I. ROUTINE. ORGANIZATION
Chairman Webster called the meeting to order at 7:O0 P. M.
A. ROLL CALL
Present: Commissioners Anderson, Bennett, Crisp, Higgins
and Webster.
Absent: Commissioner Glenn.
B. MINUTES
There was a motion by Commissioner Bennett, seconded by
Commissioner Higgins, that minutes of the meeting of
April 10, 1961 be approved as submitted; motion carried.
II. pUBLIC HEARINGS
Chairman Webster declared Public Hearings open at 7:0~ P. M.
A. C-33 - Wm. christens~n, Sobey Road - Change of Zoning -
P.~. Christensen was present and reminded the Com-
mission that this application was in accordance
with the General Plan. He further stated that he
felt that this buffer zone was in the best interest
of all concerned. Mr. Andrew P..Lassen, Mr. John
Hexem and Dr. F. C. Greaves were present and ad-
vised the Commission that they were opposed to the
Change of Zoning, since they felt that if this was
granted it would be only a matter of time before
it spread through the entire area. There was no
one else present who wished to comment regarding
this application. Chairman Webster declared the
Public Hearing on c-33 closed at 7:20 P. M. It
was the consensus of the Commission that this
would be classified as spot zoning and should not
be approved prior to the Public Hearing on the
Proposed Zoning Ordinance. There was a motion by
Commissioner Higgins, seconded by Commissioner

Crisp, that the Planning Commission recommend to
the City Council that this application for Change
of Zoning be denied. Roll call vote: Ayes:
Anderson, Bennett, Crisp, Higgins and Webster.
Noes: None. Absent: Glenn. Motion carried.
B. C-~ - Wm. and Walter Sea~raves, SaratoRa Avenue - Change
of Zoning -
Mr. Norman Stoner, attorney, and Mr. Ned Abrams,
architect, were present to represent the appli-
cants. Mr. Abrams advised that the proposed apart-
ments were of the town-house type, based on the
cluster plan, with 20% ground coverage and no
through streets. He further stated that there
would be ample green area with termis courts,
swimming pools, etc., and that the entire area
would have a residential, rather than commercial,
appearance. There was no one else present who
wished to comment regarding this application.
Chairman Webster declared the Public Hearing closed
on C-3~ at 7:42 P. M. There was a question as to
whether the proposed 3,OOO square feet per dwel-
ling unit was adequate in this area, and whether
this apartment area should be specified co-opera-
tive only. There was a motion by Commissioner
Higgins, seconded by Commissioner Crisp, that this
matter be referred to the Building Site Committee
for study, that this study include a conference
with the applicants, if necessary, and that a re-
port with recommendations be submitted by the Com-
mittee at the next regular meeting; motion carried.
C. C-~ - ~ratoga Inn, Saratoga Avenue - Qhange of Zoning -
Both Mr. Long and Mr. Benson, the owners, were
present. Mr. Long advised that this application
was in accordance with both the General Plan and
the Proposed Zoning Ordinance, but that they were
now ready to develop the entire Saratoga Inn pro-
perty, so had filed the application rather than
wait for the hearing on the Proposed Zoning Or-
dinance. When the Commission advised that a 60
foot frontage on Saratoga Avenue was needed for
the apartment property, Mr. Long advised that the
property was available and that this was satis-
factory. There was no one else present who wished
to comment regarding this Change of Zoning.
Chairman Webster declared the Public Hearing on
C-3~ closed at 8:11 P. M. There was a motion by

Commissioner Crisp, seconded by Commissioner Hig-
gins, that the Planning Commission recommend ap-
proval to the City Council of the re-zoning to
R-4-H of the property as outlined in the legal
descripti6n on file, plus a 60 foot strip extending
along the easterly boundary from the property to
Saratoga Avenue. Roll call vote: Ayes: Anderson,
Crisp, Higgins and Webster. Noes: Bennett. Ab-
sent: Glenn. A question arose as to whether this
was a sufficient vote, so ~n order to determine
the legality, this matter was continued to the
meeting on May 8, 1961.
D. UP-27 Clarence W. Neale, Sarato~a-Sunnyvale..Road - Ex-
tension of an Existin~ Non-Conforming Use -
Mr. Neale was present to give further details re-
garding this request for a Use Permit. There was
no one else present who wished to comment regar-
ding this matter. Chairman Webster declared the
Public Hearing closed on UP-27 at 8:45 P. M.
There was a motion by Commissioner Bennett,
seconded by Commissioner Anderson, that this ap-
plication for a Use Permit be granted for a period
of two (2) years from date, subject to the present
paved area being reserved for parking, and retail
sales being conducted on the non-paved area only.
Roll call vote: Ayes: Anderson, Bennett, Crisp
and Higgins. Noes: Webster. Absent: Glenn.
Motion carried.
Chairman Webster declared a ten (lO) minute recess at 8:55 P. M.
The meeting was called to order again at 9:05 P. M.
E. V-193 Jack F. Ma~iore, CopntrV Squire Lane.- yariance
from Front Yard Requirements -
Mr. Maggiore was present to give further details
regarding this request for a Variance. There was
no one else present who wished to comment regar-
ding this matter, but Mr. Howe advised that there
was a communication in the file with four
signatures protesting this Variance. Chairman
Webster declared the Public Hearing closed on
V-193 at 9:19 P. M. Commissioner Crisp advised
that the Variance Committee felt that approval
of this application would grant Mr. Maggiore a
privilege denied others in the area, since the

set-backs had been observed by his neighbors.
There was a motion by Commissioner Higgins,
seconded by Commissioner Bennett, that this ap-
plication for a Variance (V-19S) be denied. Roll
call vote: Ayes: Anderson, Bennett, Crisp, Hig-
gins and Webster. Noes: None. Absent: Glenn.
Motion carried.
Chairman Webster declared Public Hearings closed for the
evening at 9:21 P. M.
III. CO~LITTEE REPORTS
A. SUBDIVISION AND BUILDING SITES
1. ~ - Colbert Nakata, E~a Re~ina - Building Site
Approval -
There was a question as to whether this site had been
approved by the Health Department, so Chairman Web-
ster ordered the matter continued until the meeting
on Mmy 8, 1961, with a request that a written com-
munication regarding approval be obtained from the
Health Department in the meantime.
2. SDR-2~ - Joseph C. Romeo, Pierce Road - Building
~ Site Approval -
Mr. Romeo was present and agreed to the Conditions
of Tentative Approval which had been established.
There was a motion by Commissioner Anderson, seconded
by Commissioner Higgins, that this application
(SDR-27~) be granted tentative approval subject to
the nine (9) conditions contained in the Building
Site Committee Report da~ed April 24, 1961, including
the addition of the words "between driveway and
Pierce Road" at the end of Condition #5; motion
carried.
3- ~DR-276 - Lyle Benson, Williams Rpad - Buildin~ Site
~_~ Approval
Mr. Benson was present and stated that the Conditions
of Tentative Approval were acceptable. There was a
motion by Commissioner Anderson, seconded by Commis-
sioner Crisp, that this application {SDR-276) be
granted tentative approval, subject to the seven (7}
conditions contained in the Building Site Committee
Report dated April 21, 1961, #3 of which has been

modified by the addition of the words "betWeen drive-
way and Willjams Avenue"; motion carried.
SD~8 - Saratoga Inn., Saratoga Avenue - Build.ing
Site Approval - Co-op Apartments -
Chairman Webster ordered this matter continued until
the meeting on May 8, 1961, since Conditions of Ten-
tative Approval had not been established and the
property had not been re-zoned.
5. ~- Mrs. Jerd Sullivan, Reid Lane - Building
Site Approval -
Mr. Stafford was present to represent Mrs. Sullivan,
and reviewed the conditions with the Commission.
There was a motion by Commissioner Anderson, seconded
by Commissioner Crisp, that this application (SDR-279)
be granted tentative approval subject to the ten (10)
conditions contained in the Building Site Committee
Report dated April 24, 1961, #5 of which has been
modified and initialed on the official copy; motion
carried.
6. SD- 281 - ~larence Minnerly, Off Highway 9 - Subdi-

Mr. Jim Minnerly and Mr. Bill Kaemmerling were pre-
sent to represent the applicant. After discussion,
there was a motion by Commissioner Bennett, seconded
by Commissioner Higgins, that item #20 of the Sub-
division Gommittee Report dated April 24, 1961, be
deleted; motion carried. There was a motion by Com-
missioner Anderson, seconded by Commissioner Higgins,
that tentative approval be granted SD-281 subject to
the 24 conditions contained in the Subdivision Com-
mittee Report of April 2~, 1961, #20 of which was
deleted by a previous motion; motion carried.
7- SDR-282 - Western ~ills Development Company~ Sobey
~ R~ad - Buildin~ Site Approval -
Mr. Cecil Kettle was present to represent the appli-
cant. After conditions were discussed, there was a
motion by Commissioner Anderson, seconded by Commis-
sioner Higgins, that SDR-282 be granted tentative

Chairman Webster ordered this matter continued until
the meeting on ~ay 8, 1961, since conditions of ten-
tative approval had not been established.
B. ARCHITECTURAL DESIGN REVIEW
1. A~4~ - Walter J. johnson, Sign, Laundry, Quito Shop-
pin~ Center -
There was a motion by Commissioner Higgins, seconded
by Commissioner Anderson, that the existing sign at
the Laundry in the Quito Shopping Center be approved;
motion carried.
2. A-~i - Saratoga Inn, Saratoga Avenue, Co-on Apartments
Chairman Webster ordered this matter continued to the
meeting of May 8, 1961, since the property had not
been rezoned.
IV. pETITION~ A~ GRIEVANCES
A. WRITTEN
1. SDR-200 - Saratoga Inn, Saratoga Avenue - Request for
Extension ~f entative Building Site Ap-
proval - Hotel Units -
There was a motion by Commissioner Bennett,
seconded by Commissioner Crisp, that this
application for a one (1~ year extension
of SDR-200 be granted; motion carried.
2. A-~2 Paul Masson Winery, Saratoga Avenue -
Request for. Reconsideration of Storm Waters
Fee -
There was a motion by Commissioner Higgins, seconded
by Commissioner Bennett, that the Storm Waters Fee

fo.r. Reconsideration of Storm Wa.ters Fee
in question be applied only to the improved portion
of the property as requested in the letter signed
by Leo W. Ruth, dated April 24, 1961; motion carried.
3. Mr. Howe advised that there was a communication on
file from Mr. Milan M. Popovich, President of the
Azule Improvement Association, regarding the exten-
sion of Ted Avenue. Chairman Webster referred this
matter to the Subdivision Committee, with a request
that they study the situation and arrange through
the City Administrator to meet with the Planning Com-
mittee of the City Council.
4. Mr. Howe advised that a letter signed by Harry A.
Nethery had been submitted by the Cupertino Union
School District, concerning access to the school site
on the Southwest corner of Prospect Avenue and Titus
Avenue. Chairman Webster ordered this letter filed
for reference in connection with street patterns.
C. ORAL
There was a motion by Commissioner Bennett, seconded by
Commissioner Crisp, that Public Hearing on the Proposed
Zoning Ordinance and Map be set for three (3) weeks from
date; motion carried.
Chairman Webster welcomed Councilman Glennon to the
meeting.
Commissioner Crisp suggested that the City Attorney be
Contacted regarding the Subdivision Ordinance. Chairman
Webster requested that Mr. Howe prepare a letter for his
signature requesting that this Ordinance be submitted as
soon as possible.
Mr. Galeb approached the Commission and stated that he
felt there had been a misunderstanding with regard to
Ted Avenue. He advised that he had no objection to Ted
Avenue going through. Chairman Webster suggested that
Mr. Galeb write a letter stating his position and submit
it for the records.
Chairman Webster declared the meeting adjourned at ll:lO P. M.
