Chairs-- ~ebster stated that only the zoning~as under consideration at this time, since a tentative map for the subdivision had not been filed to date. He directed the Staff to uotifyl~r, Henderson, appointed by the ~roup as their re~re- santatire, when the tentative map appeared on the agenda. A Staff Report pertaining to this application was read by the Secretary. George Ratty was present to discuss this matter ~th the C~.~{eelon and advised that the park (4-1/2 acres) ~ould acconodate approxim~eXy 600 people and had been rented about thirty (30) times this year. He fur- ther advised than he had arranged for over-flow parking space from Nor~elle Tt.~pson and A1 Dampsay. BRUCE 0~s at~orney~ ~as present and stated that he represented forty (40) persent opposiU~ this Use Per- mit. Chairman~ebster stated that the Co~,issionvould receive a letter from l~. Oneta advised that his clients objected to the noise, traffic congestion and const~lption of aXcoholic beverages, and for these reasons felt that the Use Per~t should not be granted. Mr. (hleta suggested that if the Planning Connission felt that it should be granted, howavers that the fullerlag conditions be incorporated in the Use Petit to pro- tect the people residin8 in ~he area: 1. The park should be closed at 5:30 P. H. or earlier. 2. The surroundinS area should be a toy-zone. 3. A11o~no hard liquor in the park. 4. Require a five (5) foot landscaped strip around the park. 5. DR. CHARLES L. JOPaSON~ JR. stated that it nouId be nice if the voXu~e on the sound was levered, but that he had no other objection to the park. Co~{ssioner Crisp stated that he felt that the area should be rezoned instead of grantin8 a Variance in an R-1-20s000 zone to allow a lot depth of less than is required for a R-l-10s000 zone. E. F~ It was the consensus of the Counission that the Map Act of California and the City of Saratoga Zoning Ordinance provided no basis on which they could grant this Variance. Noes: Co~tssioner Glenn. Absent: None. Notion carried. F, V-205 - Jack Western~ Kittrid~e Road - Variance from Required Lot Width The Public Hearin~ on V-205 was epennd at 9:50 P. ~, The Secretary re- potted that Notices of Public Hearing had been mailed and that the fol- lowingwritten conmunications had been received: 1. Mr. Western was present and discussed this mtter · with the Commission. M, There was a motion by Conu~s- sionnr HiSginss seconded by Comissioner Crisp, that V-205s Jack Western, be granted in accordance with Section 1~.6 of Ordinance NS-3; motion carried Chairs- Webster declared Public Hearings closed for the evenings subject to UP-33 being continued until the meeting on November 2~s 1961. Jo ~--txt of Los Gates, had been tinable to com- plete the pla~s in time for this mastiff, but that they would be sub- mitted prior to the next meetind. On the basis of this infersrations Chairnmn l~ebster directed this matter continued until the meetin~ on November 27, 1961. B. A-64 - Si~Iml Oil C~apany, saratosa-Sunnyva~e Road - Final Architectural Approval - Service Station There was a motion by Ce~lssioner Hia~ins, seconded by Bennett~ that the final plans for A-64, Signal Oil Company Service Stations Saratoaa-Sunuyvale Road, be approved as submitted (Exhibit A-l) with the exception of the followinS requirements: 1, Color scheme to conform to Color Schedule submitted 0)rawin~ D). 2. Roof to be beige and brown a~re~ate, 3. The supportin~ steel columns for the pump canopy to be square in- stead of round. ~. All sians are disapproved. Re-sub~it in accordance with Ot~tinance NS-3o Notion carried unanimously. C, A-65 - ~ui~o Merchantss Association - Directional Sign for ~uito Shop- pin~ Center The Secretary advised that the ordinance did not provide for a sian of this type, Mr. James Collins was present to discuss this mat=e= with the Coa~.~ission. There was a motion by Co~missioner Beunet~, seconded by Con~issioner Hi~ins, that A-65 be denied; motion carried mously.
