I. ~UTINE ORGANIZATION
The meeting was called to order by Chairman Webster at 7:30 P. M.
A. ROLL CALL
Present: Commissioners Crisp, Glenn, Johnson, Kellum, Norton and
Webster.
Absent: Commissioner Cowley.
Bo MINU~ES
Commissioner Johnson moved, seconded by Comissioner Kellum, that
the reading of the minutes of the meeting of September 10, 1963,
be waived and that the minutes be approve] as submitted; motion
carried unanimously.
IX. PUBLIC HEARINGS
The Chairman declared public hearings open for the evening at 7:34 P. M.
A. LT-54 - Kenp~th L. Peterson, Leonard Road - Use Permit for Horse -
Continued from September lO, 1963
The applicant was present to discuss this application further with
the Commission.
Commissioner Crisp read the Subdivision Connnittee Report relative
to this matter which stated 1) it was felt that the proposed loca-
tion of the stable was poor and contrary to the requirements for a
conditional use 2) the Commi=tee was not prepared to recommend
approval of this location and 3) they would be happy to give fur-
ther consideration to this application if a more suitable location
was proposed.
C~,,{ssioner Glenn suggested that this matter be continued until
the next reSular meeting so that the applicant could meet with the
Staff and try to work out a better location for the stable.

FAr. Paterson stated that while this seemed the mos~ logical loca-
tion, he was certainly willing to try to work out a more suitable
one.
On the basis of the foregoing, Chairman Webster directed UP-54,
Kenneth L. Paterson, continued until the meetin~ on October 14,
1963.
B. V-2~9 - Anthony R. Ciraulo, Franklin Avenue - Variance to allow
Rear Yard Setbgck of 12.5' in lieu of the required 2~'
The public hearing on V-230 was opened at 7:46 P. M. The Secretary
advised that Notices of Hearing had been mailed and there were no
written co~m~unications on file.
Mr. Ciraulo was present to discuss this application with the
elan. He presented a floor plan to show that the location of the
kitchen created the need for the family room addition to be placed
in the ~ndicated area. He stated that he had contacted his neighbors
and there were no objections to the proposed addition.
Commissioner Crisp, on behalf of the Variance Co~ttee, stared
1) they were unable to make any of the findings required by law for
the granting of a Variance and 2) there were no doubt many other
people in Saratoga who would like a similar Variance.
After further discussion, Commissioner Crisp moved, seconded by Com-
missioner Kellum, that the public hearing on V-230 be closed; motion
carried unanimously and the hearing was closed at 8:15 P. M.
C~m~issioner Johnson moved, seconded by Co~m~issioner Crisp, tha~
V-230, Anthony R. Ciraulo, be denied since the findings set forth in
Article 17.6 of Ordinance NS-3 could not be made; motion carried
unanimously.
C. V-231 - Robert H. Smith, Hill Avenue - Variance to allow Site Area
of 30~_000 square feet in lieu of re.quired ~0,000 squar~ feet
The hearing on V-231 was opened at 8:18 P. ~I. The Secretary advised
that Notices of Hearing had been umiled and there were no written
communications on file.
Mr. Smith was present to discuss this application wi~h the Comis-
sion. He explained l) this property had been purchased on the basis
of two legal building sites 2) the existing house had been located
so that a second site could be developed and 3) a tentative map on
the second site had previously been approved by the City but had
been allowed to expire.

II. C. V-231 - Robert H, Smith
14H. J, DUEELs Bonnie Brae Lanes stated 1) when he applied for a
minor Variance sometime ago~ Mro Smith protested on the basis that
the Ordinance was writte=~ for the protection of the people and
should be adhered to 2} his Variance request had been denied and
he felt there had been a Just basis for Mr. Smith;s protest 3) he
was now protesting Mro Smithss proposed Variance on the same basis
and 4) the granting of this Variance would set a precedent for
others in the area who would like similar Variances.
During the discussion that followeds the Commission observed 1) the
zoning in this area had been changed only after careful considera-
tion and in accordance with the wishes of most of the residents of
the area 2) there were no doubt many others in Saratoga who would
like similar Variances 3) it would be u~fair to grant this request
and deny o~hers in similar circumstances 4) tile request was more a
zoning matter than a Variance and 5) the findings required by law
for the granting of a Variance could not be made~
Commissioner Johnson moveds seconded by Commissioner Crisps that the
hearing on V-231 be closed; motion carried unanimously and the
Chairman closed the hearing at 8=45 P. ~.
Commissioner Johnson moved, seconded by Connnissioner Kellums that
V-231s Robert He Smith, be denied since the findings set forth in
Section 17.6 of Ordinance NS-3 could not be made= motion carried
unanimously.
Chairman Webster declared public hearings closed for the evening at
8=47 P. Mo

SUBDIVISIONS AND BUILDING SITES
A. SDR-444 - MacKay & Somps, Inc., Quite Road - Building Site Approval -
I Lot - Continued from September 10, 1963
Jim Cole of MacKay & Somps~ Inc. was present and expressed satis-
faction with the proposed conditions of approval.
Commissioner Crisp moveds seconded by Commissioner Keliums that the
tentative map for SDR-444 (Exhibit "A-l"s filed September 16, 1963)s
MacKay & Sompss Inc. s one lot on Quite Roads be approved subject to
the conditions outlined in the Building Site Committee Report of Sep-
tember 23s 1963; motion carried unanimously.

III. B. SD-445 - Floyd U. Davis, Harleigh Drive - Subdivision - 8 Lots -
.Continued from. September 10, 1963
I~n. Hunt of Hunt Engineering was present to represent the applicant
and expressed satisfaction with the proposed conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Norton, that the
tentative mop for SD-4/+5 (Exhibit "A-i" filed September 17, 1963)

Floyd W. Davis, 8 lots, Harleigh Drive, be approved subject to ths
eight (8) conditions outlined in the Subdivision Connnittee Report of
September 23, 1963; motion carried unanimously.
C. SDR-447 - ~.. L. Snow~ Lomita Avenue - Build~n; Site Avvroval - 2 Lots
Comnissioner Crisp advised that the applicant had requested that this
motter be continued until the next regular meetin~ to allow time for
consultationwith representatives of the Christian Science Church.
On the basis of the foregoing, Chairm-n Webster directed SDR-447 con-
tinued until the meeting on October 14s 1963.
D. 8DR-448 - ST. Thomas E. Farker, Fourth Street - Building Site
Approval - 1 Lot
Dr. Parker expressed satisfaction with the proposed conditions of
approval.
Comissione~Crisp moved, seconded by Connnissioner Kellum, that the
tentative map for SDR-448 (Exhibit "A', filed September 13, 1963),
Dr, Thomas E. Parker, i lot on Fourth Street, be approved subject
to the conditions outlined in the Building Bite Conunittee Report of
Sept~-nher 23, 1963~ motion carried unanimously.

1~, Kocher was present and advised that, althouEh the Youth Center
had obtained the legal info~natlon as to how they could ~rant the
right-of-way~ a meeting had not been held to authorize same. He,
therefore, requested that this motter be continued until the next
regular meeting.
On the basis of the foregoing, Chairman Webster directed A-118, George
J. Kocher, continued until the meetin~ on October 14, 1963.

IV, B, A-115 - Sacred Heart Church, Saratoga Avenue - Final Design Review -
School Addition
Commissioner Glenn, on behalf of the Design Review Committees stated
that they had found the exhibits satisfactory and suggested, with
regard to Father Gearyss letter pertaining to landscaping, that a
$1,000 performance bond be posted to guarantee that this work would
be done,
Father Ceary ~s present to discuss this application with the Commis-
sion and expressed willingness to post the suggested bond.
Commissioner Glenn moved, seconded by Commissioner Johnson, that
final design approval be granted A-115s Sacred Heart Church, for
school addition as sho%~ on Exhibit *~-1', sheets i through 13, filed
September 13, 1963, subject to the following:
1) PerformAnce Bond in the amount of $1,000 to be posted to cover
landscapings said bond to be released only after landscaping
has been completed,
2) Landscaping to be completed within one (1) year.
Father Geary protested the requirement for a ~ive (5) foot landscaped
strip along the property line,
After further discussion, Chairman Webster moved that the motion be
amended by changing Condition 2 to Condition 3 and inserting the fol-
lowing as Condition 2:
2) Landscape Plan to be submitted for approval by Design Review
Committee,
Commissioners Glenn and Johnson accepted the proposed amendment as a
part of their motion. Motion, as amended, carried unanimously.
C. A-121 - Harry D. James, Saratoga-Sunnyvale Road - Design Review -
Sign for Nursery
Commissioner Glenn moved, seconded by Commissioner Johnson, that
design approval be granted A-121, Harry D. James, for a sign con-
forming to size, color and location sho~m on Exhibits '~" and "B",
filed September 13, 1963; motion carried unanimously.
D. A-122 - Saratoga Country Club, Prospect Avenue - Preliminary Design
Review - Club House
Commissioner Glenn moved, seconded by Commissioner Johnson, that pre-
liminary design approval be granted A-122, Saratoga Country Club, for
Club House as shown on Exhibit '~", consisting of two sheets, filed
September 13, 1963; motion carried unanimously.

Comcissioner Norton, who ~epresented the Commission at the City Council
meeting on September 18, 1953s advised as follows:
1) Maxmar Investment Company application for Change of Zoning was
continued until the meetin~ on October 2s 1963, at the request
of the applicant.
2) Preposed Chester Avenue Assessment District was discussed and
referred to the Planning Committee for cousultation with the Sub-
division Co~mitteei
3) Paul Gardiner application for Change of Zoning was denied.
4) Request for elimination of underground utility requirement in
connection x.~ith Garcia Subdivision was referred to Planning Com-
mittee for a meeting with the Subdivision Committee.
5) Copies of Underground Utility Policy x~ere forwarded ~o engineers,
developers, utility companies, etc.
6) Uniform street numbering policy has been proposed by the County.
7) With reference to the Eichler Homes, Inc. appeals the Council
reversed the decision of the Planning Corm~ission.
VIe NEW BUSINESS
A. Chairman Webster extended a welcome to Councilman Drake and Good
Government Group representatives Gordon Hunter and Mrs. Donald
French.
B. Commissioner Johnson advised that the Board of Governors of the
Brookside Club had requested a meeting to discuss proposed changes
in connection with the Club. Chairman Webster suggested that they
contact the Staff and arrange a meeting with the Subdivision
Co~m~ittee.
OL~ BUSINESS
~he Secretary advised 1) the violations at the intersections of Thelma
and Hammons Avenues and Fruitvale and Farwell Avenues had been abated
and 2) prior to the meeting on October 14, 1963s the situation at the
intersection of Saratoga Avenue and Saratoga Glen Place would be
corrected,

1) SDR-366 - California Steel Buildings, Saratoga-Sunnyvale Road -

The Secretary read a letter from A. M. Carreid requesting a six
(6) month extension in connection with SDR-366.
Connissioner Crisp moved, seconded by Conuuissioner Glenn, that
the extension be granted for a period of six (6) months from
September 23, 1963; motion carried unanimously.
2) SDR-373 - George G. Moustakas, Vessing Road - Request for
~x~ension
Ihe Secretary read a letter from George G. Moustakas requesting
an extension in connection with SDR-373.
Commissioner Crisp moved, seconded by Commissioner Kellum, that
an extension be granted for a period of one (1) year from
expiration date (October 8, 1963); motion carried unanimously.
3) SDR-3?5 - Mark Thomas & Company, Bella Vista Drive - Request for
Extension
The Secretary read a letter from John H. Martin requesting an
extension in connection with SDR-375.
Commissioner Glenn moved, seconded by Corm~issioner Johnson, that
an extension ~o granted for a period of one (1) year from expira-
tion date (September 11, 1963); motion carried unanimously.
