M. Ao ROLL CALL Presentl Commissioners Crisp, Glenn, Johnson, Kellum and Norton. Commission Webster arrived at approximately 7~25 P. M. Absent: Cormnissioner Cowley. B. MINUTES Co~ulssloner Glenn moved, seconded by Commissioner Crisp, that the reading of the minutes of August 26, 1963, be waived and that the minutes be approved as submitted; motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evening at 7:14 P. M. Ao ~-60 - Maxmar Investment Company~ Walnut Avenue - Change of Zoning from "R-1-12,S00" to '~-M-3,000" - Continued from August 26, 1963 The Secretary rand thQ following ~rritten cousu'~nications which .had been filed in protest of the proposed change of zoning since the meeting on August 26, 1963: 1) letter signed by Charles H. Smith and Charlotte Lo Smith 2) letter from the Good Govermmen~ Croup signed by Mrs. Mary Ruth Owen, Secretary and 3) letter signed by Cecil Ho Hawkins. Herbert Re,net and Goodwin B° Steinberg were present to represent the applicanto Mro Steinberg stated 1) it was their desire to have this development blend with the area 2) they would like to meet with the Design Review Committee to ascertain the wishes of the community with regard to such a development and 3) it was felt that this development would be beneficial to the City, Comissioner Webster arrived at approximately 7:25 P. ARTHUR Lo COOL~Y, Squirrel Hollow Lane, stated that his objec- tion ~as not relative to the design of the apartments but the mere fact that they were apartments. Comm{ssioner Crisp read the report of the Subdivision Committee w~th regard to this application° The Secretary then read the Staff report pertaining to this matter, With regard to Mr, Steinberg~s request for time to work up a pre- sentations Commissioner Crisp stated that a great deal of time had already been spent on this application and he could see no reason to continue it further~ Commissioner Johnson moved~ seconded by Commissioner Kellum, that the public hearing on C-60 be closed; motion carried unanimously. ~he Chaffman declared the hearing closed at 7;35 F. Mo Commissioner Glenn moved, seconded by Commissioner Johnson~ that the Subdivision Committee Report regarding C-60, Mamnar Investment Company, be adopted and transmitted to the City Council as the recommendation of the Conmissions Roll call vote: Ayes: Comis- sicnets Crisp~ Glenn, Johnson, Kellum, Norton and ~lebster. Noes: None. Absent: Commissioner Cowley. Motion carried unanimously, B, C-61 - Paul Ho Gardiner~ Allendale Avenue - Change of Zoning from '~-1-40,000" to '~-I-15,000" - Continued from August 26~ 1963 The Secretary read~ in part~ a letter filed by Desmond Johnson~ appraiser, giving further information relative to this application, Chairman Websuet adml.tted this letter into evidence. FREDERICK TURi'~R, 18940 Alcott I4ay~ read and filed t~o petitions protesting the proposed change of zoning with signatures of 49 residents of =he immediate area. These petitions were filed for record, RICP~/tD HEISERs 18880 Allendale Avenue, stated= 1) he lives across the street from ~he subject property 2) at pre~ent the view is not pJ.easant since the vacant lots are overgT. owa '~th grass and weeds 3) he could look forward to little more since the average person does not landscape a full acre 4) he felt the subject property should be zoned for lots of not more than one-half acre. Sam Anderson~ attorney for the applicants observed that an artificial barrier had been created to separate the acre zoning from smaller lots and stated that he felt Allendale Avenue~ a natural barrier, should be the dividing line, Planning, C. B, C-61 - Paul. tI~ Cardiner FRED OVERBECK, 18860 A!cott Way, stated that he felt that if this application ~as approved, previous applications for half acre zoning along Attendale Avenue should be approveds too, ROBERT Jo BLACKs 13760 ~ianteca Way, questioned the manner in which the subject property would be divided. After examining the maps, he expressed satisfaction with the proposal and stated that the pro- perty was not as ~xide as he had thought. ROSALIE PATTERSON, 18900 Alcott Way, questioned the type homes pro- posed for this property. Chairman Webster explained that this was set forth, more or less, by the Zoning Ordinance and Building Code. Connnissioner Crisp read the Subdivision Comnittee Report pertaining to this matter. The Secretary then read the Staff Report relative to this appIication. Commissioner Glenn moved, seconded by Commissioner Johnson, that the public hearing oa C-61 be closed. Motion carried unanimously and the Chairman declared the hearing closed at 8:14 P. M, Co~missioner Johnson moved, seconded by Commissioner Glenn, that the report of the Subdivision Co~Bittee relative to C-61, Paul H. Gardiner. be approved and that the report be transmitted to the City Council as the recommendation of the Co-,-~ssion. Chairman Webster moveds seconded by Co~assioner Glenn, that the motion be modified by adding the following: ton the basis that the present zoning on this property is an integral part of the existing zoning in the area and the General Plan of the City of Saratoga." Absent: Commissioner Cowley. C. UP-54 - Kenneth Lo Peterson, Leonard Read - Use Permit for Horse The public hearing on UP-54 wss opened at 8:17 P. Mo The Secretary advised that Notices of Hearing had been mailed and read a co~lnunica- tion filed in protest of this Use Permit signed by MARIA and SAM J. CIRIGLIANO, JEAN C. and JAMES G. Chairman Webster referred this application to the Subdivision Cem- mittee for study and a report at the nex: regular meeting, then directed II9-54 continued until that time, D, V~eX9 ~ Dovald G, MacKay~ Sobey Road - Variance to allow Lot Width of i16! for Lgt ~' a~d 105! for Lo~ 'B' in lieu of required 150~ The public hearing on V-229 was opened at 8:30 P, H, The Secretary advised that Notices of Hearing had been mailed and read a conv~ui- cation filed by JAMES A, RODRIGUES opposing the granting of this Variance, Jim .C~le of l~acKay & Somps~ representing the applicant~ displayed a topographical map showing that there were only two possible building sites on the subject property° He also displayed drawings showing the three possible ways to divide the property, two of ~ich conformed to the ordinance and the third of ~nich weuld require a Variance, JOHN M, BUTLE~ crigim~l owner of the propertys advised that when he sold t|~is portion of his property (approximaa~.ely one and a half years ago) he was amre of the acre zoning but did not know about the minimum width requirement, He further stated 1) the terrain created a physical hardship and 2) the only logical way to divide the property ~ould require a Variance~ After fur=her d~scuss~on, Coz.~m~ssioner Crisp stated 1) he felt that the granting of this Variance would establ:13h a precedent and 2) he knew of several other land o~ners in Saratoga uith similar problems who ~ould like a Variance of this type~ Cc~mnissioner Johnson concurred with Counnlssioner Crisp and stated that he could see no reason to grant a Variance where there was a legal solution to the problem, Commissioner Johnson moveds seconded by C~-anntssioner Crisp~ that the public hearing on V-229 be closed~ motion carried unanimcusly and the Chairman declared the hearing closed at 8:57 P, M, Plannine. SDR-446 - James Martin Construction Company, Sobey Road - Building Site Approval - 1 The applicant ~as present and expressed satisfaction~lth the proposed conditions of approval, Co,~.issioner Crisp moved, seconded by Conntssioner Kellum, that the tentative map for SDR-446, (Exhibit '~", filed August 30, 1963) be approved subject to the condttons outlined in the .Building Site Coumittee Report of September 10, 1963; motion carried unanimously. IV, DESIGN REVIEW A. ~-5~ - ~arato~a Post Office, Saratoga Avenue ~ Final Design Review The Secretary advised that Mr. Green, architect, had telephoned to say that he ~ould be late and requested that discussion of this application be deferred until his arrival. On the basis of the foregoings Chairman Webster postponed discussion relagive to A-55 until later in the evening. B. A-118 - George J. Kocher, Big Basin ~ay - Final Design Review - Crafts Display and Accessories - Con~inued from AuBust 26~ 1963 The Secretary read a letter from the Sara~.oga Youth Centers signed by Dr. Warren Sturla, pertaining to the ri~ht-of-~ay needed in connection with this application. On the basis of this letter, Chairman Qebster directed A-118 continued until the mee=in~ on September 23, 1963. C. ~-119 - Thomas E. Parker, Fourth Street - Final Design Review - Office Bu!Id~n8 Con~uissioner Glenn moved, seconded by Commissioner Johnson, that final design approval be ~ranted A-119, Thomas E. Cormnissioner Glenn seconded the motion ~nich carried with Convnissioner Johnson dissenting on the basis that he felt the amendment was inconsistent with action taken to adopt. the unifarm sign. Commissioner Glenn's original motion, as~emended by Chairman ~ebs~er's motion, carried with Commissioner Johnson dissenting fo~' the reason previously stated. VII. OLD BUSINESS A. SD-439 - W. C. Cartins Prospect Road - Subdivision - 40 Lots - Request for Exception on Condition of Tentative Map Apprw al Co~muissioner Crisp read the Subdivision Committee Report pertaining to this matter. Joe Rogers and E!mer D~Angelo, engineer~ ~e~'e present to further discuss this request ~ith the Commission, Conmissioner Crisp moved, seconded by Commissioner Glenn, that the Plan- ning Commission approve the Subdivision Committee Report of September 10 1963~ with respect to 3D-439s request for exception on condition of ten- tatire map approvals and that the C~nnission recommend to the City Coun- cil that Condition 14 be revised as outlined in Paragraph 7 of the Subdi- vision Couu~lttee Report~ Roll call vote: Ayes: C~miseioners Crisps Glenns Kellum and Norton.. Noes: Commissioners Johnson and Webster, Absent: Commissioner Cowley, Mo~.ion carried. Basis for the dissenting votes was a feeling that in this particular case the objective of visual harmony would not be fully met because of the ~ype utilities in adjoining subdivisions. GENERAL PLAN CommtGsioner Kellum moved~ seconded by Commissioner Johnson, that the Secretary be directed to maintain a f~le of suggestions relative to review of the General Plan in the fall of 1964 by a Citizens Counittee; motion carried: unantmously~ Commissioner Kellum suggested that the strip of acre zoning along the north side of Allendale Avenue be studied. Chaix'man Webster directed that this suggestion be placed in the General Plan Suggestion File. VII. OLD BUSINESS B. Const. ructlo. n SiBns After a suggestion by Commissioner Cle_nn, ConmLissioner Norton moved, seconded by Commissioner Kellum, that the Secretary be instructed to draft an amendment to the ordinance to allow constz~ction signs; motion carried unanimouslyo The Secretary read a proposed amendment submitted by Commissioner Glenn. The Chairmen directed that the Secretary instigate the necessary pro- ceedings for enactment of this amendment. Co Secretary~s Report with re~ard to Violations The Secretary discussed the status of abatement of various zoning violations with the Con~aission, with particular emphasis on the inter- section at Saratoga Avenue and Saratoga Glen Place (Mandell) and the intersection at The.~na and Hammons Avenues° The Co,,i,nlssion suggested that he inspect the intersections at Fruitvale and Farwell Avenues, and ~a Paloma Avenue and Oak Placeo VIII. COMMUNICATIONS A. WRITTEN B.
