reading of the minutes of April. 27s 1964 be mived and that the
minutes be approved subject to the following modification:

would be unable to continue in that capacity because of heavier admin-

of commendation was in order, Commissioner Crisp read a letter whichs
at his requests had been prepared by the Staff for the Chairman~s

Commissioner Crisp moveds seconded by Commissioner Kellums that the
letter commending Mr. Iqiden for his outstanding performance as Sara-
toga City Engineer be approved and transmitted to the Santa Clara
County Director of Public ~orksl motion carried unanimously,

A, C-67 - Dr, A, W, Babiencos Saratoga Avenue and Kosich Drive - Change
of Zoning from "R-l-lOs000" (Single Family Residential) to
"P-A" (Professional-Administrative) - Continued from April 27s
1964
The Secretary advised that two written coaunications had been filed
since the meeting on April 27s 1964. He then read 1) a letter from
the applicant and 2) a l~ter opposing the subject change of zoning
signed by D, K, Sommerville of Radoyka Drive.
The applicant vas present and discussed the various statements made
by Mr, Sommervilles some of which he questioned, He also advised that
Mr, Sc, amerville was incorrect in assuming that he w~shed to establish
three doctorss offices on this property~ that his proposal had been
for only two,

There ms no one else present who wished to comment with regard to this
application.
Commissioner Crisp read the report of the Subdivision Committee relative
to this matters recommending that the Commission recommend denial of this
application.
Commissioner Kellummoveds seconded by Commissioner Glenns that the
public hearing on 8-67 be closed; motion carried unanimously and the
hearing ms closed
Commissioner Glenn moveds seconded by Commissioner McFall~ that the
report of the Subdivision Committee relative to C-67 be adopted and
transmitted to the City Council as the recommendation of the Commission.
Roll call vote: Ayes: Commissioners Crisps Glenn, KellumJ McFa11s
Nortons and OsRorke. Noes: None. Absent: Commissioner Cowley.
Motion carried unanimously.
B. V-242 - Stephen Stephens, Glenmont Drive - Variance in connection with
Front and Side Yard Setback Requirements - Continued from

The Secretary read a communication from la~Tence E. Pohl~ adjacent
property o~merj stating that he did not object to the granting of the
subject Variance.
The applicant ~as not present.
Commissioner Kellum advised that the Variance Committee had met with the
applicant and found that there were additional engineering and planning
details to be worked cut. He recommended, therefore
be continued.
On the basis of the foregoing, Chairman Norton directed V-242 continued
until the meeting on May 25s 1964.
· C. V-243 - E. L. Isbells Thelma Avenue - Variance to allow an 8w Side Yard
Setback in lieu of the required 10w Side Yard Setback - Continued
from April 27~ 1964
The Secretary read the following'written communications filed in support
of the subject Variance: 1) letter from Robert N. Finnie, Thelma Avenues
and 2) letter from Mr. and Mrs. Edwin E. Perrin~ Thelma Avenue.
The applicant ms present to discuss this request further with the
Co~ission.
There ms no one else present who wished to comment with regard to
this matter.
Commissioner Kellumread the report of the Variance Committee relative
to V-243, E. L. Isbe11, recommending that this application be denied
since the Committee had been unable to make the findings required by law
for the ~ranting of the Variance.
Commissioner Crisp. moveds seconded by Commissioner Kellums that the public
hearing on V-243 be closed; motion carried unanimously and the hearing
ms closed at 8:02 P. M.
Commissioner Kellummoved, seconded by Commissioner O~Rorke, that the
report of the Variance Cormnittee relative to V-243s E. L. Isbe11, be
adopted and that the application be denied; motion carried unanimously.

IX, D, V-244 - Virgil P..Force, Bucknall Road - Variance to allow a 21' Front
Yard Setback in lieu of the required 25' Front Yard Setback -
Continued from April 27 ~ '1964
The Secretary advised that no fur'thor co~nications had been filed in
connection with this application.
The applicant urns present but stated that he had no further comment unless
there were questions he could answer.
There was no one else present who wished to speak with regard to this
matter,
Commissioner Kellum read the report of the Variance Committee relative
to V-244, Virgil P. Force, recommending that this application be denied
since the Committee had been unable to make the findings required by
law for the granting of the Variance.
Commissioner Crisp moved, seconded by Commissioner O'Rorke, that the
public hearing on V-244 be closed'; motion carried unanimously and the
hearing ~s closed at 8:06 P. M..
Commissioner Kellum moved, seconded by C~issioner O'Rorke, that the
report of the Variance Committee relative to V~244, Virgil P. Force,
be adopted and that the application be denied; motion carried unanimously.
E. V-245 - Ruth and Going, Inc., Arroyo de Saratoga - Variance to allow an
8' Side Yard for Lot No. 147 of the Arroyo de Saratoga Subdivision
(Via Escuela) in lieu ef the required 10' Side Yard
The hearing on V-245 was opened a't 8:07 P. M. The Secretary advised
that Notices ef Hearing had been mailed and the only c~mmunication on
file was a letter from the applicant. He then read the letter which
explained the need for the subject Variance.
Joe Sweany, applicant's representative, was present to discuss this
matter with the Commission. He explained that originally P. C. & E.
had thought they would be able to align the utility poles in a ~ay that
would enable the developer to place the house on the lot but had later
found that this would not be possible.
After further discussion, Chairman Norton directed V-245, Ruth and Going,
Inc., continued until the meeting: on May 25, 1964 and referred same to
the Variance Comu,ittee for study and a report at that time.
F. UP-66 - W. T. Sowell, Argonaut Sh.~pping Center - Use Permit for a Ballet
School in the Argonaut Shopping Center located on Highway 9
The hearing on UP-66 was opened at 8:11 P. M. The Secretary advised that
Notices of Hearing had been mailed and there were no written communications
on file.
The applicant ~ms net present, and there was no one else present who
wished to comment with regard to this matter.
C~issioner Crisp read the report ef the Subdivision Committee relative
to UP-66, recommending that this application be approved subject to
certain conditions.
Commissioner McFa11 moved, seconded by Commissioner O'Rorke, that the
public hearing on UP-66 be closed; motion carried unanimously and the
hearing was closed at 8:16 P. M.
It ums moved by Commissioner McFall and seconded by Commissioner Crisp
that the Subdivision Committee Report of May 7, 1964 relative to UP-66
be adopted and that the applieati0n be approved subject to the conditions
detailed in the report; motion carried ,~,n~uimously.

Chairman Norton extended a welcome to Councilman Richard Drake and Mrs. Ruth
O~ens of the Good Government Group and expressed the Commissionss appreciation
for their attendance.
III. SUBDIVISIONS AND BUILDING SITES
A. SDR-474 - Lloyd C. Tidballs Palomino Way - Building Site Approval - I Lot -
Continued from April 27, 1964 .
The applicant ms present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Crisp moveds seconded by Co~issioner McFall, that the
Building Site Committee Report of' May 11, 1964 relative to SDR-474, Lloyd
C. Tidball, be adopted and that the tentative map (Exhibit "A", filed
February 21, 1964) be approved in. accordance with the site development
plan (Exhibit "B", filed May 11~ 1964) subject to the conditions detailed
in the Building Site Co~ittee Report; motion carried unanimously.
B. SDR-486 - Ed F. O~ens, Vessing Road - Building Site Approval - 1 Lot -
Continued from April 27~ 1964
The applicant ms present and questioned the proposed conditions of
approval relating to road construction and storm drainage fee. He also
filed a letter setting forth his reasons for same which was read by the
Secretary.
After further discussion, Cofafaissioner Crisp moveds seconded by Commissioner
McFa11~ that the Building Site Committee Report of April 13, 1964 relative
to SDR-486, Ed F. Owens, be adopted and that the tentative map (Exhibit
filed April 3, 1964) be approved subject to the conditions detailed in the
Building Site Committee Report; motion carried unanimously.
The applicant requested that the letter read earlier by the Secretary be
accepted as a request for reconsideration of conditions.
This request ms granted and Chairman Norton referred this matter to the
Subdivision Committee for consideration and a report at the next regular
meeting.
C. SDR-492 - Robert C. Jones, Quito Road - Building Site Approval - I Lot
The applicant ms present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
Building Site Committee Report of .May 11, 1964 relative to SDR-492 be
adopted and that the tentative map (Exhibit "A", filed April 24, 1964) be
approved subject to the conditions detailed in the Building Site Committee
Report; motion carried unanimously.
D. SDR-493 - A.. Har...o. ld Bray ,. _Vickery Lane - Building Site Approval.- 1 Lot
Commissioner Crisp explained that .further exhibits were needed in connec-
tion with this application and that the applicant had requested a con-
tinuance to allow adequate time for the preparation of same.
On the basis of the. foregoing, Chairman Norton directed SDR-493, A. Harold
Bray, continued until the meeting :on May 25, 1964.
IV. DESIGN REVIEW
A. A-141 - Claude T. Iindsay, Cox Avenue - Final Design Review - Subdivision
Homes - Continued from April 27,..19..64
After discussions Commissioner Glenn moved, seconded by Comu~issioner
~risp, that A-141~ Claude T. Lindsay~ be granted final design approval
of the 14 homes in ~nit i of Tract 3742 as shown en Exhibit "C", filed
April 17, 1964; motion oarTied unanimously.

IV. B, A-114 - Eichler Homes~ Inc., Cox Avenue - Final Design Review - Subdivision
Homes - Continued fromApril 27t 1964 ..
After discussion, Commissioner Glenn moved, seconded by Connissioner
OsRorke, that A-114, Eichler HomeS, Inc., be ~ranted final design approval
of the homes on Lots 3 through 12.as shown on Exhibit "B-2", filed March 16,
1964s subject to the following conditions: 1) the driveway entrance to
Lot 12 is to be changed from De Mavilland Drive to De Anza Drive and
2) the front yard setbacks on Lots 6 and 8 are to be changed from 25 feet
to 30 feet. Notion carried unanimously.
C. A-145 - Joseph Longs Saratoga Avenue - Prelhninary Design Review - Office
Building - Continued from April 27, 1964
The Secretary advised that the site plan for this office buildlug was
bein5 revised so suggested that the application be continued until the
next regular meeting.
Chairman Norton, on the basis of the foregoing, directed A-145 continued
until the meeting on May 25, 19644
D. A-146 - Corinthian Studios, SaratOga-Los Gatos Road - Preliminary Design
Review - Sales and Storage Building - Continued fromAple1 27s 1964
The Secretary advised that the site plan was being revised to provide
additional parking so it was his recommendation that this matter be con-
tinued until the next regular meeting.
Chairman Norton so directed.
E. A-148 - Douglas Larson~ Big Basin Wa7 - Final Design Review - SiCn
Commissioner Glenn moved, seconded by Commissioner OIRorke, that A-148,
Doughs Iarson, be granted final design approval of the sign shown on
Exhibits '~" and "B" subject to the following conditions: 1) all
existing signs on the roof and on the building to be removed 2) intensity
of illumination of interior lighting shall not exceed 430 millihmperes
and 3) a satisfactory rendering of the multi-colored stained glass shall
be submitted for Planning Commission approval. Notion carried unanimeusly.
F. A-149 - Dr. Norman Abrahams., Saratoga Avenue - Preliminary Design Review -
Professional Office
The applicant ~as present to discuss this application with the Co~,iission.
Commissioner Glenn moved, seconded by Cou~issioner McFall, that A-149,
'Dr. Norman Abrahams, be granted preliminary design approval for office
building as shown on Exhibit ~" subject to the off-street parking being
completed prior to occupany of the building; motion carried unanimously.
V. CITY COUNCIL REPORT
Commissioner OeRorke gave a brief report on the City Council meeting of
May 6, 1964s with particular emphasis on the following:
1) Preliminary resolutions relative t0 the Chester Avenue Assessment District
were approved by the Council.
2) The City Administrator recouaaendedi that the portion of the County Code
relating to on-street parking and repair of vehicles be adopted as part
of the City Code.
3) The Council appointed Mr. Rawak as Flood Control District representative.
4) Santa Clara County has requested that Saratoga participate in a mass
transpor tation study..

A, Ordinance 38,1 - An Ordinance amending the Saratoga City Code by adding
Article VI to Chapter 13 thereof, relating to Official
Plan Lines - Continued from April. 27, 1964
Commissioner Glenn read the report of the General Plan Committee,
recommending that the Commission recommend to the Council that
Ordinance 38,1 be enacted,
Commissioner Glenn moved, seconded by Commissioner Crisp, that the
report of the General Plan Committee relative to Ordinance 38,1 be
adopted and transmitted to the City Council as the recommendation of
the Commission; motion carried unanimously,
B, St, Charles Street - Council request for review of Right-of-Way and
Improvemen~ Requirements - Continued from April 27s
Commissioner Crisp read a draft of a report from the Planning Commission
to the City Council relative to'improvement of St, Charles Street,
Commissioner Crisp moved, seconded by Commissioner Kellum, that the
report read by Commissioner CriSp relative to St, Charles Street be
adopted and transmitted to the Council as the reco~endation of the
Commission, Motion carried 5.to 1~ with Commissioner Glenn dissenting
on the basis that the proposed 20 foot one-my street ms not wide
enough,
C. ViOlations
In answer to inquiries from Commissioners Glenn and Crisp, the Secretary
advised 1) the sign violations at the nurseries along H~ghway 9 would
be abated and 2) the sign in violation at the First Valley Bank would
be removed,
VIII. COMMUNICATIONS
A. ~ITTEN
SDR-349 - O. T. Robertshaw, Farwell Avenue - Request for Extension
The Secretary read a letter from Mrs. A. S. DelCarlo, new owner of the
subject property, requesting an'additional six month extension in
connection with SDR-349.
Commissioner Crisp moved, seconded by Commissioner Kellum, that an
additional extension of six months from May 14, 1964, be granted in
connection with SDR-349; motion carried unanimously.
