PLACE: Saratoga High School, Herriman Avenue~ Saratoga, California T/PE: Regular Meeting I. ROUTINE ORCANIZATION The meeting was called Co order by Chairman Norton at ?:30 P. H. A. ROLL CALL Present: Con~issioners Cowley, Crisp, Kelltan, McFall, Norton and O'Rorke. Absent: Commissioner Glenn. B. MINU~ES Commissioner Crisp moved that the reading of the minutes of March 23, 1964 be waived and that the minutes be approved as submitted. Com- missioner MaFall seconded the motion which carried unanimously. xx. .UBL C HS NGS The Chairman declared public hearings open for the evening at ~:35 P. M. A. Ordinance NS-3.6 - An Ordinance amending Ordinance NS-3, the Zoning Ordinance of the City of Saratoga, by establishin~ a Planned Community District Zoning Classification, and by amending Sections 14.1 and 18.11 of said Ordinance - Continued fromMarch 23, 1964 The Secretary briefly reviewed this matter and reed several sections of the proposed ordinance. There was no one present who wished to comment further with regard to this matter. Commissioner Crisp moved, seconded by Commissioner Kellum, tha~ the hearing on proposed Ordinance NS-3.6 be closed; motion carried unani- mously and the Chairman declared the hearing closed at 7:44 P. M. It was moved by Commissioner Kellum and seconded by Commissioner Crisp that proposed Ordinance NS-3.6 be approved by the Plannin~ Com- mission and transmitted to the City Council with the recommendation tlmt it be enacted; motion carried unanimously. B. UP-63 - Faith Bible Chapel, Big Basin Way - Use Permit for Church and Sunday School at 14660 Big Basin Way - Continued fromMarch 23, 1964 The Secretary read a report from the Staff and"Subdivision Committee reco~ending that this application be approved ~ubject to certain conditions. There was no one in the audience who wished to comment with regard to. this raatter. Commissioner Crisp moved, seconded by Commissioner Kelltnu, that the ~ public hearing on UP-63 be closed; motion carried unanimously and Chairman Norton declared the hearing closed at 7:47 P. M. II. B. UP-63 - Faith Bible Chapel It was moved by Commissioner Crisp and seconded by Commissioner McFall that UP-63, application of Faith Bible Chapel for a Use Permit for a Church and Sunday School at 14660 Big Basin Way, be approved subject to the conditions set forth in the report of the Staff and Subdivision Committee which was read previously by the Secretary; motion carried unanimously.. C. UP-64 - Stanford University, Pike Road - Use Permit to allow Stanford University to use Grandview Ranch on Pike Road for Special Academic Purposes - Continued from March 1964 The Secretary read 1) a letter from Dr. Broemser of Saratoga Rills Road opposing the granting of the subject Use Permit and 2) a p~tition signed by 20 residents of the area opposing the granting of this Use Permit. Messrs. Douty and Miller were present to represent Stanford Uni- versity but had no further comment regarding this matter. JAMES.R. JEDLICKA, Pike Road, spoke in support of the proposed Use Permit. He stated 1) the type people such seminars would bring to Saratoga would be a credit to the City and 2) the pro- posed use of Grandview Ranch could be compared to the Masson con- certs-'and Montalvo activities, and such uses were the basis of the cultural enviromnent of Saratoga. JAMES A. }~NDRY, who owns property adjacgnt to the subject property, stated 1) he, too, had been concerned about the proposed us of the property so had spoken to representative of the University 2) he now felt sure that the proposed use of GrandviewRanch would be an asset to the conununity and 3) he could see no reason w~y access problems could not be worRed out to the satisfaction of all con- cerned in this matter. RICHARD G. MARTIN, Pike Road, spoke in opposition to the granting of this Use Permit on the basis of inadequate access to the subject property. HENRY JESSON and PHILIP DEVIN, Pike Road, stated that they would not object to Stanford's proposed use of the property if the access problems could be solved. Commissioner McFall read 1) the report of the Subdivision Committee relative to UP-64 and 2) the report of the Building Inspector with regard to bringin5 the existing building up to Code. After further discussion, Commissioner Crisp moved, seconded by Commissioner O'Rorke, that the public hearing on UP-64 be closed; motion carried unanimously and the hearing was closed at 8:20 F. M. In answer to a question from the Commission, Mr. Douty advised that Stanford University would discontinue use of the building until the various matters had been cleared. Commissioner Crisp moved that UP-64, application of Stanford Univer- ,sity for a Use Permit to use GrandviewRanch for special academic ':' purposes, be granted subject to the conditions outlined in the Sub- division Committee Report read earlier by Commissioner McFall; Com- - missloner McFall seconded the motion which carried unanimously., II. D. UP-65 - Saratoga Lutheran Church, Saratoga-Los Gatos Road - Use Permit for Church and Sunday School on the southwest corner of the intersection of Saratoga-Los Gatos Road and Glen Una Drive - ~ontinued fromMarch 23, 1964 The Secretary advised that a revised site plan had been submitted, then briefly reviewed this matter. He also read a letter from l~ward L. and Kathleen Brooks opposing the granting of the subject Use Permit. Almon Edgar, architect Warren Gilbert, and a representative from the Church were present but stated that they had no further comment. BERNARD ALTERs Glen Una Drive, spoke in opposition to the granting of this Use Permit on the-basis of 1) hazard ous traffic congestion 2) ~nadequate site area and 3) desire to keep the area strictly residential. JO}hNMERCADO, Saratoga Avenue, withdrew his support of this applica- cation on the basis of inadequate site area when he learned that the site consisted of only two acres. Church representatives observed 1) the subjedt proposal was in com- pliance with the Zoning Ordinance .2) accessibility had been one of the major considerations in selecting the site 3) research had shown that there were people in Saratoga who were interested in having the church locate in the area and 4) this would be a small church so it seemed unnecessary to have a large site. Commissioner Crisp moved, seconded ~y Commissioner Kellum, that the public hearing on UP-65 be closed; motion carried unanimously and the hearing was closed at 8:55 P. M. Commissioner Crisp moved that the Subdivision Committee Report of April 2, 1964 relative to UP-65 be adopted and that UP-65 be denied;. Commissioner Kellum seconded the motion which carried unanimously. Tm.N ~U_NUTE RECESS E. C-67 - Dr. A. W. Babienco, Saratoga Avenue and Kosich Drive - C~ange of Zoning from 'R-I-IO,000" (Single Family Residential) to '~-A" (Professional-Administrative) The public hearing on C-67 was opened at 9:05 P. M. The Secretary advised that a Notice of Hearing had been published and no written conmunication had been received in connection with same. He then read a letter from the applicant requesting that this application be' continued. . This request was granted and the Chairman directed C-67 continued until the meeting on April 27, 1964. F. C-68 - Mason Enterprises, Inc., Wardell Road - Change of Zoning from "R-l-15,000" and "R-I-40,000" (Single.Family Residential) to "R-I-12,500-P-D" (Single Family Resid.entlal Planned Development The public hearing on C-68 was opened at 9:08 P. M. The Secretary advised that a Notice of Hearing had been published and that a peti- tion with 127 signatures of residents of the area and a letter from - Mrs. Shirley Diemet had been filed in ~ppositlon. He then read these ~ co~nunications, together with a letter from the applicant. II. F. ~68 - Mason Enterprises, Inc. Dick Rogers was present to represent Mason Enterprises, but stated that he felt the application and accompanying letter were self- explanatory so had no further comment. LEROY GARRETT, Foothill Lane, MRS. A. OT~ENBERG, Foothill Lane, DAVE DEIMER, Wardell Road, and MRS. ~I.RXANDER JETT, Wardell Road, spoke in opposition to the proposed change of zoning. After further discussion, Chairman Norton, with concurrence of the Commission, directed C-68 continued until the meeting on April 27, 1964 and referred same to the Subdivision Committee for study and a report with ~ecommendation at that time. G. V-242 - Stephen Stephen,, Glenmont Drive - Variance in connection . · ~it~ Front and Side Yard Setback Requirements The public hearing on V-242 was opened at 9:20 P. M. The Secretary advised that Notices of Hearing had been mailed and there were no ~rfitten communications on file. The applicant was present and read a written statement explaining his n~ed for ~he Variance. There was no one else present who wished to comment with regard to this 9pplication. Chairman Norton directed V-242 continued until the meeting on April 27, 1964 and referred same to the Variance Con~nittee for study and a report at that time. ~e Chairman directed public bearings closed for the evening at 9:25 P.M. Chairman Norton welcomed Councilman Tyler, Mrs. Owens of the Good Government Group, and Mesdames 'Olds and Ottcnberg of the League'of 14omen Voters, and e.Tpressed the Commission's appreciation for their attendance. III. SUBDIVISIONS AND BUILDING SITES A. SDR-474 - Lloyd C. ridball, Falomino Way - Building Site Approval - ~ Lot - Continued fromMarch 23, 196~ The Secretary read a letter from the applicant granting a 60 day extension in connection with Planning Commission action on this application. Commissioner Crisp advised that the requested site development plan had not been received so recommended that this application be continued. Chaimnan Norton, on ~e basis of the foregoing, directed SDR-474 continued until the meeting on April 27, 1964. B. SDR-482 - Walter E. Hileman, Peach Hill Road - Building Site Approval '- 1 Lot - Continued fromMarch 23~ 1964 Commissioner Crisp advised that the Health Department had not yet approved this site for septic tank development so recommended that' SDR-482 be continued ~o allow the applicant time to work this matter '='' out. Chairman Norton directed SDR-482 continued until the meeting on ~ April 27, 1964. -4- III. C. SDR-483 - Finis B. Wilkinson, Jr., Via Regina - Building Site Approval - 1 Lot Mrs. Wilkinson was present and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of April 13, 1964 relative to SDR-483, Finis E. Wilkinson, Jr., be adopted and that the tentative map .(Exhibit '~", filed March 30, 1964). be approved subject to the condi- . tions set forth in the Building Site Committee Report; motion carried unanimously. D. SDR-484 - Andrew P. Lassen, Sobey Road - Buildin~ Site Approval - 2 Lots Commissioner Crisp advised that a site deKelopment plan had been requested in connection with this application and recommended that it be continued to allow the applicant sufficient time to have this plan prepared. Chairman Norton~ on the basis of this recommendation, directed SDR-484 continued until the meeting on April 27, 1964. E. SDR-485 - Edgar W. Herton, Woodbank Way - Buildin~ Site Approval - 1 Lot Mrs. Ibrton and her engineer, Charles Coburn, were present and, after discussion, ~xpressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Cormnissioncr Kellum, that the Building Site Conmittee Report of April 13, 1964 relative to SDR-485, Edgar W. Herton, be adopted and that the tentative map (Exhibit "A"s filed April 1, 1964) be approved in accordance with the site develop- ment plan (Exhibit '~", filed April 13, 1964) subject to the conditions · , detailed in the BuildinM Site Committee Report; motion carried " unanimously. F. SDR-48~ - Ed F. Owens~ Vessin~ Road - Buildin~ Site Approval - 1 Lot Mr. Owens was present and after discussion, requested that this appli- cation be continued until the next regular meeting. On the basis of this request, Chairman Norton directed SDR-486 con- tinued until the meeting on April 27, 1964. G. SDR-4~7 - Ronald E. Price, Canyon View Drive - Building Site Approval - 1 LOt ~e applicant was present and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Con~nissioner Kellum, that the Building Site Conmlittee Report of April 13, 1964 relative to SDR-487 be adopted and that the tentative map (Exhibit '~", filed April 3, 1964) be approved subject to the conditions detailed in the Building Site Con~nittee Report; motion carried unanimously. IV. DESIGN REVIEW A. A-141 - Claude T. Lindsay, Cox Avenue - Final Design Review - Subdi- vision }bmes - Continued fromMarch 23, 1964 Commissioner Cowley advised that the additional exhibits had not been submitted sQ suggested that this matter be continued .until the next ~ regular meeting. Chairman Norton~ on the basis of this suggestion, directed A-141 continued until the meeting on April 27, 1964. IV. B, A-122 - Saratoga Country Club, Prospect Avenue - Final Design Review - Club House Warren Heid, architect, was present to discuss this application with the Commission. Commissioner Cowley moved, seconded by Cormmissioner O'Rorke, that A-122, application of Saratoga Country Club for final design approval of Club House, be approved in accordance with Exhibit '~-1"; motion carried unanimously. C. ~-144 - Brookside..Club~ Cox Avenue - Final. Desinn Review - Club House Warren Heid, architect, was present to discuss this appli~ation with the Commission. Con~nissioner Cowley moved, seconded by Commissioner O~Rorke, that A-144, Brookside Club, be granted final design approval of the Club Nouse as shown on Exhibit '~"' motion carried unanimously. . V. CITY COUNCIL REPORT Commissioner Kellum advised that he was not prepared to give a report on the City Council meeting of April 1, 1964, since he had been unable to attend the meeting. NEW BUSINESS A. Official Plan Line Ordinance - City Council Referral The Secretary advised that the Official Plan Line Ordinance had been transmitted to the Planning Commission by the City Council with a request for a recommendation. Chairman Norton referred this matter to the General Plan Committee for study and a report at'the next regular meeting. B. St. Charles Stree~ - City Council Referral The Secretary advised that the City Council had requested that the ~ Commission review the proposed right-of-way and improvement require- ments for St. Charles Street and report back to the Council. Chairman Norton referred this matter to the Subdivision Con~ittee for study and a report at the meeting on April 27, 1964. VII. OLD BUSINES~ Design Standards - Cpntinued from March 23~ 1964 Cormissioner Cowley advised that there was no further report at this time and recommended that this matter be continued until the next regular meeting. Chain, an Norton so directed. VIII. COMMUNICATIONS A. WRI'ff~N 1. Request for Dance Studio_i~! ArRona~t ShoDDin~ Center The Secretary read a letter from W. T. Sowell requesting that '~ance Studios" be added to the list of.permitted uses for the VC-N" Zoning Districts so that a Dance Studio could be opened in the Argonaut Shopping Center. He advised that a similar pre- vious request had been denied. -6- VIII. A. 1. Dance Studios After discussion, Chairman Norton, with concurrence of the Conmis- sion, directed this matter continued until the meeting on April 27, 1964, and directed that the Secretary send Notices of Hearing to all property owners within a 500 foot radius of the proposed 'site so that an informal hearing could be held at that meeting. 2. SDR-346 - Dr. }~x~obbins, Saratoga Avenue - Request for Extension 3. SD- 347 - Dr. Isaac N. Abrams, Saratoga Avenue - Request for Extension ~e Secretary read letters requesting a one year extension in con- nection with SDR-346 and SD-347. After discussion, Cormnissioner Crisp moved, seconded by Corm~is- sioner Cowley, that an extension of one year from the current date of expiration be granted in connection with SDK-346, Dr. }~Robbins, and SD-347, Dr. Isaac N. Abrams; motion carried unanimously. Commissioner Kellum inquired about the legality of the signs at the Fruitstand and the two Nurseries along Saratoga-SunnFale Road.
