PLACE: Fruitvale School, Fruitvale Avenue, Saratoga, California TYPE: Regular ~eeting I ROUTINE ORGANIZATION Meeting was called to order by Chairman Webster at 7:02 P.M. A. ROLL CALL: PRESEh~: Anderson, Bennett, Crisp, Glenn, Higgins and Webster. ABSENT: Parden B. MINUTES Motion by Commissioner Bennett, seconded by Commissioner Glenn that minutes of the meeting of December 12, 1960 be approved as written. Motion carried. II PUBLIC HEARINGS A. Y-77 T S..G~ Hernandez .. Chairman Webster requested Secretary to give the back- ground on the letter from Mr. Hernandez dated December 9, 1960. Secretary read said letter. City Administrator explained to the Chairman that Mr. Hernandez had received V-77 a Variance for four (4) additional units. A letter dated Hernandez June 12, 1958 from the City of Saratoga to Mr. Hernandez was read by Secretary stating the City Planning Commis- sion had noted that time limit for removal of Unit 8 would terminate on December 15, 1960. The Commissionerss examined the plot plan. Mr. Hernandez stated he needed storage facilities and that in removing the garage, the area would be available for parking; definitely no other structure would be built as ingress and egress to his property would be enhanced. Commissioners Crisp and Glenn had visited the premises; recommended that a change in the conditions on a Variance granted previously should be approved. ~l- Minutes (Cont'dl December 27, 1960 PUBLIC HEARINGS (Cont'd) Chairman Webster inquired of Mr. Hernandez how much time the removal would require° Commissioner Higgins moved that the change in conditions of a Variance previously granted be approved until March 1, 1961. Motion was seconded by Commissioner Glenn that the written agreement heretofore executed by Mr. Hernandez in V-77 be amended to omit removal of Unit #8 in its entirety and substitute removing kitchen in Unit #8 approximately eight (81 feet wide, plus removal of the garage directly opposite Unit #8 and that the removal be accomplished by~rch 1, 1961. Motion carried. The Chairman directed Secretary to see that the modifications and exceptions be carried out by Mr. Hernandez. B. V.-183 - The Saratoga Federated Church - Saratoga-Los Gatos Road and Oak Place. The Secretary stated that Notice of Public Hearing had been mailed to surrounding property owners. Mr. Gifford Sobey, representing The Saratoga Federated V-183 Church, displayed a colored picture of proposed Church Federated Church addition. There was a general discussion among the Commissioners regarding the parking problem on Sunday, but which did not apply during the week. The Chair- man also spoke on the reduction of required parking spaces. No one but Mr. Sobey asked to speak on this matter. Motion made by Co~issioner Glenn, seconded by Commissioner Crisp, that the Variance be granted and that the Applicant be allowed a 38 foot height structure; that the 81 off-street parking spaces be accepted subject to Architectural and Site Control; subject to the Applicant's maintaining the parking spaces on the portion at the intersection of Oak Place and Park Drive. Chairman Webster asked Mr. Frank Verdier, represent- ing Mr. Barthold, if it would be agreeable with him to permit the Planning Commission to consider S~-2~4- Peck L. Merrick. Mr. Verdier had no objection. III. CO~M~.ITTEE REPORTS A. SUBDIVISIONS AND BUILDING SITES SDR-244 Peck L. Metrick - i Lot off Merrick Drive. Attorney Bonacina stated he could hardly see any point in repeating the facts already given to the Commis- sion, and did not know what else he could present. He also stated he had discussed it with the City Attorney and thought he had eliminated the corridor situation. He requested a continuance to work out the situation. Commissioner Anderson stated he could clarify the Subdivision Committee's Report on the matter. The Subdivision Committee recommended dis- SDR~2~ Metrick approval because o~ poo~ t~esign, the lot is a cor- ridor lot because the proposed access road stops at the lot. Therefore, this lot does not have required area of 20,000 square feet in accordance with Ordi- nance No. 3A-8. Mr. Bonacina said that if he had 60 feet on the access road he thought the map could be redesigned. Commissioner Anderson made reference to the City Attorney's opinion dated November 14, 1960. Mr. Bonacina asked for suggestions to be made and permission to redesign said 60 foot frontage, but could not ask f6r a decision for Mr. Metrick at this meeting. Commissioner Anderson's suggestion was to design the lot to conform to Ordinsnce No. 3A-8. Mr. Bonacina stated he does not ~mnt any more than any- one else, but that they had a very serious problem which the developer had created. Commissioner Bennett Minutes (Cont'd) December 27, 1960 ~. SUBDiVIS~ONS AND BUILDING SITES (Coni'd) asked Mr. Bonacina if he would like %o have 2 weeks extension. Mro Bonaci~m indicated he would, and SDR-2~ would see Mr. Gilbert, the Engineer. Commissioner Metrick Bennett suggested to Chairman Webster this matter be continued to meetinZ of January 9, 1961. It was so ordered. V-18~ - Robert Barthold, Jr., - 1991~ Glen Brae Drive Chairman Webster requested Mr. Frank Verdict, who represents Mr. Barthold, to explain the situation briefly. Commissioner Anderson said that Lot A(l~9) was a comer lot and asked Mr. Verdict if Glen Bra(. or LanarkLane was considered front yard. Mr. Vet- diet explained that the Post Office had provided 3 addresses for the 2 original lots. Commissioner V-18~ Barthol_d Anderson asked the City Administrator if the Planning Commission could determine which is the front or rear yard. City Adn~inistrator replied yes. It was de- termined that the rear yard of Lot A adjacent to lot in question was on Lanark Lane. Mr. Verdict stated that Lot B would provide sufficient room for a fine type home. The Chaii~nan asked for any further ques- tions from the audience. Mr. Carl Bailey spoke from the audience stating he lived across the street on Lanark Lane and desired to know ~-hat implications, if any, were to be derived from the decision that Lot rear yard was on Lanark. Mr. Bailey was satisfied with the explanation he received. Moved by Commis- sioner Crisp, seconded by Commissioner Glenn that the request for Variance be granted since the granting of the Variance would not allow this lot any privilege not enjoyed by other lots in the area. Continued fro~ mapping o~ November 28, 1960. The Chairman requested Secretary to read letter from Mr. Kirkwood dated December 16, ]-960. Secretary read said letter which stated Mr. Kirh~ood would be on vacation through Jammry 6, 1961 and unable to attend current meeting. Commissioner Anderson recom- SDR-243 Kirlc~ood mended the Chaix~an appoint a Committee to meet with Councilmen Glennon and Hartman. Chairman Webster ordered the matter confirmed to the January 9, 1961 meeting, and directed the Secretary to write Mr. Kirkwpod. SDR-2~9 - Robert Barthold, Jr. - Lanark Avenue - Portion of Lot 126, Tract 1709, Saratoga Glen. Continued from ~e~ing of December 12, 1960. It was moved by Commissioner Anderson, seconded by Commissioner Higgins that SDR-249 be granted tenative SDR-249 ~arthold Building Site Approval, subJsct to the six (6) con- ditions in the Subdivision C~mmittee's Report dated December 23, 1960. There being none, Commissione~ Anderson moved, seconded by Con~issioner Crisp that SDR-251 be granted tentative Building Site Approval, subject to ~he six (6) conditions in Subdivision Committee Report of December 23, 1960. SDR-252 - The Saratoga Federated Church - Saratoga-Los ~atos Road and Oak Place Mr. Gifford Sobey discussed the plans with the Plan- ning Commission and stated he wou].d not like to take down the old Acacia trees if full paving requirements -5- Minutes - Cont'd) December 27, 1960 A. SUBDIVISIONS AND BUILDING SITES (Cont'd) were necessary . Commissioner Anderson suggested that Mr. Huff, Director of Public Works, would be able to help with the problem. Motion was made by Commissioner Anderson, seconded by Commissioner Crisp, SDR-252 that the Saratoga Federated Church be granted tenta- Federated Church rive Building Site Approval, subject to the eight (8) conditions in the Subdivision Committee Report of December 23, 1980. Motion carried. B. ARCHITECTURAL AND SITE CONTROL A-37 - LuRay Company, In., Plumbing. Continued from ~petin~ of December 12, 1960. The Chairman turned the matter over to Commissioner Higgins who expressed the thought that some policy should be made by the Planning Commission on Archi- tectural Control. Commissioner Bennett stated that corrugated iron is a fire trap. Commissioner Anderson inquired whether concrete block structure would be more suitable and asked the City Administrator if the City of Saratoga could control the types of material. A-37 The City Administrator stated we had adopted the LuRa¥,Inc. Uniform Building Code and must act accordingly. Com- missioner Higgins suggested the Planning Commission should formulate a ~uide. Commissioner Bennett is opposed to any corrugated iron structure in Saratoga. At this point Chairman Webster gave recognition to CounciLman Drake being in t~e audience and thanked him for his attendance. Also, the Chairman asked Council- man Drake for any comments on Architectural Control in C-S Zone. Councilman Drake stated there was no Architect on the City Council, but would welcome a joint study group to begin obtaining some basic rules. Commissioner Crisp sugEested a joint study group mainly for aesthetic reasons. It was the consensus -6- Minutes -(Cont'd) December 27, 1960 B. IV. PETITIONS AND GRIEVANCES A. ~fRITTEN SDR-179 - Sarato~ Inn Secretary read a communication from Lyle Benson of Saratoga Inn dated December 19, 1960 regarding an ex- tension of Building Site Approval due to expire March 23, 1960. The matter was referred to Subdivision Committee for review.. Secretary read a communication from Livingston & Blaney of December 19, 1960 stating that the new Zoning Ordinance and ~mp will be completed at the end of the month. B. ORAL Commissioner Bennett stated he had several complaints regarding Fruitvale Avenue. It was regarding the nursery on Fruitvale Avenue. He suggested it may be appropriate for the City ~mnager to get in touch with the Times-Observer and Saratoga News. Mr. Howe ex- plained there was nothing that could be done about the nursery until the City of Saratoga has adopted ~he new Zoning Ordinance.
