CITY OF SARATOGA PLANNING COMMISSION

I. ROUTINE ORGANIZATION
The meeting was called to order by Chairman Norton at 7:35 P. M.
A, ROLL CALL
Present: Commissioners Crisp, Kellum, McFall, and Norton.
Absent: Commissioners Cowley, Glenn, and OsRorke.
B, MINUTES
Commissioner McFall moved, seconded by Commissioner Kellum, that the
reading of the minutes of August 24, 1964 be waived and that the minutes
be approved as submitted to the Commission; motion carried unanimously.
II. PUBLIC HEARINGS
The Chairman declared public hearings open for the evening at 7:38 P. M.
A. C-73 - Westhope Presbyterian Church, Cox Avenue - Change of Zoning from
'~-l-lO,00O" (Single Family Residential) to '~-N" (Neighborhood
Conm~ercial} - Continued from August 24~ 1964 .
The Secretary briefly reviewed this application and advised that no fur-
ther communications had been received.
ELMER GARRISON, represe~ting the Church, requested that action on C-73
be deferred to allow time for further study and consultation with the
County Library representatives.
On the basis of this request, Chairman Norton, with concurrence of the
Commission, directed C-73, Westhope Presbyterian Church, continued until
the meeting on September 28, 1964.
B. C-74 - Frank Bonnet, Pierce Road - Change of Zoning from '~-1-40,000"
(Single Family Residential) to '~-1-40,000 P-C" (Single Family
Residential Plan~ed Community District) - Continued from

The Secretary briefly reviewed this application and advised that no fur-
ther communications had been filed.
Mr. Bonnet was present but stated that he had no further comment at this
time.
Commissioner Crisp advised 1) SD-516, filed in conjunction with C-74,
does not meet ordinance requirements 2) the applicant met with the Sub-
division Committee and it was agreed that they l.;ould await establishment
of the Hillside Standards 3) it was the reconnnendation of the Subdivi-
sion Committee, therefore, that this application be continued.
On the basis of this recommendation, Chairman Norton directed C-74s
Frank Bonnet, continued until the meeting on September 28, 1964.

II. C. Ordinance NS-3.7 - An ordinance amendinE Ordinance NS-3, relating to
Design Standards for Residential Districts, Identifi-
cation Signs for the Rear of Coumaercial Structures,
and Setbacks for AccesSory Structures
The hearing on Ordinance NS-3.? was opened at 7:44 P. M. The Secretary
advised that a Notice of Hearing had been published and there were no
written communications on file. He then read the proposed ordinance and
and it was discussed, section by section.
There was no one in the audience who wished to comaneat with regard to this
matter.
Chair~mn Norton suggested that subsection "f" under Section I be modified
to read as follows:
'With the specific approval of the Planning Commission, modifications
of the above design standards or alternative standards may be applied,
if such modifications or alternatives are substantially equivalent in
effect to the above standards and equally or better adapted to achieve
the purposes stated in Section 13.1."
It was moved by Coumnissioner McPall and seconded by Co~mnissioner Kellum
that Chairman Nortongs proposal for amendment of subsection "f" under
Section I be adopted. Motion carried unanimously.
With reference to subsection "e" under Section 3, Chairman Norton directed,
with concurrence of the Commission, that the word "above" be substituted
for '~ereinabove'~.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the public
hearing on Ordinance NS-3.7 be closed at 7:59 P, M. and that the proposed
ordinance, as amended, be forwarded to the City Council with the recom-
mendation that it be enacted; motion carried unanimously.
D. Ordinance ~S-3.8 - An ordinance amending Ordinance NS-3, relating to Con-
trol of Gas Stations in Conmaercial Districts by Use
Permit
The hearing on Ordinance NS-3.8 was opened at 8:00 P. M. The Secretary
advised that a Notice of Hearing had been published and there were no
written communications on file. He then briefly reviewed the ordinance
and explained that it was proposed as a permanent ordinance to replace
the emergency ordinance now in effect,
There was no one in the audience who wished to comment with regard to
this matter.
Commissioner Ke!lummoved, seconded by Commissioner Crisp, that the public
hearing on proposed Ordinance NS-3.8 be closed. Motion carried
unanimously and the hearing was closed at 8:02 P. M.
It was moved by Commissioner Kellum and seconded by Commiosioner Crisp
that Ordinance N5-3.8 be approved and forwarded to the City Councll with
the recommendation that it be enacted. Motion carried unanimously.
Chairman Norton declared public hearings closed for the evening at 8:03 P. M,

1II. SUBDIVISIONS AND BUILDING SIT~S
A, SD-516 - Prank Bonnet, Pierce Road - Subdivision Approval - 80 Lots -
Continued from A~ust .24, 1964 ...
Commissioner Crisp suggested that SD-516, Frank Bonnet, be continued until
the meeting on September 28, 1964s since, as previously stated, this pro-
posal did not meet ordinance requirements and it had been decided that the
applicant would await establishment of Hillside Standards.
Chairman Norton so directed.
B. SDR-520 - James J. Asher~ Kit~ridge Road - Building Site Approval - I Lot
The applicant was present and expressed satisfaction with the proposed
conditions of approval.
Commissioner Crisp moved, seconded by Commissioner McFall, that the Buil-
ding Site Committee Report of September 14, 1964 relative to SDR-520,
James J. Asher, be adopted and that tile tentative map (Exhibit '~", filed
September 4, 1964) be approved subject to the conditions set forth in the
Building Site Committee Report; motion carried unanimously.
C. SDR-521 - William C. PerrV. Bohlman Road ~ Bui.%~inM Site Approval - 1 Lot
After discussion Commissioner Crisp moved, seconded by Commissioner Kellum,
that the following condition be added to the conditions set forth in the
Building Site Committee Report of September 14, 1964 relative to SDR-521:
"Submit irrevocable offer of dedication to provide for a 30 foot half-
street on Bohlman Road along the entire frontage of the property."
Motion carried unanimously.
Mr. Perry expressed satisfaction with the proposed conditions of approval.
It was moved by Commissioner Crisp and seconded by Coranissioner Kellum
that the Buildin~ Site Committee Report of September 14, 1964 relative
to SDR-521, as amended, be adopted and that the tentative map (Exhibit '~",
filed September 4, 1964) be approved subject to the conditions set forth
in the Building Site Committee Report; motion carried unanimously.
IV, DESIGN REVIEW
A. A-153 -Mi]o Corporation, Saratoga-Sunnyvale Road - Final Design Review -

Co~nissioner Kellum advised that a review of the exhibits revealed that
the applicant had conformed with the ordinance requirements and the sug-
gestions of the Planning Commission.
It was moved by Commissioner Kel!um and seconded by Co=~issioner McFall
that final design review be granted A-153~ Mijo Corporation, for the
coE~nercial building as sho~qn on Exhibit '~". Motion carried unanimously.
B. A-154 - Richfield Oil Corporation, Big Basin Way - Preliminary Design
Review - Plans for Remodeling Service Station - Continued from

Com~issioner Kellum advised that these plans had been reviewed with the
applicant's representatbe and that additional time was needed to work
out a number of problems, In vie-w of this, he recommended that A-154,
Richfield Oil Corporation, be continued until the meetln~ on September 28,
1964.
Chairman Norton so directed.

IV, C. A-155 - United Presbyterian Church, Saratoga Avenue - Final Design Review -
Church Buildin~ - Continued from August 24. 1964
Co~nissioner Kellum moved, seconded by Commissioner Crlsp~ that final
design approval be granted A-155, United Presbyterian Church, as shown
on Exhibits '~", "B", and '~", with the specific condition that 154
parking spaces be paved at the time of construction of the Church and
that a bond be posted to guarantee completion of the remaining 54 spaces
within one (1) year from the date of completion of the Churchl motion
carried unanimously.
D. SS-39 - Claude T. Lindsay, Cox Avenue - Final Design Approval - George-
town Subdivision Identification Sign
Con~nissioner Kellum moved, seconded by Commissioner Crisp, that final
design approval be granted SS-39, identification sign for Georgetown
Subdivision, in accordance with Exhibits '~", "B", and '~"; motion car-
ried unan~nously.
V. CITY CQ.~N~IL REPORT
In the absence of Commissioner O'Rorke (who covered the City Council meeting
on September 9~ 1964), the report on action taken at the last City Council
meeting was deferred.
Chairman Norton acknowledged, with pleasure, the presence of Councilman Burry,
Messrs. Robbins and Brinkley of the Good Government Group, and Mrs. Ottenberg of
the League of Women Voters. He again expressed the appreciation of the Co~ission
for the active interest taken by the civic organizations.
VI, NEW BUSINESS
A, ~-55 - Lyle J, Benson (Carl Dozier), Saratoga Avenue - City Council
Request for Recommex~ation relative to E]:t~nsion of Time
~he Secretary read a letter from Carl Dozler requesting an extension of
time in connection with the conditional zoning on the former Saratoga
Inn property, and explained that the Council had referred the matter to
the Commission with a request for a recommendation,
IGEITI{ SIEGRIST, representing Mr. Dozier, filed a copy of a letter from
the Argonaut~brtgage Company stating their intent to make a construction
and long-term take-out loan to finance this project, subject to certain
conditions. Chainman Norton read the letter and directed that it be filed
for record. Mr. Sisgrist then stated that JOHN ALLEN of PONELL'S and RAY
DOUGLAS of the BRA]~DI~]G IRON were both quite interested in leasing the
restaurant and bar, and that almost 100% of the other leases could now be
signed.
After discussion Commissioner Kellum moved, seconded by Commissioner Crisp,
that, on the basis of statements submitted by the applicants the Plannin8
Coum~ission recommend to the City Council that an extension of one (1) year
from the present date of expiration be granted in connection with C-55;
motion carried unanimously.
B. ~D-430 - ~. L. Hiatt. Saratoga-Los Gatos Road - Rcq~est for. Modificat~on
The Secretary advised that the City Council had referred Mr. Niatt's
request for modification of conditions to the Planniv~ Commission for a
reco=mendation relative to the type of curb and gutter to be used in the
subject subdivision. He then read a Staff Report pertaining to this matter.
Cormuissioner Crisp moved, seconded by Commissioner Kellum, that the sub-
ject Staff Report relative to SD-430 be adopted and transmitted to the
City Council as the recommendation of the Commission; motion carried
unanimously.

VI, C. Tract No. 3822 - Saratoga-Sunnyvale Road - Request to allow Removal of
T;ees alon~ Calabaz~s Creek
The Secretary read a letter from MacKay & Somps requesting permission to
remove a number of trees to facilitate construction and maintenance of
the berm along the Calabazas Creek.
After a brief discussion, Chairman Norton directed this matter continued
until the meeting on September 28, 1964 and referTed same to the Subdivi-
sion Committee for study and a report at that time.
VII. OLD BUSINESS
A. tieveneer ~Van Vle~c Realty) - 12750 Idlewood Lane - City Council Request
for Reconmendation relative to allowing
Access to Cox Avenue from Lot 181 of Tract
1489 - Continued ~Fom AuguSt 24. 1964
The Secretary 1) advised that the City Council had requested a recomen-
dation relative to Mr. Clevenger's request that access to Cox Avenue be
allowed from the rear of Lot 181, Tract 1489 and 2) presented a report
prepared for the Chairman's signature. Chairman Norton then read the
report.
Commissioner Crisp moved, seconded by Commissione~ Kellum, that the Chair-
man be authorized to sign the report recommending that Mr. Clevenger's
request be granted and that the report then be transmitted to the City
Council; motion carried unanimously.
B. James Adair - Request for Addition of Use to C-N District - Continued from
August 24. 1964
lhe Secretary briefly reviewed this matter and read a report from the
General Plan Con-m~ittee recommending that "Cocktail Lounge" be added to
the list of Conditional Uses for C-N Zones.
There was no one present who wished to coment with regard to this matter.
Commissioner Crisp moved, seconded by Commissioner Kellum, that the report
of the General Plan Committee be approved and that a resolution be adopted
adding "Cocktail Lounge" to Section 7.3(a) of Ordinance NS-3; motion car-
ried unanimously.
VIII. COMMUNICATIONS
A. ~-145 - Joseph Long, Saratoga Avenue - Request for Release from Condition
established under C-55
The Secretary read a letter from Mr. Long requesting that the Planning
CommisSion allow him to obtain a building permit for his proposed Real
Estate Office on Saratoga Avenue.
DOUGLAS ADAMS, representing the applicant, explained that this matter had
been discussed with the Subdivision Committee and it was at the CoF~ittee's
suggestion that the request was filed.
After discussion Chairman Norton directed this smtter continued until the
meeting on September 28, 1964 and referred same to the Subdivision Com-
mittee for study and a report at that time.
