The meetin~ was called to order by Vice Chairman Johnson at 7:00 P. N.

Present: Cu~lsstoners Crisp, Glenn, Johnson and Kellum.
Absent: Commissioners Covley and Webster. (C~lssioners Cowley and
Webster arrived at approximately 7:02 P. M.)

reading of the minutes of the meetin~ of Narch 11, 1963~ be waived
and tbat the minutes be approved as prepared and submitted to the
C~-!ssion; motion carried unanimously.

Webster, at the request of Vice Chairman Johnson, asstnned the Chair.

After the Secretary had briefly reviewed this matter. Commissioner
Crisp read a report from the Subdivision C~,-,dttee.
Mr. Adams, present to represent the applicant, observed that the reqnes-
ted chance of zonin8 was in compliance with the General Plan.
There was neonn else present who wished to co~lnent with reCard to this
application.
After discussion, Commissioner Glenn moved, seconded by Commissioner
Crisp, that the public hearing on C-53 be closed; motion carried tmanl-

There was a motion by Commissioner Crisp, seconded by Cun~ission~r
Johnson, that the Planning Cuu~ission reconmend to the City Council
that C-53, ~I, L, Sno~, application for change
R-I-40,000 to R-I-20,000, be approved; motion carried unanimously.
Bo C-54 ~ Robert Neale, Saratoga Avenue - Change of Zoning from R=lt-3,000
to C~.C (Community Comm~.rcial) - Con.~inued from Narch ll~ 1963
After this application was briefly reviewed by the Secretary, C~n~is-
sioner Crisp read a report from the Subdivision C,-...-ittee,
ERS, FAITH APPI21BY sta~ed that she most emphatically objected to the
proposed conditional zoning for the subject property because
felt it would have a detrimental effect on the neighborhood 2)
would alter the C-C zoning boundary as set forth by the General Plan
3) she felt that palking would be inadequate 4) she did not feel
that the proposed change of zoning could be classified as orderly
expansion since it would fill no connnunity need and 5) she ~as con-
cenled as to lðer the building ~ould be used as an Antiqne Shop or
Used Furniture Store,
The applicant ~ras present and stated that in addition to antiqusss
he planned to have a=t objects and decorator items in the Shop,
CI~Ar~E_NCE NEALE defined "antique" as a collectc~ss item more than 100
years old,
RICHARD BENI~TT stated that while Saratogass shops did not necessarily
conform with this definition, he felt they were excellent shops for
Saratoga.
CATHERINE ADC0CE, who resides in one of 14Is. Applebyes apartments,
stated that she objected to the proposed change of zoning since the
Antique Shop ~ould be near her front
DOROTHY O ~Tr.L, who shares an apartment with Catherine Adcock, stated
that she, too, objected to the proposed change of zoning.
NARVIN PEARSON, Saratoga Place, expressed concern that the merchan-
dise from The Barn ~ould be transferred to the subject location, He
also expressed noncern ~lth regard to increased traffic congestion,
GEORGE OLDHAIl stated 1) he o~nsd the property across the street
2) increased traffic and parking would affect him more then anyone
else 3) he had no objections to the proposed change of zoning 4) he
felt that the proposed use of the property vould be better for the
axca than any otJ~e~ use,

II. B, C-54 - Robert Meals
JEANNE NEALE (MRS, Robert Neale) advised (xxlth reference to Marvin
Pearson~s statement) that she and her husband had no connection ~rith

Clarence Neale submitted a petition with apprc~4~n~tely 250 signatures
supporting the proposed change of zoning.
Robert Neale submitted a ~rtitten statement pertaining to previous pro-
tests filed in connection with the proposed change of zoning. Chair-
man Webster accepted the statement and directed it filed for record.
There was no one else present who wished to con~aent vrlth regard to
this matter, so Conauissioner Glenn moved that the public hearing on
C-54 be closed. Cvu~nissioner Crisp seconded the motion which cat~cied
unanJr~nusly, Chairman Webster directed the heax~n~ closed at 7:56 rol~
Conunissioner Crisp moved, seconded by Connnissioner Glenn, that the
Planning Commission recomend to the City Council that Coeditional C-C
(Conmunity Commercial) Zoning be approved in connection ~rlth C-54,
Robert Neale~ subject. to the condi~.ions set forle~ in the Subdivision
Committee Report of March 21, 1963, Roll coll vote-' Ayes: Connis-
sioners Ccvley, Crisp, Glenn, Johnson, Kellum and Webster. Noes: None.
Absent: None. Motion carried unantroously.
II. C. V-225 - Roy B. Naylot, Shadow Mountain Drive - Variance in connection
with Lot Depth of two (2) lots and Site Area of one (1) lot of
proposed 37 lot Subdivision west of Shado~ Mountain Drive -

The Secretary briefly reviewed this application and read a SCarf Report
pertaining to
At the suggestion of Commissioner Johnson (Chaimn of the Variance
Committee), Chairman Webster directed that SD-408 (tentative map
covering subject subdivision) be considered prior to discussion with
regard to the Variance application
VII, B. SD-408 - Roy B, Naylot, Shadow Mountain Drive Conttn,,eH from March 11~ 1963
The Secretary advised that a revised map~ including the Pegan Lane
connection, had been submitted.
H~. Naylot was p~esent to discuss this matter with the Coum~ission and
questioned Condition No. 6 (pertaining to sidewalks)' of the proposed
conditions of approval. The Commission advised that this requirement
was set forth by the Subdivision Ordinance, so only the City Council
had the authority Co modify

After further aiscussion, Commissioner Crisp moved, seconded by Commis-
sioner K~lltun, that the tentative map for SD-408 (Exhibit "A-I", filed
March 20, 1963), Roy B. Naylot, 3F lots off Shadow Nounrain Drives be
approved subject to the conditions contained in the Subdivision Cubit-
tee Report of March 25, 19631 motion carried unanimously.

There was no one present who wished to comment further with regard to
this application.
It was the consensus of the Cor~,t ssion that this request for a Variance
was warranted since development of the adjoining subdivision had more
or less partcreed the street and lot design of these lots.
There was a motion by Commissioner Glenn, seconded by Commissioner
Johnson, that t_he public hearing on V-225 be closed; motion carried
unanimously and Chairman 14ebster declared the hearin~ closed at 8:25

Cu~issioner Johnson moved, seconded by Commiss~oner Crisp, that V-225,
application for a Variance in connection with the depth of two lots and
site area of one lot of proposed 37 lot subdivision, be granted as
shown on the tentative map (Exhibit "A-l" of SD-408); motion carried
unanimously.

D. Proposed Amendment to Zonin~ Ordinance NS-3 re 4-H and Similar Projects
The public hearing on the proposed amendment to Ordinance NS-3 was
opened at 8:40 P.
Commissioner Crisp advised that the City Council had approved the report
transmitted by the Planning Commission and had requested that the City
Attorney draft an amendment for the purpose of holding a public hearing.
He further advised that the proposed amendment was essentially the same
as the report.
DR. G. I. S~IITH, Quito Road, stated l) he felt 4-H and similar projects
were an integral part of our chtldren's growin~ up 2) he was empirerio
cally in favor of such projects 3) he was opposed to the mere restric-
tive clauses of the proposed nm~ndment and 4) he felt a more permissive
amendment was needed,

DESPOND JOHNSONs Quito Roads stated that while he felt that some control
yes desirables he felt the amendment was too restrictive since children
who lived on smaller lots would not be allowed to have even small
animals,
HERBEKT PAULSON, E1 Quito Way, stated that he did not object to the
proposed amendment but felt that it would develop into quite a headache
since he did not feel it could be controlled, When Chairman Webster
explained the requirements and advised that the Planning Co..is,ion
would retain continuin~ Jurisdiction, Hr. Paulson withdrev his
B. T. CALEB, S~ull Ways stated that he felt tlmt any requirement that
would prohibit such projects was too restrictive.
COUNCILMAN DRAKE raised a question as to whethe~ or not the proposed
amendment was properly packaged since, while two calves would be ample,
it seemed doubtful that two chickens would be a sufficient number for
such a project.
RUSSELL STRA~ETZ, Sobey I~oad, stated that two chickens would not be
adequate since the project would require a sufficient n~ber to sell
eggs for profit.
After further discussion, Cormhis,loner Glenn moved, seconded by Co~nis-
,loner Crisp, that the public hearing in connection with the proposed
amendment to Ordinance NS-3 be closed; motion carried unanimously and
Chairman Webster directed the hearing closed at 9:15 P. N.
Cun~nissioner Glenn moved that proposed Ordinance NS-3.3 (the subject
amendment) as w~itten be forwarded to the City Council as the recom-
mendation of the Plannin~ C~aaission; C~,~tssiomer Crisp seconded the
motion. Roll call vote: Ayes: Cu~u~issioners Co~ley, Crisp, Glenn,
Johnson, Kellum and Webster. .Noes: None. Absent: None. Notion car-
ried unanimously,

The Secretary read a letter from James Riley, engineer, requesting a 30
day extension in connection with SDR-384. He advised that a 30 day ex-
tensionwould ~,-ke the application valid through April 2Is 1963.

approved subject to the conditions contained in the Building Site Comnit-
tee Eeport of ~ch 25, 1963; motion carried vnnnimously,

son, that the tentative map for SDR-413 (Exhibit "A', filed l~arch 7~ 1963)
be approved subject to the condi~ions contained in the Buildin~ Site Com-
mittee Report of March 25, 1963; motion carried unanimously,

Co~,lssioner Crisp e~plained thac the tentative map for SD-414 covered
the property originelly covered by Unit 2 of SD-268, He further
explained that Planning C~lssion approval o~ the tentative map for
SD-268 had expired before a final map could be filed on Unit 2, so the
applicant had re-applied ~nder SD-414o Re advised that the only ne~
condition proposed pertained to an access road through Lot No, I of this
subdivision,

George Somps, e~ineer for the applicant, was present and expressed satis-
faction with the proposed conditions of approval,
The Secretary read a petition filed by the Azule Improvement Association,
B, T. CALEB requested that action on SD-414 be deferred until the ques-
tion regardin~ the extension of Ted Avenue had been solved.
FRANK CH~SNOSs Vice President of the Azule Improvement Associations
stated that the Association felt that both Ted Avenue and DeSauka Avenue
should be extended as sho~n on the map filed with the County several
years ago, In answer to a question from Commissioner Crisp, lit, Chesnos
stated (on bebslf of the Association) that the proposed 18 foot access
rend was not Satisfactory since they felt a full street, as originally
planneds was needed,
B, T, Caleb stated that he ~ould dedicate and improve a 60 foot
of-way extendir~ to the Kirkorian Subdivision at any time that Nr, Kir-
korian~ould install the connection,
There was an extended discussion between the Pl~n,tng Com~issions
Sompss Frank Chesnos and B, T. Galeb, The Co~m~ssion indicated an
intention to request extension of Ted Avenue through Lot No, I of the
Kirkorian Subdivision (along the lines of the diagram of the October
1962 letter from John E, Thorns to ~mo E, Glennon) on the condition that
B. T, Galeb collate ~ork on the Ted Avenue extension~rithin one year,
If that work ~ms ~ot cu~leted within one years the Commission agreed
that the Kirkorian Subdivision would be allo~ed to improve Lot No, 1
out an easement or access of any kind across it,
Chairman Webster directed SD-414, Ira Kirkorian, continued until the
meetin~ on April 8s 1963, and requested that Ceorge Somps re-design the
subdivision to provide a full street through Lot No, h

The Secretary advised that final si=e approval on this property was
denied by the City Council so recomended that A-99 be denied without
prejudice,

Counnissioner Cowley moved that action on the request for final design
approval in connection with C-54 be deferred until the meeting on
April 22, 1963s since the applicantte application for change of zoning
on this property would come before the City Council on April 17, 1963.
CouniSsionev Johnson seconded the motion which carried unanimously.

Sam Kauffnmnn was present and advised that colors had uot been assigned
to the individual homes since they planned to allow the buyers to select
their colors from the approvnd color schemes.
Cor~,tssioner Cowley advised that the Committee had reviesed the exhibits
submitted in co-~ction with this application and while they approved
the lay out, =hey felt that color schedules for the individual homes and
sn-?les of the various colors were needed. He suggested that this
be continued until the next regular meeting to allow the applicant ade-
quate time to sub~Lt these
On the basis of this sug~estions Chairman Webster directed A-103,
& Kauff~,nnns Inc°~ continued until the meeting on April 8~ 1963.

for Extension
The Secretary read a letter from Ruth and Going requesting an extension
of one year in connection xqith SD-328.
Commissioner Johnson moveds seconded by Co~anissioner Crisps that the
request for an extension of one year in connection with gD-328 be
granted; motion carried unanimously.
