Saratoga, California Type: Regular Meetin~ I. ~ODTINE ORGANIZATION The meeting was called to order by Chairman Webster at 7:00 P. H. A. ROLL CALL Present: Commissioners Cowley, Crisp, Glenn, Johnson, Kellum, Norton and Webster. Absent: None. B, MINU~ES Commissioner Johnson moved, seconded by CoEmtssioner G1eun, that the reading of the minutes of Nay 27, 1963. be waived and the minutes be approved as submitted; motion carried unanimously. lI. PUBLIC HEARINGS The Chairman declarnd public hearings open for the evening at 7:03 P. M. A. C~57 - Virgil R. Herring, Big Basin Way - Change of Zoning from ~ro- fessional-Mministrative' to 'Communtty-Couahercial' - Continued fromMay. 27w 1963 The Secretary advised that because of a revision of this application it had been necessary to re-publish the Notice of Hearing. For this rea- son, he recommended thaC this matter be continued until the next regu- lar meeting. There was no one present who ~ished to conanent further with regard to this application. On the basis of the Secretary'a recommendation, Chairman Webster directed C-57 continued until the meeting on June 24, 1963. B. C-58 - Etchlet Homes, Inc., Cox Avenue - Change of Zoning from 'Agri- cultural" to '~-1-12~500 P-D' - Conttnu..ed from Ma~ 27~ 1963 The Secretary briefly reviewed this application and read a co~m~unica- tion from E. L. SPLITSTONE, engineer for the applicant, was present to discuss this matter with the Commission. There was no one else present who wished to comment with regard to this application, Commissioner Crisp stated that he concurred with the Staff Report but recommended that action on this application be deferred until the ten- tatire nmp had been considered. In answer to a question from Connnissioner Cowley, Mr. Berger, appli- cant's attorney, advised that application for Design Review would proba- bly be filed prior to the meeting on June 24, 1963. At 7:20 P. H. Chairman Webster, on the basis of Couunissioner Crisp's recommendation, suspended discussion on C-58 until later in the evening. C. V-228 - Earl J. Peter, Saratoga Avenue - Variance to allow Lot Depth Of llOw in lieu of required 140~ The public hearir~ on V-228 was opened at 7:21P. H. The Secretary advised that Notices of Hearin~ had been mailed and read a Staff Report pertaining to s~e. The applicant was present and explained that the owner of this residual parcel had given him permission to apply for the Variance since it was needed prior to approval of his three lots on June Way. He observed that l) this Variance had previously been granted by the Commission in connection with another tentative map 2) the proposed depth was the same as other properties along Saratoga Avenue all the way to Herriman Avenue and 3) the proposed depth was adequate to build homes compara- ble to other in the area and still observe the setbacks required by the City. LEE HCKOWN co,~ented Chat the homes already built by Hr. Peter had up- graded the entire area. ROGER LAW, representing eight underwriters who have made loans on Hr. Peter~s homes, stated that his homes were quoted for maximum financing and would enhance any neighborhood. I~, CARRIER stated that Hr. H. ~, Jer~ies Drive, after requesting clarification of this application, stated that she was opposed to the granting of tile Variance. WM. H. BOWEN, Je~ries D~ive, stated that he, too, objected to the granting of this Variance. HOWAP, I) K. LARSON, Cerneil Court, observed that tile applicant had no intention of building on the property on which he requested the Variance. The Commission again explained Mr. Peter's need for the Variance before obtaining approval of his lots on June ~qay. H. R. ~ORTA, Jetties Drive, after requesting clarification of the situa- tion, stated that he was opposed to the granting of the Variance. After further discussion, Commissioner Cowley moved, seconded by missloner Johnson, that the public bearing on V-228 be closed; motion carried unanimously and the Chairman declared the hearing closed at 8:00 P. M. Connissioner Johnson moved, seconded by Conmissioner Crisp~ that the Variance (V-228) be granted subject to the condition precedent relative to the improvement of Saratoga Avenue (that Saratoga Avenue be dedicated and improved to provide for a ~5' half street for the entire frontage of the property on Saratoga Avenue, a distance of approximately 4~0'). Roll call vote: Ayes: Commissioners Cowley, Crisp, Glenn, Johnson, Kellum, Norton and ~ebster. Noes: None. Absent: None. Motion car- tied unanimously. Commissioner Crisp moved, seconded by Commissioner Johnson, that SDR-424, Earl J. Peter, be reinstated for consideration ;~y the Planning Commis- sion; motion carried unanimously and Chairman Webster directed that SDR-~2~ be placed on the agenda ~or the meeting on June 2~, 1963. ~ENMX1TOTE RECESS Ill. ~UBDIVIS~ONS AND BUXLDINC SI~ES A. ~DR-421 - M. A. Broemser, Saratoga Hills Road - Building Site Approval - 1 Lot - C~ntinued from May 2~, 1963 ..... Commissioner Crisp advised that the requested site development plan had been ~eceived and approved by the City Engineer. D~. Broemser Cou~nissioner Crisp moved, seconded By Con~ni~sioner Johnson, that the tentative map for SDR-421 (Exhibit "A'~, filed April 15, 1963) be ap- proved in accordance with the site development plan (Exhibit "B-i) subject to the conditions outlined ih the Building Site Committee Report of June 10, 1963; motion carried unanimously. B. SD-427 - Eichler Homes, Inc., Cox Avenue - Subdivision - 83 Lots - C. ontinued from May 27~ 1963 . I~. L. Splitstone, applicant~s engineerr was present and expressed satisfaction with the proposed conditions of approval. Co~=atsstoner Cowley suggested that C-58 and SD-427 be continued until an application for Design Review had been filed sothat the lot layouts, elevations, etc. could be reviewed at the same time. He observed that it was possible that in reviewinE the Eichler homes as proposed for Saratoga the Co~,~sston might have a different viewpoint. Commissioner Glenn stated that if the developer proposed the same type home he had built in other places, he did not feel that the Design Review Committee would be favorably impressed. The Secretary ramindnd the Coremission that it was necessary that they take action on the tentative map within 45 days of the date it was filed unless it was continued by mutual consent. He observed, however, that perhaps it could be continued because of the zontnE application. bit. Berger, attorney for the appltcant~ advised that they would abide by all requirements of the City of Saratoga, but felt that unless there was something technically wrong, the tentative mep should be approved. In answer to a question from Connnissioner Norton, Mr. Berger stated 1) he hoped the Design Review application would be filed within the month hut could not cormnit himself to this 2) he did not feel that the Commission would want to hinge this tentative map on a set of plans and 3) he felt it would be better if the tentative map was approved and the developer was allowed to take adequate time to prepare the plans for Design Review. He also suggested that the Commission visit an area of Eichler homes comparable to those proposed in Saratoga. M. L. Splitstone stated that he felt sure the developer was fully aware of the obstacles of Design Review and requested that since the zonin~ application would tab time, the Colmission approve the tentative map so they could continue. He further advised that the developer had gone beyond the requirements of the ordinance by proposing underground facilities for the area. -4- ~.lannin~ Co~mission Minutes - June l0t 1963 - Continued III. B, S~-427 - Etchlet Homest CounissiOner Crisp advised that the developer had complied with all requirements of the Subdivision Ordinance and stated, with concur- rence of Commissioner Johnson, that he frankly did not know whether or not they could Safer action on the map pending Design Review. Every effort was made by the Connni~sion to mnke the applicant aware that a great deal depended on the DePign Review appiication. They still wanted approval of the tentative map at this time, so the Com- mission decided that it was the developeris calculated risk. After further discussion Chairman Webster suggested that the followix~ be included in the proposed conditions of approval as Condition No. 14: Applicant must assume full responsibility and risk for any expense incurred in connection with this subdivision prior to final design approval (attention is directed to Article 13 of City of Saratoga Zoniu~ Ordinance NS-3). Commissioner Norton moved, seconded by Commissioner Crisp, that pro- posed Condition No. 14 be modified to read as follows: Attention is directed to Article 13 of City of Saratoga Zonin~ Ordinance NS-3. Motion carried with Commissioners Cowlay and Webster dissenting. Conunissioner Crisp moved, seconded by Co~unissioner Johnson, that the tentative map for SD-427 (Exhibit "A-i", filed June 4, 1963) be approved subject to Conditions I through 13 as outlined in the Subdivision Com- mittee Report of June 10, 1963, and Co~C~on 14 which was just added; marion carried with Conunissioners Cowley and Webster dissenting. II. B. C-58 - Eichler Homes, Inc. The hearing on C-58 continued at 9:00 P. M. There was no one present who wished to speak with reSard to this matter. Commissioner Glenn meved, seconded by Conmnissioner Johnson. that the public hearin~ on 8-58 be clased; motion carried unanimously and the hearinS was closed at 9:01P. M. Commissioner Crisp moved, seconded by Cohauissiousr Norton, that the Planning CouTaission recommend to the City Council that C-58, Elchler Homes, Inc., application for change of zoning from '~" to '~-i-12,500 P-D", be approved in accordance with the tentative map (Exhibit "A-I'9 filed in conjunction with this application. Roll call vote: Ayes: Commis- sioners Crisp, Glenn~ Johnson, Kellum and Norton. Noes: Commissioners Cowley and Webster. Absent: None. Comissioner 14ebster stated, with concurrence of Connissioner Cowley, that his '~o" vote was ba~ed .solely on the fact that he felt that the Design Review application should be considered concurrently with these two applications, pESIGN REVIEW NEW BUSIlqESS A, ~port - Commissione~.C.risp 1. Commissioner Crisp gave a brief resume of Council action on June 5, 1963, and advised that the Council had requested that the Conmission select a qualified retired person to make a study regarding annexa- tion. He stated that the Director of Public Works had suggested for- mer Planning Commtesioner Adrien L. Anderson and he concurred with this suggestion. It was the consensus of the Commission that Mro Anderson was highly qualified to mice the study. Commissioner Crisp moved, seconded by Commissioner Johnson, that 1) Chairman Webster be authorized to contact Mr. Anderson and re- quest that he make this study and 2) if he was unable to obtain his services, the Chairman be authorized to contact another qualified person; motion carried unanimously. 2. C-.nmuissioner Crisp advised that a citizens representative had pro- posed the establishment of a Scout Building on the Corporation Yard property, Be added that ~he formal proposal ~ould be presented to the Planning Commission in the near future, B, 8eport - Commissioner Norton Co~n~ssioner Norton gave a brief report with regard to the Subdivision Committee meeting with representatives of Pacific Gas and Electric in connection with complete underground u~ilities. VI. ~LD BUSINESS · here was a brief discussion with regard to egenda items for review of the C-eneral Plan on July 1, 1963. Connissioner Crisp advised that the City Council had again received copies of the agenda items at the meeting on June 5, 1963, ~rlth a request that they make any additions they desired. ~lannin~ CommiSsion Minutes - June lOs 1963 .- Continued C..C~CATIONS A. ~RITTEN The Secretary read a letter from Demnond Johnson requesting clarifica- tion of the required right-of-way for the access road under SDR-411. On the basis of a suggestion from Con~nissioner Crisp, Chairman Webster referred this matter to the Subdivision C~mnitCee for study and directed it continued until the meetin~ on June 24, 1963. B.
