PLACE: Saratoga High School, Herriman Avenue, Saratoga, California TYPE: Regular Meeting I. ROU~.INE ORGAINIZATION The meeting was called to order by Chairman Norton at 7:30 P.M. A. ROLL CALL Present: Commissioners Cowley, Crisp, Glenn, Kellum, McFall, Norton, and O'Rorke. Absent: None B. MINUTES Commissioner Glenn moved, seconded by Commissioner McFall, that the reading of the minutes of July 27, 1964 be waived and that the minutes be approved as submitted to the Commission; motion carried unanimously. II. PUBLIC HEARINGS The Chairman declared public hearings open for the evanidg at 7:32 P. M. A. 6-71 - Maxma~ Investment CoUpany, Walnut Avenu~ - Change of Eoning from "R-1-12,500" (Single Family Residential) to "R-M-5,000 P-C" (Multiple Family Residential Planned Community District) - Cgntinued from July 27~ 1964 The Secretary advised that no further communications had been filed in connection with this request for change of zoning. There was no one present to represent the applicant and no one in the audience who wished to comment with regard to this matter. Chairman Norton announced 1) the Subdivision Committee had not yet completed its study and report relative to this application so 2) the Planning Commission would take no action at this time. He then directed C-71 continued until the meeting on August 24, 1964. B. .UP-69 - Richard W. Koivisto, Casa Blanca Lane - Use Permit to allow a maximum of Three Lodgers or Boarders at residence located at 18659 Casa Blanca Lane - Continued from July 27~ 1964 The Secretary read l) a communication from Mrs. John Scarlett of Casa Blanca Lane filed in support of the subject application and 2) a Staff Report pertainin5 to ~his matter. There was no one present to represent the applicant and no one in the audience who wished to comment with regard to this application. After discussion Commissioner Kellum moved, seconded by Commissioner Glenn, that the public hearing on UP-69 be closed; motion carried unanimously and the Chairman declared the hearing closed at 7:42 P. M. It was moved by Commissioner Crisp that UP-69, Richard Koivisto, be denied on the basis of the Staff Report previously read by the Secretary; Commissioner Kellum seconded the motion which carried unanimously. C. ~-73 - lqesthope Presbyterian Church, Cox Avenue - Change of Zoning from "R-1-10,000" (Single Family Residential) to "C-N" (Neighborhood Commercial} The hearing on C-73 was opened at 7:44 P. M. The Secretary advised that a Notice of Hearing had been published and no written communications had been received. He then read a statement of reason filed by the applicant. -1- Elmer Garrison, present to represent the applicant, stated 1) the subject property had, at one time, been set aside for park use 2) when the proper~y was re!ased, it had been offered for sale 3) it was now felt that the subject proposal would provide the best possible us~ of the land 4) the County was preparing a sketch to show how a library could be fitted into the existing building and 6) consideration had been given to including a miniature golf course in this development. There was no one in the audience who wished to comment with regard to this matter. Commissioner Crisp suggested that this application be continued fo~ study and a report. He further stated that he felt the possibility of using this building as a library should be studied carefully before the Commission took action on this matter. After further discussion Chairman Norton directed C-73, Westhope Presbyterian Church, continued until the meeting on August 24, 1964, and referred same to the Subdivision Committee for study and a report at that time. The Chairman declared public hearings closed for the evening at 7:59 P. M. III. SUBDIVISIONS AND BUILDING SITES A. gD-496 - Mario R. Barbieri, Prospect Road - Subdivision Approval-19 Lots -Con[i~ued..frcm July 27~ 1964 Mr. Mastin, present to represent the applicant, expressed satisf~ction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner Kellum, that the Subdivision Committee report of August 10, 1964, relative to SD-496, Mario R. Barbieri, be adopted and that the tentative map (Exhibit filed May 25, 1964) be approved subject to the conditions set forth in the Subdivision Committee report; motion carried unanimously. B. SDR-497 ~ Nojet Company, Inc., Quito Road - Buildin~ Site Approval - 3 Eots - Continued from July 27~ 1964 The applicant was not present. Commissioner Crisp moved, seconded by Cormnissioner McFall, that the Building Site Committee report of June 22, 1964, relative to SDR-497, Nojet Company, Inc., be adopted and that the tentative map (Exhibit filed May 27, 1964) be approved subject to the conditions detailed in the Building S~te Committee report; motion carried unanimously. C. SDR~512 - Hans Zweig, Madtone Rill Road - Building Site Approval - 2 Lots - Continued from July 27, 1964 The Secretary advised that the revised map had not been submitted, so suggested that this application be continued until the next regular meeting. On the basis of the foregoing, Chairman Norton directed SDR-512, Hans Zweig, continued until the meetin~ on August 24, 1964. D. SDR~514 - Mijo Corporation, Saratoga-Sunnyvale Road - Building Site Approval - 1 Lot - Continued from July 27~ 1964 Commissioner Crisp recommended that this matter be continued since additional time was needed to work out the problems in connection with this site. On the basis of this recommendation, Chairman Norton directed gDR-514, Mijo Corporation, continued until the meeting on August 24, 1964. -2- E. §DR-515 - Saratoga Parent Nursery School, Sarntoga-Sunnyvale Road - Building Site Appr9~' ~_.~..~_ ................................. Commissioner Crisp explained that the State was acquiring a strip of land along the frontage of this property for the widening of Saratoga-Sunuyvale Road, making ~t necessary to relocate the building. Mrs. Stark, representing the applicant, expressed satisfaction with the proposed conditions of approval. It was moved by Commissioner Crisp and seconded by Commissioner Kellum that the Building Site Committee report of August 10, 1964, relative to SDR-515, Saratoga Parent Nursery School, be adopted and that the tentative map (Exhibit "A", filed July 31, 1964) be approved in accordance with the parking plan (Exhibit "B", filed August 10, 1964) subject to the conditions detailed in the Building Site Committee report; motion carried unanimously. IV. DESIGN REVIEW A. A-152 - Weldair, Inc., Prospect Road - Preliminary Design Review - Commercial Building - Continued from July 27, 1964 Commissioner Cowley advised that the Design Review Committee had reviewed the exhibits submitted in connection with this application and had found same to be satisfactory w~th the exception of the sign. He then explained to the appltcant*s representative, Mr. Adair, that it would be necessary to take the outside measurements of the sign rather than the inside measurements. After discussion Commissioner Cowley moved, seconded by Commissioner Glenn, that A-152, Weldair, Inc., be granted preliminary design approval of the commercial building as shown on Exhibit '~A-I", con- sisring of three sheets, subject to compliance with Section 10.5(a) of Ordinance NS-3 pertaining to signs; motion carried unanimously. B. A-153 - Mljo Corporation, Saratoga-Sunnyvale Road - Preliminary Design Review - Commercial Building - Continued from July 27, 1964 Commissioner Cowley advised that there were problems relating to this application so recommended that same be continued until the meeting on August 24, 1964. Chairman Norton so directed. C. A-154 - Richfield Oil Corporation, Big Basin Way - Preliminary Design Review - Plans for Remodelin~ Service Station. Commissioner Cowley advised that after reviewing the subject plans the Design Review Committee had suggested that they be reviaed to give the service station a more rustic appearance, especially since it is located in the heart of the village. The Secretary advised that he had talked to the applicant*s representative, Mr, Bradford, and he had agreed to try to have the plans revised prior to the next Design Review Committee meeting. In view of the foregoing, Chairman Norton directed A-154, Richfield Oil Corporation, continued until the meeting on August 24, 1964. D. A-130 - City of Saratoga, Fruitvale Avenue - Review of Site Plan - Council Chambers After reviewing the subject site plan, the Commission discussed at length the possible need for a second means of access to the parking lot. Commissioner Cowley moved, seconded by Commissioner O'Rorke, that final design approval be granted the site plan for A-130 with the suggestion that two means of access be provided for the parking lot. -3- After further discussion Commissioner OwRorke moved, seconded by Commissioner Crisp, that the pending motion be amended by changing "suggestion" to "requirament'~; motion carried with Chairman Norton dissenting. The vote ou Commissioner Cowleyes motion, as amended, carried unanimously. FIVE NINUTE RECESS Chairman Norton acknowledged, with pleasure, the presence o£ Councilman Tyler and Messrs. Michelbacher and Lewis of the Good Government Group. V. CITY COUNCIL REPORT Commissioner McFall gave a brief report on action taken at the City Council meeting on August 5, 1964, with particular emphasis on the following: 1) Preliminary approval was granted the Engineert~ Report on Chester Avenue Improvement Project. 2) C-69, Barbieri, application for change of zoning, was introduced without opposition. 3) C-70, Maggiore, application for change of zoning, was postponed at the request of the applicant. 4) City Attorney was directed to draft a resolution establishing a 15 minute limited parking zone in front of the new Post Office. 5) Initiation of annexation proceedings for the Benevento property on Prospect Road was approved by the Council. 6) Council authorized expenditure of $500.00 for development of typical site lay-out standards for hillside common greens by Fred Hector, Landscape Consultant. 7) Mayor referred proposed West Valley Junior College Campus Site (Fruitvale-Allendale Avenues) to Planning Commission for study and recommendation with a request for expediency. VI. NEW BpSINESS A. Wqst Valley Junior..Colle~e Board Meetin~ Commissioner OtRorke, who had artended the recent meeting of the West Valley Junior College Board, gave a detailed report on this meeting. The Commission expressed appreciation for the report and requested that a written copy of same be filed with the Planning Department for future reference. Commissioner 0*Rorke stated that he would write the report and file it as soo~ as possible. B.Report on Proposed Fruitvale Avenue-Allendale Avenue Junior ~olle~e Site The Secretary read a connnunication from the City Administrator officially confirming the City Council's request for a report and recommendations from the Commission relative to the Fruitvale Avenue-Allendale Avenue site proposed for use by the West Valley Junior College District. Chairman Norton explained that a Special Committee had been appointed (Commissioners Crisp, Glenn, and McFall) to make this study and that a draft of the report had been prepared. Commissioner McFall then read the subject draft. Commissioner Kellum moved, seconded by Commissioner Cowley, that the Special Conmittee Report relative to the proposed Fruitvale Avenue- Allendale Avenue Junior College Site be approved in general, with the Conwaission reserving the right to make addirons and corrections; motion carried unanimously. -4- · After the discussion that followed, it was the consensus of the Con~ission that the revisions should be made by the Commission as a whole. The report was then discussed in detail and modified as follows: Pa~e 1...paragraph 4... first line: Omit '~2,000 Pa~e 2...paragraph 5...revise to read as follows: "The possible cultural benefits, the possible availability of recreational facilities (pool, courts, etc.) for use by the public, convenience for the relatively small number of Saratoga students allocated to the College are outweighed by the disruption of the General Plan and the conflict with the principles on which Saratoga was organized and incorporated." ~ara~raph 6...revise to read as follows: "Financial aspects were considered but jud3ed secondary in importance, from the planning point of view, for determinins a recommendation in this matter." Commissioner Glenn moved, seconded by Commissioner OsRorke, that the report of the Special Committee relative to the proposed Fruitvale Avenue- Allendale Avenue Junior College Site be adopted, as modified, as the report of the Commission and that same be transmitted to the City Council together with an appropriate cover letter sirned by the Chairman; motion carried unanimously. VII. OLD BUSINESS VIII. C0~jNICATIONS A. WRITTEN 1. A-74 - St. Michaels Church, Allendale Avenue - Request for Modification of Site Plan __ The Secretary read a con~nunication from the applicant requesting that the Cormnission approve the use of a fence in lieu of shrubbery along a portion of their p~operty boundary. Commissioner Cowlay advised that the Design Review Committee had reviewad this request and had no objections providing the fence was left natural instead of being stained. After discussion Commissioner Cowley moved, seconded by Commissioner Glenn, that the request for modification of the site plan for A-74 be approved subject to the condition that the fence not be stained; motion eartied unanimously. 2. VP-~3 - Los Gatos Unitarian Fellowship, Saratoga-Sunnyvale Road - Request for Extepsion The Secretary read a letter from the applicant requesting an extension in connection with UP-53. After discussion Corcanissioner Crisp moved, seconded by Commissioner Kellum, that an extension of one year from the present date of expiration be granted in connection with UP-53, Los Gatos Unitarian Fellowship, subject to the original conditions and the following additional conditions: (1) Church seating capacity shall not exceed 250. (2) A total of 100 off-street parking spaces shall be provided. Motion carried unanimously. B. ORAL IX. ADJQURN}~NT Chairman Norton declared the meeting adjourned at 9:40 P.M.
