The meeting was called to order by Chaimn Webster at 7:07 P. H.
As ROLL CALL
Present: Co~ssioners Crisp, Glenn, Johnson, Kellum and Webster.
Absent: Ccmissioner Cowley.

Co~missioner Johnson moved, seconded by Commissioner 61ann, that the
re~ding of the minutes of the meeting of Februal'y 25, 1963, be waived and
that the minutes be approvad as prepared and submitted to the Connnission~
motion carried nnav~usly,
II. PUBLIC ~EARINCS
The Chairnmn declared public hearings open for the evening at 7:09 P.
A, C-53 - ~1, L. Snow, Loraita Avenue - Cha~e of Zoning from R-I-40,000 to
R-1-20~O00
The public haarin~ on C-.53 was opened at 7:10 P, N. The Secretary advised
that a Notice of Hearin~ had been published and there were no ~r~itten com-
munications on
The applicant was present to discuss this matter with the Co~lssion and
stated 1) the subject property is almost surrounded by parcels of less
than one acre and 2) he would like to sell a 1/2 acre lot and use the
money to improve the street.
There was no one else present who wished to comment with regard to this
matter.
Connnissioner Crisp moved that this wartar be referred to a committee for
study, Connissionar Johnson seconded the motion which carried
unanimously,
Chaimn Webster referred the subject application to the Subdivision Com-
mittee for review and a report, and directed C-53 continued until the
meeting on l~arch 25, 1963.

lI. B. C-54 - Robert Neale, Saratoga Avenue - Chan~e of Zoning from R-M-3,000 to
q-C (Co.r~nunity Connercial)
The public hearing on C~54 was opened at 7:29 P. Mo The Secretary advised
that a Notice of Hearing had been published and there were no written com-
munications on file. He also reviewed the application briefly for the
benefit of the Connnission and other interested parties.
The applicant was present and advised 1) the existing buildir~ is in
good condition and would require little remodeling 2) it would be neces-
sary to remove two trees and 3) he bad planned to provide parking on the
west side of the building but, if the Connnission so desired, the land-
scaping could be ren~ved along Saratoga Avenue and parking could be pro-
vided in that area..
IqRS. FAITH H. APPLEBY, who ox0us the adjacent property on the south and
east, protested this proposed change of zoning. She stated 1) she did
not feel that any portion of this lot had been intended for Connercial
Zoning but that it h~d happened inadvertently when the City of Saratoga
adopted the Santa Clara County Zoning Map 2) she objected to any exten-
sion of the Comertin1 Zoning into a residential district 3) she did mot
feel that parking restrictions should be lessened in any way 4) she
objected to connnercial use of her walk~ay and steps and 5) she objected
to a change of zoning that would open use of the property to the uses
permitted in a Co~unercial Zone.
Conmnissioner Crisp asked l~rs. Appleby whether or not she would object to
Conditional Zoning (limited to the subject use) if parking could be pro-
vided. Mrs. Appleby stated thaC she still would not want the Antique
Shop.
Chairman Webster explained to Mrs. Appleby that,.intended or not, the
Commercial Zoning on a portion of this lot was valid.
X~I~So RALPH BURI~Y, representing the Foothill Club, expressed concern with
regard to the proposed change of zonin~ on the basis that it would create
more traffic on Park Place, thereby creating a more severe parking pro-
blem for the Foothill Club. The Commission observed that the applicant
planned to provide his required number of parking spaces but that the
Foothill Club had no parking space at all.
MRo RICHARD BENNETT, Brookwood Drive, spoke in favor of this proposed
change of zoning. He stated l) Saratoga had been referred to as the
Art Centor of Santa Clara County 2) 1S such shops exist in Saratoga at
the present time and four others are trying to obtain facilities
3) activity of this kind would help to preserve the Village 4) the
building is in far better condition than the average building in Saratoga
and a portion of it is already in the Commercial Zoning 5) previous use
of the building was light industrial so it would not be a reduction in
zoning but a lift that would be an asset to the conununity 6) he felt the
Cuu~lssion should try to help the applicant provide the required parkin~

for the good of the cv,aa,unity and 7) he felt the Village could have a
great future and there was no better beginning than the granting of this
app 1 ication.
CLARENCE .NEALE spoke in favor o£ the proposed change of zoning, stating
that he felt the merchants and the City in general would benefit from
sa~e,
There was no one else present who wished to coument with regard to this
Commissioner Glenn moved that this matter be referred to a committee for
study, Commissioner Crisp seconded the motion which carried unauimously,
Chairman Webster referred this application to the Subdivision Committee
for review and a reports and directed C-54 continued until the meeting
on March 25, 1963,
C, V.-225 - Roy B. Naylot, Shadow Mountain Drive - Variance in connection with
Lot Depth of twe (2) lots and Site Area of one (1) lot of proposed
33 lot Subdivision west of Shadow Mountain Drive
Coma,issioner Crisp s~ated that action on this application was contingent
on an acceptable teutative map for SD-408s so suggested that V-225 be con-
tinued until SD-408 had been considered.
On the basis of this suggestion, Chairman Webster directed this matter
continued until the Co~nission had given consideration to the tentative
map submitted in conne. ction with SD-408.

III, SUBDIVISIONS AND BUILDING SITES_
A, SDR-384 - Fenton E, Silvey, Norton Road - Building Site Approval - 1 Lot -
Continued from February 25~ 1963
The Secretary advised that Mr. Silvey and his engineer were working on
the requested site development plan, but it was not completed. He fur-
ther advised that the time element would allow the Commission to con-
tinue this application until the next regular meeting.
On the basis of this information, the Chairman directed SDR-384, Fenton
E, Silvey, continued until the meeting on March 25, 1963.
Since there was a possibility that a great deal of t~rn~ might be required for
the discussion of SD-408 and the accompanying Variance application (V-225),
it was decided that ~he other subdivision and building site applications would
be discussed first.

III. C. SDR-409 - Marwie~ Construction Company, Hill Avenue - Building Site Appro-
val - 4 Lots
lrvin Henningson was present to represent the applicant and expressed
satisfaction with the proposed conditions of approval.
Co.~-~issioner Crisp moved, seconded by Counissioner Kellum, that the ten-
tatlye map for SDR-409 (Exhibit '~", filed March 1, 1963), Marvieg Con-
struction Company, 4 lots off Hill Avenue, be approved subject to the
conditions contained in the Building Site Coz~nittee Report of March 11,
1963; motion carried unanimously.
Do ~D-410 - Chat Akinss Montalvo Road - Subdivision - 7 Lots
Bob Beam, engineer, was present to represent the applicant and questioned
Condition No. 4 of the proposed condi~ions of approval. When Co~nissioner
Crisp advised that it was necessary that the residual parcel be considered
a part of the subdivision, Mr. Beam explained ~lat his client did not own
the remaining property, Commissioner Crisp explained that it would all
have to be shown on the tentative map since it had been under one owner-
ship until this time.
Perry Polentz was present and stated that since he was required to improve
a half street plus three feet, he felt this developer should be required
to do the same. He also questioned the provisions for drainage.
Aftec further discussion, Comicsloner Crisp moved, seconded by Commis-
sioner Hellum, that the tentative map for SD-410 (Exhibit '~"s filed
March 1, 1963)~ Chat Akins, seven lot subdivision off Montalvo Roads be
approved subject to the conditions contained in the Subdivision Committee
Report of March 11, 1963~ as modified by adding the following at the end
of Condition Noo 5:
"as required by the City Engineer."
Motion carried uoanimously.
E. ~DR.-411 -D__e__am_~oed Johnsoni quito Road -Buildina Site Approval - 4 Lots
Comissioner Crisp advised that the Building Site Co~nnittee desired a
joint meeting with the Planning Committee of the City Council before
plating the proposed conditions of approval in connection with this appli-
cation, to discuss the extension of Dares Avenue to quito Road. For this
reason, he recoxmneeded that this matter be continued until the next regu-
lar meeting.
On the basis of this recon~nendation, Chairman Webster directed SDR-411
continued until the meeting on }iarch 25, 1963.

III. B. SD-408 - ~oy B. Naylot, Shadow Mountain Drive - Subdivision - 33 Lots
Cu~Auissioner Crisp advised 1) it had been the understanding of the Sub-
division Cu.l-.~ttee, during previous discussions, that the northern por-
tion of Ragan Lane would be connected with the southern portion of Regan
Lane at the time the subject property was developed, through property not
included in this subdivision and 2) because of a difference of opinion
with regard to this matter, the tentative map submitted in connection with
8D-408 had not been conditioned.
Roy Naylot and Lee Brandenburg were present to discuss this matter with
the Conmission and advised 1)Liepave, fruit rancher, still owns the pro-
perty needed for the extension of Regan Land and will not sell it
2)LJepava advised that he would sell additional property to the south
and 3) it seemed that the logical time to connect Regan Lane would be
at the time the r~rn-ninder of Liepave% property was developed.
Cornre{ ssioner Crisp observed that the question in connection with the
subject application was whether or not the Commission felt it necessaxy
for Regan Lane to be connected to serve this subdivision.
Adrien Anderson, 20232 Craigen Circle, was present and stated 1) he wns
Chairman of the Subdivision Committee at the time the first preliminary
map was discussed and the Committee had requested that the developer ob-
tain sufficient land to include the extension of Regan Lane in this de-
velopment 2) internal circulation is necessary for subdivisions to keep
short haul traffic off Saratoga Avenue and Itigh~ay 9 and 3) he was con-
cerned about amount of traffic this subdivision would put in Argonaut
Subdivision.
The Commission e~plainnd that many subdividers (MilJevich, McKinnon,
Cocciardi, etc.) had been required to improve streets under similar
circumstandes. The Co,,~,lssion quoted Part I, Section 2.2, of Subdivision
Ordinance NS-5, ~ich reads as follows:
"Section 2.2: Subdivision - "Subdivision" shall mean and include any real property,
improved or unimproved, or portion thereof, shown on the latest
adopted County tax roll as a unit or as contiguous units, which is divided for the
purpose of sale. lease, or construction of improvements thereof, ~ether irmnediate
or future, by any person, firm, corporation, partne::ship, association or other
entity, governmental or otherwise, into two or more parcels. It shall include all
divisions of land which are excluded from the definition of "Subdivision" by the
tenms of Business and Professions Code Section 11535 of the State of California.
Land shall be considered to be divided by either (a) the filing with the Planning
Commission of a tentative map showing division into lots or parcels, or (b) the
sale, contract of sale, lease, transfer or other conveyance of any portion of a
unit or contiguous units in one o~nership as shown on the latest adopted County tax
roll, regardless of the manner of land description, or (c) the recording of any
record of survey or other map or description of a parcel less than the whole as

sho~m on such latest adopted tax ro11, or (d) any other separation of land into
legally discernible parcels. ~he separation of a single site from a larger parcel
shall constitute a division,"
~en Chairman Webster, at the request of Cv.aissioner Crisp, polled the
Commission, there was a unanimous' expression of belief that Regan Lane
should be connected,
Commissioner Crisp advised that the Subdivision Ccmittee had promised
the applicant at an earlier meeting that if the Commission felt that
Regan Lane should go through, then the City Attorney would be asked to
rule on the legality of this requirement.
Chairman Webster observed that if Mr.Ljepava would not sell the land for
the extension of Regan Lane, then perhaps the subject tentative map was
premature.
After further discussion, Chairman Webster directed SD-408 continued
until the meeting on March 25, 1963, to allow the Subdivision Committee
time to try to ~ork this matter out.
II. C. V~225 - Roy B. Raylot, Shadow D~untaiu Drive - Variance in connection with
Lot Depth of t~o (2) lots and Site Area of one (1) lot of proposed

The public hearin~ in connection with V-225 was resumed at 10:00'P. M.
In vie~ of the lack of action with regard to SI)-408s Chairman Webster
directed the public hearing on V-225 continued until the meetin~ on
March 25, 1963.
The Chairman declared public heari,~s closed for the evening at 10:02 P. ~.
IV. D~IGNREVlEW
A. A-99 - Goodwin B. Steinberg, Saratoga-Sunnyvale Road - Final Design
Approval -~Apartments - Continued from February 25w 1963
Connissioner Glenn advised that this property was still under study by
the City Council (with regard to High~xay 9), so it was his reco-~ldation
that this matter be continned until the next regular meeting.
Chairman ~ebster, on the basis of the foregoin~ directed A-99~ Goodwin

IV. B. A-102 - Robert Neale, Saratoga Avenue - Final Design Approval - Antique
Shop _,
COmmiSSioner Glenn reconunended that this matter be continued until the
next regular meeting, since no action could be taken until the property
was properly zoned.
Chairman Webster directed A-102, Robert Neale, continued until the meeting
on March 25, 1963.
C. 88-30 - p~. Isaac N. Abrams, Saratoga Avenue - ~esi~n Approval - Sign
After discussion, Commissioner Glenn moved, seconded by Commissioner
Kellum, that SS-30, Dr. Isaac N. Abrams, be approved as shown on Exhibits
"A" and '~", subject to the following conditions:
1) Applicant shall submit to the City an appropriate contract (between
the applicant and ~. Seagraves) for the installation of this sign
on the lands of Seagraves as indicated on Exhibit '~".
2) Rough, hand-hewn timbers are to be used.
Motion carried unanimously.

After discussion, Commissioner Crisp moved that the Planning Co~m~ission adopt
the Procedure Resolution (Resolution No. PC-109) as submitted. Commissioner
Johnson seconded the motion which carried una~4m~naly.
OLD BUSINESS
A. RidinM Aeadem~. Bohlman Road - ~raft of Resolution
Coum,issioner Johnson moved that Resolution No. P~-llO be adopted and
transmitted to the Santa Clara County Planning Commission° Commissioner
Crisp seconded the motion which carried unanimously.
B. Library Report
Commissioner Glenn advised tha= a meeting had been held between the
General Plan Coam~ittee, George Fartier,Mrs. Georgia Ryder, and Charles
Early's Library Committee on March 1, 1963. He further advised that more
time was needed hut that he expected to have a report by the next meeting.

Co~lssioner Crisp advised that the City Council bad approved and trans-
mitted a letter to the President o£ the School Board based on the report
presented to the Co~ission two weeks be£ore.
