I. ROUTINE ORGANIZATION
The meeting ~as called to vrder by Chalrman Webster at 7:40 P, M.

B, MINUTES
Commissioner Johnson moveds seconded by Commissioner Glenn~ that the
reading of the minutes of the meeting of Segtember 23, 1963, be
waived and that the minutes be approved as submitted~ motion carried
unanimously.
II. PUBLIC HEARINGS
The Chairman declared public hearings open for the evening at 7=43 P. M.
A. UP-54 - Kenneth L. Peterson~ Leonard Road - Use Permit for Horse -
Continued from September 23~ 1963
Commissioner Crisp advised that the proposed location of the stable
had been changeds hut it was his feeling that the present proposal
· ~as no better than the previous one°
Commissioner Norton stated that he felt the present location was
satisfactory since the stable would be partially shielded by the
slope of the property.
In answer to a question from the Chairmans the Secretary advised
that no.one had appeared to object to the granting of this Use
Permit aud ~hat only one iettc~ of protest had Leen received. He
further advised that the ietter was Signed by three (3) families
and did not specifically mention the location of the stable.
Cor~nissioner Norton'stated that he did not feel that the neighbors
were close enough t~ be bothered by anything other than the fact
that the stable would be partinlly visible.

II. A. UP-5____~ - ~enneth Lo Peterson
~here was no one present who wished to comment with regard to
this application.
Counuisstoner Glenn moved, seconded by Commissioner Norton, that
this matter be continued antil the next regular meeting and
referred to the Design Review Committee for further study
and a report with recommendation at that time. Roll call vote:
Ayes: Commissioners Cowley~ Glenn, Johnsons ~orton and Webster.
Noes: Commissioner Crisp. Motion carried.
Co~missioner Crisp requested that the Design Review Committee*s
recommendation cover both design and location.
Chairman Webster directed UP-54 continued until the meeting on
October 28~ 1963, and referred the matter to the Design Review
Committee for a report at that time,
V-232 - Lotrill A, Palms Canyon View Drive - Variance to allow Lot D.e. pth of 85 feet in lieu of the required 115 feet
The hearing on V-232 was opened at 8:01P, M. The Secretary aavlee~
that Notices of Hearing had been mailed and there were no ~ricten
co~munlcations on file. He then read a Staff Report pertaining to
this matter.
Guy M~rianette was present to represent the applicant. He stated
1) the square footage was more than adequate but the required
depth was not available so they were asking for a Variance to
allow them to build on a lot 1~0s x 85~ and 2) the homes proposed
for the subject lots were comparable to others in the area.
Ronald Price stated that he and Mr. Marianotre had an option to
purchase the subject property but wanted to obtain a Variance to
insure two legal lots before comple~l~x~ the trausaction.
Commissioner Johnson inquired with regard to the possibility of
requiring a site development plan on this parcel.
Commissioner Crisp stated that the City Engineer felt that a site
development plan should be obtained before making a decision.
Messrso Marianotre and Price stated their willin~ness to furnish
a site development plan.
Chairman Webster stated that he felt this property would not
remain undeveloped and that development would require a Variance
whether the property remained one (1) lot or vas divided into
two (2) lots.

IX. B. V-232 - Lotrill An Palm
After further discussion, Chairman Webster directed V-232 continued
until the meeting on October 28, 1963, to allow the applicant
sufficient time to file an application for building site approval,
together with a site development plan,
C. Ordinance NS-3o3 -.Proposed Amendment to Ordinance NS-3 relative
to Site Area Requirements and Temporary Con-
struction SiCns
The hearing on the proposed amendment to Ordinance NS-3 was
opened at 8:15 P. M. The Secretary advised that a Notice of
Hearing had been published and there were no written communications
on file. He then read the draft of the proposed amendment.
It oas the consensus of the Commission that "owners~ architects,
designers, engineers, and other similar profession~is" should be
included in Section 10o8-1 of the proposed amendment.
Commissioner Crisp raised a question with regard to signs for
Service Clubs such as Rotary, Lions, etc. A common standard was
suggested, with a limitation of one sign at each entrance to the
City.
Commissioner Oowley suggested that the proposed amendment be
studied further by the Staff~ that provision for Service Club
signs be included, and that copies of the revised draft be sub-
mitted to the Commission for review prior to the next regular
meeting. Chairman Webster, with c~ncurrence of the Commissions
so directed.
Co~m{ssioner Crisp advised that the City Attorneyes interpretation
of Section 14.6 of the Zoning Ordinance allows the City to request
only that the set-back be taken from the property line, not from
the access road right-of-way to which the owner has fee title. He
suggested that Section 14.6 be modified to require that in the
case of access roads~ whether public or private~ the set-backs
be taken from the right-of-way linen
Chairman Webster~ with concurrence of the Connnissions directed
that the Staff include this modification in the revised draft
of the amendment. He then directed the public hearing on the
proposed amendment to Ordinance NS-3 continued until the meeting
on October 28~ 1963~ and requested that the Secretary attempt to
transmit copies of the revised draft to the Commission before the
end of the week.
Chairman Xqebster declared public hearings closed for the evening
at 8:40 P. M.

Commissioner Crisp moved, seconded by C~....~.lssioner Norton, that the
Building Site Committee Report of October 14, 1963, relative to
SDR-450, Jerry Kocifs 3 lots outdo!on Koads be adopt6d and that
the tentative map be approved subject to the conditions outlined

Connnissioner Crisp advised that this condition was a specific
requirement from the Department of Public ~erks.
~r~ Hover protested t~is conditions stating 1) he had been assured
by the Staf~ that oil and screenings ~ould be sufficient and 2) the
required improvements would be greater than those now existing on
any portion of the street.

IlI. D. SDR-451 - Wade H~rer
Co=an~ssioner Crisp stated that since this requirement represented
a new policy, he would be glad to discuss the ~atter £urther wLth
the City Engineer and Director of Public Works.
After further discussion, Mr. Hover sugSested that the ten2ative
nap be approved subject to the proposed conditions since he had
the right to ~ile a request for reconsideration within thirty (30)
days if he so desired.
Commissioner Crisp moved, seconded by C~..-..~ssioner Norton, that
the Building Site C~-.~lttee Report of October 14, 1963, relative
to SDR-451, ~ade Hover, 2 lots on Peach Hill Road, be adopted and
that the tentative map (Exhibits '~-l", filed October 4, 1963)
be approved in accordance with the site development plan (Exhibit "B",
filed October 14, 1963), subject to the conditions ontlined in the
Building Site C(~nuittee Report; motion carried unanimously.
IV. DESICN REVIEW
A. A-118 -Ceorge J. Eocher, Big Basin Way - Final Design Review -
Crafts Display and Accessories - Continued from
September 23, 1963
The Secretary read a letter addressed to Mr. Kocher and signed
by A. A. Den~sey, granting him permiseien to use his property for
parking,
Mr, Kochsr explained that he hoped to obtain a right-of-~ay across
the Youth Centar property in the near future and mould like to use
Mr. DempseyeS property for parking until that time. He further
explained that Mr. Dempsey planned to develop public parking on
this property in the future.
Comnissioner Glenn observed that if a right-of-~ay could be ob-
tained across the Youth Center property, nany people could develop
parking areas on the rear of their property.
Commissioner Glenn moved, seconded by Ce..~issioner Norton, that
the Co,uuission accept the temporary parking for a period of
thirty (30) days, that the Secretary be directed to contact the
Youth Center and inquire about the possibility of a right-of-~ay,
and that A-118 be continued until the meeting on November 12, 1963.
The Secretary advised that representatives o~ the City were
meeting with the merchants next week to try to work out a
solution to the parking problem.

IV, A, A-118 - George J.. Kocher
Comissioner Cowley suggested 1) that the C~ission take no
action on the ma~ter at this tim 2) that A-118 be continued
for a period of thirty (3:3) days to allowMr. Kocher adequate
time to submit a perking plan that will comply with the Ordi-
nance or submit evidence that he has a satisfactory solution to
the problem.
Chairman Webster recognized Mr. Kocherss contribution to the com-
munity and expressed regret that there was nothin~ more that
could be done.
Comm~esioners Glenn and Norton withdrew their motion and second
in favor of Ce~issioner Cowley*s suEEestion.
Chairman Webster directed A-f18 continued until the meeting on
November 12, 1963, to allow the applicant sufficient time to
make arrangements for satisfactory parking.

VI, NEW BUSINESS
A. Mrs, Iris Stiles~ Komina Aven~e - Request for Exception from
. Requirements set forth in

Mr. and Mrsl Stiles ~ere present to discuss this matter with
the Ce~ssion. Mr. Stiles explained 1) their lot contains
25,000 square feet and is located in the R-I-IO,O00 Zoning
District 2) they would like to divide the property into two (2)
lots since there is a nice building site on the rear of the lot

3) Ordinance RS-5 requires that the rear lot b~ve a 20 foot access
road and there i~ only 17 feet bet~en the e::isting house and
the property line 4) they ~ould like the City to make an excep-
tion and allow them to use a 15 foot access road,
Dr, Rosasco ~as pre~ent and advised that their deed restrictions
required that each lot contain a minimum of 14,000 square feet,
Mr, Stiles stated that he ~as not. a~are of this,
grs, Ruth 0~en observed that every meeting seemed to bring another
request for an increase in density, and expressed concern since
Saratoga Is a low density area served by one high school,
Dro Rosasco stated 1)' he felt the division of this property would
do~n~rade the area 2) it is presently a very nice area and he
would not like to see it changed,.
Mrs, .Stiles stated that the rear of their property ~ould make a
beautiful building site and she felt the entire area would benefit
from it,
~r, Brubaker expressed appreciation of the Stiles~ contribution to
the neighberhood~ bu~ stated th~ he~ too~ ~e~ that the division
of their property ~ould do~n~rade the area,

seconded by C~.~,,lssioner Covley,.that the request be denied since
the req~iremants of Section 5,2 of Ordin~nce ~-5 could not be
mat; motion carried unanimously,

V. CITY COUNCIL.REPORT
Chairman Webster gave a brief report on agenda items from the City
Council n_-sting of October 2s 1963~ vith particular emphasis on the

2) The Council appro~ed the streamlined facilities recommended by the
Co~ission with re~ard to the Carcia Subdivision on Prospect Avenue.
3) Mr. Mittelman of Roeu Hall Corporation requested that the City
pay the difference between the actual cost at this time and the
original estimated cost for insr. alling storm sewers and accel-
eration-decelera~ion lanes for the Dee~park Subdivision inasmuch
as the widening of High..~y 9 hao delayed the installation. This
matter %ms referred ~o the Public Welfare Co-eni~tee of the City
Council.
~) The City Attorney recounended that action be taken to repeat the
emergency ordinances se~tin~ aside certain p=rcels of land for
future park use.
5) George Ratryes claim (filed against the City for storm damage)
· ms rejected.
6) Clarence Toy requested a modification of conditions imposed in
connection ~..th SDR-435 to allow him to delay improvement of
St. Charles Street. This reques~ was referred to the Planning
Counittee of the City Council,
7) Paul Gardinerts request for Change of Zoning on Allendale Avenue

VII. OLD BUSZNESS
A. Co~lssioner Johnson co.!!!!euded the Secretary for his progress in
abating the violation at the intersection of Saratoga Avenue
and Saratoga Glen Place, The Secretary advised that the abate-
ment would be completed in the very near future.
Commissioner Cowlay observed that the violation at the inter-
section of Thelms and Hannnons Avenues had also been abated.
Be The Secretary read a communication from the City Administrator
advising that the City Council had requested that the Planning
Connnission deny requests for exceptio, in the case of under-
ground utilities unless there was proof of extreme hardship.

The Secretary read a letter from Wmo D. Vance requesthag an
extension of one (1) year in connection with SDR-379.
