ROUTINE ORGANIZATION The meeting was called to order by Chairman Norton at 7:30 P.M. A. ROLL CALL 'Present: Co.mmissioners Cowley, Crisp, Glenn, Kellum, McFall, Norton and O'Rorke.. Absent: None. B. MINUTES : It was moved by Commissioner Glehn, seconded by Commissioner O'Rorke, that the reading of the minutes of August 10, 1964 be waived and that they be approved as submitted to the Conmission. The motion carried unanimously. II. PUBLIC HEARINGS Chairman Norton declared public hearings open for the evening at 7:36 P. M. A. C-71 - Maxmar Investment Company', Walnut Avenue - Change of Zoning from "R-1-12,500" (Single Family Residential) to "R-M-5,000 P-C" (~ltiple Family Residentlal Planned Community District) - Continued from August !0, 1964 . The Secretary read a letter from Mr. H. J. Oberhaus of Alta Vista Avenue stating his objections to this application. Commissioner Kellum read a Subdivision Committee Report stating the findings of their study. DOUGLAS EWING, Williams Rbad, expressed conern, because 1) he felt this would permit houses to be built on lots of 5,000 square feet instead of the now required 12,500 square feet 2) thereby increasing popula- tion density in the area and 3) homes would not be sold. Comuissioner Glenn pointed out that each unit would be permitted only a mature couple with no children. In this way the amount of population could be contr,lled. Chairman Norton, in answer to Mrs. T.N. Phillips question, pointed out that there were 5 acres and more of the required land available for such a project and that each unit would be controlled by deed restrictions. FLORA BRONZICH, Williams Avenue, brought up the question 1) the necessity of the Common Green and 2) what effect this would have the traffic on Williams AVenue and Walnut? Pl. anninR Commission Minutes - August 24,' 1964 - Continued Chairman Norton explained that there is a demand for smaller houses with little yard work for Older people in the Saratoga area. F/~o OBERI~US, Alta Vista AVenue, stated that he was still opposed to the plan, because of anticipated traffic and population increase. DRo COOLEY, Squirrel Hollow Lane, inquired 1) if it had been clearly established that control will be contracted for between Maxmar and the City of Saratoga, and ~) if these would be two story residents? Chairr~ln Norton answered that they would be one story and one and one- half story houses with 7 to 10 steps. N37,. COLLETON~ Victor Place~ asked that Highway 9 be used for construc- tion equipment and not Walnut and Williams and Chairman Norton agreed there was a good possibility. Commissioner Crisp moved, Seconded by Commissioner McFall to approve Subdivision Committee Report dated August 10, 1964, which includes recomnendation that Public Hearing be continued. Motion carried unanimously Chairman Norton declared pdblic hearing closed for C-71, Maxmar Investment Co., at 8:22 P.M. After further discussion, Chairman Norton, with consensus of the Cmmission, directed C-71, Maxmar Investment Company, continued until meeting of September 28, 1964. B. C-73 - Westhope Presbyterian ChurCh, Cox Avenue - Change of Zoning from "R-l-10,000" (Single Family Residential) "C-N" (Neighborhood Comnerc].al) The hearing on C-73 was opened at 8:25 P.M. The Secretary advised that no further com~munications had been filed in connection with this· request for change of zoning. There was no one present to represent the applicant and no one in the audience who wished to~ comment with regard to this application. Commissioner Crisp suggested that this application be continued for further study. He, also, suggested the Commission give careful consideration to the possibility of a research library on this property. After further discussion Chairman Norton directed C-73, Westhope Presbyterian Church, continued until the meeting on September 14, 1964. C. C-74- Frank Bonnet, Fierce Road - Change of Zoning from "R-i-40,000" (Single Family Residential.) to "R-I-40,000 P-C" (Single Family Residential Plan___n~ Conaun~ty District)__ The hearing on C-74 was opened at 8:28 P.M. The question of access toZ the barbecue and stable areas was di~cu'ssed by the City Planning C,gn~nis~ion and was approved. After further discussion Chairman Norton, with concurrence of the Comnission, directed C-74;, Frank Bonnet, continued until the meeting on September 14, 1964 and' referred same to Subdivision Com~ittee for study and a report. . Chairman Norton directed the hearing on C-74 closed at 8:40 for th~ evening. D. V-247 -- Charles Boyd, Sarahills Drive - Variance in connection with Side Yard Setback Rcguirements. The hearing on V-247 was opened at 8:41 P,M, The Secretary advised that a Notice of Hearing had been published and briefly reviewed the subject application. ~, BOYD, Sarahills Drive~ stated he ~nts to make the best possible use of the natural terrain and urged the Co~ission to require all builders to pu~ fire proof roofs on all future homes in the area. After a brief discussion, during which Commissioner Kellum suggested ~. Boyd redesign the house and Co~issioner Glenn advised that perhaps t.~. Boyd could move the hoarse five feet to the front of the property, Co~issioner Kellum moved, seconded by Co~issioner O~Rorke, that the hearing on V-247=be closed; motion carried unanimously and the Chairman declared the~ hearing closed at 8:50 P.M, Co~issioner Kellum moved~ seconded by Commissioner Crisp, that the Staff Report be approved axed V-247, Charles Boyd, application for variance to allow a i5 fo6t side yard setback be denied on the basis that the findings necessary for granting a variance could not be m~de. E, V-248 - Mijo Corporation - Sarato~a-Sunn~ale Road - Variance in connectioa with Front Yard Setback Requirements The hearing on V-248 was Opened at 8:53 P.M, The Secretary advised that Notices of Hearing had been mailed and then read a letter from the the applicant ' s ~epresentative (~. Menard, Architect) pertaining to the reasonsl for requesting the Variance: 1) the right- of-way requirements on Highway 9 2) frontage road requirements by City of Saratoga, and 3) Flood Control right-of-way requirements cn Calabazas Creek all established the need for a Variance of 20 feet on the front yard setback'. V-248 - Mijo Corporation Chairman Norton reviewed' the-findipgs n.~cessary for the Commission to make in granting a Variapoce and Commissioner Kellum read the Staff Report, which reco~ended Final Design Review be granted as sho~m on Exhibits "A" & ~'B" and subject to V-248 and SDR-514 being appr oved. ~ At 9:05 P.M. it was move~ by Conm~issioner Crisp, seconded by Co~issioner O~Rorke, that Public Hearings close on V-248. Co~issioner Kellum moved, seconded by Co~issioner Crisp, that V-248 be granted on the basis of the Staff Report previously read by CoEissioner Kellum. Motion carried unanimously. III. S~DIVISIONS AND BUILDING SITES A. SDR-512 - Hans Zweig, ~drone Hill Road - Building Site Approval - 2 Lots - Continued from August ~O. 1964 The applicant was not present. Co~aissioner Crisp moved, seconded by Co~issioner McFall, that the Building Site Committee Report of August 24, 1964, relative to SDR-512, ~ns Zweig~, be adopted and that the tentative map (Exhibit "A", filed Ju~y ].6, 1964 ) be approved subject to the conditions detailed in2 the Building Site Co~ittee report; motion carried unanimously. B. SDR-514 - Mijo Corporation, Saratoga-Sunnyvale Road - Building Site Approval - 1 Lot - Continued from August 10, 1964 ~. Menard, present to" represent this applicant expressed satisfaction with the proposed conditions of approval. Co~issioner Crisp moved, seconded by Commissioner McFall, that the Building Site Co~ittee Report of August 24, 1964, relative to SDR-514, Mijo Corporation, be adopted and that the tentative map (Exhibit "A"-I, filed August 21, 1964) be approved subject to the conditions detailed in the Building Site Co~ittee report; motion carried unanimously. C. SD-516 - Frank Bonnet, Pierce Road - Subdivision Approval - 80 Lots The applicant had submitted a written request to the Subdivision Committee asking that SD-516 be continued until the meeting of September 14, 1964 sin~e additional time was needed to work out the problems in connection with this site. Comnit~ee report of August 24, 1964, relative to SDR-5!7, C.o Vigan, be adopted and that the tentative map (Exhibit "A", filed August 14, 1964) be approved subject to the conditions detailed in the Building Site Committee report; motion carried unanimously. E. SDR-518 - Frank J. Orlando, Saratoga Creek Drive - Building Site Approval - 1 Lot The applicant was not present. commissioner crisp moved, seconded by Commissioner McFall, that the Building Site Committee report of August 24, 1964 relative to SDR-518, Frank J. Orlando, be adopted and that the tentative map (Exhibit '~", filed August 14, 1964) be approved subject to the conditions set forth in the Building Site Committee report; motion carried unanimously. F. SDR-519 - George. Slater,. Palomin0 Way - Building Site Approval - 1 Lot The applicantsT representative, Mr. Conrad Stieber, expressed satisfaction with the proposed conditions of approval. Commissioner Crisp moved, seconded by Commissioner McFall, that the Building Site Committee report of August 24, 1964, relative to SDR-519, George Slater, Be adopted and that the tentative map (Exhibit "A", filed August 14, 1964) be approved subject to the conditions detailed in the Building Site Committee report; motion carried unanimously. IV. DESIGN REVIEW A. A-153 - Mijo Corporation, Sarato~a-Sunnyvale Road - Preliminary Design Review - Commercial Buildin~ - Continued from August 10, 1964 After considerable discussion Commissioner Cowley moved, seconded by Commissioner Glenn, that Preliminary Design Review approval be granted A-153 on the basis of Exhibits "A" and "B"and with the suggestion that it be determined who or what will occupy the building and that it be extablished that twenty-seven hundred square feet be required for dining area.. Motion carried unanimously. B. A-154 - Richfield Oil Corporation, Big Basin Way - Preliminary Desig~ Review - Plans for Remodeling Service Station - Continued from August 10, 1964 As yet the revised planshad not been submitted; therefore, the Ckairman, upon the recommendation of the Committee, directed that A-154 be continued until the meeting of September 14, 1964. ~5- '~lannin~ Commission Minu~.es - .A~_!~t'st____2t2,..].964 - Contint C. A-155 - United Presbyterian Church, Sara. toga Avenue - Final Design Review - Church Building ,__ Commissioner Cowley advised that there were revisions to be made pertaining to parking and' landscaping; so, Commi'~tee recommends that this item be continued until the m. eeting on September 14, 1964. Chairman Norton so directed. FIVE MINUTE RECESS Chairman Norton acknowledged, with pleasure, the presence of Councilman Drake and Mrs. Ruth Owen of the Good Government Group. V. CITY COFNCIL REPORT Chairman Norton gave a brief report on action taken at the City Council meeting on August 19, 1964 with particular emphasis on the following: 1) C-69 - Mario Barbieri, applicatign for change of zoning, was granted. 2) SDR-509 - Charles E. Harden, req.uest for modification of conditions for Building Site approval', was denied. 3) SDR-306 - Peck Merrick - Mr. Mer,rick has sold the property and no longer wishes an extension; so, the City Council authorized the refund of the $100.00 cash bond posted by Mr. Merrick. 4) SDR-505 - Saratoga Parent Nursery School, application for Building Site approval for one lot, was approved. 5) C-70 - O. R. Maggiore - The representative for this applicant was advised to make a written request for withdrawal of the application and for refund of the fee. 6) A report on the Junior College submitted by a Special Committee, appointed by Chairman Norton, was read and discussed by the City Council. · VI. NEW BUSINESS ~ A. SDR-454 . Hugh Purcell, Saratoga; Avenue - Request for change of right-of way r e quit ement s The Secretary described Mr. Purcell's request for modification of road improvements.. Commissioner Crisp mov. ed, seconded by Commissioner Kellum and unanimously approved [o grant a request for change of right-of-way requirements to Mr. Hugh Purcall subject to Record of Survey as shown on Exhibit "C". VII. B. OLD BUSINESS Commissioner Glenn, complimented the Secretary on the quick action on getting the smaller signs removed from the bigger subdivision signs. -6- ..~ ~ Plannin~ Cormr, ission Minutes - Au~:~st 24,.1964 - Continued Commissioner O'Rorke was excused at 9:55~ because of urgent pcrsonal matters. VIII, COMMUNICATIONS ; A, James Adair - Request for addition of use to C-N District The Secretary read a letter from the applicant requesting permission to open a cocktail lounge, The applicant was present and stated that it would be a higher quality type Of lounge, Chairman Norton explained to th~ Commission that it is now possible to have a bar without a restaurant under State Law. After further discussion, Commissioner Crisp ~uggested this matter be held until the next meeting to give the Commission an opportunity to study this matter more carefully before taking action. Chairman Norton referred the matter to the General Plan Committee for re- port and recommendation at the next meeting. B. SDR-437 - Phillip Collins - Palomino Way After short discussion Commissioner Crisp moved, seconded by Commissioner Kellum that an extension of one.year from the present date of expiration be granted in connection with SDR-437, Mr. Collins, subject to the original conditions. Motion unanimously;carried. C. SDR-440 - Shannon Lightfoot Commissioner Crisp moved, seconded by Commissioner McFall, that an extension of one year from the present date of expiration be granted in connection with SDR-440, Mr. Shannon Lightfoot, subject to the original conditions. Motion Carried unanimously. D. Mr. ClevenRer - 12750 Idlewood Lane. SaratoRa Mr. Clevenger was present and stated that he would like to submit for approval a plan to build a drive~my off Cox Avenue; so, he could drive his camper truck into his drive.~ray. ConLmissioner Crisp requested that this matter be referred to the Subdivi- sion Committee until the next regular meeting to allow adequate time to review the conditions. Chairman Norton so directed. Commissioner Cowley requested to be absent during the month of September, because he was taking a trip to:Europe. Chairman Norton granted approval of Commissioner Cowley's request and stated Mr. Cowley would be missed, andSextended his wishes for a good trip. IX.
