PLACE: Saratoga ~igh School, Herrimam Avenue, Saratoga, California TYPE: Regular Meettn~ I. ROUTJEE ORGANIZATION The meeting was called to order by Chairman Norton at Z~30 P.M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Glenn, Kellum, McFall~ Norton, and O'Rorke Absent: None B. MINUTES Commissioner Glenn moved, seconded by Commissioner McFall, that the reading of the minutes of June 22, 1964 be waived and that the minutes be approved as submitted to the Coramission; motion carried unanimously. II. PUBLIC ItEARINGS Chairman Norton declared public hearings open for the evening at 7:32 P.M. A. C-~9 - Mario R. Barbieri, Prospect Road - Change of Zoning from "Ao~ricultural" to "R-I-iO,000" (Single Family Residential) - Continued from June 2.2, ].964 The Secretary briefly reviewed ~his application and advised that no further communications had been ·filed in connect].on with same. The applicantts representative Stated that he had no further comment~ and there was no one in the audience who wished to speak with regard to this matter. Commissioner Crisp read the report of the Subdivision Committee relative to C-69, recommending that the Commission recommend approval of this request for change of zoning. Commissioner Kellum moved, seconded by Commissioner Crisp, that the public hearing on C-69 be closed. Motion carried unanimously and the hearins was closed at 7:35 P. M.~ Commissioner Crisp moved, seconded by Commissioner McFall, that the Subdivision Committee Report of 7 July 1964 relative to C-69, Mario R. Barbieri, be adopted and transmitted to the City Council as the recommendation of the Commission; motion carried unanimously. B. C-Z.0 - O. R. The Secretary briefly reviewed this application and advised that no further communications'had been filed in connection with same. Mr. LaCroix was present to represent the applicant but stated that he had no further comment. There was no one in the audience who wished to speak with regard to this ~qt.ter. R~ Ma~Ri,}re In answer to Mr. LaCroix's request that the Commission defer .this matter for further study under the General Plan Review, Chairman Norton explained that to continue this application for six to nine months would complicate the records but that there was no reason the matter could not be reviewed at that time even though it was no longer on the agenda. Discussion followed relative to 'the possible withdrawal of the appli- cation and recovery of the filing fee. After conferring with his client, Mr. LaCroix requested that C-70 be withdra~n1 and that this matter be placed on the agenda for the General Plan Review. Commissioner Cowley moved, seconded by CoF~missioner Glenn, that the public hearing on C-70 be closed. Motion carried unanimously and the hearing was closed at 7:49 P..M. Commissioner Kellum moved, seconded by Commissioner O~Rorke, that the applicant's request for withdrawal of this application be granted subject to the approval of the City Attorney; motion carried unani- mously. A question arose as to the legality of allowing the application to be withdrawn at this time. After discussion, Commissioner Kellum with- drew his motion with concurrence' of the Commission. Commissioner Crisp moved, seconded by Commissioner McFall, that the Subdivision Committee Report of '13 july 1964 relative to C-70, O. R. Maggiore, be adopted and forwarded to the City Council as the recom- mendation of the Commission, and that the Council be advised that the Commission had no objection to the withdrawal of this application without prejudice. Roll call vo~e: Ayes: Commissioners Cowley, Crisp, Glenn, Kellum, McFall, an~ Norton. Noes': Commissioner O'Rorke. Motion carried. Commissioner O~Rorke, in explain'ing the basis for his negative vote, stated 1) he felt that the applicant had been led (by the Commission) to believe that withdrawal of the application would be in order if he so desired and that the filins fee might be refunded so 2) in all fairness he felt that the matter; should be continued until proper' procedure had been established. After further discussion it was the consensus of the Commission that withdrawal of the application and the possibility of a refund of the filinE fee were matters to be handled by the Council. Therefore, CoF. missioner Crisp moved, seconded by Commissioner McFall, that the Subdivision Committee Report of 13 July 1964 relative to C-70 be adopted and forwarded to the City Council as the recommendation of the Commission; motion carried unanimously. C, UP-68 - Stanford Research Institute, Fruitvale Avenue - Use Permit f~r .Tempora.ry Research Antenna Site The hearinE on UP-68 was opened at 8:03 P, M, The Secretary advised that the required Notices of Hearing had been mailed and there were no communications on file, He 2then briefly reviewed the applicant;on and read a letter from the appli'canto Richard Bartholomew of Stanford Research Institute was present to discuss this matter with the Commission, !Is advised 1) the Use Permit was needed for a period of three weeks beginnin~ on or about August 15, 1964 2) any noise c.r~eated in connection with this instal- lation would be well muffled 3): there would be no transmissions since the station was for receivin~ only and 4) adequate sanitation facili- ties would be provided. After further discussion of this matter Commissioner Glenn moved~ seconded by Commissioner O~Rorke, that the pt~blic hearing on UP-68 be closed. ~tion carried unanimously and the hearing was closed at 8:09 P. M. Commissioner Crisp moved, seconded by Commissioner Glenn, that UP-68, Stanford Research Institute, application for a Use Permit for a tem- porary research antenna site, be approved for a period of three (3) weeks beginning on or about 15 August 1964, subject to any State or sanitation re~irements which might be applicable; motion carried unanimously. D. V-246 - W. Do Cunningham, Canyon View Drive - Variance in connection with Rear Yard Setback Requirements The public hearing on V-246 was opened at 8:11 P.M. The Secretary advised that Notices of Hearingzhad been mailed and no written com- munications had been received. He then briefly reviewed the subject application and advised that the City Attorney had suggested the possibility of a Variance for Mr. Cunningham since 1) the revised lot lines were the result of acquisition of additional property which improved the layout of the lot and 2) the need for the Variance was in connection with the original. lot lines only, not the lots lines as they now exist. The Secretary further advised 1) the additional pro- perty had been acquired by a previous o~ner several years aCo and 2) the City Attorney had suggested a revocable Variance for a specified period providing sufficient time for the recordation of a survey map establishing the revised lot lines which would eliminate the need for the Variance. Mr. Cunningham was present but had no further comment. There was no one in the audience who wished to speak regarding tl~is request. Commissioner Kellum read the report of the Variance Committee relative to V-246, recommending thst this request be granted. After further discussion Commissioner Crisp moved, seconded by Com- missioner Glenn, that the publi~ hearing V-246 be closed. Motion carried unanimously and the hearing was closed at 8:21P. M. Commissioner Kellum moved, seconded by Commissioner O'Rorke, that V-246, W. D. Cunningham, be granted for a period of ninety (90) days during which time the applicant is to have a revised survey map recorded establishing the lot lines as sho~u on Exhibit "A" which will eliminate the need for the Variance; motion carried unanimously. It was brought to the applicant's attention that he would be in viola- tion upon the expiration of the Variance (ninety days from date) unless the revised survey map had been recorded in the meantime as specified. Chairman Norton declared public hearings closed for the evening at 8:23 P.M. III. SUBDIVISIONS AND BUILDING SITES A. SD-496 - Mario R. Barbieri, Prospect Road - Subdivision Approval - 19 Lots - Continued from June 22, 1964 Commissioner Crisp advised that the Subdivision Committee was not prepared to m~ke a recommendation relative to SD-496 at this time so suggested that this matter be continued until ~he next regular meeting. On the basis of the foregoinS, Chairman Norton directed SD-496, Mario R. Barbieri, continued until the meetins on July 27, 1964. B. SDR-497 - No]et Company, Inco, Q~ito Road - Building Site Approval - 3 Lots - Continued from ~une 2g, ].964 The Secretary read a letter from!the applicant~s representative (Mrs. Ann Iambourne) requesting that this matter be continued to allow time to work out problems relative to the right-of-way. On the basis of this request, Chairman Norton directed SDR-497, Nojet Company, Inc., continued until the meetin~ on July 27, 1964. C. SD-498 - MacKay & Somps, Inc., Saratoga-Sunnyvale Road - Subdivision Approval - 25 I,ots - Continued from June 22, 1964 Commissioner Glenn read the report of the General Plan Committee rela- tive to the request made on behalf of the LanS-McVey property. After discussion Commissioner Glenn moved, seconded by Commissioner Cowley, that the General Plan Cofimittee Report of July 13, 1964 rela- tive to SD-498 be approved and that this item be placed on the agenda for the General Plan Review; mo[ion carried unanimously. The applicant~s representative e~pressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Subdivision Committee Report of 13 July 1964 relative to SD-498, MacKay & Somps, Inc., be adoptediand that the tentative map (Exhibit "A-I", filed 9 June 1964) be approved subject to the conditions outlined in the Subdivision Committee report; motion carried unanimously. Sobey Road Subdivision D. SD-501 - L. A. D. Development Company, - Approval - 9 Lots - Continued from June 22,.1964 Commissioner Crisp advised 1) while the applicant~s representative had telephoned a request that this application be continued, written permission to extend the time for action on the tentative map had not been filed 2) application had n6t been made for the Variance necessary to development of this property and '3) it was the recommendation of the Subdivision Committee, therefore, that this application be denied. After discussion Commissioner Crisp moved, seconded by Commissioner Kellum, that the applicant's request for continuance in connection with SD-501 be denied and that the application be disapproved without prejudice; motion carried unanimously. E. SD-503 - Clay McCullough & Company, Sobey Road - Subdivision Approval - 10 Lots - Continued from June 22t 1964 Mr. Mastin, representin the proposed conditions of approval. Commissioner Crisp moved, seconded by Commtssiomer McFall, that the Subdivision Committee report of 13 July 1964 relative to SD-503, Clay McCullouSh & Company, be adoptedZand that the tentative map (Exhibit "A-I", filed 1 July 1964) be approved subject to the conditions outlined in the Subdivision Committee Report~ motion carried unanimously. Scherf, Canyon View Drive - Building Site Approval - 1 Lot - Continued from ;June 22~ 1964 Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee report of 13 July 1964 relative to SDR-505 be adopted and that the tentative map (Exhibit "A", filed 10 June 1964) be approved in accordance with the site development plan (Exhibit "B", filed 10 July 1964) subject to the conditions outlined in the Building Site Committee report; motion carried unanimously. G. SDR-507 - George O. Lindem.: Oriole Road - BulldinE Site Ap.proval - 1 Lot F~. and Mrs. Lindera were present 'and expressed satisfaction with the proposed conditions of approval.. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee Report of 13 July 1964 relative to SDR-507, George O. Lindem, be adopted and :that the tentative map (Exhibit '~", filed 19 June 1964) be approved Subject to the conditions detailed in the Building Site Committee report; motion carried unanimously. H. SDR-509 - Charles E. Harden, Sob~y R~ad - Building Site Approval - 1 Lot Mr. Harden was present to discuss this application with the Commission and expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee report of 13 July 1964 relative to SDR-509, Charles E. Harden, be adopted and that the tentative map (Exhibit '~", filed 3 July 1964) be approved subject to the conditions detailed in the Building Site Committee report; motion carried unanimously. I. SDR-510 - A. H. Campbell, Woodbank Way - Buildin~ Site Approval - 1 Lot Mr. Campbell was present and expressed satisfaction with the proposed conditions of approval. ~ It was moved by Commissioner Crisp and seconded by Commissioner Kellum that the Building Site Committee ~eport of 13 July 1964 relative to SDR-510, A. H. Campbell, be adopted and that the tentative map (Exhibit "A", filed 3 July 1964) be approved subject to the conditions detailed in the Building Site Committee re.port; motion carried unanimously. J. SD-499 - MacKay & S0mps, Inc., Saratoga Avenue - Subdivision - 15 Lots - Modification of Approved Tentative Map The applicant~s representaitve expressed satisfaction with the condi- tions proposed in connection with the revised tentative map. Commissioner Crisp moved, seconded by Commissioner Kellum, that the revised Subdivision Committee report of 13 July 1964 relative to SD-499~ MacKay & Somps~ Inc., be adopted and that the revised tentative map (Exhibit '~-3", filed 3 July =1964) be approved subject to the condi- tions outlined in the revised Subdivision Committee Report; motion car- ried unanimously. Chairman Norton welcomed Councilman Drake and Mr. Los, Good Government Group representative, and expressed the Commission's appreciation for their attendance. IV. DESIGN REVIEW A. A-114 - Eichler Homes, Inc., Cox Avenue - Final Design Review - Subdi- vision Homes for Portion of Tract 3572 Commissioner Cowley briefly reviewed this application and called atten- tion to the Staff Report in the Commission folders. A-114 - Eichler Homes~ Inc. question from Commissioner Cowley, Mr. Boyd, applicantts representative stated that he felt that the location of the house on Lot 22 could be modified sli~htly. . After further discussion, CommiSsioner Cowley moved, seconded by Com- missioner Kellum, that A-114, EiChler Homes, Inc., be 8ranted final design approval of the subdivision homes for Tract 3572 as shown on Exhibits '~" (Perspective), "B-3" (Site Plan), "C" (Entrance Plan), "D" (Landscape Plan), "E" through "J" (Elevations), subject to sub- mittal of a revised site plan for Lot 22 for approval of the Design Review Committee prior to construction; motion carried unanimously. B. A-138 - First Church of Christ,~ Scientist, Lonntta Avenue - Final DesiRn Review - Church BuildinR Commissioner Cowley briefly reviewed this application and commended the applicantIs representatives for their excellent cooperation and outstanding presentation. Commissioner Cowley moved, seconded by Commissioner O~Rorke, that A-138, First Church of Christ, Scientist, be granted final design approval as shown on Exhibits "A-I" (Working Drawings) and "E" (Color Rendering); motion carried unanimously. C. A-149 - Dr. Norman Abrahams, Saratoga Avenue - Final Design Review - Professional BuildinR After discussion Commissioner Cowley moved, seconded by Commissioner OIRorke, that A-149, Dr. Norman. Abrahams, be granted final design approval of office building as sho~ on Exhibit '~-1" (Workin~ Drawings) subject to the access road from Village Drive over Lot 2 to Lot 3 being improved and completed prior to or simultaneously with occupancy of the building; motion carried unanimously. V. CITY COUNCIL REPORT : Commissioner Crisp gave a brief report on action 'taken by the City Council at the meeting cn July 1, 1964, with emphasis on items of particular interest to the Planning Commission. VI. NEW BUSINESS : A. Request for Annexation - Benevento PropQ~tX Commissioner Crisp advised that the Planning Committee and the Subdi- vision Committee had reviewed the request for annexation of the Bene- vento property on Prospect Road (at the northwest City boundary) and could foresee no serious problems or objections. He further advised that a ~ritten report would be:prepared for the next regular meeting if the Commission so desired. Chairman Norton, with concurrence of the Commission, expressed general approval of Commissioner Crispts oral report and requested that the written report be presented at the meeting on July 27~ 1964. B. Common Green Development Standards The proposed standards for common green development' were discussed at length by the Cordnission. With reference to the preliminary proposals that have come before the Subdivision Committee, Commissioner Crisp observed that the developers tend to try to crowd a sufficient number of homes onto the usable land to average one loz per acre even in the very steep terrain. Common Green Development Standards that a study session be called Zwhen one of the developers presents a plan that appears satisfactory~to the Staff and Subdivision Committee. Chairman Norton advised that he felt that recreation facilities were of secondary importance in a common green development..,that the first concern was to prevent undesirable development in the steep terrain that would scar the hillsides. lie further stated that he, personally, preferred that some of the brush area in the hills be left in its natural state. After further discussion CommiSsioner O'Rorke moved, seconded by Com- missioner Cowley, that the proposed standards for co.mmon green develop- ment be approved in principal and that the Committee be requested to follow them as closely as possible in trying to work out the preliminary plans before them at present; motion carried unanimously. C, Newell Association, Inc. Appli~ation - County Plann].n~ Commission The Secretary advised that the Newell Association of Sunnyvale had filed an application with the County Planning Commission for a Change of Zoning for a Research Laboratory on the Palm property south of Villa Montalvo. He suggested that he attend the County Commission meetinE to present the City of:SaratoEats opposition to this application. Chairman Norton, with concurrence of the Commission, requested that he attend the meeting and speak for the VII. OLD BUSINESS SDR-397 - John P. Maltby Woodbank Way - Request for Explanation - Continued from June 22,_1~6J . The Secretary briefly reviewed this matter and called attention to the Staff Report in the Commission folders. After discussion Commissioner Crisp moved, seconded by Commissioner Cowley, that the Staff Report of 13 July 1964 relative to SDR-397, John P. Maltby, be approved and that the Secretarybe authorized to respond to the appli- cantis inquiry on the basis of this report; motion carried unanimously. vIII. COMMUNICATIONS A, WRITTEN 1, UP-47 - Westhope United Presbyterian Church, Saratoga Avenue - Request for Extension The Secretary read a letter requesting an extension of one (1) year in connection with UPs47, Westhope United Presbyterian Church. : After discussion Commissioner Crisp moved, seconded by Commissioner Cowley, that an extension be granted iu connection with UP-47, Westhope United Presbyterign Church for a period of one (1) year from July 8, 1964; motion'carried unanimously. 2. SD-430 - M, L. Hiatt, Saratoga-Los Gatos Road - Request for Extension The Secretary read a letter requesting an extension in connection with SD-430, M. L. Hiatt, After discussion Commissioner Crisp moved, seconded by Commissioner Cowley, that an extension be granted in connection with SD-430, M, L. Ly~h, I,a Paloma Avenue -- Request for Extension The Secretary read a letter requesting an extension in connection with SDR-432, W. H. Lynch.[ Commissioner Crisp requested that this matter be continued until the next regular meeting to allow adequate time for the Building Site Committee to review the conditions of approval relative to La Paloma Avenue. Chairman Norton so directed. B. ORAL The Secretary called to the Commissiongs attention the invitation from Pacific Telephone for lunch and a tour of the Company~s facilities on July 22, 1964. The then requested that ~he Commissioners advise the City Administrator whether or'not they would be able to attend. IX. ADJOURNMENT Chairman Norton declared the meeting adjourned at 10:14 P. M.
