ROLL CALL Present: Co-~esioners Cowley, Crisp, Glenn, Johnson, Kellum and Norton. Absent: Comissioner Webster. B, MINVEES Commissioner Glenn moved, seconded by Commissioner Crisp, that the readin~ of the minutes of July 1, 1963, be waived, that the minutes be epproved as submitteds and that the minutes become a part of the record of the hearing on the General Plan~ motion carried unanimously. Commissione~ Glenn moved, seconded by Con~nissioner Crisp, that the ~eadin~ 6f the minutes of July 81 1963, be ~aived and that the minutes be approved as submitted; motion carried unanimously. PUBLIC IiEARINGS The Chairman declared public hearings open for the eveninE at 7:05 P. M. A, General Plan Revisions - Continued from July 1~ 1963 The Secretary read l) conmunication from Mrs. Charles R. Miller and Mildred Miller opposing the rerouting of Pierce Road through their ranch 2) petition with 11 signatures of property o~ners along Big Basin Way favoring a Fine Arts, Specialty Shop Zone alone Big Basin Wsy from Fifth Street to the westerly limits of the 14600 Block 3) petition with 43 si~natures of residents of the Carniel Avenue, Wardell Road, Foothill Lane Area opposing the northerly extension of Carniel Avenue and 4) coa~unication from Don Orlando favoring Commercial ZoninS of all property northeast of the La~reuce Expressway. Vice Chairman Johnson referred the petition re~ardinE the northerly extension of Carniel Avenue to the General Plan Committee since this matter had not been discussed previously. ~1~ ~annin~ Commission Minutes - July 22~ 1963 - Continued IX, A. General Plan R~"v~sions Commissioner Glenn read the report of the General Plan Committee vlth referanne to the proposed revisions. There was no one present who wished to com,~nt with.regard to this mat~ ter so Commissioner Glenn moved, seconded by Conm~issioner Crisp, that the hearir~ on r~ision of the General Plan be closed; motion carried unanimously and the Chairman declared the hearing closed at 7:26 P. M, Commissioner Crfspmoved, seconded by Commissioner Cowlay, that the report of the General Plan Committee be approved and transmitted to t~e City Council as the report of the Commission; motion carried unanimously. B. C-59 - A. & G, Investment Corporation, Prospect Avenue - Change of Zoning from "A~ricultural" to '~-M-4,000-X" The Chairman declared the hearing open on C-59 at 7:28 P. M. The Secretary advised that a Notice of Hearing had been published and there ~ere no ~rritten communications on file. He then read a Staff Report pertaininS to this matter and displayed three (3) artist's reederinSs of the proposed development. HARRY GAleL, representinS the applicants stated 1) the proposed Saratoga development was approximately the same as that epproved by Los Altos 2) the individual units would be quite luxurious though small 3) even the guest perkinS ~ould be provided off-street 4) the development was not proposed as a co-op or condominiom but instead, he would maintain and operate it as investment property 5) a park and recreation area with swt~inS pool, shuffleboard, etc. would be provided and 6) there would be one and two bedroom, one and t~o bath units, some of which would hsNe a family room. N. J. LEE, 12885 Woodmerit Drive, stated that he was opposed to a develop- ment of this type since Saratoga's objective was low density. He reques- ted that the Commission study this proposal thoroughly and deny the application. ERSo JEANNE JETZ, 20760 Wardell Road, concurred with Mr. Lee. She also raised a question with regard to the proximity of this property to the proposed Fremont High School. Vice Chairman Johnson referred this matter to the Subdivision Connuittee for study and a report at the meeting on August 12, 1963s then directed the public hearing on 8-59 continued until that time. The Sec.~etary advised that Notices of Hea~in~ had been mailed and there were no ~ritten con~nunicatlons on file. He then read a Staff Report pertaintv~ to this matter. Connnissioner Crisp advised that the Subdivision Committee had reviewed this application and could see no reason why it should not be approved. There was no one present who wished to connnent further with regard to this matter. Commissioner Crisp moved, seconded by Connnissioner Kellums that the pub- lic hearin~ on UP-52 be closed; motion carrind unanimously and the Chair- man declared the [marin~ closed at 7:55 P. M. Connnissioner Crisp moved~ seconded by Co;=nissioner Kellum, that IIP-52, Charles Gordons application for Use Permit for the keeping of one (1) horse, be approved subject to all provisions of Ordinance NS-3; motion carried unanimously. D. UP-53 - Los Gatos Uni~arian Fellowship~ Saratoga-Sunnyvale Road - Use Permit for Church a~ Sunday S~hool Tl~e hearing on I/P-53 was opened at 7:56 P. M, The Secretary advised that Notices of Hearin~ had been mailed and reed the following col~uuntcations: 1) petition with signatures of 16 resi- den~ of the Verde Vista Lane, Saratoga-Sunnyval¢ Road Area protecting the grantin~ of the subject Use Permit 2) con~nunication fromMrs. R. ~. Hitchnmn, adjacent property o~ner, objecting to the grantlull of the Use Permit and 3) Staff Report pertainin~ to this matter. PAUL BEAUDRY, representin~ the Church, discussed this application with the Connnission and advised that the Church had 115 members at present, 33 of whichwere residents of Saratoga. After further discussion, the Chairman referred this matter to the Sub- division Committee for study and a report at the meetin~ of August 12, 1963.' He then directed the public hearing onC-53 continued until that time. Vice Chairman Johnson declared public henrings closed for the evening at 8:05 P. B, SD-433 - John Rodri~ues~ Sara~o~a-Sunnyvale Road - Subdivision - 26 Lot~ Rolph R~nona, representing the applicant, protested Condition No. 13 of the proposed conditions of approval. Ha advised that the developer would like to use the streamlined distribution system without electro- llers instead of having all u~ilities underground. 1'he Commission referred Mr. Ramona to the Comnission's policy interpretation which was to be discussed later in the evening. Commissioner Crisp moved, seconded by Commissioner Norton, that the tentative map for SD-333 (Exhibit "A-2", filed July 22, 1963) be approved subject to the cOnditions outlined in the Subdivision Committee Report of July 22, 1963; motion carried unanimously. C. SDR-434 - Mrs. Vivian Silva, Willjams Avenue - Building Site Approval - 1 Lot, The applicant ~as present and expressed satisfaction with the proposed conditions of approval. Connnissioner Crisp moved, seconded by Commissioner Kellum, that the ten- tative~p for SDR-434 (Exhibit "A", ~iled July 12, 1963) be approved Subject to the cOnditions outlined in the Building Site Co~maittee Report of July 22, 1963; motion carried unanimously. D. SDR-435 - Clarence ~oy, St. Charles Street - Building Site Approval ~ Con~nissioner Crisp reconnended that this matter be continued since, at the request of the Euilding Site Committee, the applicant was in the process of revising his tentative mop. Com~ssioner Crisp advised that a site development plan had been reques- ted, submitted and approved, Connuissioner Crisp moved, seconded by CommissionerKellum, that the ten- tattve map for SDR-436 (Exhibit "A', filed July 12, 1963) be approved in accordance with the site development plan (Exhibit '~", filed July 22, 1963) subject to the conditions outlined in the Building Site Committee Report of July 22, 1963; motion carried unanimously. OLD BUSINESS A. Polic~ re Underground Utilities Commissioner Norton read a report from the Subdivision Conmmittee with regard to Planning Cu,,assion Policy in connection~th underground utilities. Petition r~.~ennis Jackson The Secretary read a Staff Report advising ~at this matter had been referred to the City Attorney for further investigation. Vice Chairman Johnson directed this matter continued, bu~ withheld from ~he agenda, until the City Attorney's report had been received. D. ,Optometrist - Additional Permitted Use in Professional-Administrative Zone Co~issioner Crisp read a report from the Subdivision Committee recom- mending that "Optometrist" be added to the list of permitted uses in the Professionel-Administrative zone. Commissioner Crisp moved, seconded by Cuu~issioner Cowley, that the report of the Subdivision Con~nittee be adopted, chat "0ptometrist" be added to the list of permitted uses in the Professional-Administrative zone, and thac suitable notation be made to insure its inclusion in the next printing of Ordinance NS-3; mo=ion carried unanimously. Plennir~ Co~ission Hinutes - July 22~ 1963 - Continued CO~3qlCATIONS SDK-362 - John Jacobs, Jr., Kittrid~e ..Road - Eequest for Extension The Secretary read a letter from John Jacobs, Jr. requesting an exten- sion in connection with SDR-362. After discussion, Cor~nissioner Glenn moved, seconded by Commissioner Crisp, that the request for extension in connecUion with SDR-362 be denied since it was the policy of the Commission to grant such an exten- sion only when it was requested prior to the expiration date of approval of the tentative map; motion carried unanimously. 1. Mr. Don Krandall. Case Blanca Lane. requested tlmt provision be made to allow a mortuary in the vicinity of the Paul Masson Cham- pagne Plant. He stated that he felt a mortuary was need in the area a~t thought this ~ou~d be an ideal location. The C~,~esion explained that provision had been made to allow a mortuary in the C~-,,unity Con~nercial zone. and suggested that Mr. Krandall discuss this matter with ~he Planning Director for further particulars. 2o Vice Chairman Johnson acknowledSed the presence o~ Councilman Hartman and Massrso Charles Smith and Robert Suhr of the Good Government Group, and expressed the Coauisstonss appreciation for ~heir attendance° N~ETI~G ADJOURNED A~ 9-'40 Po lt.
