I, ROUTINE ORGANIZATION
The meeting was called to order at 7:30 P, M. by Chairman Norton.
A. ROLL CALL
Present: Commissioners Cowleys Crisps Glenn~ Kellum and Norton
Absent: None.
Bo MINUTES
Con~nissioner Crisp moved, seconded by Conmaissioner Cowley~ that the
reading of the minutes of January 13~ 1964 be waived and that the
minutes be approved as submitted; motion carried unanimously.
Chairman Norton stated that no changes would be made in the various com-
mittees at the present time since the Council had not yet appointed the
two new Commissioners, He designated Con2nissioner Kellum Acting Chair-
man of the Variance Committee until permau~n~ appointments were made,
The Chairman stated that he was aware that a number of people in the
audience had artended because of an interest in UP-60s application of
Mrs. Clara Andersens Pierce Road= for a Use Permit for a maximum of
three lodgers or boarders, For the convenience of the interested parties
he then explained that there would be no discussion in connection with
this application since it had been withdrawn prior to the meeting. At
the request of the Chairman~ the Secretary read the letter of withdrawal.
ADRIEN Lo ANDERSON, Craiaen Circles questioned abatement of the existing
violation since Mrs. Andersen had one boarder at this time. Chairman
Norton advised that the City ~ms aware of the violation and it would be
dealt with through regular channels, A show of hands among ~he inter-
ested parties indicated that those present had artended to oppose the
application, in support of the petitions filed in protest.
IIo PUBLIC HEARINGS
A, C-62 - Warren D, Porter, Jr, Fifth Street - Change of Zoning from
'~-M-3s000" (Multiple Residential) tO "C-C" (Community
Commercial) - Continued from Jannat7 13~ 1964
The Secretary briefly reviewed this application then read a Staff
Report pertaining to same.

Fw, Porter was present and expressed willingness to have the use of
the property restricted to the uses listed in the Staff Report.
There ~s no one else present who wished to comment w~th regard to
this matter,
Commissioner Crisp, on behalf of.:the Subdivision Co,~lttees explained
1) the BubJect property is located in back of the Saratoga Carpet
Shop 2) approximately one-third of the lot lies within the
Zonin8 District 3) the Committee felt that it would be undesirable
to open this property to certain uses permitted in the 'C-C" Zone
4) through discussions with the applicant the Committee had arrived
at the list included in the Staff Report and 5) it was the recom-
mendation of the Committee that the Commission recommend "Conditional
C-C' zoninG for the subject propertys restricting use of the property
to those uses listed in the Staff Report.
Commissioner Crisp moved, seconded by Commissioner Cowley, that the
hearing on C-62 be closed. Motion carried unanimously and the hear-
ing was closed at 7|44 P. M.
Comissioner Crisp moveds seconded by Commissioner Cowleym that the
Staff Report of January 27~ 1964 relative to C-62 be adopted and
transmitted to the City Council as the recommendation of the Com-
mission; motion carried unanimously.
Commissioner Kellum explained to those present that conditional
zoninG was usually restricted to one use but that in this instance~
the Couphis,ion felt that any of the uses on the list would be
appropriate for the subject property.
B. UP-59 - St. Andrews Episcopal Church, Saratoga Avenue - Use Permit
for Portable Classroom for Educational Use
The public hearing on UP-59 was opened at 7=48 P. No The Secretary
advised that Notices of Rearing had been mailed and there were no
s~citten communications on file, He then read a Staff Report per-
taining to this matters
There was no one present to represent the Church, but the Secretary
advised that representatives had planned to attend and would no
doubt be present later in the evening,
There was no one in the audience who wished to comment with regard
to this application,

II. B. UP-59 - Sto Andtaws Episcopal Church
Commissioner Cowlay moveds seconded by Commissioner Kellums that the
public hearinS on UP-S9 be closed. Motion carried unanimously and
the hearing ~as closed at 7153 P. M.
After further discussions Commissioner Cowlay requested that the
Desian Review application filed by the Church be considered together
with the Use Permit application, Commissioner Kellum concurred
that it would be desirable to d~ecuss the two applications simul-
taneously but augSeated that further discussion be deferred until
the Church representatives arrived.
Commissioner Cowlay moved, seconded by Commissioner Kellums that the
hearinS on UP-59 be re-opened. Motion carried unanimously and the
hearinG was re-opened at 7:57 P. M.
Chairman Nortons with concurrence of the Commission, directed UP-59
continued until later in the evening.
C. U~-60 - Mrs. Clara Andersens Pierce Road - Use Permit for Maximum of
three Lod8ers or Boarders

D. V-238 - Helen K. Rayburns Big Basin Way - Variance to allow uncovered
ParkinG Spaces for Residence in lieu of Carport or Garage
and to allow Parking Spaces for both Residence and Antique
Shop to be nine feet in width in lieu of the required ten
feet.
The public hearing on V-238 was opened at 7:58 P. M. The Secretary
advised that Notices of Hearing had been mailed and there ~ere no
~rftten communications on file. He then reviewed this application
and read a Staff Report pertainins to same,
Dwight Gaswell was present to represent the applicant and stated
1) the existins buildin~s ~ould be removed from the property and
new buildings constructed 2) to provide better traffic circulations
the applicant had made arrangements to use the exit on the adjacent
property and 3) because of the shape of the propertys it was felt
that the apartment should be located on the back of the property,
tearing the second story of the building in fr~= for ceunercial use.
SAM HERNANDEZs Bls Basin Way, stated that h9 was opposed to the
granting of the subject Variance sinde he felt that the site was too
small for the proposed development.

II., D, V~238 - Helen Ks Rayburn
C~ARBNCE NBALEs Saratoga-Sunnyvale Road, stated that new buildings
were needed on Big Basin Way and he felt the parking problem would
be worked out in time. Therefore~ he was in favor of granting this
Variance.
Commissioner Crisp moved} seconded by Conunissioner Kellums that the
public hearing on V-238 be closed. Motion carried unanimously and
the hearing was closed at 8:08 P. M.
After £urther discussions Cer~nissioner Crisp suggested that the
hearing on V-238 be re-opened and that this matter be referred to
the Variance Co~:nittee for study and a report at the next regular
meeting,
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
hearing on V-238 be re-opened, Motion carried unanimously and the
hearing was re-opened at 8:10 P. M.
Chairman Norton~ with concurrence of the Commission~ directed V-238
continued until the meeting on February lOs 1964s and referred this
application to the Variance Committee for study and a report at that
time,
E, V-239 - Clarence Neales Saratoga-Sunnyvale Road - Variance to allow
Accessory Structure in required rear yard to be 20 feet in
helBh~ in lieu of the permitted 14 feet
The public hearing on V-239 ~s opened at 8:ll P, M~ The Secretary
advised that Notices of Hearing had been mailed and there were no
~ritten communications on file.
The applicant was present and read a letter l) setting forth his
reasons for requesting a Variance and 2) discussing compliance with
Section 17.6 of Ordinance NS-3.
DONALD STAMPER~ Marion Avenue~ opposed the granting of the Variance
en the basis that the building might be used in connection ~ith the
applicant~s business.
There was no one else present who wished to comment with regard to
this n~tter.
Chairman ~orton, with concurrence of the Cormuission, direoted
continued until the meeting on February 10,
to the Variance Committee for study and a report at that time.

A. ..SD- 465 - Co L. Long,on, Canyon View Drive - Subd~visiou Approval -
26 Lots - Continued from January 13s 1964
Commissioner Crisp advised that although the site development plans
had been submitted, they had not been approved by the City Engineer.
He suggested, therefore, that this mat=or be continued until the
next regular meeting.
On the basis of the foregoing, Chairman Norton directed SD-465 con-
tinued until the meeting on February lO, 1964,
B. SDR-467 - Joyce Hendry, Canyon View Drive - Building Site Approval -
3 hers
The applicant ~as present and requested that discussion of this
application be deferred until later in the meetin~ to allow time
for a generaE review of the proposed conditions of approval.
The request was granted and Chairman Norton directed discussion of
SDR-467 continued until later in the evening.

Review - Addition to Pet Clinic - Continued from January 13,

Ctnmassioner Cowlay advised that the applicant had submitted further
exhibits but they had not been received in time for the C~---.Ittee to
review them prior to the meeting~ He suggested, therefore, that this
applica=~-on be continued until the next regular meeting°

Review - PorTable Classroom for Educational Use
Mro Emerson ms present to repv.,esent the Church and stated 1) the
subject portable classroom was the same as the one previously
approved except for the addition of restrooms 2) these classrooms
were designed Ta be portable but would be used until another wing
~s built cute the exlstiu~ permanent building and 3) the additional
wing could not be built for four to eight years, possibly even longer
since the loan on the church build~u~ would have to be paid first.

COmmissioner Cowley stated that the Design Review Co,--~lttee had no
objections to the architectural conception of the claseroomo Rowever,
he raised a question as to whether use of the word "portable' ~as
n~sleading .since it indicated a more temporary use of the classroom.
After further discussion, Chairman Norton~ with concurrence of the
C~.-;-lssion, directed that the word 'portable" be omitted.
In response to a request from Connnissioner Cowley, ~r. Emerson
advised that a copy of the Church*s Conera1 Plan would be filed
with the Cc~nissiono
Comissioue~ Glenn moved, seconded by C~.~..;tssioner Kellum, that the
hearing on UP-59 be closed; motion carried, Com~ssioner Crisp
abstained,
Connnissioner Glenn moved, seconded by Connnissioner Kellom, that
UP-59, St, Andrews Episcopal Church, be granted subject to Design
Review; motion carried,
Connnissioner Cowley moved, seconded by Commissioner Kellum, that
A-133, St, Androws Episcopal Church, be ~ranted final design review
for classroom as shown on Exhibit '~"; motion carried unanimously.
IV, C, A-134 - Carl L, Dozier,-Saratoga Avenue - Preliminary Design Review -
Restatwant and Office ~uildinSs
Robert Ton, desi~ner, ~s present to discuss this application with
the Con~ission, He advised that the proposed restaurant included
1) banquet room, 1400 nquare feet, seating capacity 100 2) dinin~
room, 1225 square feet, seatin~ capacity 50 3) bar, 535 square
feet 4) office, ~00 square feet 5) kitchen, 950 square feet
6) miscellaneous storage, 745 square feet and 7) basement storage,
1000 square feet.
The Counission a~reed that this ms within the original concept of
the restaurant,
A question wns raised as to whether the Connnission could exclude the
westerly parcel from the subject application. Consensus ~as that
the matter should be continued until the Plannin~ Director could
confer with the City Attorney,

IV. C, A-134 - Carl L, Dozier
A further question k~s raised as to whether the restartrants in its
proposed locatton~ would encroach upon the Flood Control easement.
The Con~nission suggested that Mr. Ton check with Flood Control
District representatives as soon as possible.
Chairman Norton, on the basis of the foregoin~s directed A-134
continued until the meeting on February 10, 1964.
The Cotmission then 1) informed Mr. Ton that they had no objections
to the proposed architecture and 2) requested that the Planning
Director keep l~r. Ton advised of forther developments in connection
with this matter.
SDR-467 - Joyce Nendry~ Canyon View Drive - Building Site Approval -
3 Lots - Cqntinued from. earlier in The Meetin~
After reviewin~ the proposed conditions of approval~ the applicant
requested that this application be continued until the next regular
meeting to allow time £or a £orther meeting with the Building Site
This request ~as granted and Chairman ~o~ton directed 5DR-467 con-
tinued until the meetinll on February 10~ 196~o
V, CITY COUNCIL REPORT
The Secretary reed a report from former Comm~es~oner ~ebster pertaining
to action taken by the City Cauncil at the meeting on January 15, 1964.
Chairman Norton expressed the Commissionss appreciation for Mrs ~ebster~s
attendance and the report.
VI. NEI4 BUSINESS
A. Proposed Ordinanc~ NS-3°5
The Secre~mPy read proposed Ordinance NS-3.5 relative to changinn
conditions of conditional reclassificatioao
The Chairmen explained the need for the proposed amendment and
advised that it would be on the agenda for public hearing at the
meetin~ on February 10~ 196~.
B, Chester Avenue Assessment District
The Secretary road a communication from the City Administrator ad-
visinE that the City Council had referred the matter of the Chester
Avenue Assessment District to the Planning Commission with a request
that the Conmission review the proposed plan to determine how'it
would fit into the overall development of the area.

Fruitvale Avenue Plan Liu~
~he Secretary advised that the City Council had referred the pro-
posed Fruitvale Avenue Plan Line to the Planning Cormlesion for their
approval,
Chairman Norton referred this matter to the General Plan Committee for
review and a report at the meeting on February 10m 1964,
D, Strqet Li~htin~ at ~ajo~ Intersections
· he Secretary advised that the City Council had requested that the
Planning Commission n~ke a study relative to street lighting at
~aJor intersections ~_th particular emphasis on aesthetics,
Chairman Rotton referred this matter to the General Plan Cow~ttee
~er study and a report at their ea~'liest convenience,
E, l~le Chairman acknowledged the presence of ~mo C, Henley, City Admin-
istrato~, and Gordon Huuter~ Good Government G~oup represontative,
and expressed the Comm~sSion~s appreciation for their attendance,

~he Commission ~ae advised that work on the Retirement Development Pro-
gram w~s progressing and that a report would he submitted soon,
Chairman Norton requested that the S~aff transmit a copy of the prelim-

The Secretary read a letter reques~ing an extension of one year

1964, and that consideration be given to further extension at
that time; motion carried unanimously,

VIII, A, 2, Storat~e of Junk Cars
The Secretary read a latter £rom Dominic S, Nicoletta relative
to the parking of junk cars in residential areas of the City.
After discussion, Chairman Norton requested that the Planning
Director investigate the scope of this problem and submit a
report to the Comission at the mating on February 10, 1964.
Chairman Norton advised that a preliminary mp had been submitted
in connection mith a proposed subdivision north d Cox Avenue ~/aich
~ould be one of the largest subdivisions in Saratoga, He requested
that the Commissioners see the map at the office and observe the
general area,
