M., Monday, March 13, 1961 Place: Fruitvale School, Fruitvale Avenue, Saratoga, California Type: Regular Meeting I. ROUTINE ORGANIZATION Chairman Webster called the meeting to order at 7 P. M. A. ROLL CALL Present: Anderson, Bennett, Crisp, Glenn, Higgins and Webster. Absent: None B. MINUTES There was a motion by Commissioner Crisp, seconded by Commissioner Glenn, that minutes of the meeting of February 27, 1961 be approved as submitted; motion carried. II. PUBLIC HEARINGS Chairman Webster declared Public Hearings open at 7:05 P. M. A. y-187 - Cronemiller, Allen and Goodman - Off Seagraves Way. There ~Jas no one present to represent the appli- cant. After discussion, Chairman Webster defer- red hearing on this application until later in the meeting, at which time further action would be taken. B. V-l~8 - Anthony Tavares - Saratoga Avenue Mr. Pierce, representing Mr. Tarares, advised that a variance of only 3 feet 4 inches was needed instead of the 7 feet indicated in the application. Me also submitted a letter dated March lO, 1961, consisting of two (2) pages, on which there were 32 signatures stating no ob- jection to the proposed porch. This letter was admitted as part of the file of record. Mrs. Tavares was present and Mrs. Robert M. Smith, a neighbor, who stated that she had no objection. V-188 - Anthony Tavares Saratoga Avenue The consensus of the Commission was that they could find no basis on which to grant this Variance. Chairman Webster declared the Public Hearing closed on V-!~8 at ?:30 P- M. There was a motion by Commissioner Higgins, seconded by Commissioner Glenn, that this Application for Variance (V-188) be denied. Roll call vote: Ayes: Anderson, Bennett, Crisp, Glenn, Higgins and Webster. Noes: None. Motion carried. C. UP-26 - Fenten E. Silvey - Norton Road There was no one present to represent the appli- cant. Commissioner Crisp advised that no map or sketch had been submitted with the application and that the City Office had been unable to con- tact the applicant regarding same. Chairman Webster ordered this Public Hearing continued until the meeting of March 27, 1961, and directed City Administrator Howe to try again to contact Mr. Silvey. At 7:39 P- M. Chairman Webster declared Public Hearings closed for the evening, with the exception of V-187 which was to be taken up later. III. COmmITTEE REPORT__S. A. SUBDIVISION AND BUILDING SITES 1. ~R-2~7 - Stern and Renzel - Quito Medical Center Cosmissioner Anderson advised that a revised tenta- tive map ha~ been submitted end conditions had been established. There was no one present to represent the applicant. There was a motion by Com~ni~sioner Bennetb, seconded by Commissioner Cri,~p, that SDR-257 be approved subject to the 11 conditions contained in the Subdivision Com=mittee Report dated March 13, 1961; motion carried and tentative approval was granted. Cen~issioner }{i~gins abstained from taking part in the discussion and voting in the matter of SDR-257. 2. SD-258 - Broom and Kauffmann - Titus and Bellwood Ave. Commissioner Anderson advised that conditions of tentative approval had not been established for this subdivision. A. 2. ~D-258 - Frown and Kauffmann - Titus and Bellwood Ave. rezoned. Chairman Webster ordered SD-258 continued until the meeting of March 27, 1961. 3- SDR-263 - James W. Gagnon - Highway 9 City Administrator Howe reported that the City Attor- ney had suggested that the applicant apply for a Variance on the rear lot, requesting approval of a 15 foot corridor instead of the required 20 feet, thereby making the front lot the required 85 feet in width. Commissioner Anderson read a report from the Subdivision ConnT, ittee containing a similar recommen- dation. There ~fas a motion by Commissioner Crisp, seconded by Con~issioner Glenn, that the report of the Subdivision Committee, signed by CoF~issioner Anderson, be adcpted, that the recommendations in the report be transmitted to the applicant by the Secretary, and that this matter (SDR-263) be continued until the meeting of March 27, 1961; motion carried. ~. SD-26~ - Cronemiller, Allen & Goodman - Off Seagraves Way. Comm~issioner Anderson stated that the Subdivision Committee could not reco~nend the tentative msp to she City Council, since it would land-lock the ad- joining property. There was a motion by Commissioner Anderson, seconded by Commissioner Higgins, that SD-264 be denied because of poor design; motion car- tied. Con~issioner Glenn was temporarily absent. V-.i~_7 - Cronemiller, Allen & Goodman - Off Seagraves Way. Chairman Webster ordered Public Hearing clo3ed on V-187. There was a motion by Commissioner Crisp, seconded by Commissioner Anderson, that this appli- cation for Variance (V-187) be denied. Roll call vote: Ayes: Anderson, Bennett, Crisp, IIiggins and Webster. Noes: None. Commissioner Glenn was tem- porarily absent. 5. ~DR-2~ - San Jose Water Works - Off Prospect Road Mr. Norman Andrews was present to represent San Jese Water Works. He questioned condition #3 of the Sub- division Committee Report, since the road in question crosses a golf course. After dis- cussion, there was a motion by Commissioner Anderson, seconded by Commissioner Crisp, that SDR~265 be granted tentative approval, subject to the seven (7) conditions contained in the Subdivision Committee Report, ~3 and #6 of which have been corrected as per the copy signed by Commissioner Anderson; motion carried. 6. SDR-266 - Mrs. II. L. Jepsen - Live Oak Lane There was no one present to represent the applicant. After discussion, there was a motion by Commissioner Anderson, seconded by Commissioner Crisp, that SDR-266 be tentatively approved subject to the ll conditions contained in the Subdivision Committee Report da'~ed March 13, 1961 and signed by Commis- sioner Anderson; motion carried. 7~ SDR-267 - Philip D. Lively - Off Sobey Road There was a motion by CoFaissioner Anderson, seconded by Commissioner Crisp, that SDR-267 be ~ranted ten- tative approval subject to the eight (BY conditions conbained in the Subdivision Committee Report dated P{arcb 10, 1961; motion carried. Mrs. Lively was present and submitted Record of Survey. 8. SD-268 - Ira Kirkorian - Off Saratoga-Sunnyvale Road Commissioner Anderson reported that conditions of tentative approval had not been established for this subdivision. Chairman Webster ordered this application continued until the meeting of Pxarch 27, 1961. Commissioner Anderson suggested that SD-243, Robert C. Kirkwood, Horseshoe Drive, be pu~ on the agenda for the meeting of March 27, 1961. Chairman Webster requested that the Special Committee on Street Standards in Acre Zones again try to organize a meeting and submit their report, so that the Commission would be in position to act on this ap- plication (SD-243). ~. ARCHITECTURAL AND SITE CONTROL 1. A-43 - Walter J. Johnson - Sign - Quito Shopping Center. Johnson - Sign - Quite Shopping Center. be requested to investigaLe the sign in connection with this application and submit a report to the Commission, and that the Secretary be directed to obtain an opinion from the City Attorney concerning' the legality of the existing sign; motion carried. 2. A-~6 - San Jose Water Works - Prospect Road ~Tr. Norman Andrews was present to represent San Jose Water Works. After discussion, there was a motion by Commissioner Higgins, seconded by Commissioner Bennett, that application A-46 for Architectural and Site Control be approved in accordance with the landscape plan by George E. Martin; motion carried. II. C. UP-26 - Fenten E. Silvey - Morton Road Mr. Silvey approached the Commission with an apology for his late arrival. Chairman Webster advised him that his application had been continued until the next meeting and requested that he submit the required drawings as soon as possible. IV. PETITIQNS AND GRIEVANCES A. WRITTEN UP-8 --- S, DR-17~ ..... Saratoga Inn City Administrator Howe read letters from Mr. Lyle Benson requesting an extension of one (1) year on both his Use Permit (UP-8) and Tentative Building Site Approval (SDR-179). After discussion, there was a motion by Com- missioner Glenn, seconded by Commissioner Higgins, that UP-8 and SDR-.179 be e~'oended for a per~od of one year from the date of this meeting; motion carried.
