A. ROLL CALL Present: Bennett, Glenn, Crisp, Parden, Hidins, Andersen Absent: Webster Chairman Webster assumed the chair at 7:05 P.M. B. MINUTES Metion by Comt~sioner Glenn that minutes of meeting of December 1960, be accepted with ~ended first page; as shown on corrected copy distributed; seconded by Co~missioner Crisp; metion carried unanimously° II PUBLIC HEARINGS Chairman Webster declared public hearin~ opened at 7:10 P.M. A. UP-23 - SAN JOSE WATER WORKS - CONGRESS SPRINGS ROAD Mr. Andrews appeared representing the San Jose Water Works in their request for a Use Permit for a seven (7) foo~_, 10,000 gallon water stor- age tank at the location on Congress Springs Road. Cu,auissioner Bennett moved that the present applies- Works tion UP-23 be approved subject to the same conditions specified by Resolution No. A3-1 dated June 22, 1959, which pertained to Arehitac~ural and Site Control for the filter plant on Congress Spriu~s Road, seconded by Ce-.~ssioner Crisp; motion carried. Metion for amendment to the Resolution No. A3-1 as adopted, addin~ to Condition 1 the words "except that the tank may be retained in nattral redwood", by Counissioner Glenn; seconded by C~tssioner Parden; matron carried. COI~1TTEE REPORTS A. SUEDIVISIONS & BUILDING SITES 1. SD-243 - RO.B_ERT KII~IqOOD .- BELLA VISTA & HORSESHOE DRIVE Continued from meetlu~ of December 27~ 19~0. Secretary read a letter SD-2~3 Robert from Hr. Gilbert of Hark Thomas & Co., representin~ V~T. Kirk~oed, Kirkwood requestin~ a delay of action in this matter. Chairman Webster ordered SD-2~3 continued until the next meetin~ on January 23~ 1961 at the request of the applicant~e a~ent. Secretary reported that the date of January 25, 1961 has been set for a joint meeting of Planning Commission and City Connell c~lttees to study the curb and gutter problem. 2. SDR-244 - PECK L. MERRICK - I LOT OFF MERRICK DRIVE Continued from meetin$ of December 27, 1960. Secretary read a letter SDR-244 from applicant's attorney requesting a conC!n,~ce until January 23s 1961 Peck L. Metrick due to engineer's absence from the city. Chairman Webster ordered SDR-244 continued until the next meeting on January 23, 1961. 3. SDR-2~3 - MRS. R. J. STILES - 1 LOT AT FIFTH &OAK STR~.ETS Co..~.~.t eelsnor Anderson read the Subdivision Co--n~ttee~s report recommend- SDR-253 inS approval of the application subject to the nine (9) conditions R.J. presented. Motion by Comm~ssioner Anderson that SDR-253 tentative map Stiles for Building Site Approval be appreved subject to the nine (9) conditions listed on the Subdivision Committee's report dated January 9, 1961~ se- conded by Commissioner Crisp; motion carried. IV PETITIONS & GRIEVANCES A. WRITTEN 1. ABANDONMENT OF RAMSEY DRIVE~ TRACT 1690~ SAI~TOGA GLEN Director of Public Works stated that investigation reveals this street has not been abandoned by the City and since it was a condition of the Tentative Approval of IYact 1709 that the pavement be obliterated, he Ramsoy sUggested to the Comm{ssion that they reconunend the abandonment to the D~ive City Council for action, Commissioner Parden was excused from partici- patirlg in the discussion and abstained f~om voting on this matter since he owns property directly adjacent. He stated that he had no prior knob- ledge that this issue would come before the Ccm~ssion at this ~otton by Co~lsstoner Biggins that the Pl~nnin~ C~lsslon recommend to the City Council to declare abandonment of Ramnay Drive as shown on map of Tract 1690s Saratoga Glnn; seconded by Commissioner.Glenn.' -' .A~eS: Webster, Anderson, Crisp, Glenn, Hi~gins, Bennett. Abstaining: Parden Motion carried. Evidence was submitted to the Commission that ~he land in Tract 1709 behind Rmusey Drive is already developcd with residences. X ..-.' : · u. .' -2- -, .. "L : .. ... 2, ROJERT EORGAN - TBACTS 2720 & 2725 Secretary read a letter dated December 23s 1960 f~om Robert Morgan request- lng extension of tentative approval of tentative maps for Tracts 2720 and Robert 2725 to June 1~ 196ls since~ due to financial di~ficultiesJ he would be 1,IDrgan Tracts unable to present the final maps by the date of expirazion~ January 25s 2720 & 2725 1961. Connissioner Anderson wished to go on record as saying that such extensions should not be encouraged if applicants are trying to promote sales of subdivisions. Motion by Co.....'.issioner Higgins; seconded by Cem- mls8ioner Parden that the time within which final maps can be filed for Tracts 2725 and 2720 be extended to June ls 1961; motion carried. 3. SDR-179 - SARATOGA INN C~u~lssioner Anderson reported this matter continued from meeting of December 27s 1960. He read the following Subdivision Committee report: "From: Subdivision Committee January 9s 1961 To: Chairman~ Planning Ccmmiesion SDR- Subj: SDR-179 - Saratoga Saratoga I~reference to letter from Lyle Benson of Saratoga Inns dated Decem- ~nn bet 19~ 1960s reque~tin~ n~.ne (9) months~ extension of Ten~ative Build- in= Site Approval granted March 23, 1960 which matter was referred to the Subdivision Connittee for revie~ the following facts are noted: The Subdivision Consul=tee has considered this matter and reconnends that no action be taken on this request at this tima~ in vte~ of the fact that the present Tentative Building Site Approval does not expire until March 23s 1961s which allows smple time =o complete the Conditions for Final Building Site Approval. Therefore~ if approved by the Plannin~ Courtlesions it i~ recommended that a letter be d~rected to Mr. Benson of Saratoga Inn to inform the owners of this action and requiting the owners to submit a later request for extensions if necessary~ in sufficient time to allow request to be acted ~on prior to expiration date of 14arch 23~ 1961. /s/ A. Chairman Webster welcomed Councilman John Lang~ill to the meeting. Chairman Webu=er informed the Commission thst at the nex~ meeting on January 23, 1961 an election of officers for the ensuin~ year ~ill be held to select a Chairm~ns Vice-Chairman~ Secretary a~d Coumr~ttees. -3- 4, UNIZARIAN FELLOWSHIP OF LOS GATOS Secretary read a letter from the Unitarian Fell~ship of Los Gates request- UNIT}a- an affirmation of interest from the Comm/ssion in their plan to build a IAN FELLOW- church on two (2) acres of property at 15701 Fruitvale Avenues Saratoga, SHIP Chairman Webster ordered the Secretary to reply to this letter stating it will be necessery to follow the procedure of filing an application for a Use Permit before the Planning Commission can take any action on this matter, 5, A-37 - LU-RAY COMPANY~ INC. Mr, Jones appeared before the Commission to discuss further his applies- A-37 tion for Architectural & Site Control, He was advised by the Chairman to LU-RAY meet with the Architectural & Site Control Counlttee at a time to be arranged by the Secretary, 6o C-26 - SACRED HEART CiIURCB John E, Tracy appeared to represent J, Cyril Johnson in the matter of a violation of Ordinance 3A-ZC-13 establishing P-O-H zoning involving the property at the intersection of Big Basin Way & Sixth Streets fo.~merly C-26 Sacred Heart Church property, A part of ~his buildinS is presently being SACRED HEART used by~acq~ess Coiffure__s as a Beauty Shop operated by Mrs, Schonenburger, CHURCH Mr, Tracy presented maps to the Cemmlusion verifying the fact that the applicant understood the present use of the building to be legal at the time the remodeling was undertaken, All parties are most cooperative iu this matter but wish clarification of the proper use which can be made of this building, Chairman Webster advised ~, Tracy that an luves=!.gation will be made by the Commission~ buts notwithstanding the fact that ~r, Johnson my have misunderstood the zoning restrictions at the time~ the building is limitcd to professional use, Chairman Nebster directed the Secretary to investigate this matter fully and give him a telephone report as soon as possible, ~I~ANWEBSTER DECLARED ~ETINGADJOURNED AT 8:20 P.M.
