FRED LEITZ, 19520 Scotland Drivej asked if other sites.had been aban- doned ,01ely because of expense and was advised by Chairman Anderson ~hat there were dimensional~ as weli as monetary, reasons why teleta= tion was not considered feasible. C~mmtssioner Crisp moved, seconded by Commissioner Glenn to close the Public Hearing on UP-37s Pa2= Alto Development Corporation. Hotion carried unanimously 7:48 P. M. Commissioner Glenn moveds seconded by Commissioner Johnson that the Use Permit UP-37 for Pale Alto DevelOpment CorpOration for a private recreational club for use of residents of Arroyo de Saratoga subdivision be granted, subject to restrictions One (1) through eleven (11) of the Subdi~ision Committee Report dated June 20, 1962, and that the first sentence of the first paragraph be changed to read "The private recre- ation club~ including the Saratoga Avenue entrance to the Arroyo de Saratoga Subdivision shall be owned, operated and maintained by a private, non pro£it corporation, under the la~,s o~ the State of California. Commissioner Crisp stated that~ in vis~ of the new evidence submitted at tonighes hearing~ ha felt the matter should be continued to the meeting of July 23 for the benefit of those co~nnissioners who were not present. Commissioner Glenn withdrew the motion for approval of the Use Permit~ Commissioner Johnson withdrew his second. Commissioner Crisp moved~ seconded by Commissioner Glenns that the Planning Commission postpone its action in this matter till the July 23 meeting. AYES: Cor~ntssioners Crisps Glenn, Johnson. NOES: Commissioner Anderson. ABSENT: Commissioners Webster, Cowlay. Motion carried. B. C-46 - Gilbert C. Hoy, Saratoga-Sunnyvale Road - Change of Zoning from "R-l-12tS0~~ to "C-S' The Public Hearing on C-46 was opened at 8:06 P. M. The Secretary stated that a Notice of Public Hearin~ had been published and that Notices of Public Hearing had been mailed. The Secretary read a Staff report regardin~ this application. GILBERT MAY, 21170 Big Basin Way, spoke in favor of the resonin~ and stated that the area had been in use as a nursery for some 30 years by Mr. and bits. Swain and that they had sold the property about four years ago and, because of illness, had not been ~ware when the City 'dezoned" the area to residential zoning. May Swains if the area is not rezoned and objected that the area would not be desirable for residential purposes. ~lr. Hay requested continuation of the matter to the next meetin8 to enable l~ro &t~rs. Swain *s attorney to appear on their behalf, NR. B. T. C~LEB, Seagull Way, ~poke in favor of the rezoning, advocatin~ nursery use as an improvement to the area. ~he Secretary stated that this is a non-conforming use which 'could continue with a Varia~ce for a 35 year period from 1956when a 3~ype 5 buildin8 was constructeds but r~r, Hay objected that in the event of fire or other hazard the Variance would not suffice and therefore he had applied for a chanZe of zoning. Com~ssioner Crisp moveds seconded by Ce.~;~ssiouer Johnson that the matter of C-~6 be continued to give the attorneys ~. Stanley, an opportunity to speak fo~ the applicant and that the public hearing be continued to the meeting of July 23~ 1962. F~otion carried unanimously ~nd Chairman directed the public hearing closed for tonight and continued to the next regular m~eting. Wince, Sobey Road - Buildin6 Site Approval - one .~1~ lot. ~r. ~in~o's realtor was present to represent the applicant, and after brief discussion, expressed satisfaction with the proposed conditions of approval. Secretary read the reports dated July 9s 1962s from the Subdivision Committee regarding this request for reconsidersrich of Condition #3 of SDR-307, The applicant was presents and r~r. PESTORINOs who stated he lives adja- cent to Hro Carlsons spoke in behalf o£ the applicants stating that Pike Road is net 18 feet wide and that he did not feel it necessary forM r, Carlson to widen to.18 feet to serve only three to four sites~ He cited the expense of widening and asked that Condition #3 be waived, on the basis of hardship, Several C~lssioners advised that they had made'a thorough check of the areas once accompanied by C~unty Fire Marshall Bruce Wiggins, and concurred that the present ~id~h of the road. is. inadequate for fire and life protec~ion. The Co~ission agreed ~h~ waiving the access toad requirement in this cue would not only set a precedent but would disregard the basic reason for this requirement; that of providin~ for safe and adequate access to building sites, Commissioner Crispm~veds seconded by Cozmnissioner Johnson that the Subdivision Committee Report dated July 9, 1962~ relative to request for reconsidersrich of Condition ~3 of SDR-3OTs be approved and adopted as the recommendation from the Co~mission to the City Council; motion carried unanimously, VII CO~ffJNICATIONS A. kIRITTEN (1) Secretary read a letter from GIFFORD SOBEY, Architects requesting that an extension be granted to Saratoga Federated Church SDR-2~2s ~hich expired December 27s 1961. RICHARD. T. HIPPARDwas present to represent Hr, Sobeys and appealed to the Co..~...lssion to grant the extension as the construction contract had already been awarded and the building site approval had expired without their kno~ledges due to an oversight in their office, DR.
