higgins will attend a later meeting due to prior
committments.
