The meeting wae called to order by Chairmen Webster at 7:00 P. M.

Present: Co~nissioners Cowley, Crisp, Glenn, Johnson, Kellum, Norton
and Webster.
Absent: None.
B, MINUI~S
Commissioner Johnson moved, seconded by Commissioner Glenn, that the
reading of the minutes of April 22, 1963, be waived and that the minutes
be approved as submitted to the Commission; motion carried unanimously.
Since there were eight (8) public hearings on the egenda, the Commission
decided to hear the communications first, then proceed with the other items
on the agenda.

A, NRITTEN
1. SDR-34~ - O. T. RobertshawT Farwell Avenue - Request for Extension
The Secretary rend a letter requesting an extension of six (6)
months in connection with approval of this tentative map.
Commissioner Olenn moved, seconded by Commissioner Kellum, that the
six (6) month extension requested in connection with SDR-349 be
granted; motion carried unanimously.
2. St. Michaels Church~ Allendale AXehue - Picnic Pacilitie~
~9~e Secretary read a letter fromMrs. Riclmrd W. Boettcher opposing
the proposed picnic facilities at St. Michaels Church.
Chairman Webster requested that the Secretary check into this matter
and submit a report at the meeting on May 27, 1963.

VII, B, ORAL
Kenoyer Use Permit - Santa Clara County
Boris Stanley, attorney, gave a brief resume of previous action with
regard to the Kenoyer Use Permit application (Santa Clara County) and
advised that final action was to be taken on Monday, May 20, 1963.
He requested that members of the Commission try to attend the Board
of Supervisors m~eting and that the City Council be requested to sub-
mit a resolution protesting the granting of this Use Permit.
Chairman Webster directed that the Secretary bring this request to
the attention of the City Council and that he (the Secretary) attend
the meeting on Dionday. He stated that he would talk to members of
the Cuumaission about attending the meeting.
II. PUBLIC HEARINGS
The Chairman declared public hearings open for the evening at 7:20 P. M.
A. qT55 - Lyle Benson, Saratoga Avenile - Change of Zoning from '~-M-3,000"
to "Conditional C-C" - Continued from April 22, 1963
After a brief review of this application, Conmissioner Crisp read the
report of the Subdivision Committee.
There was no one present who wished to comment with regard to this
matter°
Commissioner Kellemmoved, seconded by Commissioner Cowley, that the
hearing on C-55 be closed; motion carried unanimously and the Chairman
declared the hearing closed at 7:29 P. M.
Commissioner Cowley moved, seconded by Commissioner Kellum, that the
Planning Commission recomend to the City Council that C-55, Lyle
Benson, be approved in accordance with tile Subdivision Committee Report
of May 13, 1963. Roll call vote: Ayes: Cormuissioners Cowley, Crisp,
Glenn, Johnson, Kellum, Norton and Webster. Noes: None. Absent:
None. Motion carried unanimously.
B. C-56 - O. R. Maggiore, Saratoga Avenue -- Change of Zoning from
'~-I.-10,000" to '~rofessional-Administrative"
The hearing on C-56 was opened at 7:31P. M. ~e Secretary advised
that a Notice of Hearing had been published and tilere were no written
communications on file.

II. B. C-~6 - O. R. Ma~glore
Mr. Flecknet of Pleckner-Palmtag Realty was present to represent the
applicant. He explained that the application for Chan~e of Zoning had
been filed since it was felt that the subject property was unsuitable
for single family residential. He advised that many of the property
owners in the area had been contacted and had received the idea
favorably.
PLOYD STEINBERG, Saratoga Glen Place, observed ttmt the two (2) homes
recently built at the intersection of Saratoga Avenue and Mellon Drive
had sold very quickly. For this reason he felt that the subject pro-
perry could be used effectively for residential purposes, so recom-
mended to the Commission that this application be denied.
WARREN BEER, Saratoga Creek Drive, stated that he felt the '~-A"
area bein~ developed by Dr. Abrsms would be sufficient for this area,
so believed that additional '~-A" zonin~ would adversely affect pro-
perty values. On this basis, he objected to the proposed Change of
Zoning.
Mr. Flecknet stated that he, too, llved in the Saratoga Woods area
and did not feel that the additionel '~-A" zonin~ for the proposed
development would adversely affect property values.
Conunissioner Johnson suggested that the report on the feasibility of
s~-l" zoning in this area (presented when apartment zonin~ was re-
quested for the area a few years a~o) be studied.
It was the consensus of the Commission ~het this matter should be
referred to a committee for study and a report,
Chairman ~4ebster directed C-56 continued until the meeting on May
1963, and referred this matter to the Subdivision Colmnittee with a
request that they make a study and submit a report at that meeting.
C. C-57 - Virgil K. Herring, Bi~ Basin Way - Charts of Zoning from
fessional-Admtnistrative" to "Community Commercial"
The hearin~ on 8-57 was opened at 7;5~ P. M. The Secretary advised
that a Notice of Hearin~ had been published and read three (3) written
conm~unications filed in protest of this Change of Zonin~ (1, ARTUS
I~ETZQ~ER ...... 2, BARBARA CALD~LL and ...... 3s ~%NA L. LOZE ...... all of
Big Basin Way).
The applicant was present and advised 1) the Antique Shop would be
closed before the theatre opened so there should be no traffic problem
2) the 50" x 50" s~ace in front of the existing buildin~ could be used
for parkin~ and 3) his existing shop is rented on a month-to-month

basis...the property is not for sale...a more permanent location for
the shop is needed°
SAM HERNANDEZ, Big Basin Way, stated that he was in favor of the sub-
ject change of zoning but felt that the zontn~ should be extended to
include the entire block. He suggested that tt~ Connisston make a
study of the feasibility of '~-C" zoning for the area from Fifth Street
to Sixth Street.
There was a motion by Coxmnissioner Glenn, seconded by Ceunnissioner
Norton, that C-57 be continued and referred to a committee for study;
motion carried unanimously.
Chairman Webster directed the public hearing on C-57 continued until
the meeting on ~y 27, 1963, and referred this matter to the Subdivi-
sion Committee for a review of the circumstances and a report at that
meeting.

D. _UP-49 - George Katty, Wildwood Park - Use Permit for Operation of
~ildwood Park as Conmmnity Facility ~icnic Ground)
The hearing on UP-49 was opened at 8:23 P. M. ~a~e Secretary advised
that Notices of Hearing had been mailed and read three (3) written
communications filed in protest of this Use Permit (I, MR. AND MRS.
AtLNOLDMERCER ...... 2, FA{. AND MRS. WALTER HAPa}L~Naed ...... 3, I. A.
AI~NE).
Chairman Webster requested that the applicant or his representative
explain the basis of this application in view of the agreement executed
between the City of Saratoga and Mr. Ratty (agreeing that picnic facili-
ties would not be operated on this property).
OEORGE H"UTCHINSON, Mr. Ratty's attorney, stated 1) the adoption of
Ordinance 3E-1 prevented Mr, A~atty's doing anything else with the pro-
perty 2) it had caused the property to be an economic burden 3) the
other "frozen" property is zoned so that the present use can be con-
tinued 4) his client would like to utilize the property to gain what
revenue he could to help pay the taxes 5) applicant was willing to
limit the facilities to much smaller groups than before 6) it was
felt that this was not an unreasonable request since the property could
not be used for any other purpose ~) the City Attorney had advised
that there would be no problem with regard to the agreement between the
City and the applicant if the City desired to grant this temporary Use
Permit and 8) in answer to a question from Cu~,~ssioner Crisp. he
stated that the applicant would like to retain his beer license.

II. D. UP,-4~ - Ceorge Ratty
ARNOLD MERCER, Speaking on behalf of eight (8) neighboring property
ox~aers present to oppose the granting of this Use Permit, stated that
their objections were the same as before and suggested that rather
than restate the details of these objections, the Commission refer
the file on the hearing last year.
There was no one else present who wished to c~mment with regard to
this matter.
Chairman Webster observed that Mr. Hutchinson had made a strong and
persuasive presentation and agreed that a hardship could be created
when you had to pay taxes on property that could not be used. He
minded M~. Hutd~inson, however, that the Co~aission, too, had a pro-
blam since, in vi~¢ of the agreement executed between the City and the
applicant, they could not approve this application. He advised
they would have to confer with the City Attorney, Chairman Webeter
raised the question as to x~mther this matter should be referred to
the City Council since, in addition to its being a matter of policy,
the City Council had enacted the Ordinance and entered into the agree-
merit with the applicant, After further discussion, it was agreed that
the applicationwould probably go to the ~ity Council anyway, since
the losing side would no doubt appeal.
Commissioner Cri~p sta~ed that he felt the City Council would probably
like to have a reeo~ndation from the Planning Commission and he did
not feel that the Comm/ssion could grant the Use Permit.
Chairman Webster stated that he felt there was a definite hardship
involved and different alternatives for action on this application
were discussed.
Commissioner Crisp moved that this matter be referred to a committee
for study and a report with recommendation at the next meeting. Chair-
men Webster declared this motion dead for lack of a second.
Coimuissioner Glenn moved, seconded by Commissioner Kellum, that the
public hearing on UP-49 be closed; motion carried with Commissioner
Crisp dissenting. Chairman Webster declared the hearing closed at
9:10 P. M.
Connnissioner Glenn moved, seconded by Commissioner Johnson, that UP~49,
George Ratty, be denied. Roll call vote: Ayes= Commissioners Cowlay,
Crisp, Glenn, ~ohnson, Kellum, Norton and Webster. Noes: None.

II. E. ~P-50 - Mrs° Nora Thorneycroft, Lynde Avenue - Use Permit for Academic

The hearing on UP-50 was opened at 9:12 P. M. ~le Secretary advised
t[mt Notices of Hearii~ had been mailed and there were no written com-
munications on file.
The applicant was present and explained her plans for 1) usinE the
circular drive~my for loadin~ and unloadinE the children and 2) reSu-
latinE her hours so that her students would not arrive and depart at a
time that would conflict with public school arrivals and departures.
She further stated that 1) she had talked to Miss Paul at the State
Office and there would be no problem obtaining a license 3) she would
have approximately ten (10) students and 3) would hold classes five
(5) days each week. With regard to remedial students, she stated that
she would not take more than three (3) students in a class and they
would meet twice each week.
JXMGI~aj{~.M, Lynde Avenue, stated that with all due respect to Mrs.
Thorneycroft he 1) felt it would create a traffic problem and
felt it would be a business establishment in the neiEhborhood.
EMIL JOHNSON~ Reid Lane, representir~ the SaratoSs Orchard Subdivisions
stated that if a business of one type was allowed he felt it would
open the door for other business establishments. He further stated he
felt the traffic would be a problem.
MERVINMOYLES, Elyira Avenue, stated t|mt the school (Foothill School)
was being expanded next year so the traffic load would be greater. For
this reason, he opposed the ErantinE of this Use Permit.
HOWARD MADSON, Canyon View Drive, stated that he felt the idea was
excellent but the location poor.
Coum~issioner Glenn moved, seconded by Cuum~ssloner Kellum, that this
matter be referred to the Subdivision Committee for study and a report
with recon~nendation at the next reEular meeting~ motion carried with
Con~nissioner Cowley dlssentinE.
C~airman Webster directed the public hearin~ on b'9-50, Mrs. Nora Thor-
heycroft, continued until the meetinE on May 27, 1963~ and referred
this matter to the Subdivision ConEnittee for further study and a report
at that time.

IX. F. ..b'P-51 - Mrs. Frances Martindale, Oak Place - Use Permit for Nursery
~chool in Social Hall Buildin~ at Saratoga Federated Church
The hearing on L~-51 was opened at 9:47 P, I~ The Secretary advised
that Notices of Hearing had been mailed and there were no written com-
munications on file,
Mrs, Martindale was prayant to discuss this application with the Com-
mission, She advised 1) the Church bad given its permission for the
Nursery School 2) Mrs, Gordon Hunter would be the other teacher 3)
there was a definite need for such a school in the area since there
was only one other and it had been filled for years and 4) the Church
would like to see the facility (Social Hall Building) used more during
the week.
After further discussion, Commissioner Kellum moved, seconded by Com-
missioner Johnson, that the public hearing on U~-51 be closed; motion
carried unanimously and the Chairman declared ~e hearing closed at
9:57 P. M.
At the suggestion of Commissioner Kellom, Chairman Webster referred
this matter to the Subdivision Connnittee for study and recommendations
with regard to conditions, then directed U~-51 continued until the
meeting on May 27, 1963.
G. ~-2~6 - Riclmrd O. B~{ater, Sobey Road - Variance to allow Lot Width
of 135' for two (2~ lpts in lieu of required 150'
The public hearing on V-226 was opened at 9:59 ~. M. ~he Secretary
advised that Notices of Hearing had been mailed and there were no writ-
ten communications on file.

and advised that the lots had been established many years ago and tmd
been under three (3) ownerships si~ce that time.

of granting the subject Variance.
Comuaissioner Johnson (Chairman of the Variance Committee) requested
that this matter be continued until the meeting on May 27, 1963, since
there was a question regarding this application which should be dis-
cussed with the City Attorney.
On the basis of this request, Chairman Webster directed V-226 continued
until the meeting on May 27, 1963.

Zhe public hearing on V-227 was opened at 10:05 P. M. The Secretary
advised that Notices of Hearing had been mailed and there were no writ-
ten eoumunications on file.
l~ere was no one present who wished to conanent with regard to this
application.
It was the reconmaendation of the Variance Committee that this applica-
tion be granted since the request was for only a few inches.
Commissioner Johnson moved, seconded by Commissioner Crisp, that the
public hearing on V-227 be closed; motion carried unanimously and the
Chairman declared the hearing closed at 10:08
Commissioner Johnson moved, seconded by Commissioner Norton, that
V-227, John G. Oldfin, ba granted to allow a lot width of 149.03' in
lieu of the required 150' since it was a diminutive situation and
obviously a physical hardship; motion carried unanimously.
The Chairman declared public [tearings closed for the evening at 10:10 P. M.
Chairman Webster welcomed Councilman Fred Ritehie and thanked him for his pre-
sence at the meeting.

III. pUBDIVISIONS AND BUILDING
A. SDR-384 - Fenton E. Silvey, Norton Road - Building Site Approval
Continued from Apri.~ 22, 1963 ,.
It was the reconmaendation of the Building Site Committee that this matter
be continued since the requested site development plan had not been sub-
mitted in time to allow the City Engineer odequart time to check it.
The Secretary read a letter from James Riley, engineer for the applicant,
granting an extension of time in connection with this application.
On the basis of the foregoing, Chairman Webster directed SDR-384 con-
tinued until the meeting of May 27, 1963, to allow adequate time for
the site development plan to be checked and conditions established.

B. $DR-421 - M. A. Broemser, Saratoga Hills Road - Building Site Approval -
1 Lot
Commissioner Crisp advised that examination of the tentative map revealed
that the average grade of this lot exceeded 10%. Therefore, in compliance
with Ordinance 3E-2, a site development plan should be required.
After discussion, Chairman Webster directed SDR-421 continued until the
meeting on May 27, 1963s and requested that the Secretary promptly write
to tile applicant advising that a site development plan was required in
compliance with Ordinance 3E-2.
Coummissioner Crisp suggested that perhaps a plan could be worked out so that
the Subdivision Committee and City Engineer could be authorized to determine
whether or not a site development plan was needed.
Chairman Webster directed that this matter be placed on the agenda for dis-
cussion at the meeting on May 27, 1963.
C. SDR-42~ - John Krumpotich, Saratoga-Sunnyvale f, oad - Building Site
~pproval - 1 Lot
The applicant was present and questioned Condition II, C~ pertaining to
an offer of dedication. The Commission further explained this
requirement.
Co,~l~issioner Crisp moveds seconded by Commissioner Kellum, that the ten-
tative map for SDR-422 ~xhibit "A" filed April 16~ 1963) be approved
subject to the conditions contained in tile Building Site Committee Report
of May 13, 1963~ motion carried unanimously.
D. SDR-423 -Neil H. Dollardl Palomino Way - Buildin~ Site Approval - 4 Lot~
Commissioner Crisp advised that the average Erade of this parcel exceeded
10%, so a site development plan was needed ~n compli~nce with Ordinance
3E-2.
Chairman Webster directed SDR-423 continued until the meeting on May 27,
1963, and requested that the Secretary write to the applicant promptly,
advising him t]mt a site development plan would be required before the
Co~lssion could consider this application.
E. SDR-424 - Earl J. Peter~ June Iqay - BuildinM Site ~pproval - 3 Lots
The applicant and his representative, Lee McKo~m, were present.
Cuu~lssioner Crisp advised that approval of these lots would create an
illegal lot with regard to the residual parcel. ~lerefore, he suggested
that this matter be continued until the next regular meeting to allow
adequate time to obtain an opinion from the City Attorney.

III. E. SDR-424 - Earl J. Peter
In view of the foregoing, Chairman Webster directed SDR-424, Earl J.
Peter, continued until the meeting on May 27, 1963, to permit t~une
for an opinion from the City Attorney with regard to a legal matter.
. F. SDR-425 - John G. Oldfin, Fruitvale Avenue - Building Site Approval - 1 Lot
The applicant was present, expressed satisfaction with the proposed
conditions of approval and advised (with regard to the suggestion per-
raining to Coynet Drive) that a joint driveway had been contemplated.
Commissioner Crisp moved, seconded by Con=aissioner Kellum, that the
tentative map for SDR-425 (Exhibit "A", filed May 3, 1963) be approved
subject to the conditions contained in the Building Site Committee Re-
port of May 13, 1963; motion carried unanimously.
G. SD-426 - Brown & i~uffmann, Inc., Prospect Avenue - Subdivision -
116 Lot. s
M. L. Splitstone was present to represent the applicant and expressed
satisfaction witlx the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Subdivision Committee Report of May 13, 1963, be adopted and that the
tentative map for SD-426 (Exhibit "A", filed May 3, 1963) be approved
subject to the conditions imposed in connection with SD-327; motion
carried unanimously.
IV. DESIGN REVIEW
A. A-55 - Saratoga Post Office, Saratoga Avenue - Preliminary Design Approval-
Continued from April 22~ 1963
Commissioner Cowley advised that there had been no further submittal from
Mr. Green, architect for the applicant, so it was the recommendation of
the Design Revie~ Committee that this matter be continued until the next
regular meeting.
Mr. Green was present, together with Mr. DeTurk, and advised 1) he
realized that Highway 9 was being widened in this area and a map was
now in work 2) he could understand that the Commission might like to
continue this item until the map was completed 3) the Post Office was
scheduled for occupancy in November, 1963, so time was of prime impor-
tance and 4) Mr. DeTurk was reluctant to buy the property until I~e was
assured that he could obtain a building permit.

IV. A. A-55 - Saratoga Post Office
After further discussion, the applicant was advised that the absence
of revised plans was the reason for no Co~nittee action and it was sug-
gested that appropriate drawings be submitted prior to the closing date
for the ageads of the May 27, 1963, meeting.
Chairman Webster then directed A-55 continued until the meeting on
May 27, 1963.
A-102 - Robert Neale, Saratoga Avenue - Final Design Approval - Antique
STop - Continued from April 22~ 1963
Commissioner Cowley suggested that this matter be continued until the
meeting on ~y 27, 1963, since the Change of Zoning application on ~is
property would again come before the City Council on b~y 15, 1963.
Mr. Neale was present and concurred with this suggestion.
On the basis of the foregoing, Chairman Webster directed A-102s Robert
Neale, continued until the meeting on ~L~y 27, 1963.
C. ~-194 - Barbara G. McKenzie, Big Basin Way - Final Design Approval -
Antique Shop
Comissioner Cowley advised that the Design Reviaw Comittee had re-
quested that the applicant make two (2) revisions in the plans, and
noted that the applicant had complied with this request.
Donald McKenzie, representing the applicants stated 1) they would pre-
fer that the parking area be approved as originally designed since that
would allow adequate space for adding a storage room at a later date
2) the parking as originally designed met the requirements of the Zoning
Ordinance and 3) they would accept approval of the alternate plan if
the Conwnission felt it could not go along~rlth the original plan.
Cou~nissioner Cowley moved, seconded by Conmaissioner Glenns that A-104s
Barbara G. Mc/enzie, Antique Shop on Big Basin ~ay, be granted final
design approval as shown on Exhibit "A-I", sheets 2, 3 and 4 and the
revision of sheet 1; motion carried unanimously.
D. A-106 - Art-Craft Neon, Oak Street - Design Approval - Sign for Standard
Oil Service Station
l~xe Secretary advised, in answer to a question from Cormnissioner Cowley,
chac the proposed sign was about 5 square feet ~maller than the sign
displayed at the Argonaut Station.

IV. D. A-106 - Art-Cra£t Neon
Counissioner Cowley moved, seconded by Connissioner 3ohneon, that A-106,
sign for Standard Oil Service Station, be granted design approval as
shown on Exhibit "A", dated April 30, 1963; motion carried unanimously.
E. A-107 - First Church of Christ Scientist, Saratoga Avenue - Design
Approval - Off-Site Directional Sign
After discussion, Conunissioner Cowley moved, seconded by Commissioner
3ohnson, that A-107, off-site directional sign for First Church of
Christ Scientist~ be approved as shown on Exhibit "A", dated May 3,
1963; motion carried unanimously.
F. A-108 - ~illard Thqmpson, Oak Street - Final Design Approval - Apartments
Commissioner Cowleymoved, seconded by Connuissioner Johnson, that A-108,
Willard Thompson, be granted final design approval of proposed apart-
merits on Oak Street as shown on Exhibit "A-l", sheets 1 through 6, dated
Hay 3, 1963; motion carried unanimously.
G. ~-109 - G. C. Welker, Prospect Avenue - Design Approval - Interior
Decoratin~ Shop
The applicant was present to discuss this matter with the Commission.
Commissioner Cowley moved, seconded by Commissioner Johnson, that
design approval be granted A-109, G. C. Welker, Interior Decorating
Shop on Prospect Avenue, as shown on Exhibit "A", dated May 3, 1963,
subject to the following conditions: 1) parking area to be black-
topped and 2) provision for parking to be as indicated on Exhibit "A".
Motion carried unanimously.

UnderMround Electrical Facilities - Sarahills Subdivision (John Rodrigues),
Pierce Road - City Council Request for
PlanninM Commission Reconunendation
The Secretary advised that the City Council had requested that the Planning
Conuuission make a recommendation with regard to Mr. Rodrigues' proposal for
underground electrical facilities for his subdivision off Pierce Road.
Commissioner Crisp advised that the Subdivision Conunittee had met with the
subdivider to review this matter. He explained that there would be an
Assessment District and there would be no cost to the City.

V. ~nderground Electrical Facilities - Sarahills Subdivision (John Rodri~ues)
14,r. Rodriguas waa present and advised 1) it was £elt that street lights
were essential in this araa of the hills 2) driveways would be removed
from streets so that post lamps would not be adequate 3) because of view
lots it was felt that the regular wooden poles should not be used 4) it
would cost $600 per lot to provide the underground facilities 5) these
lights were designed so that there would be no problem for the people below
and 6) because of topography of this area there is not adequate room in
the right--of-way to go underground completely. Mr. Rodrigues further ad-
vised that this facility had been used in San Marco.
During the discussion that followed, the general consensus was in favor
of this type of pole arrangement. The only question was the level and
direction of illumination.
Counissioner Norton moved, seconded by Connissioner Cowley, that tile Plan-
ning Conm~ission advise the City Council that the Commission had no objec-

VI. 9LD BUSINESS
A. General Plan - Proposed Revisions
Chairman Webster, with concurrence of the Cuu~ission, directed this
matter continued until the meeting on May 27, 1963.
B. Library File
Commissioner Glenn submitted a clipping from the May 13, 1963 edition
of the Saratoga News and requested that it be placed in the Library File.
Chairman Webster so ordered.
