The meeting was called to order at 7:30 P. M, by Chairman Norton.

The Secretary briefly reviewed this application and reed a connunication
from Kenneth I. ~L~rts supporting' this request.
The applicant' was not present and there was no one in the audience who
wished to comment with regard to: this matter.
The Commissioners advised that they had visited the site as requested by
the Chairman.

Commissioner Kellum advised that. the Variance Co~mittee had been unable to
m~ke the findings required by law for the granting of a Variance. It was
the recommendation of the Committee, therefore, that this Variance be
denied.
Commissioner Glenn moved, seconded by Commissioner Crisp, that the public
hearing on V-237 be closed. Motion carried unanimously and the hearing
was closed at 7:40 P. M.
Commissioner Crisp moved, seconded by Commissioner Glenn, that V-237, Wm.
L. Cooley, be denied since the findings required under Section 17.6 of
Ordinance NS-3 could not be made; motion carried unanimously.
B. V-238 - Helen K. Rayburn~ Big Basin Way - Variance to allow Uncovered
Parking Spaces for Residence in lieu of Carport or Garage and to
allow Parking Spaces for both Residence and Antique Shop to be
nine feet in width in lieu of the required ten feet - Continued

Dwight Caswell was present to represent the applicant and advised that
the need for the Variance was created by the peculiar shape of the
property.
Sam Hernandez, Big Basin Way, opposed the granting of the subject Variance.
Commissioner Glenn stated that he felt the applicant was trying to crowd
too much onto this lot, He observed that decreasing the number of
buildings or the space within the buildings would eliminate the need for
the Variance. ~
C_omm~ssioner Crisp concurred with Commissioner Glenn.'
CommissionerKellumadvised that the Variance Committee had revie~ed this
matter very carefully and was unable to make the findings necessary for
the granting of the Variance. The Committee recommended, therefore,. that
this application be denied.
Commissioner Glenn moved, seconded by Commissioner Kellum, that the public
hearing on V-238 be closed. Motion carried unanimously and the hearing
was closed at 7:51P. M.
Commissioner Crisp moved that V=238, Helen K. Kayburn, be denied since the
findings required by law for the' granting of a Variance could not be made.
Commissioner Kellum seconded the motion which carried unanimously.

sory Structure in required rear yard to be 20 feet in height in
lieu of the vermitted 14 feet - Continued from January 27~ .1964. ...
The applicant was present but stated that he had no further comment with
regard to this request unless there were questions to be answered.
There was no one in the audience'who wished to speak with reference to
this matter.
Commissioner Kellum advised that.the Variance Committee had visited the
site and had carefully studied the plan, but had been unable to make the
findings required by Section 17.6 of Ordinance NS-3. 'He stated that it
was the Connn!ttee's reconmendatiOn, therefore, that this application be
denied..
Commissioner Cowley moved,-seconded by Connnissioner Crisp, that the public
hearing on V-239 be closed. ~otion carried unanimously and the hearin~
was closed at 7:58 P. M.
Commissioner Glenn moved, seconded by Commissioner Kellum, that V-239,
Clarence Neale, be denied on the basis that the findings required for the
granting of a Variance could not be made. ~otion carried unanimously.
D. C~65.- MacKay & Somps~ Xnc., Cox Avenue - Change of Zoning from 'Agricul-
The hearing on C-65 ~as opened at 7:59 P. M. The Secretary advised that
a Notice of Hearing had been published and there was one ~rit~en communi-
cation on file.
Jim Cole, representing the applicant, requested that this matter be defer-
red until later in the evening since his client had not arrived.
This request was granted and Chairman Norton directed C-65 continued until
later in the evening.
E. UP-61 - Town and Country Realty Company, Saravia~Drive - Use Permit for
Temporary Sal~ Office for Sarahills Subdivision
The public hearing onUP-61 was opened at 8:01P. ~. The Secretary advised
that Notices of Hearing had been mailed and there were no written conauuni-
cations on file, He then read a Staff Report pertaining to this matter.
Ty Papalias was present to represent the applicant and explained that
instead of using a model home sales office, they would like to build
small office on one of the lots in the subdivision.

After discussion, Mr. Papalias was informed that Design Review would be
required in connection with the ~]subject sales office. .He expressed will-
ingness to comply with this requirement.

application,
Commissioner Glenn moved, seconded by Commissioner Crisp, that the public
hearing on UP-61 be closed, Motion carried unanimously and the hear'ing
was closed at 8:05 P, M,
Commissioner Crisp moved that IIP~61~ .Town and Coun=ry Realty Company, be
granted subject to Design Review .of the proposed sales office and any
Signs to be used in connection with sames and that a time limit of one (1)
year be placed on this Use Permit. Commissioner Cowley seconded the
motion which carried unanimously.,
Fo Ordinance NS-3.5 - Proposed Amendment to Ordinance NS-3 relating to
.Cha. n~i_n~ Conditions. of Co.nditional Reclassification
The public hearing on Ordinance NS-3.5 was opened at 8:07 P. M, The
Secretary advised Chat a Notice of Hearing had been published and there
were no written communications on file. He then read the proposed ordi-
nance~ relating to changing cond'itions of conditional reclassification.
There was no one in the audience' who wished to comment with regard to this
matter.
After discussion, Commissioner Crisp moved, seconded by Commissioner Glenn,
that the public hearing on Ordinance NS-3.5 be closed. Motion carried
unanimously and the hearing was closed at 8:11 P. M,
Commissioner Crisp moved, second'ed by Con~n~ssioner Kellum,' that the Plan-'
ning Commission recommend to the' City Council that Ordinance NS-3.5 be
adopted; motion carried unanimously.
D. C-65 - MacKay & Somps, Inc., Cox: Avenue - Change of Zoning from "A~ricul-
tufa1" and '~-1-12,500" to '~-1-10,000" - Continued from earlie~

The Secretary read a co~unicati0n from Betty Jane and A. L. Irwin opposing
the proposed change of zoning,'
Mr. Cole explained 1) the subject property is located on the north side
of Cox Avenue between the railroad tract and the proposed West Valley
Freeway 2) it is a difficult parcel to subdivide 3) the applicant felt
that the railroad tract and the proposed freeway would make natural
barriers for this zoning.

M, J. Lee, Woodmont Drive, opposed the proposed change of zoning. He
stated that he would like to see:the city maintain the low density indi-
cated by the General Plan and the granting of this change of zoning would
set a precedent that would make similar applications hard to deny,
John Ostrowski, Ione Court, concurred with Mr. Lee and observed that the
developer would gain approximately 20% density if this change of zoning
was approved.
George Towne, Jr., Wolcott Ways Stated that he had moved to Saratoga
because of its objectives with regard to density, zoning, etc. and would
not like to see it changed. He, therefore, opposed the proposed change
of zoning.
James Lovely, Ione Court~ opposed the proposed change of zoning because
of the increase in density.
Richard Brian, Glenb~ae Drive, spoke in opposition to the proposed chan~e
of zoning because of the increased density. He further stated that he
might feel differently if the builder had bought the property prior to
plans for .the freeway.
B. T. Galeb, Seagull Way, stated 1) he did not feel that large lots
would be an asset in the subject.area 2) he felt that smaller lots would
provide the best use of the land.so 3) he was in favor of the proposed
change of zoning,
A show of hands indicated that 16 of the interested parties present
opposed the proposed change of zoning and two (2) favored the proposed
change.
Jim Cole explained that a flexible lot size was needed in connection with
this particular area to enable .them to work out the street pattern but
that they had no desire to change the density, In answer to a question
from the Chairman,.Mro Cole stated that if a '~D" District would accom-
plish their purpose, this would be fine. He explained that they would
like to make the lots along the freeway and the railroad deeper.than the
others.
A representative of the developer stated that because of a 70 foot PG&E
easement, the railroad and the proposed freeway, a p=oblem had been created
in connection with development of the subject parcel. He further stated
that, actually, their application was a request for nothing more than
a '~D" Zone.

Commissioner Crisp explained that while the Subdivision Committee did no=
normally make a report on zoning'matters, a study had been made in
nection with the subject application because of the pending subdivision°
He stated that the Committee wasl. not in favor of rezoning this property
to 10;000 square foot lots.
Jim Cole advised that perhaps the '~D" zoning would accomplish their pur-
pose as well as the requested '~-1~10,000" zoning, so requested that this
matter be continued to allow adequate time to change the application,
On the basis of the foregoing, Chairman Norton directed C-65, NacKay &
8omps, Inc., continued until the next regular meeting and referred same
to the Subdivision Committee for study as to ~hether this property was
suitable for '~D" zoning.
The Chairman declared public hearings closed for the evening at 8:40 P.
FIVE NI~JTE RECESS
Chairman Norton acknowledged, with pleasure, the presence of Mr. Gordon Hunter of
the Good Government Group and observed that Mr. Louis Wine, another member of this
group~ had been present earlier in the evening.

A, SD-465 - C. L. Longson, Canyon View Drive - Subdivision Approval - 26 Lots.-

Willard Thompson was present to represent the applicant and expressed
satisfaction with the proposed conditions of approval,
Commissioner Crisp moved, seconded by Commissioner Kellum, that the Sub-
division Committee Report of February 10, 1964~ relative to SD-465s be
adopted and that the tentative map (Exhibit '~", filed January 3, 1964)
be approved in accordance with the site development plan (Exhibit '~-1",
filed February 10, 196Z~) subjectz to the 16 conditions detailed in the
Subdivision Committee Report; motion carried unanimously,
B. SDR.-467 - Joyce Hendrys Canyon View Drive - Building Site Approval - 2 Lots -

Commissioner Crisp advised that the applicant had mat with the Building
Site Co~ittee to discuss the.street and utilities. He further advised,
however, that the Committee still was not prepared to make a recommenda-
tion with regard to the utilities~ so suggested that this matter be con-
tinued until the next regular meeting to allow time for further study of
this situation,

III. B. SDR-467 - Joyc~ Hend;t
Mr. Hendry was present and expressed willingness' to have the matter con-
tinued further.
On the basis of the foregoing, Chairman Norton directed SDRo467s Joyce
Hendry, continued until the meeting on February 24, 1964.
C. SDR-46_____~8 - Ca~ L. Dozier, Saratoga. Avenue - Building S~e Approval - I Lot
Mr. Dozier and Mr. Ton were present to discuss the proposed conditions of
approval with the Commission.
Chairman Norton advised that the City Attorney had ruled that the westerly
100 feet of the old Saratoga Inn.property (not under ownership to the
applicant but included in the change of zoning covering the applicant~s
property) could only be used for.parking until a further change of zoning
was granted. He explained, however, that this did not affect the existing
building located on this property.
Commissioner Crisp explained that. building site approval would not include
approval of the apartment shown on the plan nor the location of the
building. He further explained that these items would be discussed under
Design Review.
Commissioner Crisp moved, seconded by Commissioner Xellum, that the
Building Site Committee Report of February 10, 1964 relative to SDR-468,
Carl L. Doziers be adopted and that the tentative map (Exhibit '~", filed
January 30, 1964) be approved subject to the conditions detailed in the
Building Site Committee Report; motion carried unanimously.
D. SDR-469 - Rose Robertson, Piedmont Road - Building S%t.~ ApPrOve! - 1 Lot
Commissioner Crisp advised that a revised site development plan would be
required in cormection with this application and that septic tank
clearance had not yet been received from the Health Department. It was
the recommendation of the Building Site Committee, therefore, that this
meter be continued until the next regular meeting.
On the basis of this recomendation, Chairman Norton directed SDR-469
continued until the meeting on February 24, 1964.
IV. DESIGN REVIEW

Commissioner Cowley advised that' it was the recoEmendation of the Design
Review Committee that this application be approved on the basis of the
exhibits submitted.

Commissioner Cowley moved, seconded by Commissioner Glenn, that final

Commissioner Cowley advised that:. the Design Reviex¢ Committee could find
no justification for approving the apartment shown on the exhibits.
After discussion, Chairman Norton explained that the applicant would have
to apply for the apartment to be added to the conditional zoning since
it was not originally included.
Commissioner Cowley moved, seconded by Commissioner Glenn, that preliminary

C. A-13.1 - Cupertino Union School District, Titus Avenue - Final Design
Review - Laurel Hansen School
The Secretary advised that Mr. LSfgren had requested that this matter be
continued since their landscape plan was not ready.
Commissioner Cowicy recommended that this request be granted.
On the basis of the foregoing~ Chairman Norton directed A-131 continued
until the meeting on February 24, 1964.

Co~m{ssioner Cowley moved, seconded by Commissioner Glenn, that A, 135,
Clarence Toy, be granted preliminary design approval instead Of ·final
design approval as requested unt:il the Design Review Committee had an
opportunity to review the plans more carefully~ motion carried unanimously.
Commissioner Crisp .gave a brief report on the City Council meeting of Feb-
ruary 5, 1964, with particular emphasis on City Council approval of an assess-
ment district for the improvement of portions of Saratoga and Cox Avenues and
appointment of the two new Planning 'Commissioners.

VI. NEW BUSINESS
A. Church Off-Street Pa.rki..ng
~he Secretary read a letter from'Mayor Glennon relative to church parking.
Chairman Norton referred this matter to the Subdivision Committee for
study and a report as promptly as possible.
B. Subdivision Fen~.e.s
The Secretary advised that a question had been raised at the last City
Council meeting as to whether the solid board subdivision fences along
major streets were advisable or whether a more open design should be
considered.
Commissioner Crisp advised that the Planning Committee of the Council had
requGsted that consideration be given to a more open type fence since the
solid board fentess from an aesthetic point of view, deteriorated rapidly.
He further advised that it was felt that perhaps the residents would help
maintain the right-of-way if a more open design was used.
After discussion, Chairman Norton referred this matter to the Design
Review Committee for study and a. recommendation as soon as convenient.

A. SDR-402 - Alex Swanson, Saratoga Hills Road - Request for Extension -
Continued from January 27., 196~ .
Commissioner Crisp moved, seconded by Commissioner Glenn, that a total
extension of one year from the original expiration date be granted in con-
nection with SDR-402, Alex Swanson; motion carried unanimously.

Commissioner Glenn reviewed the request from the City Councils then read
a report from the General Plan Committee pertaining to this matter.
After discussion, Commissioner Glenn moved, seconded by Commissioner Crisps
that the report of the General Plan Committee dated February 3, 1964s
relative to the Chester Avenue ASsessment District, be adopted and trans~
mitted to the City Council as the recommendation of the Commission; motion
carried unanimously.

VII, C, Fruitvale Avenue Plan Line - Referred by City Council - Continued from

Commissioner Glenn advised that '~he General Plan Committee had met with
the Director of Public Works to review the proposed precise plan line for
[ruitvale Avenue from Gardner Lane to Saratoga-Los Gatos Roads and it was
the recommendation of the Committee that this plan line be approved.
After discussions Commissioner Gienn moved~ seconded by Commissioner Crisp,
that the proposed precise plan line for Fruitvale Avenue from Gardner Lane
to Saratoga-Los Gatos Road be approved as sho~n on the Plan Line Eaps and
that the Secretary be directed to advise the City Council of this actionJ
motion carried unanimously.

Commissioner Glenn advised that he had discussed this matter with Playor
Glennon and he had suggested that it be placed on the agenda for the
General Plan Review.

The Secretary requested that this matter be continued until the next regu-
lar meeting since he had been unable to complete his investigation.

Commissioner Crisp suggested tha~ this ordinance be set for public hearing
on March 9~ 1964, and requested that each Commissioner study the proposed ..

Corm~!ssioner Glenn tooreds seconded by Commissioner Crisp, that the Commis~
sion tentatively approve the draft of the proposed ordinance and direct
that the Secretary set same for public bearing on March 9s 1964~ motion
carried unanimously.

The Secretary displayed colored maps showing a subdivision that conformed
to the suggested desian ~tandards and one that did not.

Commissioner Cowley requested that each of the Commissioners rev. iew the
maps and submit their comments to the Design Review Conunittee~

H. Ordinance NS-5 -.proposed Amendment to Part Thre~
After discussion, Commissioner Crisp moved, seconded by Commissioner
Kellum, that the Planning Commission approve the proposed amendment. to
Ordinance NS-5 (relative to minimum access road .reimbursement).as submit-
ted and transmit same to the City Council for enactment; mot'ion'carried
unanimously.
