M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Glenn, Kellum, McFall and O'Rorke. Absent:. Commissioner Norton. (Commissioner Norton arrived at approxi- mately 7:35 Po Mo) Bo MINUTES Commissioner Glenn moved, seconded by Commissioner Cowley, that the reading of the minutes of February 10, 1964 be waived and that the minutes be approved as submitted; motion carried unanimously. II~ PUBLIC HEARINGS The Chairman declared public hearings open for the evening at F:34 Po M. A. .~-65 - MacKay & Somps, Inc., Cox Avenue - Change of Zoning from "Agricul- tural" and '~-1-12,500" to '~-1-12,500 P-D" - Continued from February 10, 1964 Commissioner Crisp advised 1) the subject application had been revised so it would be necessary to publish a revised notice setting the public hearing for the next regular meeting (March 9, 1964) 2) a tentative map showing the proposed subdivision had not been submitted and 3) for these reasons, no action could be taken!on C-65 at .this time. Commissioner Norton arrived at approximately F:35 P. M. and, at the request of Vice Chairman Kellum, assumed the Chair. B. T. Galeb, Seagull Way, stated that at the time the General Plan was adopted (1960), the Planning Consultant (Lawrence Livingston) had referred to the property between the proposed freeway and the railroad as a problem area and had indicated that special consideration should be given in con- nection with the development of same. He stated that he, personally, felt that large lots in this area would be a detriment rather than an asset. He also indicated that he felt that by allowing smaller lots it would be possible to develop a park in the area that would actually cost very little but would benefit all of Saratoga. UP-6__2 - Blossom View Homes, Covina Cou~t - Use Permit for Model Home Sales Office for Blossom View Su.~division The hearing on UP-62 was opened at 7:4,8 P. M. The Secretary advised that the property owners within a 500 foot radius of the subject property had been notified and there were no written communications on file. He then read a Staff Report pertaining to this application. Morris J. Lee was present to represent the applicant. There was no one in the audience:who wished to comment with regard to this matter. Commissioner Crisp moved, seconded by Commissioner Cowley, that the public hearing on UPo62 be closed. Motion carried u~nimously a~d the hearing was closed at 7:50 P. M. Commissioner Crisp moved that UPs62, Blossom Vie~Homes, application for a Use Permit for Model Home Sales Office, be gra~ted for a period of one (1) year. Commissioner Cowley seconded the motion which carried unanimously. C. V-24__0 - Jack Carlsen, Lutheria Way - Variance to eliminate temporarily the requirement for two off-street parking spaces, located in a garage or cavort. f~r the resid~e located at 14330 Lutheria Wa~ The hearing on V..240 was opened a't 7:51P, M. The Secretary advised that Notices of Hearing had been mailed and there was one written communication on file. He then read the communication which had been filed by Dorothy V. Fanning in opposition to the proposed Variance. George Worn, Lutheria Way, stated 1) the lack of off-street parking for the Carlsen residence had created a hazardous situation on this curve 2) he was aware of Mr. Carlsen'~ problem bu~ felt that the City had shown every consideration 3) ten of the 13 property owners on Lutheria Way fel= .that Mr, Carlsen should provide the off=street parking but 4) he, personally, would l~ke to see the City gra~t him a little more time. He also observed that since the garage had not been built the house had become an illegal, non-conforming building, Couanissioner Crisp moved, seconded by 'Coafnissioner Crisp, that the hearin8 · on V-240 be closed,' Hotion carried unanimously and the hearing was closed at 8:10 V. l~i. Commissioner Crisp moved, seconded by Commissioner Cowley, that V-240, Jack Carlsen, be denied since the findings required by law for the grantin~ of a Variance could not be made; motion carried unanimously. D. V-241 - John H. Ntchelmore, Aspesi Drive - Variance to allow a 21.5t rear yard in lieu of the requi..red 25t re.a.r y.ard_ ~he hearing on V-241 was opened at 8:12 P. H. ~e Secretary advised that Notices of Hearing had been mailed and there were no ~ritten communica- tions on file. He then briefly reviewed this application. ~he applicant ~as present but did. not wish to couauent with regard to this request. Jack NorSan, representing Lockheed, observed that two innocent parties ~ere involved in this matter and that he, personally, felt that a Variance was justified. Coumassioner Kellum advised 1) the Variance Conn3ittee had visited the site 2) in addition to the encroachment into the required rear yard, the Building Code had been violated in several ways and 3) the Committee could not make the findings required by law for the granting of a Variance. After further discussion, Commissioner Glenn moved, seconded by Commis- sioner Crisp, that the public hearing on V-2~1 be closed. Notion carried unanimously and the hearing was closed at 8:22 P. ~. By unanimous consent, the Chairman re-opened the hearing on V-241 lor~ enough for the Secretary to read a ~rritten cou~an~ication (which had been over-looked earlier) from Barbara R. and Charles ~. Notcalf who stated that they had no objection to the proposed Variance. ~he hearin~ ~as then closed by unanimous consent', Commissioner Crisp moved, seconded by Commissioner Kellum, that V-241, John H. t4ichelmore, be denied since the findings required by Section 17.6 of Ordinance NS-3 £or the grantin~ of a Variance could not be made; motion carried. Plannin~ Commission Minutes - Februar7 24, 1964 - Continued Chairman Norton acknowledged, w~th pleasure, the presence of Councilmen Brazil and observed that it ~as the first time a member of the City Council had artended in some time. The Chairman also welcomed .Mrs. Owen and Mr~ Wilberding of the Good Government Group and expressed the Commissiones appreciation for their attendance. TEN MINUTE RECESS III. SUBDIVISIONS AND BUILDING SITES A. SDR~'467 - Joyce Hendry, Canyon View Drive - Building Site Approval - 3 Lots - Continued from February 10, 1964 Commissioner Crisp advised 1) the Committee was not ready to make a recommendation in coxmection with this application 2) the applicant had requested that this matter be continued until the next regular meeting and 3) it was the recommendation of the Committee that this request be granted. On the basis of the foregoing, Chairman Norton directed SDR-467 continued until the meeting'on March 9, 1964. B. SDR-469 - Rosemarie Robertson, Piedmont Road - Building Site Approval - 1 Lot - Continued from February 10, 1964 The applicant was present and expressed satisfaction with the proposed conditions of approval° : In answer to a question from Morris J. Lee, the Commission assured Mrs. Robertson that the conditions of approval established in connection with SDR-469 would have no effect on her existing driveway (off Piedmont Road) which crosses the subject property. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Committee Report of February 10, 1964 relative to SDR-469 be adopted and that the tentative.map (Exhibit "A-l", filed February 6, 1964) be approved in accordance with the site development plan (Exhibit filed February 10, 1964) subject to 'the conditions detailed in the Buil- ding Site Committee Report, Condition. II, G, of which has been modified by inserting the word "additional" between the ~ords "no" and "direct". Motion carried unanimously, C. SDR-470 - Ben M. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Building Site Committee Report of. February 24, 1964 relative to SDR-471 be adopted and that the tentative map (Exhibit '~A", filed February 5, 1964) be approved subject to the conditions detailed in the Building Site Com- mittee Report; motion carried unanimously. Splitstone was present to represent the applicant and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Glenn, that the Subdi- vision Committee Report of February 24, 1964, relative to. SD-472, Wesley Kosichs 24 lots on Kosich Drive, be adopted and that the tentative map ~xhibit "A", filed February 14, 1964) be approved subject to the condi~ tions outlined in the Subdivision Committee Report; motion carried unanimous ly. F. ~SD-473 - Brown & Kauffmann, Inc. s Scully Avenue - Subdivision Approval - 62 Lots Commissioner Crisp advised 1) this subdivision was more or less an exten- sion of Prides Crossing 2) the street pattern had not been completed since it was being coordinated with that of the future Lindsay Subdivision and 3) it was the recommendation of the SubdiVision Committee that this matter be continued until the next regular .meeting. Commissioner Cowley moved, seconded by Commissioner Glenn, that A-131, Cupertino Union School District, .be granted final design approval subject to 1) landscaping to be completed within a period of four (4) years and 2) fencing along the south property line to be installed prior to occu- pancy of the school.. Motion carried unanimously. Bo A-1..3.5 - Clarence Toy, St. Charles Street ~ Final D.e.,siRn _Review - Apartments Commissioner Cowlay advised that the City Council, in compliance with Mac. Toy's request, had authorized a refund of all fees paid in connection with Mr. Toy's application for Building Site Approval (with the exception of the filing fee) since he had decided not to develop 'the property. further advised that the exhibits 'submitted in connection with the subject application were inadequate and it was the recommendation of the Design Review Committee that this application be denied. Commissioner Cowlay moved, seconded by Commissioner Glenn, that A-135s Clarence Toy, be denied; motion carried unanimously. C. A, 136 - Virgil R. Herring, Big Basin Way - Final Design Review - Antique S,__hop. Commissioner Cowlay advised that the City Council had approved acceptance of a bond covering Mr. Herring's required off-street parking for a period of one (1) year. He further advised that after reviewing the exhibits the Design Review Committee recommended 1) that the number of parking spaces required for this building be seven plus one, the one being the existing space if it is used for parking or an additional one if the existing space is used for something else and 2) that .the four spaces indicated on the front of the building be required now (as a condition of design review) and that the bond cover installation of the three spaces indicated at the rear of the building within one (1) year. Commissioner Cowlay moved, seconded by Commissioner Glenn, that final design review be granted A-136, Virgil R. Herring, subject to the following conditions: 1) provide eight park'ing spaces 2) four parking spaces be installed now and three future spaces to be guaranteed by bond° Motion carried unanimously. Commissioner Cowlay advised that the Design Committee felt that the Village. Parking District might be well enough along within one year to make installation of the three spaces at the rear of the building unnecessary. D~ ~r137 - Town & Country Realty, Sarahills Drive - Final Design Review - ~emDora~y_ _Sale~ Of~ic%.. f0r__Sara~lls___Subdlvisi~n Commissioner Cowley advised that the Design Review Committee had no objections to the design of the sales office and that the location was satisfactory. }Ie further advised, however, that the signs as shown, was located in the right-of-way and it had not been the policy of the Commission to approve signs of this type in the right-of-way. Ty Papalias was present to represent the applicant and advised that the location of this sign would be a problem if it could not be placed in the right-of-way. Commissioner Cowley. movad, seconded by Commissioner Glenn, that A-137, temporary sales office for Sarahills Subdivision, be granted final design approval as shown on Exhibits A,.B, and C, but that this approval not include the sign indicated in the right-of-way; motion carried unanimously. After further discussion with regard to the proposed sign, Chairman Norton directed the sign under ~-137 continued until the meeting on March 9, 1964, and requested tha~ the Secretary.establish title to the property in ques- tion and take a .look at the area V. CITY COUNCIL REPORT Commissioner Cowley gave a brief report on action t~en at the City,Council meeting on February 19s 1964, with particular emphasis on the following: 1) final map approval was granted the Kirkorian Subdivision excluding the Ted Avenue extension and 2) building site approval for the Casa Bella Nursing Home was extended for a period of six months~ VIo NEW BUSINESS VII, OLD BUSINESS A. Church Off-Street Parki~ After discussion, Commissioner Crisp moved that the Commission approve the Subdivision Committee Report ~relative to church off~str~et parking and forward same to the City Council in reply to Mayor Glennon's letter of January 27, 19640 Commissioner Cowley seconded the motion which car- ried unanimously. Commissioner Glenn requested that a copy of this report be placed in the General PlanReview fileo The Secretary suggested that the.Commission wait to hear from the City Council before starting proceedings to amend the Ordinance. -7- Planning Commission Minutes g Februa. ry 24~:1964 - Continued VII. B. Desinn Standard~ Commissioner Cowley again requested that the Commissioners make sugges- tions. to the Planning Director after reviewing the colored maps at City Hall. Commissioner Crisp suggested that the "14 foot accessory structures" be reviewed because of the construction of guest houses over garages. After further discussion, Chairman Norton directed this matter continued until the meeting on March 9, 1964. Co Storage qf Junk Cars The Secretary advised that some ~ities control situations such as this by ordinance but that he had been unable to discuss this matter with the City Attorney since he was out of town, Mr. Warner, Montrose Avenue, advised that such a problem existed in con- nection with several houses in his area. Mr. Feldman, Montrose Avenue, advised 'that some of these people were conducting businesses. Chaiman Norton requested that the Plamning Director contact the City Attorney with regard to correcting the existing situation and enacting an ordinance. D. Ordinance NS-3.~ relati___ya__to Planned Community Districts Commissioner Glenn questioned the advisability of permitting commercial uses in the proposed PC Districts. Commissioner Cowley questioned allowing recreational centers within the PC Districts because of the City'Council's point of view relative to Arroyo de Saratoga's request. Councilman Brazil explained that the City Council had not opposed recreation centers as such, but had felt that they should be located well within the developments so that the people who enjoyed the advantages of'the centers would also be the ones to cope with possible disadvantages.' Commissioner Cowley also co~mmnted as followS: 1) If the PC Districts were intended for older residents, would Saratoga need more than one? 2) A PC District could be combined with any RM District, but he, personally, did not feel that a PC District should be located adjacent or contiguous to developed residential property in R-1Distric'~s. -8- P!annin~ Commission Minutes -.February 24~ 1964 - Continued Vll. Ordinance NS-3.6 3) All schools should be limited to religion, crafts trade, etc. 4) Recreation should be for residents only except for a maximum of four guests. 5) Theater and restaurant should be restricted to residents and their Suests. 6) Lodges should be restricted.. 7) Medical Center should be restricted more. Commissioner Cowley also observed that it would be much easier to establish standards now than try to do it later. Commissioner Glenn observed thatiproperty developed by a non-profit organi- zation would be removed from the tax rolls. Commissioner Kellum observed that there were many different type develop- ments and perhaps Saratoga might need one each of one, two or three types, i.e., rental units, condominium or co-op units and permanent total care facilities. He stated that he had been unable to determine what the majority of the interested parties in Saratoga would prefer. Commissioner Cowley stated that he felt that the ordinance, as proposed, would open the City up to'%oo many and too much." Chairman Norton reminded the Commission that the subject ordinance had been set for public hearing before the Planning Commission ohM arch 9, 1964. E. City COuncil 81uunb~rs The Secretary read a con~unication from the City Administrator relative to the proposed City Council Charfibers. SD-328 - ArToyo de Sarato~a,:SaratoKa~venue - Request for'Extension The Secretary read a letter from Joseph Sweany requestinE an extension of one year in connection with SD-328. Chairman Norton directed SD-328 continued until the next regular meeting and referred same to the Subdivision Committee for study and a report relative to policy position at that time. 2. SDR-397 - John P. Maltby, W.o.0dbank.._Way - RequeSt for Extension The Secretary read a letter requestin~ a six month extension in con- nection with SDR-397. Commissioner Glenn moved, seconded by Commissioner Kellum, that an extension of six months from the date of expiration be granted in connection with SDR-397 as requested~ motion carried unanimously.
