Connnissioner Crisp moved, seconded by Cu~lssioner Glenn, that the reading of the minutes of the meeting of July 23~. 1962, be waived and that the minutes be approved as prepared and submitted to the C~lssien; metion carried una,~m-usly, PIIBLIC HEARINGS The Chairm-n declared public hearings open for the evening at 7:05 P. A. UP-33 - G~orge Rat~y, Wildx~oed Park - Revie~ of COmpliance with Con- aStio.ns ~s~ablish.ed ~.nd.e.r. U~.e Permit .... .. The public hearing on UP-33 ~as opened at 7:0~ P. M. The Secretary advised that Notices of Hearing had been mailed and six (6) c~n~uni- cartons had been received. He ~urther advised that the subject Use Permit had been suspended on July 12, 1962, for non-compliance with conditions, and that it was the responsibility of =he C~a~ission hold a public hearing, determine whather or not coedi~ionn had been met and, if net, revoke the Use Permit or ~ake other appropriate action. The Secretary read the conditions of the Use Permit and explained the City Council ~odification of condition Mr. Ratty and his attorney, George Hutchinson, were present. It was decided that the conditions in questiDn ~ould be discussed individually and that the usual procedure would be reversed so that the opposition would be heard, then the rebuttal. .Plarn~n~ C~ission IRnut~ - AuguSt 13, 1962 - Continued lI. UP-33 - Ceo~e RatLV~ Wtld~ood Park Condition. #8 (Liquor) The Secretary submitted a raffle ticket for one of the recent Wild~ood Park fimctions, one (1) prize of ~hich was a c~se of liquor. lifo Hutchinson stated that several c~.~lain~s had been filed with regard to liquor, so Councilman Glennon had made an inspection the fullowin~ Sunday and would verify tMt no liquor was found on prp~.~ses. He further stated that all parties had been told that liquor ~as net allowed and, to the beet of his knowledge, there had been no violation of this rule, Both Hr, Hutchinson and Ratt-y stated that the ticket was merely for the drawt~ for the case of liquors that the liquor had not been delivered at the park but somewhere else at a later date, lifo Hutchinson stated that he had no objection to the exhibits so Chairman Webster directed that ticket ~[1340 for the function at Wild~ond Park on June 24, 1952; be entered as Exhibit in ~-q~er to a question from the Chairman~ 1~o Hutchinson stated that this ticket wa~ not issued by l~ildwood Park~ but by the people k~no had rented th_~ park° There was ne one else present ~ho vlshed to uoment with re~ard to condition Chair.~- Webster directed the finding that there ~as no evidence in support uf the ~om~laint that liquor ~as bein~ consigned on the pe~k premises, that althau~h the ~icket ba~ been submitted~ i~ was not positive proof. The Secretary advlseds in answer to a question from the that the existinS fence did not cureply ~rlth the condition since was not a cyclone fence and was net six (6) feet in height. He further advised that the portion of the property uext to the cot- rages x~as fenceds but not in compliance %rith the type fence re- quired by the conditions and that the fence along the creek had not been provided. Mr~ Hutchinson stated that at the time of the. appeal to the City Council he was not aware~ and did not think the Council kn~w, ~hat the p~u~erty alon~ ~he top of Wildx~ Park belonged to Mr~ Ratty, He said he felt this was quite a buffer for the parks ,ha that nothin~ larSer than a small dog could Set through this area. Hutchinson verified that there was no fence alon~ the creek nor alon~ Fourth Street. MRS. H= A. MEI~/IEals Sprinter l~nds stated that the fencin~ required by the Cu~ssion had not been erected. H. A. MRCERs Sprir~er Roads etated that the fencin~ had net been dono in compl{--ce w~th the conditions but there was a fence on his property which had been placed across the ri~ht-of-way on his side. MRS. EVE SYMON, Sprinter Avenue, stated that the only fence 1ahich had been erected was the portion near the Mercer property. MRS. 14AE ELLIOTT, Sprinter Avenues stated that condition ~l had not been fully complied withs since the only fence erected was the one on the boundary of the Mercer property. The C~.....~ssion accepted as Exhibits "2" and "3" two (2) photo~rapha submitted by Mr. Ratt-y showin8 the board fence erected alon~ the Mercer property (147 feet). There was no one else present who %fished to connnent with regard to the fence. Batty again stated that he was on the prer~ises durin~ these affairs and other than the three (3) evenings they had permission to be open late. the po~er was cut at sundown and the people bed moved out by 8:30 P. 1~. He htrther stated that no police or sheriff had come to the park on the date mentioneds that he ~;as at the park until about 9:30 P. N.,-then had retired to his apartment which is no more th~- ten feet from the park. He stated that the artists from the Horse~s Houth and other places come to the park as late as 11 o%lock, that they are sometines drink~n~p and noisy, and that has been necessary at times for him to go do~ and ask them to leave, Cun~tssioner Crisp moved, seconded by Commissioner Anderson, that the public hearing on UP-33 be closed; motion carried .mnv4~usly and Chairrnnn Webster declared the public hearing closed at 9:23 Chairran ~ebster informed the Cou~ission that there ~ere three (3) courses of action open: 1) revoke the Use Permit 2) medley the Use Permit or 3) continue suspension tmtil all conditions had been mete · here ~zas a motion by Cou~lssioner Anderson, seconded by Cummissioner Crisp, that a findinE be adopted. based on the evidence, that the Use Permit has been and is being violated in several respects to a significant degree. He suggested, therefore, that this application be continued until the next meetir~ and thats in the meantime, the applicant submit the additional drawings re- quested by the Committee. On the basis of this suggestion, Chairman ~qebster directed V-220 continued until the maetin~ on August 27, 1952, and requested that the applicant submit the additional material prior to that meeting. The Chairman declared public hearix~s closed for the eveninB at 10:10 Po M., subject to V-220 bein~ continued until the meetix~ on August 27, 1962. After readin~ the proposed conditions of approval, Mro Rapperry, on behalf of Mro Mercers requested that the subject application be ~ithdra~n. On behalf of the C,R~alssion~ Chairman Webster granted this request and no action was taken. C. SDR-370 - R. D° l{ildebrandt, Bohlma~n Road - BulldinE Site Approval 1 Lot Co~issioner Anderson advised that this matter was under study and that it was the recon~nendation of the Building Site C~Ittee that SDR-370 be continued until the next regular meeting.
